third programme <strong>of</strong> law reform <strong>2008</strong>-<strong>2014</strong>31 Legal Aspects <strong>of</strong> Assisted Human ReproductionThis project will examine the need for regulation <strong>of</strong> assisted human reproductionin Ireland, taking into account general policy reviews already done in this area.The project will include the legal aspects <strong>of</strong> sperm donation, surrogacy andrelated issues such as consent. The Commission will consult with those whohave particular expertise in the scientific and medical aspects <strong>of</strong> this area.32 PrivacyThis project will build on previous work by the Commission under the First<strong>Programme</strong> <strong>of</strong> <strong>Law</strong> <strong>Reform</strong> in which it completed an examination <strong>of</strong> privacyand surveillance. The project will take into account relevant legislativedevelopments, in particular the Privacy Bill 2006.H. Commercial <strong>Law</strong> and the <strong>Law</strong> <strong>of</strong> Obligations33 Frustration <strong>of</strong> ContractsThis project on frustration <strong>of</strong> contracts will examine the legal effects <strong>of</strong>unforeseeable and other events (such as war or industrial action) which areoutside the control <strong>of</strong> contracting parties. This research will build on previouswork by the Commission on the reform <strong>of</strong> other aspects <strong>of</strong> contract law.34 Insurance ContractsThis project will review existing rules concerning insurance contracts, such asformalities, material non-disclosure, ‘basis <strong>of</strong> contract’ clauses and the concept<strong>of</strong> insurable interest. The project will examine whether these rules wouldbenefit from codification, from the perspectives <strong>of</strong> business efficiency andconsumer protection.35 Damages in Contract and Tort <strong>Law</strong>This project will examine the legal principles concerning the award <strong>of</strong> damagesin contract and tort law. This research will build on previous work by theCommission on the law <strong>of</strong> damages.17
