Building Regulations Approved Document Hwhich includes a requirement for provision ofindoor storage space for storage of separatedrecycled materials up to 0.25m 3 , and provisionof and access to individual or communal wastecontainers.There is no provision under the Sustainableand Secure Buildings Act 2004 to apply BuildingRegulations to existing homes to improvemanagement of household waste. As thereis no available good practice guidance on theoptimal provision of facilities within the homefor recycling, it would be appropriate to carryout research in this area to establish whetherthe standards in the Building Regulations aresatisfactory, and to inform development of theCode for Sustainable Buildings.Recommendation: Government reviewsbest practice in provision of facilities in thehome for recycling and composting, (withparticular consideration of high densityhousing) with a view to reviewing theBuilding Regulations Part H if necessary.New housing developments should considerplanning for its own waste managementinfrastructure.Recommendation: Government reviews bestpractice in design of waste managementinfrastructure at a community scale.8.4 Delivering the savings: Incentives anddisincentivesPolicies to enable recycling can no longerincrease recycling rates. Facilities provision andcommunication need to be backed up with aprice signal.Householders currently pay a fixed chargeas part of their Council Tax. The EnvironmentalProtection Act 1990 does not allow householdersto be charged according to the amount ofwaste that they produce. It is however possibleto reward the householders for reducingthe waste they produce or for increasing theamount of recyclables they separate out; thiscan be implemented at the local authority level.This could be an effective measure with personalgain being one of the main motivators behindchanges in behaviour patterns.Financial incentives should be introducedat local authority or national level. Defra iscurrently piloting schemes to incentivise peopleto recycle and reduce waste. The results shouldbe broadly disseminated and used to informpolicy.Recommendation: Local Authorities take aleading role in developing local recycling andcomposting incentive schemes following theDefra pilot.The London Borough of Barnet has establisheda compulsory recycling scheme, which includespenalties for putting recyclable waste in theresidual waste bin. The unusual scheme hasbeen implemented through Section 46 of theEnvironmental Protection Act 1990, 33 althoughno penalties have yet been awarded, and it isextremely difficult to prove responsibility fornon-compliance. This may be a positive modelto roll out more widely.Many countries operate a scheme to chargehouseholds for the unseparated waste theyproduce that can not be recycled. A ‘pay asyou throw’ charge to households would senda strong signal to households and would be apowerful way to increase recycling rates. Wepropose that local authorities should be giventhe power to charge for unseparated wastefrom at least 2010 when all local authoritiesmust have in place the facilities to collectseparated waste for recycling.45 (1) Where a waste collection authority has a duty by virtue of section 45(1)(a) above to arrange for the collection ofhousehold waste from any premises, the authority may, by notice served on him, require the occupier to place thewaste for collection in receptacles of a kind and number specified.(2) The kind and number of the receptacles required under subsection (1) above to be used shall be such only as arereasonable but, subject to that, separate receptacles or compartments of receptacles may be required to be used forwaste which is to be recycled and waste which is not.(6) A person who fails, without reasonable excuse, to comply with any requirements imposed under subsection (1),(3)(c) or (d) or (4) above shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.(Environmental Protection Act 1990)74 Stock Take: Delivering improvements in existing housing.
