It is not intended as asubstitute for professi<strong>on</strong>al legal advice.What is this leaflet about?It is about changes <strong>to</strong> <strong>the</strong> l<strong>on</strong>g occupati<strong>on</strong> equity provisi<strong>on</strong> in <strong>the</strong> Landlord andTenant (Amendment) Act 1980 brought about by <strong>the</strong> enactment andcommencement of <strong>the</strong> Residential Tenancies Act 2004. In <strong>the</strong> case of successortenants in <strong>the</strong> formerly rent c<strong>on</strong>trolled sec<strong>to</strong>r, it is a follow up <strong>to</strong> <strong>the</strong> informati<strong>on</strong>leaflet produced in 2002 <strong>to</strong> advise <strong>the</strong>m of <strong>the</strong> changes associated with <strong>the</strong> expiryof protecti<strong>on</strong> under <strong>the</strong> Housing (Private Rented Dwellings) Act 1982. It isrelevant <strong>to</strong> all tenants who, <strong>the</strong>mselves, or in c<strong>on</strong>juncti<strong>on</strong> with <strong>the</strong>ir predecessorsin title, will have completed 20 years tenancy of a dwelling by 1st September2009.What is <strong>the</strong> l<strong>on</strong>g occupati<strong>on</strong> equity provisi<strong>on</strong> in <strong>the</strong> 1980 Act?It is an entitlement <strong>to</strong> claim a renewable l<strong>on</strong>g occupati<strong>on</strong> equity lease of up <strong>to</strong> 35years (or whatever shorter term <strong>the</strong> tenant nominates) under <strong>the</strong> Landlord andTenant (Amendment) Act 1980 that applies <strong>to</strong> tenants who (<strong>the</strong>mselves or inc<strong>on</strong>juncti<strong>on</strong> with <strong>the</strong>ir predecessors in title) have occupied <strong>the</strong> dwelling for morethan 20 years.What distinguishes l<strong>on</strong>g occupati<strong>on</strong> equity lease tenancies from o<strong>the</strong>rtenancies?2Such a lease entitles a tenant who complies with its terms <strong>to</strong> retain possessi<strong>on</strong> of<strong>the</strong> dwelling except in <strong>the</strong> limited circumstances outlined in <strong>the</strong> 1980 Act. Thetenant specifies <strong>the</strong> length of <strong>the</strong> lease (up <strong>to</strong> 35 years) and, as <strong>the</strong> lease isrenewable, <strong>the</strong> right is potentially perpetual. The tenant may assign or sub-let<strong>the</strong> tenancy. Unless <strong>the</strong> landlord and tenant agree a rent, <strong>the</strong> rent will be set by<strong>the</strong> Circuit Court at market rate reduced by <strong>the</strong> letting value of improvementscarried out by <strong>the</strong> tenant or his/her predecessors. Where <strong>the</strong> rent is set by <strong>the</strong>court, it applies for at least 5 years and a successor tenant may be eligible for ameans tested rent allowance from <strong>the</strong> Department of Social and Family Affairsapplicable <strong>to</strong> formerly rent c<strong>on</strong>trolled tenancies <strong>on</strong>ly. The Residential TenanciesAct does not apply <strong>to</strong> l<strong>on</strong>g occupati<strong>on</strong> equity lease tenants or <strong>to</strong> applicants forsuch leases whose applicati<strong>on</strong>s are still before <strong>the</strong> courts and not yet heard.


What are <strong>the</strong> changes <strong>to</strong> this provisi<strong>on</strong> in <strong>the</strong> Residential Tenancies Act?The Residential Tenancies Act abolishes, with effect from 1st September 2009(<strong>the</strong> 5th anniversary of <strong>the</strong> commencement of Part 4 of <strong>the</strong> Act), <strong>the</strong> right <strong>to</strong>apply, for <strong>the</strong> first time, for a l<strong>on</strong>g occupati<strong>on</strong> equity lease of up <strong>to</strong> 35 yearsunder <strong>the</strong> 1980 Act, except where <strong>the</strong> tenant has (before <strong>the</strong> 5th anniversaryreferred <strong>to</strong>) served notice <strong>on</strong> <strong>the</strong> landlord of his/her intenti<strong>on</strong> <strong>to</strong> claim such alease under secti<strong>on</strong> 20 of that Act. The aboliti<strong>on</strong> <strong>on</strong>ly applies in <strong>the</strong> case of thosetenants who have never previously claimed such a lease and those who haved<strong>on</strong>e so will c<strong>on</strong>tinue <strong>to</strong> be able <strong>to</strong> keep renewing <strong>the</strong>ir l<strong>on</strong>g leases as each <strong>on</strong>eexpires. In <strong>the</strong> meantime, for that period of five years, tenants will be able <strong>to</strong>renounce <strong>the</strong>ir right <strong>to</strong> a l<strong>on</strong>g occupati<strong>on</strong> equity lease under <strong>the</strong> 1980 Act. Thismeans that a tenant facing <strong>the</strong> terminati<strong>on</strong> of a tenancy (e.g. if coming close <strong>to</strong>20 years of occupancy), because <strong>the</strong> landlord wants <strong>to</strong> prevent such a rightaccruing, will be able <strong>to</strong> renounce <strong>the</strong> right in return for being allowed by <strong>the</strong>landlord <strong>to</strong> c<strong>on</strong>tinue <strong>the</strong> tenancy.Why have <strong>the</strong>se changes been made?The well-intenti<strong>on</strong>ed l<strong>on</strong>g occupati<strong>on</strong> equity provisi<strong>on</strong> has proved counterproductive,prompting evicti<strong>on</strong> of tenants approaching 20 years of occupancy. Ithas also discouraged instituti<strong>on</strong>al investment in private rental accommodati<strong>on</strong>,particularly since <strong>the</strong> c<strong>on</strong>troversy surrounding <strong>the</strong> terminati<strong>on</strong> of tenancies inMespil Estate in Ballsbridge in <strong>the</strong> early 1990s. A Working Group established in1994 in <strong>the</strong> wake of <strong>the</strong> Mespil Estate c<strong>on</strong>troversy recommended <strong>the</strong> amendmen<strong>to</strong>f <strong>the</strong> 1980 Act <strong>to</strong> provide an opt-out from <strong>the</strong> entitlement but this was notimplemented. The Commissi<strong>on</strong> <strong>on</strong> <strong>the</strong> Private Rented Residential Sec<strong>to</strong>rrecommended <strong>the</strong> aboliti<strong>on</strong> of <strong>the</strong> entitlement after a transiti<strong>on</strong>al period of 5years and recommended <strong>the</strong> availability of an opt-out from <strong>the</strong> entitlement forthat 5-year period. The Government decided <strong>to</strong> implement <strong>the</strong> Commissi<strong>on</strong>’srecommendati<strong>on</strong>s.What is <strong>the</strong> significance of this for successor tenants?Successor tenants are entitled <strong>to</strong> apply for l<strong>on</strong>g occupati<strong>on</strong> equity lease tenanciessince <strong>the</strong>y have all completed <strong>the</strong> 20 year occupati<strong>on</strong> requirement by virtue of<strong>the</strong>ir own tenancies and that of <strong>the</strong> rent c<strong>on</strong>trolled tenants from whom <strong>the</strong>ysucceeded <strong>to</strong> <strong>the</strong> tenancy. Any successor tenant who has not yet applied for <strong>on</strong>eof <strong>the</strong>se leases may do so <strong>on</strong>ly until 1st September 2009. After that date <strong>the</strong>entitlement <strong>to</strong> apply will be g<strong>on</strong>e. A successor tenant who has not applied for al<strong>on</strong>g occupati<strong>on</strong> equity lease before 1st September 2009 will be no different <strong>to</strong>tenants in <strong>the</strong> general private rented sec<strong>to</strong>r and <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong> ResidentialTenancies Act will apply.3


What is <strong>the</strong> significance of this for o<strong>the</strong>r tenants?After 1st September 2009 no significance will attach <strong>to</strong> a tenancy having lastedfor 20 or more years. Where a tenancy has lasted 20 years before that date, <strong>the</strong>tenant will be entitled <strong>to</strong> apply for a l<strong>on</strong>g occupati<strong>on</strong> equity lease <strong>on</strong>ly until 1stSeptember 2009 and <strong>the</strong>n <strong>the</strong> entitlement will be g<strong>on</strong>e. Where <strong>the</strong> tenancy haslasted less than 20 years but could reach 20 years before 1st September 2009 if notterminated before <strong>the</strong>n, <strong>the</strong> tenant will be able <strong>to</strong> irrevocably renounce his/herentitlement <strong>to</strong> claim a l<strong>on</strong>g occupati<strong>on</strong> equity lease in return for being allowed<strong>to</strong> c<strong>on</strong>tinue as tenant of <strong>the</strong> dwelling.How do I apply for a l<strong>on</strong>g occupati<strong>on</strong> equity lease?The procedure laid out in <strong>the</strong> Landlord and Tenant (Amendment) Act 1980 mustbe followed. You must first serve a notice of intenti<strong>on</strong> <strong>to</strong> claim relief <strong>on</strong> <strong>the</strong>landlord. While this can be d<strong>on</strong>e at any time up until 1st September 2009, if <strong>the</strong>landlord has served a notice <strong>to</strong> quit <strong>on</strong> you so as <strong>to</strong> terminate your tenancy, <strong>the</strong>na notice of intenti<strong>on</strong> <strong>to</strong> claim relief may <strong>on</strong>ly be served <strong>on</strong> <strong>the</strong> landlord withinthree m<strong>on</strong>ths of <strong>the</strong> service of <strong>the</strong> notice <strong>to</strong> quit.The notice of intenti<strong>on</strong> <strong>to</strong> claim relief is a ‘prescribed form’ available fromsolici<strong>to</strong>rs or from <strong>the</strong> Civil Office, Dublin Circuit Court, Áras Uí Dhálaigh, InnsQuay, Dublin 7 or <strong>the</strong> Circuit Court for <strong>the</strong> county in which <strong>the</strong> dwelling islocated. It is this notice, which starts <strong>the</strong> l<strong>on</strong>g occupati<strong>on</strong> equity lease process,that may be served <strong>on</strong> <strong>the</strong> landlord <strong>on</strong>ly if d<strong>on</strong>e before 1st September 2009.Whe<strong>the</strong>r or not <strong>the</strong> landlord is prepared <strong>to</strong> grant <strong>the</strong> lease, <strong>on</strong>ce a m<strong>on</strong>th haspassed since <strong>the</strong> notice of intenti<strong>on</strong> <strong>to</strong> claim relief was served, you may, at anytime <strong>the</strong>reafter, apply <strong>to</strong> <strong>the</strong> Circuit Court <strong>to</strong> decide <strong>on</strong> your entitlement <strong>to</strong> a l<strong>on</strong>goccupati<strong>on</strong> equity lease. If you do not make <strong>the</strong> applicati<strong>on</strong> <strong>to</strong> <strong>the</strong> Circuit Courtwithin three m<strong>on</strong>ths of serving <strong>the</strong> notice of intenti<strong>on</strong> <strong>to</strong> claim relief, <strong>the</strong> landlordmay instead apply <strong>to</strong> <strong>the</strong> Court <strong>to</strong> decide <strong>on</strong> your entitlement. Note: a l<strong>on</strong>goccupati<strong>on</strong> equity lease is not an au<strong>to</strong>matic entitlement - <strong>the</strong> Court decides <strong>on</strong><strong>the</strong> entitlement by reference <strong>to</strong> <strong>the</strong> relevant provisi<strong>on</strong>s of <strong>the</strong> 1980 Act and <strong>the</strong>circumstances of <strong>the</strong> case.Does <strong>the</strong> Residential Tenancies Act apply <strong>to</strong> l<strong>on</strong>g occupati<strong>on</strong> equity leasetenancies?4The Residential Tenancies Act does not apply <strong>to</strong> any tenancy governed by a l<strong>on</strong>goccupati<strong>on</strong> equity lease as <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong> Landlord and Te n a n t(Amendment) Act 1980 apply instead. The Residential Tenancies Act also does


not apply in <strong>the</strong> case of any tenancy where <strong>the</strong> tenant or landlord has applied <strong>to</strong><strong>the</strong> Circuit Court <strong>to</strong> decide <strong>on</strong> <strong>the</strong> entitlement of a tenant who has served noticeof intenti<strong>on</strong> <strong>to</strong> claim a l<strong>on</strong>g occupati<strong>on</strong> equity lease, for so l<strong>on</strong>g as <strong>the</strong> case hasnot been decided by <strong>the</strong> court. The Residential Tenancies Act does apply where<strong>the</strong> tenant has not served notice of intenti<strong>on</strong> <strong>to</strong> claim a l<strong>on</strong>g occupati<strong>on</strong> equitylease or, has served such a notice, but nei<strong>the</strong>r <strong>the</strong> tenant nor <strong>the</strong> landlord hasapplied <strong>to</strong> <strong>the</strong> Circuit Court <strong>to</strong> decide <strong>on</strong> <strong>the</strong> tenant’s entitlement.I may be eligible for a l<strong>on</strong>g occupati<strong>on</strong> equity lease – should I apply for it?This is a matter for you <strong>to</strong> decide and <strong>on</strong> which you may need <strong>to</strong> obtain legaladvice. A l<strong>on</strong>g occupati<strong>on</strong> equity lease, if granted, provides a level of security oftenure that landlords would be unlikely <strong>to</strong> willingly offer and that is notavailable <strong>to</strong> tenants in <strong>the</strong> general private rented sec<strong>to</strong>r. However, all leasesinvolve resp<strong>on</strong>sibilities as well as rights and you need <strong>to</strong> c<strong>on</strong>sider your ownpers<strong>on</strong>al circumstances before making such a decisi<strong>on</strong>. The important thing <strong>to</strong>remember is that you have <strong>on</strong>ly until 1st September 2009 in which <strong>to</strong> make anapplicati<strong>on</strong> should you so decide. After that <strong>the</strong> opportunity <strong>to</strong> avail of such alease will be g<strong>on</strong>e for good. It should also be noted that successor tenants whohave not applied for a l<strong>on</strong>g occupati<strong>on</strong> equity lease are ineligible for <strong>the</strong> meanstested rent allowance from <strong>the</strong> Department of Social and Family A ff a i r sapplicable <strong>to</strong> certain formerly rent c<strong>on</strong>trolled tenancies.Where can I get fur<strong>the</strong>r informati<strong>on</strong>?The means tested Free Legal Aid Scheme covers applicati<strong>on</strong>s for l<strong>on</strong>g occupati<strong>on</strong>equity leases under <strong>the</strong> 1980 Act.
