<strong>How</strong> <strong>Corporate</strong> <strong>America</strong> <strong>fell</strong> <strong>in</strong> <strong>love</strong> <strong>with</strong> <strong>gays</strong> <strong>and</strong> <strong>lesbians</strong> - December 11, 2006The trouble is, it still does: In 34 states it's legal to fire an employee simply for be<strong>in</strong>g gay.Last w<strong>in</strong>ter a photographer named Laurel Scherer, who took pictures of skiers at the WolfLaurel Ski Area near Asheville, N.C., lost her contract <strong>with</strong> the resort after she <strong>and</strong> herpartner were married <strong>in</strong> Massachusetts <strong>and</strong> ran their wedd<strong>in</strong>g announcement <strong>in</strong> theAsheville Citizen Times. The Human Rights Campaign gets about 25 to 30 compla<strong>in</strong>ts amonth about workplace discrim<strong>in</strong>ation.Pioneer<strong>in</strong>g changeWhat would people th<strong>in</strong>k? Mike Syers, a 42-year-old partner at Ernst & Young, wascom<strong>in</strong>g out <strong>in</strong> a very big way. About 3,000 partners of the firm had gathered <strong>in</strong> Orl<strong>and</strong>o fora conference last year. A two-m<strong>in</strong>ute video of Syers played on giant TV screensthroughout the convention center. He sat <strong>in</strong> the audience watch<strong>in</strong>g himself."When I started <strong>in</strong> public account<strong>in</strong>g," the onscreen Syers said, "I really didn't th<strong>in</strong>k therewas a long-term career opportunity for me. Be<strong>in</strong>g a gay man, I didn't see gay partners."But th<strong>in</strong>gs were different at E&Y, he said. He felt comfortable <strong>and</strong> welcomed.As the screen went dark, Syers's BlackBerry began vibrat<strong>in</strong>g. Messages of supportpoured <strong>in</strong>. Afterward a partner came up to him to say that his son was gay, <strong>and</strong> that hewould call home that night to tell his son how proud he was to work at E&Y.E&Y had asked Syers to make the video because he is a leader of bEYond, thecompany's GLBT employee group. bEYond is only two years old, but it sent 72 people tothis fall's Out & Equal convention. It also sponsored the 2006 Reach<strong>in</strong>g Out MBAconference, a gay <strong>and</strong> lesbian recruit<strong>in</strong>g event that attracted about 700 MBA students toNew York. Court<strong>in</strong>g them were Accenture, Dell, Goldman Sachs, J.P. Morgan Chase,Lehman Bros., McK<strong>in</strong>sey, Merrill Lynch, Microsoft, Target <strong>and</strong> Toyota, among others.This is how workplace changes typically happen at big companies - from the <strong>in</strong>side out.Gay <strong>and</strong> lesbian employees come out of the closet. They f<strong>in</strong>d one another. Theyorganize. They enlist straight allies. And they take their concerns to top managers.The first company-sanctioned network of <strong>gays</strong>, called League, was formed by gayemployees at AT&T <strong>in</strong> 1987. Now more than 110 company-supported GLBT employeegroups have registered <strong>with</strong> Out & Equal.These gay networks customarily meet <strong>in</strong> company facilities, use the company <strong>in</strong>tranet,<strong>and</strong> receive f<strong>in</strong>ancial support. Some get more respect than others. Jeff Immelt, the CEOof General Electric, makes it a po<strong>in</strong>t to clear his calendar each year for the annualgather<strong>in</strong>gs of the African <strong>America</strong>n <strong>and</strong> women's networks at GE, but he has never met<strong>with</strong> the GLBT group. That's caused some bad feel<strong>in</strong>gs.When Ernst & Young hired Syers <strong>in</strong> 2002, he decided to be more open about be<strong>in</strong>g gay,partly because he <strong>and</strong> his partner had just adopted a daughter. "I will never, ever let herth<strong>in</strong>k that her family is someth<strong>in</strong>g to be ashamed of," he says.When he mentioned his new baby to an E&Y colleague, she asked, "So what does yourwife do?" He replied, "Actually, my daughter has two dads." Years earlier he'd come out only to a few friends<strong>and</strong> co-workers; his best friend from high school never spoke to him aga<strong>in</strong>. So Syerswasn't sure what to expect when he <strong>and</strong> Chris Crespo, a lesbian colleague, went to seeJohn Ferraro, the firm's senior vice chair, to ask for company recognition of a gayemployee group that had begun to meet <strong>in</strong>formally.Ferraro listened. The 51-year-old Boston native had not spent much time <strong>with</strong> gay people -he'd been raised <strong>in</strong> a religious family, <strong>with</strong> ten brothers <strong>and</strong> sisters - <strong>and</strong> he was surprisedto learn that some GLBT employees felt uncomfortable at Ernst.He offered to become the executive sponsor of bEYond. "It was obvious that they had tomake decisions every day on whom they could talk to <strong>and</strong> how much of themselves theycould br<strong>in</strong>g to work," Ferraro says. "I can't imag<strong>in</strong>e com<strong>in</strong>g to work every day <strong>and</strong> feel<strong>in</strong>gafraid. It just felt wrong." It was wrong for the bus<strong>in</strong>ess, too, he says. "Do the percentages.Whether it's ethnicity, gender or GLBT, people are our top asset."The C<strong>in</strong>c<strong>in</strong>nati affairThere may be places <strong>in</strong> <strong>America</strong> where companies can sidestep the controversy over gayrights. C<strong>in</strong>c<strong>in</strong>nati is not one of them.In 1993, C<strong>in</strong>c<strong>in</strong>nati voters, by a 65 to 35 percent marg<strong>in</strong>, adopted Article 12, a charteramendment that prohibited the city from pass<strong>in</strong>g any law to protect <strong>gays</strong> aga<strong>in</strong>stdiscrim<strong>in</strong>ation. It was put on the ballot by conservative Christians. In 2004, the votersrepealed Article 12 by a 54 to 46 percent marg<strong>in</strong>. In between, bus<strong>in</strong>ess stepped <strong>in</strong>.The day after the 1993 anti-gay vote, Ed Offshack, an Ivy League-educated chemicaleng<strong>in</strong>eer at P&G, came to work <strong>in</strong> a sour mood. He announced to his manager that he<strong>in</strong>tended to do what he could to make the company more gay-friendly.Offshack, 46, is a second-generation P&Ger - his father worked as an hourly employee ata big manufactur<strong>in</strong>g plant <strong>in</strong> Mehoopany, Pa. - <strong>and</strong> he had no compla<strong>in</strong>ts about how he'dbeen treated by the firm. In 1989 his supervisors arranged for Offshack's partner toaccompany him when he was transferred to the Philipp<strong>in</strong>es. "I've always felt supported,"he says.But P&G was at first reluctant to support gay people <strong>in</strong> a public way. Not until 1996 did thecompany permit GABLE, its gay <strong>and</strong> lesbian employee group, to create an e-mailnetwork. Two years later children of same-sex parents were not allowed to attend a P&Gsponsored"family" event at a local amusement park.Gradually P&G came around to GABLE's po<strong>in</strong>t of view. At the group's urg<strong>in</strong>g, it pulled itsads from talk-show host Dr. Laura Schless<strong>in</strong>ger's program after she was accused of be<strong>in</strong>ganti-gay. It offered domestic-partner benefits <strong>in</strong> 2002.Not long afterward P&G agreed to support the repeal of Article 12. In a speech to theregional branch of the National Conference for Community <strong>and</strong> Justice (formerly theNational Conference of Christians <strong>and</strong> Jews), CEO A.G. Lafley said, "Article 12 is neither<strong>in</strong>clusive nor just, <strong>and</strong> it has severely harmed the economic vitality of our city."P&G donated $40,000 to gay-rights group Citizens to Restore Fairness. Susan Arnold, a lesbian who is P&G's vice chairman <strong>and</strong> apossible heir apparent to Lafley, gave $10,000. GE Aircraft Eng<strong>in</strong>es, Kroger, Federated<strong>and</strong> Hewlett-Packard all gave money to Citizens to Restore Fairness, <strong>and</strong> some urgedtheir employees to vote aga<strong>in</strong>st Article 12.Christian conservatives were aghast. The company <strong>and</strong> its executives have "publiclythrown their support <strong>and</strong> money beh<strong>in</strong>d the homosexual political agenda," said the Rev.Donald Wildmon, president of the <strong>America</strong>n Family Association.He also objected to P&G's decision to offer same-sex-partner health benefits <strong>and</strong> to itsadvertis<strong>in</strong>g on gay-themed TV shows such as NBC's "Will & Grace." The AFA, Focus onthe Family <strong>and</strong> an Ohio-based group called Citizens for Community Values called for aboycott of Tide, Crest <strong>and</strong> Pampers.Phil Burress, president of Citizens for Community Values, which opposes gay marriage<strong>and</strong> pornography, still can't underst<strong>and</strong> why P&G would <strong>in</strong>sert itself <strong>in</strong>to the culture wars."Why <strong>in</strong> the world would corporations get <strong>in</strong>volved <strong>in</strong> someth<strong>in</strong>g as murky as people'ssexual lives?" he asks.Burress, 64, is a force <strong>in</strong> Ohio politics: Citizens for Community Values has eight staffmembers <strong>and</strong> a $1.5 million annual budget. Burress is also a board member of ExodusInternational, a group that helps people walk away from homosexuality by f<strong>in</strong>d<strong>in</strong>g Christ,<strong>and</strong> is a key member of the Arl<strong>in</strong>gton Group, a high-powered Wash<strong>in</strong>gton, D.C.-basedcoalition of groups oppos<strong>in</strong>g same-sex marriage.P&G has reached out to Christian conservatives like Burress, <strong>and</strong> he says the firm islisten<strong>in</strong>g. Unlike Wildmon, he does not object to P&G's decision to provide domesticpartnerbenefits. "What they do on the <strong>in</strong>side, that's their bus<strong>in</strong>ess," he says.But Burress th<strong>in</strong>ks it's wrong for P&G to support what he calls "special rights" for <strong>gays</strong> - bywhich he means legal protection aga<strong>in</strong>st discrim<strong>in</strong>ation. Prohibit<strong>in</strong>g discrim<strong>in</strong>ation on thebasis of sexual orientation, he says, <strong>in</strong>terferes <strong>with</strong> other people's rights to be guided bytheir own moral values when decid<strong>in</strong>g, for example, whether to rent an apartment to asame-sex couple or hire homosexuals <strong>in</strong> their bus<strong>in</strong>ess. "This is a battle of rights," hesays.The Christian groups called off their boycott last year. Says Burress: "P&G has quietlybacked away from promot<strong>in</strong>g homosexuality, but they'll never admit it."He may be right on both counts. P&G's score on the <strong>Corporate</strong> Equality Index, an annualrat<strong>in</strong>g of companies by the Human Rights Campaign, has dropped <strong>in</strong> recent years. Whatdo P&G executives say about this? We can't tell you. They decl<strong>in</strong>ed to be <strong>in</strong>terviewed.Big Blue on the cutt<strong>in</strong>g edgeIn 1953, Thomas J. Watson Jr., the president of IBM, issued a written policy promis<strong>in</strong>gthat the company would hire people based on their ability, "regardless of race, color orcreed." With that history it's no surprise that IBM is now at thecutt<strong>in</strong>g edge when it comes to promot<strong>in</strong>g gay rights:●Among corporations, IBM is the No. 1 f<strong>in</strong>ancial supporter of gay rights groups <strong>in</strong>the U.S.● To export its gay-friendly culture, IBM supports employee GLBT groups <strong>in</strong> 23countries, <strong>in</strong>clud<strong>in</strong>g S<strong>in</strong>gapore, Slovakia <strong>and</strong> Colombia. There's plenty to do: In 80countries homosexual acts are illegal, as they were <strong>in</strong> parts of the U.S. until a fewyears ago.●●Last year IBM convened a group of gay college students at the Human RightsCampaign to form a national organization of students <strong>in</strong> science <strong>and</strong> technology.IBM persuaded Dr. Marci Bowers, one of the world's lead<strong>in</strong>g sex-reassignmentsurgeons <strong>and</strong> herself a transgendered person, to participate <strong>in</strong> the company'shealth <strong>in</strong>surance program.IBM stepped up its diversity efforts <strong>in</strong> 1995, when Louis V. Gerstner, then CEO, formedeight executive-level task forces, one each for women, African <strong>America</strong>ns, Hispanics,Native <strong>America</strong>ns, people <strong>with</strong> disabilities, employees <strong>with</strong> work-life issues, GBLT people<strong>and</strong> men. Men? "Everyone needs a support system," says Ron G<strong>love</strong>r, the company'svice president of global workforce diversity.Each task force was asked four questions: <strong>How</strong> can IBM attract the most talented peoplefrom your group? <strong>How</strong> can the company keep them engaged <strong>and</strong> productive? <strong>How</strong> shouldIBM market to them? And which outside groups should become IBM's partners? The goalwas for IBM to get better at attract<strong>in</strong>g talent <strong>and</strong> sell<strong>in</strong>g to broader sets of customers. "Itwas pretty simple at one level <strong>and</strong> pretty profound at another," G<strong>love</strong>r says.The IBM of today looks very different from the IBM of 1995. The number of femaleexecutives worldwide has <strong>in</strong>creased by 490 percent. The number of self-identified GLBTexecutives has grown even faster - <strong>and</strong> the number of executives <strong>with</strong> disabilities hasmore than tripled. IBM buys $2.1 billion worth of goods <strong>and</strong> services from suppliers ownedby women, m<strong>in</strong>orities or GLBT people, <strong>and</strong> it sells more than $500 million of goods <strong>and</strong>services by market<strong>in</strong>g to those groups.R<strong>and</strong>y Foster is one name beh<strong>in</strong>d the numbers. A former U.S. Air Force capta<strong>in</strong>, he gotvery good at keep<strong>in</strong>g secrets dur<strong>in</strong>g his eight-year military st<strong>in</strong>t. Foster could not tell hisfamily or friends about his work <strong>with</strong> the National Reconnaissance Office, a classifiedgovernment agency that builds spy satellites. And he could not tell anyone <strong>in</strong> the militarythat he was gay. Rather than lie about his sexual orientation, the South Carol<strong>in</strong>a nativeleft the service <strong>in</strong> 1995.After work<strong>in</strong>g at defense contractors TRW, Boe<strong>in</strong>g <strong>and</strong> General Dynamics, Foster settledat IBM, where he sells technology <strong>and</strong> services to the defense <strong>in</strong>dustry <strong>and</strong> thegovernment. "Come hell or high water, I wanted to live one life," he says. "The only th<strong>in</strong>gsI have to hide now are national security secrets, <strong>and</strong> those are good secrets."Foster didn't jo<strong>in</strong> the gay employee groups at any of the companies where he has worked."I'm not an activist," he says. "IBM's a notch above."The movement goes to BentonvilleSo where is the corporate gay-rights movement go<strong>in</strong>g from here? To Bentonville, Ark.Yep, Wal-Mart's gett<strong>in</strong>g gay-friendly. Or as an HR manager for the company put it dur<strong>in</strong>ga workshop at the Out & Equal conference, which Wal-Mart sponsored: "We're here,we're queer <strong>and</strong> we're proud to be here."Wal-Mart has <strong>in</strong>vited gay-rights leaders to Bentonville <strong>and</strong> hired Witeck-Combs, thepreem<strong>in</strong>ent gay market<strong>in</strong>g <strong>and</strong> consult<strong>in</strong>g firm. It is organiz<strong>in</strong>g workshops <strong>with</strong> the nationalgay chamber of commerce. It sponsored a panel at a conference of gay journalists, sent asmall group to the Human Rights Campaign's annual d<strong>in</strong>ner, <strong>and</strong> donated threescholarships to the Po<strong>in</strong>t Foundation, which provides support <strong>and</strong> mentor<strong>in</strong>g to studentswho are marg<strong>in</strong>alized or cast out by their families because of their sexual orientation orgender identity.Wal-Mart becomes gay-friendlyKen Pearson, a middle manager at Wal-Mart University, got Pride, the company's GLBTemployee group, started just last year. He said the group has made headway <strong>with</strong> thecompany by argu<strong>in</strong>g the bus<strong>in</strong>ess case for gay-friendly policies - that they will help Wal-Mart attract more skilled employees, reach a broader range of customers <strong>and</strong> exp<strong>and</strong> <strong>in</strong>tourban markets.This year the company tried sell<strong>in</strong>g gay-themed jewelry <strong>and</strong> promoted the DVD release ofthe gay <strong>love</strong> story "Brokeback Mounta<strong>in</strong>." Domestic-partner benefits are now be<strong>in</strong>g talkedabout by <strong>America</strong>'s largest private employer. "I didn't expect this much movement thisquickly," Pearson says.Here comes the backlash. The <strong>America</strong>n Family Association called for a Thanksgiv<strong>in</strong>gweekendboycott (called off at the last m<strong>in</strong>ute). Phil Burress, the C<strong>in</strong>c<strong>in</strong>nati-based activist,says, "Wal-Mart has no idea what they have taken on here. This Christmas, Wal-Mart'sgo<strong>in</strong>g to take a huge hit for what they've done."It's possible, but the truth is that for the past 15 years, boycotts or no boycotts, corporate<strong>America</strong> has been mov<strong>in</strong>g <strong>in</strong> only one direction, <strong>and</strong> at a pretty rapid pace.Do you recall that the restaurant cha<strong>in</strong> Cracker Barrel fired gay workers back <strong>in</strong> 1991 fornot hav<strong>in</strong>g "normal heterosexual values"? Well, a few years ago, when a Kodak employeesent an e-mail to co-workers object<strong>in</strong>g to the company's endorsement of National Com<strong>in</strong>gOut day as "disgust<strong>in</strong>g <strong>and</strong> offensive," he was the one who was fired when he decl<strong>in</strong>ed toapologize. He was entitled to his beliefs, the company expla<strong>in</strong>ed, but his behavior was notaligned <strong>with</strong> Kodak's values.So it's clear where big bus<strong>in</strong>ess is go<strong>in</strong>g. What's <strong>in</strong>terest<strong>in</strong>g is to watch it pull the rest ofthe country along. Some 249 of the Fortune 500 offerhealth <strong>and</strong> other benefits to the same-sex partnersof their employees. That's up from just 28 adecade ago.Last year, Wal-Mart (Research), <strong>America</strong>'s biggestemployer, agreed to support a network for its gay,lesbian, bisexual <strong>and</strong> transgender (GLBT) workers,jo<strong>in</strong><strong>in</strong>g such firms as Citigroup (Research), DuPont(Research) <strong>and</strong> IBM (Research). It looks at non-discrim<strong>in</strong>ation policies,domestic partner benefits, advertis<strong>in</strong>g <strong>in</strong> gaymedia, philanthropy <strong>and</strong> support for gay employeegroups. This year, 101 companies received thehighest possible 100 percent rat<strong>in</strong>g - up from 56last year <strong>and</strong> 13 when the survey was first done <strong>in</strong>2002.These firms aren't just on Wall Street or <strong>in</strong>Hollywood. For the first time, this year's topperformers <strong>in</strong>cludes oil <strong>and</strong> gas companies (BP● Crunch time at GM● The next president'sfiscal crisis● Big Oil asks for a truce● BMW keeps its pedal tothe metal● Who's to blame for highgas prices?● Cisco targets the liv<strong>in</strong>groom● Plugged In Archive(Research) <strong>and</strong> Chevron (Research)), a chemical company (Dow Chemical (Research))<strong>and</strong> a defense firm (Raytheon (Research)).That's not to say that the debate over gay issues <strong>in</strong> bus<strong>in</strong>ess is settled. Shareholdergroups that favor gay rights, led by New York City's pension funds <strong>and</strong> sociallyresponsible <strong>in</strong>vestors, filed resolutions this year at more than 20 companies, ask<strong>in</strong>g themto expressly prohibit discrim<strong>in</strong>ation based on sexual orientation. Most agreed, but some -notably ExxonMobil, the biggest company <strong>in</strong> <strong>America</strong> by revenues - oppose the idea.ExxonMobil says the resolution is unnecessary because it has exist<strong>in</strong>g "zero-tolerance"policies that ban "discrim<strong>in</strong>ation or harassment for any reason, <strong>in</strong>clud<strong>in</strong>g sexualorientation."Gay rights advocates say the policy should be made explicit. Zack Wright, a lawyer <strong>with</strong>the Pride Foundation, a Seattle nonprofit that supports GLBT causes, says, "What is agay employee supposed to do if he or she is discrim<strong>in</strong>ated aga<strong>in</strong>st? If it's not writtendown, there's noth<strong>in</strong>g they can do."Other companies oppos<strong>in</strong>g resolutions that ask them to ban discrim<strong>in</strong>ation based onsexual orientation <strong>in</strong>clude Leggett & Platt (Research), a diversified manufacturer based <strong>in</strong>Carthage, Missouri, <strong>and</strong> Amsouth (Research), a regional bank based <strong>in</strong> Birm<strong>in</strong>gham,Alabama.Meredith Benton of Walden Asset Management, which filed <strong>with</strong> Leggett & Platt, says,"You want to be sure you have access to the best <strong>and</strong> brightest employees. That is mostsucessfully done when you have an <strong>in</strong>clusive workplace."Meanwhile, shareholders filed resolutions ask<strong>in</strong>g <strong>America</strong>n Express, Bank of <strong>America</strong>(Research) <strong>and</strong> Ford to consider tak<strong>in</strong>g sexual orientation out of their anti-discrim<strong>in</strong>ationpolicies.Yes, there's a backlash underway. Backers of gay rights at Exxon last year got 29 percent. This year,Exxon shareholders vote May 31.Why are more companies embrac<strong>in</strong>g gay rights? Among other th<strong>in</strong>gs, they want to attractgay consumers. Gay purchas<strong>in</strong>g power <strong>in</strong> the U.S. has been estimated at $641 billion ayear by one gay-friendly research firm.To encourage its 600,000 members to support gay-friendly companies, the Human RightsCampaign has created a "Buy<strong>in</strong>g for Equality" guide that puts companies <strong>and</strong> br<strong>and</strong>s <strong>in</strong>green, yellow <strong>and</strong> red categories. So, for example, PepsiCo's (Research) Aquaf<strong>in</strong>a bottledwater gets a green light, while Nestle's (Research) Pol<strong>and</strong> Spr<strong>in</strong>g gets a stop sign. BestBuy (Research) is favored over Circuit City (Research), Banana Republic (Research) overL.L. Bean. Even dog foods get rated. (Iams yes, Alpo no.) You can check out the guide atwww.hrc.org/buyersguide.But consumer power cannot expla<strong>in</strong> why defense contractor Raytheon gets a perfectscore from the HRC. (Gays are not a big market for cruise missiles.) There, the issuecomes down to attract<strong>in</strong>g <strong>and</strong> engag<strong>in</strong>g workers. No company wants to make any of itspeople feel uncomfortable or unwanted.Daryl Herrschaft, director of the HRC's workplace project, says, "To any reasonablebus<strong>in</strong>ess person, the evidence is almost undeniable that this is the right th<strong>in</strong>g to do."One <strong>in</strong>terest<strong>in</strong>g th<strong>in</strong>g about this quiet revolution is that it's ga<strong>in</strong><strong>in</strong>g momentum even as asopponents of gay rights push back. Recall that last year both Microsoft (Research) <strong>and</strong>Ford got caught up <strong>in</strong> gay-rights controversies - a local m<strong>in</strong>ister urged Microsoft not tosupport a non-discrim<strong>in</strong>ation law <strong>in</strong> the Wash<strong>in</strong>gton state legislature <strong>and</strong> religiousconservatives lobbied Ford to remove its ads from gay publications. In the end, both firmscame down on the side of gay rights.It's not clear whether the Microsoft <strong>and</strong> Ford executives made cold bus<strong>in</strong>ess calculationsor whether they followed their hearts. Wal-Mart becomes gay-friendly - Nov. 30, 2006Here's some history: S<strong>in</strong>ce Wal-Mart Pride was sanctioned <strong>in</strong> 2005, Wal-Mart hassupported several gay causes. Wal-Mart donated $60,000 to Out & Equal, a nonprofitgroup that br<strong>in</strong>gs together gay-employee networks from companies across <strong>America</strong>, <strong>and</strong>this fall it sent about 40 Pride members to Out & Equal's annual convention.Wal-Mart also jo<strong>in</strong>ed the National Gay <strong>and</strong> Lesbian Chamber of Commerce, anorganization of about 24,000 gay <strong>and</strong> lesbian-owned bus<strong>in</strong>esses, <strong>and</strong> several Wal-Martexecs bought tickets to the annual d<strong>in</strong>ner of the Human Rights Campaign, the nation'slargest gay-advocacy group.It turns out that much of this activity can be traced back to an unassum<strong>in</strong>g middlemanager who several years ago asked Wal-Mart to live up to the words <strong>in</strong> the cheer - "It'sMy Wal-Mart" - that its people shout out whenever groups of them get together.Early <strong>in</strong> 2003, Ken Pearson, who works at Wal-Mart University, the company's tra<strong>in</strong><strong>in</strong>garm, came back from a corporate meet<strong>in</strong>g where the theme was "It's My Wal-Mart" <strong>and</strong>speakers <strong>in</strong>cluded the African-<strong>America</strong>n poet Maya Angelou. "But I didn't really feel like itwas my Wal-Mart, as a gay man," Pearson says.Back then, the company did not have a written policy protect<strong>in</strong>g gay, lesbian, bisexual <strong>and</strong>transgender (GLBT) employees aga<strong>in</strong>st discrim<strong>in</strong>ation. Nor did it provide health benefitsto the same-sex partners of <strong>gays</strong> <strong>and</strong> <strong>lesbians</strong>.So Pearson composed an e-mail to a Wal-Mart vice chairman, expla<strong>in</strong><strong>in</strong>g that he is gay,ask<strong>in</strong>g if he was welcome at Wal-Mart <strong>and</strong> outl<strong>in</strong><strong>in</strong>g his concerns."I sat there shak<strong>in</strong>g," Pearson recalls. "Can I hit send? There's noth<strong>in</strong>g to protect me fromlos<strong>in</strong>g my job." Soon after dispatch<strong>in</strong>g the e-mail, Pearson was <strong>in</strong>vited to meet <strong>with</strong> theexecutive, who told him that the letter had moved him <strong>and</strong> that th<strong>in</strong>gs would change.They did, <strong>and</strong> fast. In May 2003, Wal-Mart added protection for sexual orientation to itsnon-discrim<strong>in</strong>ation policy. As it happened, a shareholders meet<strong>in</strong>g organized by the PrideFoundation, a Seattle-based nonprofit that supports gay causes, also had been ask<strong>in</strong>g thecompany to do so.Wal-Mart's new 'green' imageBely<strong>in</strong>g its Bible belt roots, Wal-Mart has s<strong>in</strong>ce opened discussions <strong>with</strong> such gay rightsleaders as Joe Solmonese <strong>and</strong> Daryl Herrshaft of the Human Rights Campaign <strong>and</strong>Selisse Berry, executive director of Out & Equal. The company hired Witeck-Combs, aWash<strong>in</strong>gton, D.C.-based consult<strong>in</strong>g firm that specializes <strong>in</strong> market<strong>in</strong>g to gay consumers.After visits to Bentonville, most came away impressed <strong>with</strong> Wal-Mart's s<strong>in</strong>cerity. SelisseBerry of Out & Equal says: "The GLBT group is very committed <strong>and</strong> passionate, <strong>and</strong> theyseem to be gather<strong>in</strong>g more <strong>and</strong> more executive support."This year, Wal-Mart donated three scholarships to the Po<strong>in</strong>t Foundation, which supportsstudents who are marg<strong>in</strong>alized - often, cast off by their families - because of their sexualorientation or gender identity. They have argued that Wal-Mart, by chang<strong>in</strong>g, will be ableto attract <strong>and</strong> engage gay employees <strong>and</strong> reach more gay consumers, especially as itexp<strong>and</strong>s <strong>in</strong>to urban markets. This year, some Wal-Marts sold gay-themed jewelry. "I didn'texpect this much movement this quickly," he says.There's more work ahead. Wal-Mart still does not offer health care benefits to thedomestic partners of its GLBT employees. More than half of Fortune 500 companies doso.In the <strong>Corporate</strong> Equality Index published by the Human Rights Campaign, Wal-Martscores a 65 - up from 14 <strong>in</strong> 2002, but well shy of the 100 percent score notched by morethan 100 big companies.What's more, Wal-Mart Pride draws nearly all of its members from the home office.Pearson <strong>and</strong> his allies want to exp<strong>and</strong> <strong>in</strong>to the field, where most of the company's 1.3million employees work. As more of Wal-Mart's GLBT employees come out of the closet,their clout <strong>in</strong>side the company will grow."I worked for our company for 16 years," says David Yates, a leader of Wal-Mart Pride."The word gay had almost never been mentioned. Nor have its criticsbrought forward evidence that the company hasrefused to hire gay people, or treated gay workersunfairly.But because ExxonMobil has repeatedly decl<strong>in</strong>edto prohibit discrim<strong>in</strong>ation based on sexualorientation <strong>in</strong> its written employment policy, itsshareholders will vote for the eighth year <strong>in</strong> a rowon whether the company should do so.The annual meet<strong>in</strong>g of shareholders is May 31.The resolution, which was filed by New York CityComptroller William C. WhenExxon merged <strong>with</strong> Mobil <strong>in</strong> 1999, the merged company resc<strong>in</strong>ded Mobil's antidiscrim<strong>in</strong>ationpolicy, which referred to sexual orientation, <strong>and</strong> chose not to extend Mobil'sdomestic partner benefits to new employees. (Former Mobil workers cont<strong>in</strong>ue to getdomestic partner benefits.)Its actions have put ExxonMobil is out of step <strong>with</strong> the biggest public companies. All buttwo companies <strong>in</strong> the FORTUNE 100— Pla<strong>in</strong>s All <strong>America</strong>n Pipel<strong>in</strong>e (Research), anenergy firm based <strong>in</strong> Houston, is the other exception—prohibit discrim<strong>in</strong>ation aga<strong>in</strong>st<strong>gays</strong>. So do at least 16 states <strong>and</strong> the District of Columbia.Meanwhile, 78 of the Fortune 100 offer health <strong>and</strong> other benefits to the same-sex partnersof their employees. Among them are oil companies BP <strong>America</strong> (Research), Chevron(Research) <strong>and</strong> Shell (Research).Eric Matusewich, the deputy director of the New York City Equal Employment PracticesCommission <strong>and</strong> author of the Manager's H<strong>and</strong>book on Employment Discrim<strong>in</strong>ation Law(Andrews Publications, 2000), says ExxonMobil may worry that if it <strong>in</strong>cludes sexualorientation as a "protected class" <strong>in</strong> its employment policy, that language could beconsidered a legally b<strong>in</strong>d<strong>in</strong>g contract <strong>with</strong> its employees. Statements made <strong>in</strong> employeeh<strong>and</strong>books about due process rights for employees, for example, have been held to belegally b<strong>in</strong>d<strong>in</strong>g."I'm surprised at ExxonMobil's position, though," Matusewich adds. Consequently, ExxonMobil is subject to that nondiscrim<strong>in</strong>ationrequirement <strong>in</strong> many areas where it does bus<strong>in</strong>ess."The Human Rights Campaign, which has battled ExxonMobil s<strong>in</strong>ce 2000, has been try<strong>in</strong>gto mobilize the buy<strong>in</strong>g power of gay <strong>America</strong>ns to pressure the oil giant. Its Buy<strong>in</strong>g forEquality guide (www.hrc.org/buyersguide) recommends fill<strong>in</strong>g up the tank <strong>with</strong> BP br<strong>and</strong>sAmoco <strong>and</strong> Arco or Chevron br<strong>and</strong>s Caltex <strong>and</strong> Texaco <strong>in</strong>stead of Exxon or Mobil. Thegroup says gay purchas<strong>in</strong>g power <strong>in</strong> <strong>America</strong> has been estimated at $641 billion a year.ExxonMobil doesn't seem to be suffer<strong>in</strong>g. Last month, it reported first quarter profits of$8.4 billion <strong>and</strong> its earn<strong>in</strong>gs of $36 billion <strong>in</strong> 2005 were a record.An ExxonMobil spokesman decl<strong>in</strong>ed, via e-mail, to discuss the issue. Exxon says <strong>in</strong> itsproxy statement that the company "has zero-tolerance discrim<strong>in</strong>ation <strong>and</strong> harassmentpolicies that are comprehensive <strong>in</strong> nature, rigorously enforced, <strong>and</strong> applicable to allemployees." It goes on to say that those policies prohibit "discrim<strong>in</strong>ation or harassment forany reason, <strong>in</strong>clud<strong>in</strong>g sexual orientation."You've got to wonder.
