<strong>265.</strong> STRATEGY OF PUBLIC INTERNAL FINANCIAL CONTROL (PIFC) DEVELOPMENT INMONTENEGRO• The State Treasury sector performs the works relat<strong>in</strong>g to: mak<strong>in</strong>g payments basedon relevant documents and data submitted by spend<strong>in</strong>g units, management <strong>of</strong>account<strong>in</strong>g system <strong>of</strong> the state receipts and expenses; keep<strong>in</strong>g <strong>of</strong> the Treasuryledger; preparation <strong>of</strong> f<strong>in</strong>al statement <strong>of</strong> the budget; monitor<strong>in</strong>g and execution <strong>of</strong> thespend<strong>in</strong>g funds appropriated under the annual budget law; <strong>development</strong> andkeep<strong>in</strong>g <strong>of</strong> the budget account<strong>in</strong>g and manag<strong>in</strong>g the <strong>f<strong>in</strong>ancial</strong> <strong>in</strong>formation system;manag<strong>in</strong>g <strong>of</strong> available monetary funds on the consolidated treasury account; policy<strong>of</strong> the <strong>public</strong> debt; management <strong>of</strong> local and foreign debt; management <strong>of</strong> foreigndonations, aids, loans; keep<strong>in</strong>g records on the state debt etc.• The Internal audit sector carries out <strong><strong>in</strong>ternal</strong> audit <strong>of</strong> account<strong>in</strong>g documents receipts,contracted obligations and spend<strong>in</strong>g units’ expenses, extra budgetary funds andmunicipalities (local government units).Tax adm<strong>in</strong>istration is a body <strong>of</strong> the <strong>public</strong> adm<strong>in</strong>istration which has the competence todeterm<strong>in</strong>e and collect taxes <strong>in</strong>troduced by the Re<strong>public</strong>, based on the Law on TaxAdm<strong>in</strong>istration. This law regulates the rights and obligations <strong>of</strong> the tax authorities and the taxpayers through the procedure <strong>of</strong> determ<strong>in</strong>ation, collection and <strong>control</strong> <strong>of</strong> taxes and otherrates. The tax <strong>in</strong>spectors carry out subsequent <strong>f<strong>in</strong>ancial</strong> <strong>control</strong> to better realiz<strong>in</strong>g the budgetrevenues. The basic task <strong>of</strong> the tax <strong>in</strong>spectors is to carry out <strong>f<strong>in</strong>ancial</strong> supervision aim<strong>in</strong>g tostrengthen the <strong>f<strong>in</strong>ancial</strong> discipl<strong>in</strong>e <strong>of</strong> tax payers to ensure realization <strong>of</strong> the budget revenues.Customs adm<strong>in</strong>istration performs the operations <strong>of</strong> customs supervision over the <strong>in</strong>comecollected by the customs service based on the Law on Customs, the Decree on enforcement<strong>of</strong> the Law on Customs and the Law on Customs Service. The above mentioned legislation,<strong>in</strong>ter alia, regulates obligations, authorizations and the ways <strong>of</strong> act<strong>in</strong>g <strong>in</strong> terms <strong>of</strong> <strong>control</strong> <strong>of</strong><strong>in</strong>come collection. The department for <strong><strong>in</strong>ternal</strong> audit, which is responsible for audit<strong>in</strong>g allbus<strong>in</strong>ess activities <strong>of</strong> the adm<strong>in</strong>istration, has been formed with<strong>in</strong> the Customs Adm<strong>in</strong>istrationand reports directly to the Director <strong>of</strong> the Customs Adm<strong>in</strong>istration.M<strong>in</strong>istries and other authorities <strong>of</strong> the <strong>public</strong> adm<strong>in</strong>istration have been pursu<strong>in</strong>g thepolicies and implement<strong>in</strong>g programs <strong>of</strong> responsible usage <strong>of</strong> the <strong>public</strong> funds thus provid<strong>in</strong>gservices with<strong>in</strong> their competences.In some m<strong>in</strong>istries and adm<strong>in</strong>istration authorities <strong>in</strong>spection supervision (ex post <strong>control</strong>function) over the application <strong>of</strong> legislation is carried out, <strong>in</strong> the follow<strong>in</strong>g areas: turnover <strong>of</strong>goods and services, work performance and protection at work, energy supply, m<strong>in</strong><strong>in</strong>g,constructions, tourism and agricultural activities and other areas. Accord<strong>in</strong>g to the speciallaws, <strong>in</strong>spection supervision are carried out by direct review <strong>of</strong> general and <strong>in</strong>dividualenactments with entities be<strong>in</strong>g subject to <strong>control</strong>. An <strong>in</strong>spection <strong>in</strong> accordance with separatelaws is carried out by review <strong>of</strong> general and <strong>in</strong>dividual enactments <strong>of</strong> the entities be<strong>in</strong>gsubject to <strong>in</strong>spection, aimed at ensur<strong>in</strong>g that laws, other acts and general enactments arekept and tak<strong>in</strong>g adm<strong>in</strong>istrative or other measures to correct irregularities. An <strong>in</strong>spectionsupervision is carried out by the <strong>in</strong>spectors and other <strong>public</strong> servants be<strong>in</strong>g authorized toconduct supervision as specified by a separate law. Such activities are separate from thePIFC requirements.Directorate for Public Procurements is an authority <strong>of</strong> the <strong>public</strong> adm<strong>in</strong>istration which is <strong>in</strong>charge <strong>of</strong> <strong>public</strong> procurement procedures, that provide economic, efficient and transparentusage <strong>of</strong> the <strong>public</strong> funds and creates competitive and equal conditions for bidders .Public Commission for Control <strong>of</strong> Public Procurement Procedures exam<strong>in</strong>es the correctapplication <strong>of</strong> the Law on Public Procurements and proposes and takes measures toelim<strong>in</strong>ate irregularities found which provides for competitiveness and transparency <strong>of</strong> the<strong>public</strong> procurements procedures.Municipalities <strong>in</strong> which self-government is implemented, prepare the plans and programs <strong>of</strong><strong>development</strong>, budget and the f<strong>in</strong>al statement <strong>of</strong> the budget, accord<strong>in</strong>g to the laws.9
