The passage of Senate Bill 392 (and various provisions of the <strong>Contractor</strong>s State License Law<br />

including B&P Code Sections 7071.65 and 7071.19) authorizes CSLB to issue contractor<br />

licenses to limited liability companies (LLCs). The law says that CSLB shall begin processing<br />

LLC applications no later than January 1, 2012. The LLC will be required to maintain<br />

liability insurance of between $1,000,000 and $5,000,000, and post a $100,000 surety<br />

bond in addition to the $12,500 bond already required of all licensees. (Senate Bill 392 is<br />

However, do not apply for an LLC license yet; CSLB is not issuing licenses to LLCs at this time.<br />

CSLB staff is developing new application procedures, creating applications, and putting in<br />

place important technology programming changes that are necessary for this new feature.<br />

CSLB anticipates that it will be able to accept and process LLC applications late in 2011.<br />

Stop Orders<br />

Effective January 1, 2011, Senate Bill 1254 (B&P Code Section<br />

7127) enabled CSLB to issue a “stop work order” to any<br />

licensed or unlicensed contractor who fails to carry workers’<br />

compensation insurance coverage for all of his or her employees.<br />

The new law gives CSLB unprecedented authority in allowing<br />

the Board’s enforcement representatives to more effectively stop<br />

uninsured contracting activity, and aid in the state’s efforts to<br />

No matter what you call it—a referral fee, incentive, inducement, or kick-back, any time<br />

a fee is requested or required for referring contracting work, a state law is being violated<br />

and you risk having disciplinary action taken against your license.<br />

CSLB is aware that referral fees in the disaster response industry are prevalent and are<br />

becoming more of a concern during the difficult economic times. There is evidence that<br />

such referral fees result in the artificial inflation of charges to homeowners and to the<br />

A Message from the Board Chair<br />

As I mentioned in the last CLC newsletter, CSLB is using<br />

technology wherever possible as a cost-effective means to deliver<br />

information faster and to a larger audience. Due to budgets cuts,<br />

CSLB has suspended the distribution of a printed newsletter.<br />

This will likely be the last newsletter you receive in the mail.<br />

The best way to receive your CLC newsletter in the future is by<br />

signing up through CSLB’s “E-Mail Alerts.” The E-Mail Alert<br />

sign-up button is available on every page of CSLB’s website and<br />

enables you to select which CSLB communications you’d like<br />

to automatically receive: news and industry bulletins, meeting<br />

announcements or newsletters. If you are aware of anyone who does not have immediate<br />

access to the Internet, we encourage the use of public libraries.<br />

I am pleased to report that CSLB is maintaining its enforcement efforts against unlicensed<br />

operators and the underground economy through weekly construction site sweeps or sting<br />

operations. In the most recent statewide effort, known as the <strong>California</strong> Blitz, CSLB and its<br />

local and state partners caught 135 unlicensed individuals in 10 different cities during a<br />

three-day operation. Expanding partnerships with such agencies as the Department of<br />

Industrial Relations, Department of Insurance, and Department of Homeland Security<br />

help broaden CSLB’s enforcement and education reach—all part of helping to level the<br />

contracting playing field.<br />

One area that’s still a bargain in our struggling economy is the cost of a contractor license—<br />

about $ .82 per day for renewing licensees and about $1.09 for new applicants. The fees will<br />

increase on July 1, 2011 to about $1.00 per day for renewing licensees and about $1.22 for<br />

new applicants; a small price to pay for enforcement of fair contracting practices, statewide<br />

testing, and licensing operations that support the integrity of our industry. Read more<br />

on page 9.<br />

A new licensing opportunity will take place by the end of this year. For the first time, limited<br />

liability companies (LLCs) will be able to apply for a contractor license. This was made<br />

possible with the passage of Senate Bill 392 and becomes effective no later than January 1,<br />

2012. Policy and procedural information on LLC licenses will be available on the CSLB<br />

website later this year.<br />

Please be aware that CSLB continues to struggle with diminished resources—staffing and<br />

operating funds. Board members and staff continually reassess priorities to meet expectations<br />

ensure a level playing field for licensees who<br />

follow workers’ compensation laws. A Stop<br />

Order takes effect immediately, but can<br />

be appealed. Employees who lose pay due<br />

to a work stoppage shall be payed by the<br />

employer up to 10 days’ pay for time lost.<br />

Failure to comply with a Stop Order will<br />

be a misdemeanor, punishable by up to 60<br />

days in jail and/or a fine of up to $10,000.<br />

Mechanic’s Liens<br />

In order for a mechanic’s lien to be valid, the<br />

person serving the mechanic’s lien must also<br />

provide a proof of service affidavit or the lien<br />

will be unenforceable, per Assembly Bill 457<br />

(Civil Code Section 3084):<br />

“...The bill would require a proof of service<br />

affidavit to be completed and signed by the person<br />

serving the Notice of Mechanic's Lien, and it<br />

would be included as part of the mechanic's lien or<br />

claim of lien. The bill would provide that a failure<br />

to serve the mechanic's lien, including the Notice<br />

of Mechanic's Lien, as required, would cause the<br />

mechanic's lien to be unenforceable as a matter<br />

of law.”<br />

Criminal<br />

AB 2372 Penal Code Section 487 amended<br />

This law changes the threshold from $400<br />

to $950 to charge the crime of grand theft<br />

for stealing money, labor, real or personal<br />

property.<br />

Other Workers’ Compensation<br />

SB 313 Labor Code Section 3722 amended<br />

This bill, signed in 2009, increases the<br />

potential penalty for failure to have a<br />

workers’ compensation policy from $1,000<br />

to $1,500 for each employee not covered.<br />

Fines are administered by the director of the<br />

Department of Industrial Relations.<br />

AB 2305 Business and Professions Code<br />

Section 7125 and Insurance Code Section<br />

11665 amended<br />

The bill extends until 2013 the requirement<br />

for C-39 Roofing contractors to carry a<br />

workers’ compensation policy, even if he or<br />

she has no employees.<br />

Environmental<br />

AB 1343 Public Resources Code Chapter 5<br />

added to Part 7, Division 30<br />

Effective April 1, 2012, contractor outreach<br />

and education will begin regarding recycling<br />

of architectural paint. Implementation of<br />

this recycling program could include an<br />

assessment on the future sale of paint.<br />

CSLB/Consumer Protection<br />

Boards<br />

SB 294 Business and Professions Code<br />

Sections 7000.5 and 7011 amended<br />

This bill extends CSLB’s existence as<br />

a consumer protection board from<br />

January 1, 2011 to January 1, 2012.<br />

SB 1491 Business and Professions Code<br />

Sections 7028.6, 7028.7, 7028.9 and<br />

7058.5 amended<br />

This bill requires that a citation for acting as<br />

a contractor or salesperson without a license<br />

or registration be issued within four years, or<br />

18 months of a complaint for the violation,<br />

whichever is later. The bill also allows for<br />

contractors applying for an original license<br />

to complete and return electronically the<br />

required open book exam about asbestos.<br />

AB 1659 Government Code Section<br />

9147.7 added<br />

This law abolishes the Joint Committee<br />

on Boards, Commissions and Consumer<br />

Protection and replaces it with the Joint<br />

Sunset Review Committee. CSLB’s sunset<br />

review process remains unchanged.<br />

AB 2130 Business and Professions Code<br />

Section 22 amended and Section 101.1<br />

and Division 1.2 repealed<br />

This law is a companion bill to AB 1659,<br />

replacing the Joint Committee on Boards,<br />

Commissions and Consumer Protection and<br />

replacing it with the Joint Sunset Review<br />

Committee.<br />

AB 2500 Business and Professions Code<br />

Section 114 amended and Section<br />

114.5 repealed<br />

The bill amends current law allowing people<br />

licensed by Department of Consumer Affairs’<br />

boards and bureaus to reinstate their license<br />

without examination or penalty if serving<br />

in the <strong>California</strong> National Guard or United<br />

States Military during a period of war. The<br />

new law repeals the section defining war<br />

and extends the reinstatement provision for<br />

licensees who can prove they were serving on<br />

active, military duty. Requests must come<br />

not more than one year after discharge or the<br />

end of active duty.<br />

Where Are You?<br />

You miss out on valuable CSLB information<br />

By law, you must notify CSLB of any<br />

contact information within 90 days.<br />

Without current contact information, you<br />

might miss notification of a citation or<br />

suspension and be unaware that your<br />

license has been revoked. There is no fee<br />

to update your contact information with<br />

CSLB. Look for the Application to Change<br />

Business Name or Address form (13L-4) in<br />

the Forms and Applications section of the<br />

Laws and Regulations on the Horizon<br />

New laws and regulations that could affect your contracting business<br />

are taking effect later this year or in the coming years. A number of<br />

issues currently in the legislative and regulatory process could also<br />

impact contractors.<br />

Carpet Reclamation and Recycling<br />

The <strong>California</strong> Carpet Stewardship Law (AB 2398 http://www.<br />

leginfo.ca.gov/pub/09-10/bill/asm/ab_2351-2400/ab_2398_<br />

bill_20100930_chaptered.html) was chaptered in 2010. Beginning<br />

July 1, 2011, a Carpet Stewardship assessment fee of five cents per<br />

square yard will be placed on all carpet sold in <strong>California</strong> for the<br />

purpose of establishing methods for carpet reclamation and recycling.<br />

Beginning on April 1, 2012, wholesalers and retailers will only be<br />

able to purchase carpet from manufacturers who are in compliance<br />

with AB 2398. Civil penalties of $1,000 per day, or up to $10,000 for<br />

knowing failure to comply, negligence or intentional violations of this<br />

law may be assessed. Learn how to comply with this upcoming law at<br />

Off-Road Diesel Regulations<br />

Following a public hearing in December 2010, the <strong>California</strong> Air<br />

Resources Board made a major change to its regulation of off-road<br />

diesel emissions, and pushing back compliance dates. The new dates are:<br />

• Large fleets (more than 5,000 hp): January 1, 2014<br />

• Medium fleets (2,501-5,000 hp): January 1, 2017<br />

• Small Fleets (2,500 hp or less): January 1, 2019<br />

Legislation that has been introduced<br />

this year could further change off-road<br />

diesel regulation implementation dates<br />

(SB 724); another bill, AB<br />

128, would allow those fined<br />

for violating the regulations<br />

to suspend fines until they<br />

are in compliance with the<br />

regulations.<br />

Always Make Sure It’s in Writing<br />

The number of complaints received by CSLB’s Intake Mediation<br />

Center about poorly written contracts and contracting agreements<br />

that have not been documented on paper is increasing.<br />

Spare yourself and your customers a lot of grief by beginning<br />

a project with a written contract that spells out the consumer’s<br />

expectation and what you will be charging to live up to those<br />

written expectations. Contracts for home improvement should<br />

be done with Business and Professions (B&P) Code Section<br />

7159 in mind.<br />

CSLB-Sponsored Legislation<br />

CSLB-sponsored legislation includes:<br />

• A bill to require that a workers’ compensation exemption to<br />

be filed every time the license is renewed (AB 397);<br />

• Indemnification for CSLB industry experts (SB 865); and<br />

• A requirement that CSLB be notified within 90 days of the<br />

disassociation of the responsible managing officer or employee,<br />

and allowing in limited circumstances a 90-day period to replace<br />

the qualifier (AB 1091).<br />

Other Bills Introduced Related to License<br />

Classifications<br />

• SB 886 would specify that outstanding liabilities to the State Fire<br />

Marshal could affect a contractor’s license. The bill also calls for<br />

enacting a program for certification and regulation of sprinkler<br />

fitters to be set up by the State Fire Marshal.<br />

• AB 465 would require those seeking a business license for<br />

landscaping or gardening to provide proof of CSLB licensure and<br />

workers’ compensation insurance or exemption from it, or a<br />

signed acknowledgement of the consequences of doing contracting<br />

work without a license.<br />

Other Bills Related to Contracting and<br />

Business<br />

• AB 249 would continue to allow a consumer to recover all costs<br />

for a home improvement project for work completed while an<br />

individual was unlicensed. However, for residential projects<br />

over four units, a consumer would only be allowed to recover<br />

compensation paid when the contractor did not possess a license.<br />

• SB 190 would make further technical changes to the mechanic’s<br />

lien law overhaul passed in 2011, and would require that a person<br />

forfeit his or her lien rights if labor or materials not furnished to<br />

the property in question are included in the lien claim.<br />

If additional work or changes to the original contract are added,<br />

make sure change orders to the contract are completed in writing,<br />

and signed by both you and the consumer, as specified in B&P<br />

subsections 7159(d) and 7159.6.<br />

A well-written, detailed contract with all material descriptions and<br />

work expectations provides a clear understanding to your client<br />

about their legal obligation to pay for your home improvement<br />

services, and helps preserve your lien rights if a disagreement<br />

occurs.

About Your Board<br />

The <strong>Contractor</strong>s State License Board (CSLB)<br />

was established in 1929 as the <strong>Contractor</strong>s<br />

License Bureau under the Department of<br />

Professional and Vocational Standards.<br />

Today, CSLB is part of the Department of<br />

Consumer Affairs.<br />

A fifteen-member board appoints CSLB’s<br />

executive officer, or Registrar of <strong>Contractor</strong>s,<br />

and directs administrative policy for the<br />

board’s operations. CLSB’s Board includes<br />

nine public members (non-contractors, one<br />

of which must be a local building official and<br />

another a representative of a senior citizens’<br />

organization), five contractors, and one<br />

labor representative. The Governor makes<br />

eleven appointments and four are made by<br />

the Legislature (two by the Senate Rules<br />

Committee; two by the Assembly Speaker).<br />

The Board holds regularly scheduled public<br />

meetings throughout the state. The meetings<br />

provide the public with an opportunity to<br />

testify on agenda items and other issues.<br />

CSLB licenses and regulates contractors<br />

in 43 license classifications that constitute<br />

<strong>California</strong>’s construction industry. Currently,<br />

there are more than 300,000 contractor<br />

licenses in the state. The Registrar oversees<br />

approximately 400 employees who work at<br />

the headquarters office in Sacramento and<br />

field offices throughout the state.<br />

Headquarters staff receives and processes<br />

applications for new contractor licenses,<br />

additional classifications, changes of license<br />

records, and license renewals. Staff also<br />

reviews and maintains records of disciplinary<br />

actions initiated by the field offices, provides<br />

verified certificates of licensure used in court<br />

or other legal actions, and provides the status<br />

of licensure and other support services.<br />

Headquarters directs the activities of field<br />

offices, and initiates all disciplinary actions<br />

resulting from investigations.<br />

Field office staff investigates consumer<br />

complaints against contractors. The Statewide<br />

Investigative Fraud Team (SWIFT) focuses<br />

on unlicensed activity. CSLB’s website, www.<br />

held, business type, and CSLB disciplinary<br />

actions (if any). Also available is recorded<br />

information on licensing and examination<br />

procedures, complaint procedures and<br />

how to obtain information on a complaint<br />

that has been referred for legal action, the<br />

location and hours of CSLB offices, and<br />

current topics, such as recently passed laws<br />

or regulations. Callers can also order forms,<br />

applications, and other publications.<br />

Advertising Illegally Can Get Your Phone Disconnected<br />

CSLB has taken its enforcement<br />

efforts against unlicensed<br />

operators who advertise in<br />

various online and print media<br />

outlets a step further. Business<br />

and Professions (B&P) Code<br />

Section 7099.10 enables CSLB<br />

to notify the state Public Utilities<br />

Commission to have an illegal<br />

advertiser’s telephone line<br />

disconnected. These disconnect<br />

actions began as a pilot project<br />

in July 2010. CSLB consumer<br />

services representatives or<br />

programming technicians first identify potential illegal advertising<br />

by unlicensed operators. If they determine the ad leads to a phone<br />

number where unlicensed contracting services are being offered, a<br />

citation is recommended.<br />

Fire Protection <strong>Contractor</strong> Convicted<br />

The Executive Officer of American Fire Protection (suspended license #726110), is<br />

facing a long prison sentence after a major CSLB investigation turned up evidence that<br />

he was providing substandard, faulty fire protection systems to more than two dozen<br />

Tulare County businesses. Jurors in Tulare County found Danny Victor Williams, 47,<br />

of Camarillo, guilty of 29 felony and 26 misdemeanors counts. The CSLB investigation,<br />

which included partners from Tulare County law enforcement, led to the arrest of<br />

Williams and his partner, Ken Gordon Speck, 48, of Exeter, in 2009.<br />

Jurors found Williams guilty of 26 felony counts of maintaining impaired fire protection<br />

systems, one felony count each of grand theft, diversion of construction funds and<br />

conspiracy, and 26 misdemeanor counts of violating State Fire Marshal regulations for<br />

automatic fire extinguishers. In addition, the jury found a special allegation true that<br />

while committing the crimes, Williams took, damaged, or destroyed property valuing<br />

more than $65,000.<br />

The investigation determined that Williams trained Speck to service fire protection<br />

systems in the unlawful, unsafe manner. Speck pleaded guilty to five felonies and two<br />

misdemeanors in June 2010.<br />

Williams’ CSLB license has been suspended since 2009 as a result of CSLB’s<br />

investigation. American Fire Protection, based in Camarillo, may have engaged in similar,<br />

fraudulent fire equipment services in other central valley areas, the San Francisco Bay<br />

Area, and in the central coast region. Company representatives dressed in uniforms<br />

similar to those worn by firefighters and claimed to be fire marshals or say they were<br />

referred to the business to service hood and duct systems before they were slated for<br />

inspection or repair. They used high-pressure intimidation tactics to sell the services and<br />

in some instances targeted businesses owned by immigrants.<br />

That recommendation is further investigated by enforcement<br />

representatives who are assigned to the Intake Mediation Center.<br />

If warranted, the citation is issued. After 15 days, if the citation<br />

has not been appealed and the line is not voluntarily disconnected,<br />

the order to disconnect the phone line becomes final. The Public<br />

Utilities Commission is notified of the final order, and the PUC<br />

then notifies the telephone service provider to disconnect the<br />

number that is being used for illegal contracting activity.<br />

CSLB’s Statewide Investigative Fraud Team unit and field<br />

investigators also report their contact with illegal operators who<br />

list a telephone number in their advertising to the CSLB Intake<br />

Mediation centers to prepare disconnect orders.<br />

So far, CSLB has written 18 citations, with three receiving a final<br />

order. One illegal telephone line has been disconnected after<br />

undergoing the full investigative process.<br />

New ARB Refrigerant Regulations for<br />

Commercial Systems<br />

New <strong>California</strong> Air Resources Board (ARB)<br />

regulations designed to reduce our state’s<br />

greenhouse gas emissions and enhance<br />

existing local and federal regulations became<br />

effective January 1, 2011. Owners and<br />

operators of refrigeration systems that use<br />

more than 50 pounds of high global warming<br />

potential (GWP) refrigerants, as well as<br />

contractors, must comply with these new<br />

practices.<br />

The new rules are expected to benefit<br />

businesses through cost savings due<br />

to reduced refrigerant consumption.<br />

Commercial businesses that use more than<br />

50 pounds of GWP refrigerant are large<br />

facilities such as supermarkets and large<br />

grocery stores, food and beverage processors,<br />

cold storage warehouses, and those using<br />

industrial-process cooling.<br />

The regulation affects any person who<br />

installs, services, or disposes any appliance<br />

who refuse to pay these referral fees are losing out on business and are<br />

victims of an uneven playing field.<br />

<strong>California</strong> Business and Professions Code Section 7157(d), says<br />

referral fees are considered to be illegal inducements, a violation<br />

of <strong>Contractor</strong>s State License Law. If, after investigation, a license<br />

is found to be in violation of the law, CSLB may take a formal<br />

administrative disciplinary action and/or refer the matter to the local<br />

authorities for criminal prosecution.<br />

B&P Code Section 7157(d) – Prohibited Inducement; reads as follows:<br />

“(d) No contractor shall pay, credit, or allow any consideration or<br />

compensation of any kind to any other contractor or salesperson<br />

other than a licensee for or on account of the performance of<br />

any work of improvement or services, including, but not limited<br />

to, home improvement work or services, except: (1) where the<br />

person to or from whom the consideration is to be paid is not<br />

subject to or is exempted from the licensing requirements of<br />

this chapter, or (2) where the transaction is not subject to the<br />

requirements of this chapter.<br />

Classifications affected by these regulations<br />

include C-38 Refrigeration, “A” General<br />

Engineering, “B” General Building, C-20<br />

HVAC and C-36 Plumbing contractors.<br />

Under the new regulation, system owners<br />

and operators must conduct leak detection,<br />

monitoring, and record-keeping procedures,<br />

use U.S. EPA-certified technicians, repair<br />

leaks prior to recharging, and can only<br />

dispose cylinders after they have been<br />

properly evacuated. Distributors, wholesalers<br />

and re-claimers can only sell high-GWP<br />

refrigerants to certified technicians or their<br />

employers.<br />

Mandatory Residential Fire Sprinkler Installation<br />

An automatic fire sprinkler system in new one- and two-family<br />

dwellings became mandatory in <strong>California</strong> on January 1, 2011. In<br />

line with the 2009 International Building, Fire and Residential Code,<br />

this change comes from modifications to the <strong>California</strong> Building<br />

Code through the State Building Standards Commission.<br />

“A” General Engineering, “B” General Building, and C-36 Plumbing<br />

contractors should be aware that under current <strong>California</strong> Business<br />

and Professions Code (B&P Code) statutes and regulations only the<br />

C-16 Fire Protection classification is legally permitted to: lay out,<br />

fabricate and/or install fire protection systems. (B&P Code §7057(c)<br />

and 7026.12)<br />

Other construction trades can provide work up to the fire protection<br />

system only (known as the “T,” where the structure’s main water<br />

system intersects the fire sprinkler system), where the fire protection<br />

system is a multipurpose system providing both domestic water<br />

distribution and fire protection.<br />

The new residential code does not affect home remodel, only new<br />

construction; however, there are currently about 160 local ordinances<br />

related to residential fire sprinklers. Check with your local jurisdiction<br />

before beginning any projects.<br />

CSLB Partnership Pans Out<br />

A CSLB partnership with the San Diego<br />

County District Attorney’s Office, aimed<br />

at curbing construction fraud against the<br />

elderly, helped lead to the arrest of Raul<br />

Casillas, 49, of Chula Vista, in December<br />

2009. Casillas pleaded guilty to unlicensed<br />

contracting that defrauded at least three<br />

elderly homeowners. He plead to two felony<br />

counts of elder financial abuse, one felony<br />

count of using another person’s contractor<br />

license, and a misdemeanor count of not<br />

having his own contractor license. The<br />

investigation showed Casillas scammed at<br />

least five San Diego County residents out<br />

of hundreds of thousands of dollars, either<br />

abandoning the projects or performing<br />

substandard work.<br />

In one case, it is believed Casillas accompanied<br />

a 79-year-old woman to her bank and<br />

persuaded her to transfer $300,000 from<br />

her savings into a checking account. From<br />

that amount she withdrew $10,000 in cash<br />

and gave it to Casillas. She also took out a<br />

An increased number of inquiries and<br />

complaints have been received lately in<br />

CSLB’s Intake Mediation Center about<br />

required licensure for muralists. Muralists<br />

who undertake jobs valued at greater than<br />

$500 (labor and materials) to paint on a<br />

permanent structure are subject to state<br />

contractor licensing laws under Business<br />

and Professions Code Section 7026.<br />

It is within the scope of the C-33 Painting<br />

and Decorating license to paint a mural<br />

on the surface of a permanent structure.<br />

However, an individual who limits his or her<br />

practice to that of an artist might be more<br />

appropriately covered by the D-64 Nonspecialized<br />

contractor designation (within<br />

the C-61 Limited Specialty contractor<br />

classification).<br />

To qualify for a C-33, a person must pass<br />

the state law and business exam, in addition<br />

to the trade exam related to painting. “D”<br />

licensees are only required to pass the law<br />

and business exam.<br />

$50,000 cashier’s check for an individual<br />

she did not know. On other occasions,<br />

Casillas was seen in the bank addressing the<br />

victim as “Mom,” and writing in her check<br />

book register, answering questions that were<br />

directed towards the victim, and escorting<br />

her by the arm out of the bank. Much<br />

of Casillas’ work has been found to be in<br />

violation of building codes and poses<br />

a potential fire hazard.<br />

A judge ordered Casillas to pay about<br />

$175,000 in victim restitution.<br />

Statewide Program Helps Licensees Go (and Earn) Green<br />

Renewable energy projects have become the<br />

new trend in home building, and present<br />

many new opportunities for builders.<br />

Licensees can take advantage of special<br />

incentives and learn new skills by taking part<br />

in the Energy Upgrade <strong>California</strong> program.<br />

Energy Upgrade <strong>California</strong> is a collaboration<br />

between the <strong>California</strong> Energy Commission,<br />

the <strong>California</strong> Public Utilities Commission,<br />

utility companies, local governments, nongovernmental<br />

organizations, and the private<br />

sector to promote and fund more than $1.2<br />

billion in renewable energy projects for homes<br />

and businesses. The program also aims to<br />

reduce energy use and help train contractors<br />

and building professionals in support of<br />

construction-related jobs and the economy.<br />

Through Energy Upgrade <strong>California</strong>, local<br />

governments and utilities are offering a<br />

Drilling overhead is one of the more physically demanding jobs in<br />

construction, as it involves holding an eight-pound vibrating drill and<br />

pressing it upward with 55 pounds of force for a minute or longer for<br />

a single hole. Even during a small commercial project, hundreds of<br />

holes can be required to install various electrical, plumbing, sprinkler, or<br />

HVAC systems.<br />

Overhead drilling can cause pain and injury to nerves and muscles<br />

in the shoulder, arm, neck, and back. The symptoms often begin<br />

gradually, but over time they can lead to more serious injuries, which<br />

can leave skilled workers unable to work, sometimes permanently.<br />

Injuries from repetitive overhead drilling can be debilitating, but they<br />

are preventable. Here are some tips to consider before you drill from<br />

the <strong>California</strong> Department of Public Health and the University of<br />

<strong>California</strong> Ergonomics Program:<br />

• Drill from a platform, not a ladder. A platform gives a worker more<br />

flexibility and support to position their body as they drill, and to<br />

reach around obstacles. It also reduces the risk of falling if a drill bit<br />

binds and knocks the worker off balance.<br />

• Use an “overhead drill press”. Engineers and physicians at the<br />

University of <strong>California</strong>, San Francisco have created this tool to<br />

variety of resources, including a Web portal<br />

that features consumer and contractor<br />

information on energy efficiency and<br />

renewable energy building improvements,<br />

residential and commercial utility incentives,<br />

and scholarships and training for contractors.<br />

Overhead Drilling: Making a Tough Job Easier<br />

alleviate the strain of overhead drilling. The overhead drill press<br />

holds the drill at the top of a column, and uses a hand-wheel and<br />

gears to raise the drill to the ceiling. It can drill into ceilings 15 feet<br />

high, and accommodates most “square” roto-hammer drills. You<br />

• Use the right drill. Take advantage of new technology by using<br />

lighter drills with vibration-reducing designs. Use a drill with a<br />

clutch to prevent sudden twisting of hands and wrists if the bit jams.<br />

Be sure to use sharp bits, which reduce the force required to drill.<br />

• Alternate overhead work with others to prevent fatigue. Spread<br />

out the hours of forceful overhead work. Share the work among<br />

co-workers to allow muscles to recover. Also, take frequent breaks<br />

from overhead work to give your muscles and joints time to recover.<br />

Keep your hands and body warm while on the job.<br />

• Communication is key. If you or a co-worker is feeling any pain,<br />

be sure to tell someone immediately and get medical care. By law,<br />

employers are required to address on-the-job injuries.<br />

of Industrial Relations’ Heat Illness Prevention Network (The HIP<br />

C-20s – Winter Coolant Charges – Title 24 energy efficiency<br />

standards require verification of refrigerant charge in some residential<br />

air-conditioner installations, but this can not always be accomplished<br />

when the outdoor air temperature is below 55 degrees Fahrenheit.<br />

To avoid delaying final inspections and certificates of occupancy, an<br />

agreement form is now available from the Western HVAC Performance<br />

Alliance that states the installer, HERS rater, and homeowner-builder<br />

will commit to having the system revisited when the weather is warmer<br />

so the building official can perform final inspection in colder weather.<br />
