During the pastseven years our budget has grown. While federal funding has been flat and interest on lawyertrust account revenue has plunged, we have diversified our funding base and received increasedinvestment from the private bar. As a result, LAFLA has twice as many lawyers assisting clientsas we did in 1997. With our innovative programs, after-hours clinics, partnerships with bar associationsand community groups, six neighborhood offices, and advice centers in five courthouses, we arethe leading law firm for the poor in Southern California. LAFLA is thriving.But lafla’s goal is to make a difference in the community. And the community is nothealthy.The ranks of those needing our h<strong>el</strong>p have grown far faster than we have.While we c<strong>el</strong>ebrateour 75-year history we do not dw<strong>el</strong>l on the past. Rather, we face the future with both resolveand concern.The questions for friends of lafla are:What will growing poverty and inequality do toLos Ang<strong>el</strong>es? And what can we all do about it?Although Los Ang<strong>el</strong>es has the highest poverty rate of any major metropolitan area in thenation, and one in four children live in families that are poor, you can live in Los Ang<strong>el</strong>es and beunaware of the face of poverty.That is because most of the poor – and most of lafla’s clients –are working. Clerks and car washers, housekeepers and day laborers, earn wages that bar<strong>el</strong>y coverrents in a region with the widest gap in the country between the demand and supply for affordablehousing.Affordable child care is just as scarce, as is access to a doctor and job training for familiestrying to move from w<strong>el</strong>fare to work.The stories in this volume illustrate how lafla seeks tomeet these challenges.A cadre of poverty lawyers alone, however, will not reduce – much less end – the miseryin our midst without a broader partnership. Both the principles our profession espouses and thecore tenets of America recognize a shared responsibility to pursue justice and h<strong>el</strong>p our neighborsin need.Yet reducing poverty and inequality is also a matter of s<strong>el</strong>f-interest. Poverty and inequalityundermine faith in our democratic institutions, and cost us all in reduced productivity, economicactivity, and higher taxes.Poverty is a concern for those who are not poor. Employers cannot remain in a regionwhere workers cannot afford to live, cannot trav<strong>el</strong> to work, cannot leave their children in safehands, and lack the education and training to compete on a global stage. Businesses will see theircustomers go <strong>el</strong>sewhere; lawyers will see their clients do the same. 12<strong>Legal</strong> <strong>Aid</strong> Foundation of Los Ang<strong>el</strong>es 2003 Annual Report 13Then &NowThe History of the <strong>Legal</strong> <strong>Aid</strong> Foundation of Los Ang<strong>el</strong>esOrigin of LAFLAlafla traces its origin to the SouthernCalifornia <strong>Legal</strong> <strong>Aid</strong> Clinic Association,which was begun at usc Law School andincorporated on June 18, 1929.The entitythat would become lafla started as astudent-operated legal aid clinic in which15 law school students were enrolled.Justin Miller, a criminal law expert anddean of the law school, and John SaegerBradway, one of the country’s foremostlegal aid attorneys, were its founders.Los Ang<strong>el</strong>es in the 1920s was a cauldronof growth and turmoil.The Countypopulation had more than doubled from936,000 in 1920 to more than 2.2 millionin 1930. Oil discoveries at Signal Hill andother areas in and around Los Ang<strong>el</strong>esmade California the largest oil producingstate in 1923, accounting for one-quarterof the world's entire output of oil.Echoing today’s headlines, real estate andstock speculation led to huge fraudscandals in the late 1920s.The collapse ofthe real estate and stock booms, coincidingwith the onset of the Depression, madepaupers of hundreds of thousands ofordinary citizens. In 1930 Los Ang<strong>el</strong>es ledthe nation in the number of bankruptciesand the amount of net losses in bankruptcyproceedings. Bradway wascommitted to running a professional lawfirm for poor people. As the Depressionwore on, the population of Los Ang<strong>el</strong>esand its environs sw<strong>el</strong>led with familiescoming west for a chance to start over.As a response to the increasing povertyand lack of resources for the poor,muckraking writer and social activistUpton Sinclair instituted his End Povertyin California Campaign. epic ran Sinclairfor governor and conducted other politicalcampaigns. Former dock worker Augustus“Gus” Hawkins would become the firstAfrican American <strong>el</strong>ected to the stateassembly, representing an area later to becalled South Central l.a. And Sam Yorty,who decades later would be mayor ofl.a., ran for office on the epic t<strong>ick</strong>etas w<strong>el</strong>l.In 1937, the board of the SouthernCalifornia <strong>Legal</strong> <strong>Aid</strong> Clinic Associationvoted to transfer all of that organization’sassets and liabilities to the newly formed<strong>Legal</strong> <strong>Aid</strong> Foundation of Los Ang<strong>el</strong>es.Restrictive housing covenants, operatingsince the 1920s, were increasingly used(despite a 1948 Supreme Court decisionoutlawing them) in the post-warperiod as the city spawned suburbs andbedroom communities. In 1950, thenpolice sergeant, and later Mayor ofLos Ang<strong>el</strong>es,Tom Bradley, was initiallyprohibited from buying a home inLeimert Park because of such a covenant.In the 1950s the Lawyers’Wives adoptedlafla as its main charity, recruitingvolunteers and raising funds.Today thegroup is known as the Law Advocates ofLos Ang<strong>el</strong>es and, pursuant to lafla’sbylaws, maintains a seat on the boardof directors.After years of racial insensitivity practicedby the Los Ang<strong>el</strong>es Police Department andother law enforcement agencies, and blackunemployment hovering at 20%, the Wattsriot erupted in August 1965. In itsaftermath, Los Ang<strong>el</strong>es was cited bySargent Shriver, head of the Office ofEconomic Opportunity (oeo), as the only“major city” without a “w<strong>el</strong>l-roundedcommunity action program because ofthe failure of local officials to establish abroad-based community action boardrepresenting all segments of the community.”Federal funding of lafla began in 1966under the aegis of President LyndonJohnson’s War on Poverty. oeo headShriver established a national legal servicesprogram, which funded lafla and fiveother local legal aid operations inLos Ang<strong>el</strong>es.opposing page: Sample of Congressman Hawkins’ newsletter to constituents.

Despitethat and l.a.’s wholesale deindustrialization,which pushed a post-World War IIworkforce out of higher-paying heavyindustry and into the lower-paying servicesector, the ending of federal job trainingprograms and other safety nets underPresident Reagan, and another riot in1992, lafla continued to provideservices to clients directly affected bythese events.In 2001, lafla merged with the <strong>Legal</strong> <strong>Aid</strong>Foundation of Long Beach, which hadbeen created in 1953.TodayToday lafla is recognized as one of th<strong>el</strong>eading law firms for low-income peoplein the country.We work clos<strong>el</strong>y withcommunity advocates, private lawyers,government agencies and the judiciary toexpand access to justice, strengthencommunities, fight discrimination, andeffect systemic change.In these pages we describe a few of thecases lafla has recently undertaken forfamilies and individuals with nowhere <strong>el</strong>seto turn for h<strong>el</strong>p.


18<strong>Legal</strong> <strong>Aid</strong> Foundation of Los Ang<strong>el</strong>es 2003 Annual Report 19Employmentprotectionrare forlow-wageworkersIn 2003, LAFLA recoveredapproximat<strong>el</strong>y $260,000 forworkers in appar<strong>el</strong>, foodservice, construction, carwash, and other low-wageindustries who had beencheated out of their wages,overtime pay, vacation pay,and unemployment benefits.labor codeabusesrampantA 2003 investigation of thecar wash industry by theCalifornia State LaborCommission uncoveredsweatshop-like conditionsand rampant abuses ofminimum labor standards.At the request of Assemblymember Jackie Goldberg,LAFLA drafted and providedsupporting testimony forlegislation licensing carwashes and preventingexploitation of workers.allworkersentitled toworkplaceprotectionWith funding from EqualJustice Works, LAFLAlaunched a Know Your <strong>Legal</strong>Rights Project to involve lawstudents in efforts to educateand empower low-wageworkers. The project alsoestablished a S<strong>el</strong>f-H<strong>el</strong>p Clinicat the State LaborCommissioner Office to assistlow-wage workers withclaims for non-payment ofwages or other compensation.HousingcriticalshortageofaffordablerentalhousingIn 2003, LAFLA couns<strong>el</strong>ed8,400 low-income tenantsfacing eviction who sought toretain their housing. In thecases where LAFLA appearedas couns<strong>el</strong>, 94% resulted infavorable outcomes includingmore than $850,000 in waivedrent and costs, $375,000 inr<strong>el</strong>ocation assistance, and20,000 extended daysof sh<strong>el</strong>ter.156,000apartmentunits inLA b<strong>el</strong>owstandardLAFLA sued to rehabilitate abuilding where 11 familieswere dislocated after the roofcollapsed and faulty plumbingflooded the units with rawsewage. LAFLA also obtaineda $3.5 million judgment for 19tenants of a dilapidatedapartment building plaguedby rodent infestation, leadpoisoning, missing walls,and no hot water, heat, gasor <strong>el</strong>ectricity.16,000affordablerentalunits atriskLAFLA brought suit againstthe owner of a federallysubsidizedbuilding whosought to opt out of theprogram and raise rents tomarket lev<strong>el</strong>s, in violation ofthe Los Ang<strong>el</strong>es RentStabilization Ordinance.The owner challenged thevalidity of the ordinance butthe Ninth Circuit Court ofAppeals uph<strong>el</strong>d the ordinanceand the maintenance ofaffordable rents. LAFLA alsosued another private landlordto stop the improper removalof 127 units from theSection 8 subsidizedhousing program.

One <strong>el</strong>derlycouple, victims of a predatoryloan based on forgeddocuments andmisrepresentation ofthe loan terms, avoidedforeclosure and were able toremain in their home of 22years when LAFLA succeededin canc<strong>el</strong>ing their loan,recovered their fees andcharges, and obtained ajudgment for damages inexcess of $200,000.nearly1/3in LA’slow-incomeareas donot havebankaccountsLAFLA provided data andsubmitted comments onproposed state legislationcracking down on abuses inthe thriving payday loanindustry. Such lendersprovide short-term loans tolow-income people who livefrom paycheck to paycheck,but often employ hardballcollection tactics, chargeinterest rates that can runfrom 300% to 1,000%, andtarget the poor and thevulnerable who lack access toconventional banking services.abusiveconsumerpracticestarget<strong>el</strong>derly,minoritiesIn 2003, LAFLA assisted 286low-income consumers withproblems involvinghomeownership fraud, unfairbanking and loan practices,debt collection, credit identitytheft, and contract fraud.LAFLA also collaborated witha variety of organizations andpublic agencies to examineand address predatorylending and other financialabuses that prey on lowincomeconsumers.GovernmentBenefits1/3 ofhom<strong>el</strong>essareveteransLAFLA’s Bill Smith Hom<strong>el</strong>essVeterans Project h<strong>el</strong>pedveterans receive more than$1.5 million in retroactivebenefits and secure futureemployment, disability andother benefits ranging from$100 – $2,000 or more amonth so that they couldstabilize their lives, get offthe streets and move outof poverty.fewerreceivingw<strong>el</strong>farebut manystill poorIn 2003, LAFLA assistedmore than 1,300 vulnerableindividuals and familiessecure vital supportivebenefits from a broad rangeof programs includingCalWORKs, SocialSecurity/SSI, Food Stamps,Medi-Cal, andVeterans Benefits.most ofthe poorareworkingorseekingworkLA County settled a lawsuitbrought by LAFLA and otherpublic interest law firms tohalt discriminatory practicesthat impeded limited-Englishspeakingpersons onCalWORKs from participatingin w<strong>el</strong>fare-to-work programsand services.
