MANX NATIONAL RALLY ORDER 2OO5<br />
Coming into Operation: dh May 2005<br />
In exercise of the powers conferred on the Department of Transport by Sections I and 2 of the Road<br />
Races Act 1982r, and of all other enablingpowers, the following order is herebymade:-<br />
1. Citation and commencement<br />
Introductory<br />

(1) In this Order :-<br />
"the Act" means the Road Races Act l9g2;<br />
"the clerk of the course" means the individual designated as crerk of the course by the promoter<br />
and includes any deputy or assistant clerk of the corlrse so designated;<br />
"closure period" means any period during which an authorisation under Article 3 is in force in<br />
relation to the Course or any part of the Course;<br />
references to a constable shall be construed in accordance with section 3 of the Act (appointment<br />
of marshals);<br />
"the Course" means the roads speci<strong>fi</strong>ed in Schedule l;<br />
"the Department" means the Department of Transport;<br />
"the promoter" means Manx Auto Sport Ltd.<br />
"rally days" and "railyperiods" are as speci<strong>fi</strong>ed in schedure r;

,.the senior police of<strong>fi</strong>cer" means a member of the Isle of Man constabulary of the rank of<br />

Suspension of right of waY etc'<br />

Subject to Article 7, during any closure period in relation to any part of the Course -<br />
(a) the right of way over it is suspended; and<br />
(b) no traf<strong>fi</strong>c may pass on to or over it'<br />
ExemPtions from Article 4<br />
(1) Article 4(a) does not apply to the following persons -<br />
(a) the Clerk of the Course;<br />
(b) persons appointed by the clerk of the course as of<strong>fi</strong>cials for the purpose of the rally;<br />
(c) constables;<br />
(d) persons lawfully taking part in the rally and their attendants;<br />
(e)<br />
(Ð<br />
(2)<br />
media representatives and photographers approved by the promoter and bearing an of<strong>fi</strong>cial<br />
badge or armlet issued by the promoter;<br />
anyotherpersonauthorisedinwritingbytheDepartmentortheChiefConstable.<br />
Article 4(b) does not apply to the following vehicles -<br />

(a) vehicles approved by the clerk of the course or the senior<br />
conveyance police<br />

mentioned for the<br />
in paragraph (lxb), (c) and (e);<br />
(b) motor-cars engaged in the rally.<br />
6. Publicity for cancellation etc.<br />

7. Noti<strong>fi</strong>catÍon of end of closure<br />
(1) At the end of each section of the rally for which an authorisation under Article 3 is in force -<br />
(a) the Clerk of the Course, or<br />
(b) the senior police of<strong>fi</strong>cer after consulting the clerk of the course,<br />
shall arrange for a motor vehicle, marked as mentioned in Artic le 2Q),to travel that section of the<br />
Course.<br />
Erection of barriers and signs<br />
and closure signs are erected and<br />

(2) The barriers referred to in paragraph (1) shat consist of -<br />

9. fnsurance<br />
The promoter shall secure the folrowing insurance and indemnities _<br />
(1) against injury and damage to persons or property arising out of the conduct of the rally;<br />
(2) any claims or liability on the Department arising from the conduct of the rally<br />

6. Publiciff for cancellation etc.<br />
Administration<br />
Where the senio¡police of<strong>fi</strong>cer is noti<strong>fi</strong>ed of the cancellation of the rally or a section of the rally<br />
under Article 3(3), he shall take such measures as he considers appropriaie to inforrn the public of<br />
the effect of it.<br />
7. Noti<strong>fi</strong>catÍon of end of closure<br />
(1) At the end of each section of the rally for which an authorisation under A¡ticle 3 is in force-<br />
(a) the Clerk of the Course, or<br />
(b) the senior police of<strong>fi</strong>cer after consulting the Clerk of the Course,<br />
shall arrange for a motor vehicle, marked as mentioned in Artic le 2Q), to travel that section of the<br />
Course.<br />
8. Erection of barriers and signs<br />
(1) The prornoter shall secure that barriers, diversion signs and closure signs are erected and<br />
maintained on all roads leading on to the Course immediateiy before, or as soon as possible after,<br />
the beginning-of every closure period, and in any event before the relevant part o¡'ti. ðo*r. i,<br />
used for the rally.<br />
(2) The barriers referred to in paragraph (r) shall consist of -<br />
(a) tubular steel structures supplied by the Department with suitable signs attached, in any case<br />
where the Department so ãirects; -or<br />
(b) a rope across the road with a suitable red flag attached, in any other case.<br />
(3) The closure signs refered to inparagraphs (1) and(2)(a) shall be of the size, colourand<br />
t¡pe shown in diagram 616 in Schedule 2 to the Traifrc Signs Regulations and General Directions<br />
20022.<br />
Insurance<br />

The promoter shall secure the following insurance and indemnities -<br />
(l) against injury and damage to persons or property arising out of the conduct of the rally;<br />
