Thistlethwaytewas taken to court where he posted £200 bail, then promptly departed from Oxford, never toreturn, having sent a letter on Feb. 22, 1739 resigning all his offices (h).A new case rose against Rev. John Swinton. George Baker knew that John and Thistlethwayte had beenclose friends since Swinton's return from a trip to Italy some years before. Baker was now aservant of Swinton. He recalls that a Robert (Bob) Trustin had once slept with Swinton. "I knew Lord Swinton asmuch as a youth can know an old man and I have always been intimate with his family. So far back as 1765 he published an attack onour system of entails; in 1779 he explained a scheme for a uniform standard of weighsand measures;and in 1789 he put forth considerations in favour of dividing the Court ofSessions into more courts than one, and of introducing juries for the trial of civil causes. Allthese improvements have since taken place, but they were mere visions in his time; andhis anticipation of them, in which so far as I ever heard, he had no associate, is veryhonourable to his thoughtfulness and judgement.
