II. IntroductionJonathan Carey, born September 12, 1993, was diagnosed with mental retardationat the age of two and autism at the age of six, according to his parents, Michael and LisaCarey. Jonathan exhibited repetitive behaviors typical of some autistic children, such asrepeatedly flipping through the pages of a book without looking at the pictures andmultiple cycles of crouching down, touching the ground, and standing back up. At times,Jonathan exhibited negative behaviors such as pinching, grabbing, hair pulling, hitting,temper tantrums, and throwing himself to the ground. By the age of nine, Jonathan spokeonly a few words and phrases.Beginning with his initial diagnosis at the age of two, Jonathan received servicesfor the disabled near his home in Bethlehem, New York. As he grew older, Jonathanbecame increasingly difficult for his parents to manage at home, especially since they hadbeen unsuccessful in teaching him to use the toilet. Lisa Carey reported that Jonathanwore diapers or “pull-ups” on a full-time basis and did not seem to understand thepurpose of the toilet. Michael Carey stated that he and his wife had heard that theAnderson School was successful in toileting and “one of the big reasons why [they] putJonathan in the Anderson School” was to toilet train him.Jonathan arrived at the Anderson School in January 2003. He made progress inlearning to use the toilet, but continued to exhibit some undesirable behaviors such asaggression toward other children, throwing himself on the floor (“flopping”), and runningaway from staff (“bolting”). On December 31, 2003, a plan to address his negativebehaviors, including Jonathan’s incontinence, was implemented at the Anderson School.The staff members who cared for Jonathan were instructed to ignore negative behaviors23
