This practice reflects more than <strong>the</strong> mere'excesses‘ <strong>of</strong> a particular comm<strong>and</strong>er. Ra<strong>the</strong>r,it is a deliberate strategy <strong>in</strong> keep<strong>in</strong>g with <strong>the</strong>overall trajectory <strong>of</strong> counter<strong>in</strong>surgencyth<strong>in</strong>k<strong>in</strong>g at <strong>the</strong> national level...It is, <strong>in</strong>stead,essential to identify <strong>and</strong> decisively reject at an<strong>in</strong>stitutional level those <strong>in</strong>novations <strong>in</strong>counter<strong>in</strong>surgency strategy that have resulted<strong>in</strong> such level <strong>of</strong> political kill<strong>in</strong>gs.


Melo Commission Report•• The NPA purge <strong>the</strong>ory be<strong>in</strong>g discredited,<strong>the</strong> only o<strong>the</strong>r <strong>the</strong>ory left is that certa<strong>in</strong>elements with<strong>in</strong> or connected to somemilitary <strong>of</strong>ficers are responsible for <strong>the</strong>kill<strong>in</strong>gs. They were killed, it is said, by motorcycle• rid<strong>in</strong>g hooded killers <strong>in</strong> assass<strong>in</strong>ation manner.• Government agencies hardly need rem<strong>in</strong>d<strong>in</strong>g that <strong>in</strong> a• democratic <strong>and</strong> civilized state such as ours, one must• uphold <strong>and</strong> observe <strong>the</strong> rule <strong>of</strong> law, <strong>the</strong> pr<strong>in</strong>ciples <strong>of</strong>• justice, <strong>and</strong> <strong>the</strong> system <strong>and</strong> rules <strong>of</strong> how it is dispensed• – from <strong>in</strong>vestigation to arrest, to <strong>in</strong>quest, <strong>and</strong> to trial.• The system may be far from perfect, giv<strong>in</strong>g rise to <strong>the</strong>• temptation to take short-cuts. But precisely, short-cuts• are <strong>in</strong> defiance <strong>of</strong> <strong>the</strong> system <strong>of</strong> impartial justice. The <strong>Writ</strong> <strong>of</strong> <strong>Amparo</strong>• <strong>Amparo</strong> literally means ‘to shelter’or “protection” from <strong>the</strong> Spanishword Amparar when constitutionalrights are violated by:1.Laws2. Judicial decision <strong>in</strong> civil <strong>and</strong> crim<strong>in</strong>alcases3.Acts <strong>of</strong> any nature by <strong>the</strong> authorities


Nicaraguan Def<strong>in</strong>ition• It may be Provided through Statute under DecreeNo. 232 [The Law <strong>of</strong> <strong>Amparo</strong> for PersonalFreedom <strong>and</strong> Security] <strong>and</strong> <strong>the</strong> Constitution by<strong>the</strong> Fundamental statute <strong>of</strong> July 20, 1979.<strong>Amparo</strong> operates:a)on behalf <strong>of</strong> a person who has been deta<strong>in</strong>ed orthreatened with detention upon orders <strong>of</strong> <strong>the</strong>State;a)aga<strong>in</strong>st a sentence <strong>of</strong> imprisonment imposedupon a person who has not been deta<strong>in</strong>ed <strong>and</strong>who wishes to be released from its effects.


Argent<strong>in</strong>aIt provides for <strong>the</strong> fil<strong>in</strong>g <strong>of</strong> a writ <strong>of</strong>amparo aga<strong>in</strong>st any act or omission <strong>of</strong> apublic authority which “currently orimm<strong>in</strong>ently may damage, limit, modify orthreaten rights <strong>and</strong> guarantees explicitlyor implicitly recognized by <strong>the</strong> Constitution,except for <strong>in</strong>dividual liberty, which isprotected by habeas corpus.”


SECTION 1.• Petition. – The petition for a writ <strong>of</strong>amparo is a remedy available to anyperson whose right to life, liberty<strong>and</strong> security is violated orthreatened with violation by anunlawful act or omission <strong>of</strong> a public<strong>of</strong>ficial or employee, or <strong>of</strong> a private<strong>in</strong>dividual or entity. The writ shallcover extralegal kill<strong>in</strong>gs <strong>and</strong>enforced disappearances or threats<strong>the</strong>re<strong>of</strong>.
