e) failure in all modules in the current semester or year, with the possibility <strong>of</strong> repeating themodules (or alternatives) for a capped mark;f) failure in all modules in the current semester or year, without the possibility <strong>of</strong> repeating themodules (or alternatives) for a capped mark;g) referral <strong>of</strong> the case to the Vice Chancellor for the consideration <strong>of</strong> termination <strong>of</strong> studies.5.2 The Panel will consider valid aggravating and/or mitigating circumstances when deciding upon thelevel <strong>of</strong> penalty. The penalty for a second or subsequent <strong>of</strong>fence will normally be more severe thanfor a comparable first <strong>of</strong>fence. However, where the academic misconduct is <strong>of</strong> such significance, thepenalty for a first <strong>of</strong>fence may range from a) to g) above.5.3 The Director <strong>of</strong> HR & Registry (or nominee) shall provide advice to the Panel on the levels <strong>of</strong> thepenalties and the precedent for their application.5.4 The student, if present, will be notified <strong>of</strong> the Panel’s decision.5.5 Normally, within five working days, the Director <strong>of</strong> HR & Registry will notify the student <strong>of</strong> thedecision and that they have a right <strong>of</strong> appeal against the decision on procedural grounds only. Thestudent may respond, in writing, to the Director <strong>of</strong> HR & Registry’s formal notification <strong>of</strong> theoutcome <strong>of</strong> the Hearing, indicating a decision to appeal and giving the grounds for that appeal. Theresponse must be received by the Director <strong>of</strong> HR & Registry within ten workings days <strong>of</strong> the date <strong>of</strong>the Director <strong>of</strong> HR & Registry’s letter.5.6 If the student appeals, the Director <strong>of</strong> HR & Registry will set in motion the procedures set out below.5.7 If the student does not respond to the notification <strong>of</strong> the decision, the Director <strong>of</strong> HR & Registry (ornominee) will issue a Completion <strong>of</strong> Procedures letter.6. APPEALS AGAINST THE DECISION:6.1 The only ground for appeal against the decision <strong>of</strong> the <strong>University</strong> is that the procedures detailedherewith were not followed. There are no grounds for appeal on the basis <strong>of</strong> the following:a) new evidence (unless pertaining to procedures) not disclosed for whatever reason;b) disputing the judgement <strong>of</strong> the Panel;c) disputing the academic competence <strong>of</strong> Panel.6.2 The appellant must specify in writing to the Director <strong>of</strong> HR & Registry precisely what aspect <strong>of</strong> theprocedure was not followed. Appeals shall be considered in the first instance by the Director <strong>of</strong> HR& Registry (or nominee) and any one <strong>of</strong> the ACOs who was not involved in the original investigationor a member <strong>of</strong> the Hearing Panel which made the decision regarding the appellant. They shalldecide whether there is a prima facie case for consideration. Where there is a prima facie case, theDirector <strong>of</strong> HR & Registry (or nominee) shall liaise with the Clerk to the Governors to convene anappeals committee <strong>of</strong> the Governing Body. If there is no prima facie case for consideration, theDirector <strong>of</strong> HR & Registry (or nominee) will issue a Completion <strong>of</strong> Procedures letter.7. APPLICATION TO THE OFFICE OF THE INDEPENDENT ADJUDICATOR (OIA)7.1 A student who is dissatisfied with this process or its conduct has the right to submit an application tothe OIA that their dissatisfaction be reviewed independently <strong>of</strong> the <strong>University</strong>.7.2 This right may only be exercised once the internal processes have been exhausted.Academic Misconduct Policy for Taught Programmes– revised January 2011 Page 9 <strong>of</strong> 11
