President Danielarap Moi was backing out of promises to review the c<strong>on</strong>stituti<strong>on</strong>, and Nowrojee had g<strong>on</strong>eto complain to Mwai Kibaki, then the most senior oppositi<strong>on</strong> figure. Kibaki listened andshrugged. “<str<strong>on</strong>g>Kenya</str<strong>on</strong>g> yetu,” Kibaki said – “Our <str<strong>on</strong>g>Kenya</str<strong>on</strong>g>”.T<str<strong>on</strong>g>his</str<strong>on</strong>g> was meant to suggest t<str<strong>on</strong>g>his</str<strong>on</strong>g> was just the ways things were, so why waste time gettingangry about it? But coming from a politician it meant, for the ruling elite, the country hasalways been theirs for the taking. And aided by a weak, complicit judiciary that has sinceindependence virtually guaranteed senior politicians immunity from c<strong>on</strong>victi<strong>on</strong>, theyhave taken a lot.Those at the very top of the political pile usually took the most. The family of the firstpresident, Jomo <str<strong>on</strong>g>Kenya</str<strong>on</strong>g>tta, stole so much land they made the original white British settlerslook like petty thieves by comparis<strong>on</strong>. Succeeding <str<strong>on</strong>g>Kenya</str<strong>on</strong>g>tta, Moi grabbed land too, butwww.marsgroupkenya.org 1


www.marsgroupkenya.orgAnother was William Ruto, the agriculture minister, who was alleged to have incitedKalenjin gangs. Both str<strong>on</strong>gly deny any wr<strong>on</strong>gdoing. <str<strong>on</strong>g>Kenya</str<strong>on</strong>g>tta had already taken theKNCHR to court to try to clear <str<strong>on</strong>g>his</str<strong>on</strong>g> name. Ruto subsequently announced in Novemberthat he was also pursuing legal acti<strong>on</strong> against the KNCHR.The two men, who both have str<strong>on</strong>g presidential aspirati<strong>on</strong>s and are extremely wealthy,then came together to form an alliance.From outside the move may have seemed positive – leaders from the Kikuyu andKalenjin communities leading the way <strong>on</strong> rec<strong>on</strong>ciliati<strong>on</strong>. But the alliance appears to bepurely political, meant to guarantee that <strong>on</strong>e of the two is <str<strong>on</strong>g>Kenya</str<strong>on</strong>g>’s next leader, c<strong>on</strong>tinuingthe Kikuyu-Kanlenjin hold <strong>on</strong> power (<str<strong>on</strong>g>Kenya</str<strong>on</strong>g>tta was Kikuyu, Moi is Kalenjin, Kibaki isKikuyu), to the exclusi<strong>on</strong> of <str<strong>on</strong>g>Kenya</str<strong>on</strong>g>’s 40 other ethnic groups.
