If yournew pool, spa, or hot tub is not finaled and you have not received a Certificate <strong>of</strong> Completion by October 1, 2000,this law will affect you. The new law will require that all new residential pools, spas, and hot tubs be equipped with atleast one pool safety feature as specified in F.S. 515. A summary <strong>of</strong> which is that, in addition to the present fence/screenenclosure requirement, all new pools, spas, or hot tubs shall have at least one <strong>of</strong> the following safety features:1. “An approved safety pool cover” means a manually or power-operated safety pool cover that meets all <strong>of</strong> the performancestandards <strong>of</strong> the American Society for Testing and Materials (ASTM) in compliance with Standard F 1346-91.2. “Barrier” means a fence, dwelling wall, or non-dwelling wall, or any combination there<strong>of</strong>, which completely surroundsthe swimming pool and obstructs access to the swimming pool, especially access from the yard outside the barrier.A residential swimming pool barrier must have all <strong>of</strong> the following characteristics:(a) The barrier must be at least 4 feet high on the outside.(b) The barrier may not have any gaps, openings, indentations, protrusions, or structural components that could allowa young child to crawl under, squeeze through, or climb over the barrier.3. “Exit Alarm” means a device that makes audible, continuous alarm sounds when any door or window, which permitsaccess from the residence to any pool area that is without an intervening enclosure, is opened or left ajar.Any person who fails to equip a new residential pool, spa or hot tub with at least one safety feature as required by thisnew Florida Statute will commit a misdemeanor <strong>of</strong> the second degree.The above information is only a brief overview. The plans shall show the fence location and method <strong>of</strong> attachment, including oneend that shall not be removable without the aid <strong>of</strong> tools. (Submit Manufacturer’s Specifications.)A combination <strong>of</strong> non-dwelling walls and fences (screen enclosure, child fence, masonry fence walls, chainlink or wood fence, etc.) will protect the pool perimeter. The plans must specify the type and location <strong>of</strong> allnon-dwelling walls.Any combination <strong>of</strong> protection which incorporates dwelling walls with openings directly into the poolperimeter and all windows and doors will be equipped with exit alarms complying with Florida BuildingCode 424.2.17.1.9. (Submit Manufacturer’s Specifications.)Any combination <strong>of</strong> protection which incorporates dwelling walls with openings directly into the poolperimeter and all doors will be equipped with a self-latching device with positive mechanical latching/locking installed a min. 54” above the threshold. If this option is selected, submit plans showing all typesand location <strong>of</strong> all perimeter protection. The plans must also show the location and type <strong>of</strong> all openings, andthe hardware type for each location. (Submit Manufacturer’s Specifications.)In accordance with the Code, a final inspection <strong>of</strong> the pool project will not be approved without compliance with the PrivateSwimming Pool Safety Requirements and, upon expiration <strong>of</strong> the permit, the pool shall be presumed to be unsafe.I understand that not having one <strong>of</strong> the above installed will constitute a violation <strong>of</strong> Chapter 515, F.S. and will beconsidered as committing a misdemeanor <strong>of</strong> the second degree, punishable as provided in Section 775.082 or Section775.083 F.S.
