Applications will notbe accepted and licences will not be issued in the name/s of a partnership or anincorporated body. Only one application will be accepted from any one applicant.2) Applicant character checks will include assessment of disclosable court outcomesbased on a National Police Certificate (provided by applicant), driving his<strong>to</strong>ry and anyother relevant information available <strong>to</strong> the Department of Infrastructure.3) Applicants are also <strong>to</strong> provide evidence of financial stability including, but not limited<strong>to</strong>, a statement by a registered Certified Practicing Accountant, chartered accountant orfinancial planner confirming the financial capacity of the applicant <strong>to</strong> operate a PeakService Taxi-cab, in addition <strong>to</strong> any other business activities, including other taxi-cabs,the applicant may be involved with.4) Applicants are also <strong>to</strong> provide verifiable evidence of metropolitan taxi-cab drivingexperience, including, but not limited <strong>to</strong>, copies of taxation returns covering the periodsince at least 1 June 1997 and Business Activity Statements (since 1 July 2000) lodgedwith the Australian Taxation Office.5) The eligibility of any applicant <strong>to</strong> be considered for issue of a Peak Service Licencewill be determined on the basis of verifiable information that the applicant meets all ofthe specified eligibility criteria and satisfies the Department of Infrastructure thathe/she is a fit and proper person <strong>to</strong> be issued a licence. Fitness <strong>to</strong> hold a licence willinclude consideration of:l traffic and other offences proven against the applicant;l industry-related complaints registered with the Department and/or taxi depots;andl compliance with laws and other legal responsibilities the Department mayconsider relevant <strong>to</strong> determination of applicant suitability.6) Applicants without offences recorded against them and who otherwise have the highestdegree of service excellence within the industry will be considered in preference overapplicants who have a less satisfac<strong>to</strong>ry service his<strong>to</strong>ry.f) Specify that applications must contain the following particulars:Ðl confirmation the application is for a licence <strong>to</strong> operate a Peak Service Taxi-cabwithin the metropolitan taxi-cab zone;l the name, date of birth and address of the applicant;l confirmation the applicant is a permanent resident of Vic<strong>to</strong>ria;l details of the applicant's Drivers' Certificate including date of issue, classificationand expiry date;l a declaration of (a) taxi-cab licences previously or currently held (owned) by theapplicant or which the applicant has any direct or indirect interest in and (b) taxicablicences previously or currently operated by the applicant as the assignee of ataxi-cab licence;l a declaration of taxi-cab driving experience and, where the applicant is an existingtaxi-cab opera<strong>to</strong>r, a declaration relating <strong>to</strong> existing practices by the opera<strong>to</strong>r inproviding a high level of taxi services;l a declaration of any traffic and/or other offences recorded in the name of theapplicant;l authorisation for the Department of Infrastructure <strong>to</strong> undertake any enquiries andrecords checks deemed appropriate <strong>to</strong> enable the Department <strong>to</strong> be fully informedabout the suitability of the applicant <strong>to</strong> be considered for licence issue;


2446 G 37 12 September 2002 Vic<strong>to</strong>ria <strong>Government</strong> <strong>Gazette</strong>l an application for a National Police Certificate in the name of the applicant,<strong>to</strong>gether with a cheque or money order for the amount of $24 and made payable <strong>to</strong>Vic<strong>to</strong>ria Police; andl a non-refundable application fee of $144.In addition <strong>to</strong> the information <strong>to</strong> be contained in the application, applicants will also be required<strong>to</strong> produce, when requested by the Department of Infrastructure, the following in support of theirapplication:l proof of identity as specified in a list of acceptable proofs of identity provided bythe Department of Infrastructure; andl documentation <strong>to</strong> verify applicant eligibility claims ( as outlined in Notes 1Ð5above).g) Specify that all Tenders/Applications for taxi-cab licences within the proclaimed zone mustbe sealed in an envelope, marked ÒMetropolitan Taxi-cab Peak Service Licence IssueTPSL1/02" and mailed <strong>to</strong> be received by, or placed in<strong>to</strong>, the Tender Box, 14th Floor, NauruHouse, 80 Collins Street, Melbourne 3000, not later than 2.00pm on Thursday, 3 Oc<strong>to</strong>ber2002.h) Specify the following procedures for determination of applications by the Department ofInfrastructure:(i) The Department of Infrastructure must publish in the <strong>Government</strong> <strong>Gazette</strong> a list ofthe names of all applicants who appear <strong>to</strong> satisfy the criteria specified in paragraph(d) and (e) above and whose application is submitted by the time specified inparagraph (g) above. The notice must invite persons who wish <strong>to</strong> dispute theeligibility of an applicant <strong>to</strong> submit any relevant information within 14 days afterthe date of the publication of the list;(ii) Before accepting any applicant as meeting the eligibility criteria, the Departmen<strong>to</strong>f Infrastructure must consider any written submissions made <strong>to</strong> it in respect of theeligibility of the applicant arising from the process described in (h)(i).(iii) Only one licence will be issued <strong>to</strong> any one person;(iv) Where an application is approved, the licence will be issued on payment of thelicence fee, in full, referred <strong>to</strong> in paragraph (b);(v) A maximum of 100 Metropolitan Taxi-cab Peak Service Licences will be issued asa result of this tender.(vi) All licences issued will be subject <strong>to</strong> special conditions <strong>to</strong> ensure efficient andeffective provision of taxi services including:l Peak Service taxi-cabs will only be permitted <strong>to</strong> operate for hire duringthe hours of 3pm until 7am the following morning on any day of the week.Peak Service taxis-cabs will also be authorised <strong>to</strong> operate at other timesspecified in licence conditions during major events such as the FormulaOne Grand Prix and Melbourne Cup;l a hiring which commences prior <strong>to</strong>, but not completed by 7am will bepermitted <strong>to</strong> be completed;l Peak Service taxi-cabs must meet Vic<strong>to</strong>rian Taxi Direc<strong>to</strong>ratespecifications for licensing as a taxi and must, at the time of licensing, beregistered in the name of the licence holder;l Peak Service taxi-cabs will be identified with special registration numberplates and will be required <strong>to</strong> have the roof section, including door pillarsections, painted ÒVic<strong>to</strong>rian Taxi GreenÓ <strong>to</strong> Vic<strong>to</strong>rian Taxi Direc<strong>to</strong>ratespecifications. The remainder of the body will be painted ÒVic<strong>to</strong>rian TaxiYellowÓ and fitted with standard taxi livery decals;

The vehicle must not beoperated as a taxi if it is more than 6.5 years of age. Age limits arecalculated from the manufacturersÕ build date as shown on the vehiclecompliance plate; andl Peak Service taxi-cab licences must not be transferred or assigned <strong>to</strong>another person at any time. This does not prevent the licence holder fromemploying a driver or engaging a driver under a Driver BailmentAgreement. At any time, the licence holder may cease operating thelicence by surrendering the licence and taxi-cab registration plates <strong>to</strong> theVic<strong>to</strong>rian Taxi Direc<strong>to</strong>rate. In the event of the surrender of a licence at anytime, any remaining portion of the licence fee paid for that year ofoperation will be forfeited by the licence holder.(vii) (a) In the event that the number of applications that meet all eligibility criteriaexceeds the number of licences available in either category, thedistribution of licences amongst those eligible applicants will bedetermined as follows:l 50 licences will be available <strong>to</strong> applicants in the taxi driverapplicant category.If, after consideration of all eligibility and selection criteria, including ranking applicants on thebasis that applicants with the highest degree of service excellence will be considered in preferenceover applicants who have a less satisfac<strong>to</strong>ry service his<strong>to</strong>ry, any number of career taxi-cab driverapplicants are rated as equal, licence allocation will be determined in the order of longest verifiableperiods of metropolitan taxi-cab driving experience.l 50 licences will be available <strong>to</strong> applicants in the taxi opera<strong>to</strong>r category, subject <strong>to</strong>distribution of those licences on the basis of:l 18 licences being allocated <strong>to</strong> applicants who since 1 September 2001 havecontinuously held one or more taxi-cab licences either as a natural person, jointlywith another person/s or as the direc<strong>to</strong>r of an incorporated body and who operate,or are in effective control of, the taxi vehicle/s attached <strong>to</strong> the licence/s; andl 26 licences being allocated <strong>to</strong> applicants in the taxi opera<strong>to</strong>r category who since 1September 2001 have continuously operated not more than one taxi-cab as theassignee of a taxi-cab licence where such assignment has been approved undersection 150 of the Transport Act 1983 but who, in the same period did not ownany taxi-cab licence either as a natural person, jointly with another person/s or asthe direc<strong>to</strong>r of an incorporated body which holds a taxi-cab licence; andl 6 licences being allocated <strong>to</strong> applicants in the taxi opera<strong>to</strong>r category who since 1September 2001 have continuously operated more than one taxi-cab as theassignee of the taxi-cab licences where such assignments have been approvedunder section 150 of the Transport Act 1983, but who, in the same period did no<strong>to</strong>wn any taxi-cab licence either as a natural person, jointly with another person/sor as the direc<strong>to</strong>r of an incorporated body which holds a taxi-cab licenceIf, after consideration of all eligibility and selection criteria, including ranking applicants on thebasis that applicants with the highest degree of service excellence will be considered in preferenceover applicants who have a less satisfac<strong>to</strong>ry service his<strong>to</strong>ry, any number of taxi opera<strong>to</strong>r applicantsare rated as equal within any of the three licence allocation groups above, licence allocation will bedetermined in the order of longest verifiable periods of continuous metropolitan taxi-cab operatingexperience, beyond that specified above, relevant <strong>to</strong> that group of applicants.(b) In the event that there are insufficient applications which meet theprescribed eligibility criteria in either the taxi driver category (paragraph d)

2450 G 37 12 September 2002 Vic<strong>to</strong>ria <strong>Government</strong> <strong>Gazette</strong>In accordance with the requirements of clause 3.4 of VENCorpÕs ÒScheme for Development andImplementation of Retail Gas Market RulesÓ those amendments are published hereunder.Clause 1.2 is amended by inserting the following new clauses 1.2.5 and 1.2.6 after clause 1.2.4:Ò1.2.5 FRC HUB(a) Each Market Participant and Distribu<strong>to</strong>r must be certified by VENCorp prior <strong>to</strong>using the FRC HUB for transactions specified in the Gas Interface Pro<strong>to</strong>col. Forthe avoidance of doubt, a Market Participant who has no need <strong>to</strong> issue or receivea transaction specified in the Gas Interface Pro<strong>to</strong>col does not need <strong>to</strong> seekcertification until it has a requirement <strong>to</strong> use such a transaction. A MarketParticipant must achieve certification prior <strong>to</strong> its use of a transaction inaccordance with the certification process published by VENCorp.(b) VENCorp, prior <strong>to</strong> the Transition Date, must establish and publish operationalterms and conditions for the FRC HUB. VENCorp, in establishing theseoperational terms and conditions, must:(i) Provide Market Participants and Distribu<strong>to</strong>rs with the proposedoperational terms and conditions(ii) Allow a reasonable time <strong>to</strong> receive Market Participant and Distribu<strong>to</strong>rresponses <strong>to</strong> finalise the proposed operational terms and conditions(iii) Use the dispute resolution process defined in clause 1.5 as theadjudication mechanism for any disputed proposed term or condition.(c) VENCorp, prior <strong>to</strong> implementing changes <strong>to</strong> the published operational terms andconditions for the FRC HUB, must:(i) Provide Market Participants and Distribu<strong>to</strong>rs with the proposed change <strong>to</strong>the operational terms and conditions(ii) Allow a reasonable time <strong>to</strong> receive Market Participant and Distribu<strong>to</strong>rresponses <strong>to</strong> the proposed operational terms and conditions.(iii) Use the dispute resolution process defined in clause 1.5 as theadjudication mechanism for any disputed proposed term or condition.(d) VENCorp and each Market Participant and Distribu<strong>to</strong>r must comply with theoperational terms and conditions, as published by VENCorp on its website fromtime <strong>to</strong> time.(e) Where a Market Participant or Distribu<strong>to</strong>r uses or continues <strong>to</strong> use the FRC HUBin breach of the operational terms and conditions, then as soon as VENCorpbecomes aware of such breaches VENCorp must:(i) Notify the Market Participant or Distribu<strong>to</strong>r of the breach, or(ii) If a previous notice of a breach has been provided <strong>to</strong> the MarketParticipant or Distribu<strong>to</strong>r, and continued significant breaches of the samenature are evident, then VENCorp must notify the Vic<strong>to</strong>rian EssentialServices Commission and the Market Participant or Distribu<strong>to</strong>r <strong>to</strong> whomthe breach applies.1.2.6 Exemption <strong>to</strong> certificationFor the period commencing 9am 14th September 2002 and ceasing 9am 1st January 2003any Market Participant who is the registered FRO for any supply point and which supplypoints have interval meters installed, is exempt from clause 1.2.5(a) only for thosetransactions required <strong>to</strong> manage the delivery of orders and responses used in themaintenance of the interval meter or associated supply point.ÓChapter 1 is amended by inserting the following new clause 1.3A after clause 1.3.6:


Vic<strong>to</strong>ria <strong>Government</strong> <strong>Gazette</strong> G 37 12 September 2002 2451Ò1.3A Recovery of VENCorp costs(a) Retailers must pay <strong>to</strong> VENCorp amounts for services provided under these rulesand determined by VENCorp in accordance with charges approved by theVic<strong>to</strong>rian Essential Services Commission.(b) No later than 2.00pm on the twentieth business day after the end of a calendarmonth or 2.00pm on the second business day after receiving a final statementunder clause 3.6.15 of the MSOR, whichever is the later, each Retailer must pay <strong>to</strong>VENCorp in cleared funds the amount determined by VENCorp under clause1.3A(a).(c) Payments made in accordance with clause 1.3A(a) must be made using bankclearing house arrangements determined by VENCorp in consultation withaffected Retailer and published on the Market Information Bulletin Board byVENCorp.(d) Disputes raised in relation <strong>to</strong> this clause 1.3A shall be determined under the disputeprovisions of these Retail Gas Market Rules.(e) Each Retailer must pay <strong>to</strong> VENCorp the amount determined by VENCorp underclause 1.3A(a) whether or not the Retailer disputes, or continues <strong>to</strong> dispute, theamount payable.ÓClause 2.2.2 is amended by inserting the following new clause 2.2.2(c) after clause 2.2.2(b):Ò2.2.2 Site Access Information(c ) Each Distribu<strong>to</strong>r must use its best endeavours <strong>to</strong> provide each Retailer who is theFRO for a distribution supply point which is located in the distribution area of aDistribu<strong>to</strong>r with details of any changes <strong>to</strong> any site access information in relation<strong>to</strong> the meter that relates <strong>to</strong> that distribution supply point by 5.00 pm on the firstBusiness Day following the day on which the Distribu<strong>to</strong>r receives those details.Those details must be identified <strong>to</strong> the Retailer by reference <strong>to</strong> the MIRN for thedistribution supply point <strong>to</strong> which the meter relates.ÓClause 2.6.1 is amended by inserting the reference Ò(b)Ó at the start of the paragraph commencingwith the words ÒThe average heating valueÉÓ in clause 2.6.1(a).Clause 2.6.1 is amended by deleting the word ÒmayÓ and substituting the word ÒmustÓ in new clause2.6.1(b).Clause 2.6.2 is amended by deleting all the words following the words Ò(v) the consumed energy,Óin clause 2.6.2(a) and substituting the following:Òby(1) 5.00pm on the first business day after the day on which the meter was read wherethe meter reading was a validated meter reading; or(2) by 5:00 pm on the first business day after the day on which a meter read wasprovided by the FRO where the meter reading was a validated meter reading, or(3) where the Distribu<strong>to</strong>r has been unable <strong>to</strong> obtain a validated meter reading inaccordance with a meter reading schedule, by 5:00 pm on the second business dayafter the scheduled read date; or(4) where the meter reading was an estimated meter reading or a substituted meterreading by 5:00pm on the second business day after the scheduled read date.ÓClause 2.6.2 is amended by deleting all the words following the words Ò(iv) information as <strong>to</strong>whether the readings used <strong>to</strong> calculate the flow are actual meter readings, estimated meter readingsor substituted meter readings,Ó in clause 2.6.2(b) and substituting the following:Òby(1) midnight on the first business day after the day on which the meter was read wherethe meter reading was a validated meter reading; or
