EXCLUSION 3:FLOOD“Loss or damage caused by or <strong>re</strong>sulting from Flood:-meaning rising water; surface water; waves; tidalwaves or tidal water; overflow of st<strong>re</strong>ams, rivers,lakes, ponds, or other bodies of water; or spray fromany of the fo<strong>re</strong>going; all whether driven by wind or notand <strong>re</strong>gardless of any other event which contributesconcur<strong>re</strong>ntly or in any sequence to the loss or damage.”3524035


CAUSATION:BASIC PRINCIPLE• In order for a loss to fall within<strong>insurance</strong> <strong>coverage</strong>, the loss must beproximately caused by an insu<strong>re</strong>d peril.• If the loss is caused by an excludedperil, the<strong>re</strong> will be no <strong>coverage</strong>.3524036


CAUSATION:CONCURRENT CAUSES• Two or mo<strong>re</strong> causes that operate concur<strong>re</strong>ntly.• One cause is an insu<strong>re</strong>d event and the other anexcluded event.Interdependent: If neither cause would havecaused loss without the other, the excludedtakes priority and the insu<strong>re</strong>d cannot <strong>re</strong>cover.Independent: If one event would havecaused loss without the other, the insu<strong>re</strong>d can<strong>re</strong>cover.3524037
