What to Do?• The state does not make it easy. The state isagriculture-based and agriculture is a preferred use forwater. If irrigators want more water from the Niobrara,the DNR cannot deny those applicants, IF it is <strong>in</strong> thepublic <strong>in</strong>terest. There<strong>in</strong> lies the battle. WHAT is thepublic <strong>in</strong>terest and WHO gets to decide that?• DNR: “We don’t use water as an agency, we don’t care ifthere’s water <strong>in</strong> the river or not. We’re just supposed tomake sure water is USED <strong>in</strong> the best public <strong>in</strong>terest.”
