The Yorba Linda High School Grad Night Committee hasengaged third party vendors and agents to offer a variety of services and activities at the Grad Night Participant and his/herparent(s) or legal guardian(s) (collectively the "Undersigned") have read the Participant's Waiver Form and understand thenature and the inherent hazards and risks of the intended activities related to the Grad Night The Undersigned alsoacknowledge that the Vendors have informed them that participating in the Grad Night is not without risk. Certain hazards andrisks are inherent in the Grad Night and cannot be eliminated without destroying the unique character of such activities.These inherent risks may contribute to the unique character of the Grad Night but can be the cause of destruction, loss ordamage to personal property, or personal injury, illness, suffering, or in extreme cases, permanent trauma or death. TheVendors do not want to frighten the Participant, his/her parents or legal guardian or reduce the Participants enthusiasm for theGrad Night, but believes it is important for the Undersigned to know in advance what to expect and to be informed ofthe inherent risks.The Undersigned acknowledge that by engaging in the Grad Night activities, the Participant has responsibilities as aparticipant to act in a reasonable manner at all times and to listen and follow the instructions of the Vendors. TheUndersigned also acknowledge that by engaging in the Grad Night, the Participant agrees not to engage in prohibitedbehaviors, including any acts of violence, unlawful drinking, smoking, or use of drugs.The Undersigned certify that the Participant is fully capable of participating in the Grad Night. The Undersigned represent thatthe Participant is in good health and have not been advised by a physician to refrain from Grad Night activities. TheUndersigned know of no reason, health-related or otherwise, why the Participant is not capable of participating in Grad Nightactivities including, but not limited to activities which require physical exertion such as running and dancing. TheUndersigned accept full responsibility for any injuries or illnesses that the Participant may suffer during Grad Nightactivities, including, but not limited to, those resulting from any pre-existing medical condition.It is understood that unforeseen circumstances may arise for which the Vendors shall not be held responsible.Notwithstanding the foregoing, nothing contained herein shall excuse Vendors from the responsibility for wrongfulmisconduct, gross negligence or illegal activities during the course of the Grad Night.The Undersigned acknowledge that the Vendors have been available to more fully explain the nature, risks, hazards, andrequirements of the Grad Night and to answer any questions or concerns.THEREFORE, IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE GRAD NIGHT,THE UNDERSIGNED ASSUME ALL RISKS AND ACCEPT FULL RESPONSIBILITY SURROUNDINGPARTICIPATION IN THE GRAD NIGHT, TRANSPORTATION RELATED TO THE GRAD NIGHT, AND ANYACTIVITIES UNDERTAKEN AS AN ADJUNCT THERETO, WHICH RISKS AND RESPONSIBILITY INCLUDEBODILY INJURY, DEATH, OR LOSS OF OR DAMAGE TO PERSONAL PROPERTY AND EXPENSES AS ARESULT OF THOSE INHERENT RISKS AND DANGERS IDENTIFIED HEREIN AND THOSE INHERENTRISKS AND DANGERS NOT SPECIFICALLY IDENTIFIED, OR AS A RESULT OF THE PARTICIPANT'SNEGLIGENCE IN PARTICIPATING IN THE GRAD NIGHT, AND THE UNDERSIGNED SHALL NOT HOLDOR ATTEMPT TO HOLD THE VENDORS RESPONSIBLE THEREFORE.The Undersigned have carefully read, clearly understand and accept the terms and conditions stated herein andacknowledge that this Participants' Waiver Form shall be effective and binding upon each of the Undersigned, theirrespective heirs, assigns, personal representatives and estates.Signature of Participant _____________________________________________________ Date__________________Signature of Parent or Legal Guardian__________________________________________Date______________________Grad Night is not a Placentia-Yorba Linda Unified School District sponsored event.
