WHY <strong>JOIN</strong> <strong>TUI</strong>?CONGRESS 2008 AUTHORISED THE EXECUTIVE COMMITTEETO CARRY OUT A VIGOROUS NATIONWIDE RECRUITMENTCAMPAIGN. OUR AIM IS TO INCREASE OUR MEMBERSHIPAMONGST NEW RECRUITS TO TEACHING AND LECTURINGAND ALSO THOSE WHO FOR VARIOUS REASONS DID NOT<strong>JOIN</strong> <strong>TUI</strong> WHEN THEY STARTED TEACHING.Even though <strong>TUI</strong> is a growing and vibrant union there is no room for complacency: if weallow our numbers to decline our influence and our capacity to represent our membersdeclines. The strength of the union, especially in negotiating with employers and with thegovernment lies in the fact that we represents and speak with authority for a significantnumber of employees.In common with all trade unions, <strong>TUI</strong>’s core purpose is to protect our members’ conditionsof employment. The circular letters, agreements and directives that determine our payand conditions as well as ensuring the best possible quality of education provision for ourstudents have been hard won, they are not the gift of a benign management. They are theproduct of hard fought campaigns by the membership and of skilful negotiating and bargainingby the leadership of the union over many years. We need a strong union both at local andnational level, to safeguard the gains made by our predecessors and to improve further ourconditions of employment.The decision of the Executive Committee to invite literacy tutors and research staff in theInstitutes of Technology to join the union is to be welcomed. Our willingness to recruit andrepresent teachers and lecturers from diverse sectors of the public education system inIreland has been one of the cornerstones of our success. Representing members workingin these areas allows us to influence education provision in a wide sphere and enables thegeneration of the resources necessary to provide a quality service to all our members.However the current recruitment drive is focussed on recruiting new or reluctant teachersand lecturers as much as on widening our representative base.I encourage every new entrant to the teaching and lecturing profession and those who forvarious reasons have not yet become members to join <strong>TUI</strong> immediately. The main benefitof being a member of <strong>TUI</strong> is in knowing that in times of need there is a great wealth ofexpertise and experience available to each individual member of the union and also knowingthat the support of your union colleagues is always there if needed. Thousands have benefiteddirectly from membership of <strong>TUI</strong> but un-associated teachers and lecturers leave themselvesextremely vulnerable should a complication of any kind arise within their professional lives.Membership of <strong>TUI</strong> offers you protection. “KNOWING <strong>TUI</strong> WILL BE THERE FOR ME THROU<strong>TUI</strong> WORKING FOR YOUTHE FOLLOWING IS JUST A SMALL SAMPLE OF RECENTSUCCESSES ACHIEVED BY THE UNION…A member in a VEC received over €72,500 in arrears of salary and an annual increaseof over €13,000 when <strong>TUI</strong> queried the point of the salary scale on which she wasbeing paid. The case commenced with a letter from the VEC stating that she had beenoverpaid and inviting her to say how she wished to reimburse the overpayments: itfinished with the member being awarded 10 additional increments with retrospectiveeffect. The member wrote: “Got everything sorted in my pay this month. Cannotbelieve it and cannot thank you enough.”THE UNION SECURED COMPENSATION FOR A MEMBERIN YOUTHREACH BY TAKING A CASE TO THE RIGHTSCOMMISSIONER SERVICE UNDER THE MINIMUM NOTICEACT AND UNFAIR DISMISSALS ACT.A member in a VEC recently received backpay for three years at their appropriate rate aftera claim brought by the union. The member concerned, a fully qualified teacher, was being paidat an hourly rate for unqualified teachers and had no sick pay entitlements. In addition tothe backpay, the employer was ordered to pay the claimant the sum of €20,000 in respectof breaches of the Part Time Work Act 2001, for failure to implement the legislation and therefusal to treat her in like manner with her comparable full time employees.A member whose application for incremental credit for teaching service in NorthernIreland had not been concluded for over 6 years recently referred the matter to theUnion: the full entitlement and arrears of pay were secured within 3 months followingthe Union’s intervention.


GHOUT MY <strong>CAREER</strong> IS THE BEST INSURANCE I CAN HAVE.”Two members in part-time employment for 20 and 18 years respectively received full-timeContracts of Indefinite Duration following Branch and Head Office intervention throughnegotiation with their VEC. One of the members writes: “Thank you for your time andefforts, on my behalf, in talks with the VEC. You have restored my faith in people.”“I was employed in my local Youthreach as a teacher of maths and business. Iconstantly argued that I should have been on a qualified rate but the VEC refused.My <strong>TUI</strong> representative made a case to the VEC that it was reasonable to expect thatas I was fully qualified when I was first employed that I should be paid as qualifiedeven though I was teaching subjects that I was not directly qualified in. My case wassuccessful and I received €38,000 in back money.” - Georgina“IN THE LAST FOUR YEARS OF MY TEACHING <strong>CAREER</strong>I SUFFERED WITH ILL-HEALTH. MY <strong>TUI</strong> REPRESENTATIVESUPPORTED ME THROUGH THIS PERIOD AND WITH THE HELP OFA HEAD OFFICE OFFICIAL ENSURED I REMAINED TEACHING FORAS LONG AS I COULD. WHEN I EVENTUALLY DECIDED TO RETIRETHE <strong>TUI</strong> HELPED ME GET AN ENHANCED EARLY RETIREMENTPACKAGE AND BY ATTENDING THEIR PRE-RETIREMENT COURSEI WAS BETTER PREPARED FOR LIFE AFTER WORK. - BERNADETTERonan’s car was recently damaged on school grounds: “I found a scratch across the driver’s sideof my new car on Monday afternoon. I mentioned it to my union representative the next daywho informed me that as I was insured under the <strong>TUI</strong>’s motor insurance scheme administeredby the Cornmarket Group, I was covered for malicious damage to my car whilst within theconfines of the school premises and grounds. I rang the insurers that afternoon and the claimwas processed quickly and painlessly and the claim did not affect my no claims bonus.”


“I WILL NEVER BE ABLE TO EXPRESS MYCASE SETTLED AND COMPENSATION AWARDED INRESPECT OF A CASE TAKEN ON BEHALF OF A MEMBER INA VEC UNDER THE PART-TIME WORK ACT 2001 AND THEFIXED-TERM WORK ACT 2003.A pension case was settled out of court, in respect of the payment of pension and lumpsum entitlements on behalf of a member in a third level college, who had service both inthis jurisdiction and in Northern Ireland.Sinéad benefited from the union’s free legal advice scheme: “I recently had a problem -nothing to do with my job - for which I required some professional legal advice. I askedaround the staffroom if anyone knew a good solicitor. A colleague told me the <strong>TUI</strong> offers itsmembers a free First Instance Legal advice service. All I had to do was put the problem onpaper and forward it to <strong>TUI</strong>. Within a short period I had a complete legal opinion from <strong>TUI</strong>’slegal advisors which allowed me to resolve my problem without any further stress.”“I am a Lecturer in an Institute of Technology. One day withno warning I was summoned by the HR manager and advisedthat there was a complaint against me that I had made sexualadvances to a student. <strong>TUI</strong> at Branch level, through Head Officeand with their expert legal team were totally supportive andsaw the case through legal processes to my total vindication.My career was on the verge of ruin and but for <strong>TUI</strong> would haveended. I will never be able to express my gratitude sufficiently tothe union.”


“IN THE LAST FOUR YEARS OF MY TEACHING <strong>CAREER</strong>I SUFFERED WITH ILL-HEALTH. After I spoke to my <strong>TUI</strong>Area Representative my case was processed and I received a Contract of IndefiniteDuration on full hours.” - Eimer“I WAS WORKING IN A VEC SCHOOL FOR THREE YEARS, ANDWAS TOLD BY THE VEC THAT I WAS UNQUALIFIED. MY <strong>TUI</strong>AREA REPRESENTATIVE TOOK UP MY CASE AND WITHINTWO MONTHS I WAS ON THE CORRECT RATE OF PAY ANDRECEIVED €5,000 IN BACK MONEY.” - ORLAA member whose Temporary Wholetime Contract was not renewed despite theavailability of the work and service having been satisfactory was restored to her contractimmediately following the Union’s intervention. “Thank you for all you have done for me.I love to teach and you have restored some justice in the system,” the member wrote.“Advice received from <strong>TUI</strong> as to the precise timing of my retirement to avail of pay increasesand to maximise my lump sum pension benefit gained me over €5,000 in the lump sum. Welldone <strong>TUI</strong>.”<strong>TUI</strong> SUCCESSFULLY REPRESENTED A MEMBER IN A COMMUNITYAND COMPREHENSIVE SCHOOL AT A DISCIPLINARY HEARING,WHERE THE MEMBER’S JOB WAS THREATENED.“I was employed in a College as a part time lecturer and was considered unqualified. Asa result I got no increments for many years. I brought the case to <strong>TUI</strong> because I knew ofanother lecturer with the same qualification as mine doing the same job who was on the topof the scale and had been promoted. The case was taken to the Rights Commissioner underthe Part Time Work Act, I was awarded retrospective increments, placed on the correct pointof the scale and was awarded financial compensation.”

<strong>TUI</strong> SERVICES AND BENEFITSLEGAL ADVICEA scheme of free legal advice for members is available. The <strong>TUI</strong> will provide advice andassistance to individual members on matters affecting them in their employment, or in regardto their membership of the union. On matters other than those arising from employmentas a teacher or concerning their membership of the <strong>TUI</strong> a separate scheme of first instancelegal advice is also available free of charge to In-benefit members.PROVIDENT FUNDThe purpose of the fund is to provide assistance to members (or their estate) to pay medicalexpenses as a result of illness or accident which result in hospitalisation. Members may obtainthe benefit of €20 per day charged for hospitalisation subject to a maximum of €2,000 perannum. In addition a Death in Service Benefit of €7,000 is paid from this fund to the next ofkin of a member who dies in service to cover funeral expenses. Associate members receivebenefit proportionate with their subscription.CONTINGENCY FUNDThe contingency fund is designed to obviate the necessity for levies on members to financedisputes of a local nature. In the absence of disputes, the money in the contingency fundaccumulates to provide capital to fund strikes where necessary.<strong>TUI</strong> CREDIT UNIONThe <strong>TUI</strong> Credit Union is a service for saving and borrowing, usually by deduction from salary,offered to members of the Teachers Union of Ireland, Members borrow at a rate of 7.59%APR on the outstanding loan balance which is far less expensive than borrowing from thecommercial lending institutions. Since the Credit Union is a co-operative, any profits madeare returned to the members by way of an annual return which is free of DIRT tax. It is a voice for the teachers worldwide.
