Austroflex pressure test forburied pipesLegal Notice:Pressure tests are not part of the contractual services of the contractor unless specificallystated in the description of services. According to applicable standards apressure test must be conducted before the pipe system is insulated, sealed and commissioned.44Leak testingFlushing and pressure test for buried linesparticularly PEX district heating lines and also CW and EW-EA leak testing in accordance with DIN 1988 is required for buried pipelines. The pressure test protocol, which must also be confirmed by the client, informs theinstaller that the leak testing has been conducted.The completed and signed pressure test protocol is always required under the terms of the AUSTROFLEX warranty.Flushing the pipe systemFlushing with water is adequate to remove coarse impurities from the pipes.Pressure testThe completed but not yet backfilled pipeline (open ditches and open connection points) must be filled with water to exclude all air. All safety equipment, transitionfittings etc. must be adequately vented until water comes out without air. In the pressure test the preliminary andmain test required by DIN 1988 must be conducted. The preliminary test may be sufficient for smaller sections of the system such as branch and connection lines.Preliminary testIn the preliminary test a test pressure corresponding to the approved working pressure plus 50% is applied. It must be applied again twice at intervals of 10minutes within a period of 30 minutes. After a test time of another 30 minutes the test pressure must not fall more than0.6 bar and there must be no leaks.Main testThe main test must be conducted immediately after the preliminary test. The test takes two hours. After two hours the test pressure read after the preliminarytest must not have fallen more than 0.2 bar.There must be no leaks at any point in the tested system.Instructions on flushing and pressure testingThe test result may be influenced by temperature differences between pipe and test medium. General Terms of Business and Supply1. General:The following General Terms and Conditions are applicable unless other writtenagreements have been made for all supplies and services from Austroflex GmbH,Finkensteinerstr. 7, A-9585 Gödersdorf, (referred to in brief as the Seller) companyno. 871/B. Any promises or ancillary agreements made by our employees orself-employed representatives that go beyond these General Terms and Conditionsrequire our approval in writing if they are to be valid. Our representatives are notauthorised to make agreements. Terms and Conditions of Purchase of the Buyer arenot valid as part of the contract unless we have accepted them in writing. All ouroffers are subject to confirmation with reference to price, quantity, delivery date andwill not become part of the contract of purchase until we have explicitly confirmed allparts of the contract in writing. Oral or telephone information and explanations arenon-binding until confirmed in writing, as is information in brochures, catalogues, pricelists, circulars, advertisements etc. Any included or assumed approvals, standardstesting, technical data, properties, application and service descriptions, manuals mustbe considered assured properties only to the extent that the written confirmation oforder specifically refers to them.2. Place of fulfilment and court of jurisdiction:The place of fulfilment, unless otherwise agreed, is the point of shipment; for paymentthe head office of the Seller. Austrian law is exclusively applicable. The court of jurisdictionis agreed to be the applicable commercial court of the Seller.3. Supply:Our delivery deadlines and schedules are approximate only; they will only be bindingif we have explicitly accepted them in writing as binding. In addition, we do not acceptliability for failure to meet the delivery deadline in cases of blockage by act of God affectingus or our suppliers, specifically as a result of operating faults, strikes, shortagesof raw materials and goods. If one of our deliveries is delayed, the Buyer may cancelthe unfulfilled component of the contract after setting a reasonable deadline. At thesame time we retain the right in such cases to cancel in part or fully the unfulfilledpart of the contract. Claims for damages by the Buyer will not be accepted, unlessthe fault is ours or we are guilty of gross negligence. Partial deliveries are permitted.In the case of orders on demand the delivery deadline starts on the first working dayfollowing the demand (Mon-Fri). For transport and production reasons we retain theright to overdeliver or underdeliver by up to 5%. If the Buyer does not accept thegoods even after a deadline has been set, we reserve the right to cancel the contractor demand damages for non-fulfilment of the contract. Returned goods will only beaccepted by arrangement in advance and subject to 15% handling fee and payment ofreturn freight costs by the Buyer. All returns will only be accepted with a confirmedAustroflex returned merchandise authorisation, and special products or customproducts cannot be returned.4. Transfer of risk on shipment, delay in acceptance:Unless otherwise agreed shipment will be at the cost and risk of the Buyer from thestorage site of the goods. On transfer of the goods to the first transport company(post office, railways, trucking company etc.) the risk is transferred to the Buyer (thisis also applicable to deliveries in which the Seller pays the freight by prior agreement).The Buyer or the Buyer's agent must accept delivery at the destination without referenceto costs of shipmentand risk. Pallets that are not specifically defined as disposable pallets must beexchanged immediately on delivery or otherwise returned undamaged within twoweeks at the expense of the Buyer. Otherwise the Buyer will be billed for them atthe current prices. The Buyer will also pay all additional costs arising from the Buyer'sresponsibility (vehicle delay fees, motor vehicle fees etc.). We delivery unloaded,unless specifically agreed otherwise in writing. Trucks arranged by us must be unloadedwithin a maximum of two hours from arrival at the destination. If this periodis exceeded, we will require the Buyer to pay the incurred fees for waiting time andother costs as listed in the transport company invoice. If the fulfilment of the orderis delayed because of the Buyer or the Buyer's agent, the Seller is entitled to demanddamages because of non-fulfilment or to cancel the contract. Additional costs may alsobe charged (storage, transport, emergency sale).5. Warranty and complaints deadlines:The standard for evaluation of goods is their status on shipment at the destination.Open goods must be inspected for suitability by the Buyer on acceptance at thedestination. In the case of unacceptable or incorrect delivery repair and processing orresale is not permitted. The Seller must be given the opportunity to inspect the goodsbefore processing. Otherwise, warranty claims will not be accepted. Transport damageor short deliveries of goods are the sole responsibility of the transport company orfreight forwarder. The prerequisite for a warranty claim is the retention of the writteninformation from the Seller with reference to storage, processing etc. or the guidelinesdefined in the relevant standards and regulations. All processing instructions suppliedin the Seller's documentation conforms to current knowledge and experience.They are not assurances in legal terms and will not be content of a sales contract.In the application the specific conditions with reference to physical conditions, constructionconditions and legal requirements must be observed. A warranty arising fromadvice is not applicable under any circumstances.6. Liability:Liability for at-fault damages is restricted to deliberate action and gross negligence.The warranty includes only correction of the damages (substitute delivery) and islimited to the amount of the order. The Seller is not liable for compliance with specialregulations nor for import licences and approvals within Austria, unless they havebeen specifically included in the contract. The obligation for replacement arising fromthe product liability law for property damage and product liability claims that couldbe the result of other regulations is not accepted. Claims for damages, particularly fornon-fulfilment, deliberate violation of the contract and consequential damages causedby a defect are due to the Buyer only in case of gross negligence or deliberate action.Unless we have specifically agreed otherwise in writing, claims for damages will expiresix months after delivery.7. Price and payment:Prices are subject to confirmation and are based on the Seller's current price listor the order or purchase contract. They will be applicable unless otherwise agreedex works excluding freight, customs and packaging plus value-added tax in at thestatutory level. If the applicable cost factors change substantially after issue of theoffer or after confirmation of the contract before delivery, supplier and Buyer willagree to adjust the prices. We are not bound to maintain previous prices for neworders (follow-up orders). Payment must be made net within 30 days of the date ofinvoice for the Seller with no deductions. In case of payment in cash within eight daysafter the date of invoice the Seller will accept a 3% discount. Discounts will only bepermitted if there are no outstanding invoices. The terms and conditions of paymentagreed by telephone or orally will not apply is a credit check of a new customer doesnot approve an open delivery. In this case we will deliver only subject to payment incash or by cheque on acceptance of the goods. If payment is delayed, interest willbe charged at the bank rate of 5% above the current basic rate of the Austrian NationalBank plus reminder fees of €11 per reminder. Counter-demands cannot be offsetfrom the amount of the invoice. In case of changes in currency values the value on thedate of the invoice will be applicable. Drafts will only be accepted on agreement witha statement of waiver of recourse of the bank(s) involved and then if all costs and feesinvolved with the draft are paid by the Buyer. If the asset situation of the Buyer deterioratesmarkedly after delivery or partial delivery, the invoice will be due immediately.Agreed bonuses.8. Retention of title:The goods are delivered exclusively subject to reservation of title and title is transferredto the Buyer only after payment in full. In the case of processing of the goods to anew item or if the goods are connected to a main item, the Buyer acquires partial ownershipof the new item or the main item so long as the retention of title is effective.If the Buyer sells retained goods on credit, the purchase price liabilities arising fromthis are due to the Seller is they are incurred without requiring a specific statementof transfer. In the case of payments by draft, the agreed retention of title remains inforce until the draft is cashed in favour of the Seller. The goods subject to retention oftitle must not be mortgaged or transferred as security.10. Partial invalidity:If any individual clauses of these business terms and conditions are partially or completelyinvalid, the remaining terms remain full effective.
