1011 MARINE CORPS SEPARATION AND RETIREMENT MANUAL<strong>ch</strong>aracterization of service of under other than honorable conditions.Regulations further provide that service members will not be afforded an MEBaction (unless directed by higher authority) when pending administrative<strong>separation</strong> based upon misconduct or a punitive dis<strong>ch</strong>arge. See paragraph 8508in this Manual.5. If a Marine is found unfit by the PEB, notify the CMC (MMSR-2) for<strong>retirement</strong>s <strong>and</strong> the CMC (MMSR-3) for resignations. Disability <strong>retirement</strong>orders will be issued by the CMC (MMSR-4) per <strong>ch</strong>apter 8 of this Manual.6. Orders are not required for physical examinations except when travel isrequired. Request TAD orders from the appropriate comm<strong>and</strong> per the JFTR.Travel costs are <strong>ch</strong>argeable to the comm<strong>and</strong> issuing the orders.7. An enlisted Marine on active duty whose term of enlistment expires whilesuffering from disease or injury incident to service <strong>and</strong> not due to their ownmisconduct, <strong>and</strong> who needs medical care or hospitalization, may be retained onactive duty, with the Marine's consent, until recovered to the extent that theMarine is able to meet the physical requirements for reenlistment or until itis determined that recovery to that extent is impossible. See paragraph 8001of this Manual.*9. HIV Testing. HIV screening is required at least 90 days beforeseparating Marines from active duty. Results must be recorded on the SF 88before <strong>separation</strong>. HIV test results are included in the separating Marine'smedical record. If the HIV test results are not available at the time of<strong>separation</strong>, the Military Treatment Facility (MTF) will inform the Marine thathis/her medical <strong>and</strong> dental records will be closed in absentia.a. Once HIV results are received:(1) If the test is negative, the completed copies of the SF 88 <strong>and</strong>SF 93 will be sent to the Marine via certified mail.(2) If the test is positive, every reasonable effort will be made bythe MTF to inform the Marine in person <strong>and</strong> to h<strong>and</strong> deliver both the SF 88 <strong>and</strong>SF 93. Alternatively, the Marine will be informed via certified mail. TheMarine will be advised to contact the DVA to initiate a determination ofmedical benefits <strong>and</strong> eligibility. The Marine will also be advised thatpunitive <strong>separation</strong>s <strong>and</strong> other than honorable dis<strong>ch</strong>arges may disqualifyhim/her for veteran’s benefits.b. Current mailing address <strong>and</strong> phone number of the separating Marine <strong>and</strong>next of kin will be provided to the comm<strong>and</strong> <strong>and</strong> MTF. If the Marine has beenplaced on the Temporary Disability Retirement List (TDRL), the Marine will beadvised in writing that a current mailing address <strong>and</strong> phone number must beprovided to the PEB. Failure to provide an address could result either in themember's administrative removal from the TDRL or finalization of the case uponreceipt of no response after attempted delivery to last known address bycertified mail, return receipt requested.c. The MTF will notify the separating comm<strong>and</strong> <strong>and</strong> the CMC (MMSB-16) vianaval message that the Marine is fit/unfit for <strong>separation</strong>. Do not separateunfit Marines. Records will be held by the MTF pending HIV test results (orother medical data). An estimated forwarding date for the records will beprovided in the message. Once the results are received, the MTF will forwardthe health records to the separating comm<strong>and</strong> in a sealed envelope with a coverletter listing the separating Marine's full name, SSN, date, <strong>and</strong> method the1-28Ch 2
