ORDERS AGAINST WHICH APPEAL LIESSubject to the provisions of regulation 135, an employee may prefer an appear against all or anyof the following orders, namely;ifjf'k"B&ikap(i)Recovery form pay of whole or part of pecuniary loss caused to the Nigam bynegligence or breach or orders, if the amount of such loss exceeds Rs. 50/-.(ii) An order imposing any of the penalties specified in regulation 126 whethermade by the <strong>com</strong>petent authority or by appellate authority or reviewingauthority.(iii) An order enhancing any penalty imposed under regulation 126.Explanation: In this regulation the expression ‘employee’ include a personwho has ceased to be in the service of the Nigam.136. APPELLATE AUTHORITY(1) A Nigam employee including a person who has ceased to be in the service ofthe Nigam may prefer an appeal against all or any of the orders specified inregulation 136 to the authority specified in this behalf by a schedule or orderof the Board or where no such authority is specified the following-(i) Where the employee is or was a category I or category II employee ofthe Nigam:to the appointing authority, where the order appealed against, is madeby an authority subordinate to it, or to the Board where suchsubordinate to it, or to the Board where such order I s made by(ii)Chairman or Managing Director.Where the employee is or was category III or category IV:to the authority, which is, immediate superior the disciplinary authoritypassing the order.(2) (i) Notwithstanding anything contained in clause (i) of sub-regulation (1) anappeal against an order in <strong>com</strong>mon proceedings held under regulation-133shall lie to the authority to which the authority functioning as the<strong>com</strong>petent authority for the purpose of that proceedings is immediatelysubordinate.(ii)Where the disciplinary authority who made the order appealed againstthe appellate authority, then the appeal shall lie to the next higherauthority.137. PERIOD FOR APPEALNo appeal shall be entertained unless such appeal is preferred within a period of thirtydays from the date on which a copy of the order appealed against is delivered to theappellant.Provided that the appellate authority may entertain the appeal after the expiry of theabove said period, if it is satisfied that the appellant had sufficient cause for notpreferring the appeal in time.138. RECORDING OF STATEMENT OF WITNESSEThe statement of the witness shall be recorded either in English or in Hindi.After the statement of a witness is recorded, it shall be read over to him and, ifnecessary, explained to him in the language in which it was given.
