DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION1.1 <strong>Diplomatic</strong> ListSecti<strong>on</strong> 9 <strong>of</strong><strong>the</strong> ActThe Department maintains a complete <strong>and</strong> current list <strong>of</strong> pers<strong>on</strong>s c<strong>on</strong>ferredwith privileges <strong>and</strong> immunities in terms <strong>of</strong> secti<strong>on</strong> 9(1) <strong>of</strong> <strong>the</strong> Act c<strong>on</strong>sisting<strong>of</strong> diplomatic, c<strong>on</strong>sular <strong>and</strong> internati<strong>on</strong>al organisati<strong>on</strong> Offices,representatives <strong>and</strong> members <strong>of</strong> family <strong>of</strong>ficially recognised by <strong>the</strong> sendingState <strong>and</strong> accepted as such by <strong>the</strong> Republic <strong>of</strong> South Africa as <strong>the</strong> receivingState. This list is managed <strong>and</strong> made publicly available as prescribed bySecti<strong>on</strong>s 9(2) <strong>and</strong> (3) <strong>the</strong> Act.1.3 Appointments <strong>and</strong> Accreditati<strong>on</strong>Appointment<strong>of</strong> a Head <strong>of</strong> a<strong>Diplomatic</strong>Missi<strong>on</strong>1.3.1 The Branch: State Protocol is processing <strong>the</strong> request for agrémentfor <strong>the</strong> President to approve <strong>the</strong> appointment <strong>of</strong> a foreign Head <strong>of</strong> a<strong>Diplomatic</strong> Missi<strong>on</strong> as specified in Secti<strong>on</strong> 84(2)(h) <strong>of</strong> <strong>the</strong>C<strong>on</strong>stituti<strong>on</strong>. The Head <strong>of</strong> Missi<strong>on</strong> does not enter <strong>the</strong> Republicprior to <strong>the</strong> granting <strong>of</strong> agrément.Arrival <strong>of</strong> anewlyappointedHead <strong>of</strong> a<strong>Diplomatic</strong>Missi<strong>on</strong>1.3.2 On first arrival in <strong>the</strong> Republic <strong>of</strong> South Africa, a newly appointedHead <strong>of</strong> a <strong>Diplomatic</strong> Missi<strong>on</strong> will be met at <strong>the</strong> Oliver TamboInternati<strong>on</strong>al Airport by <strong>the</strong> Chief <strong>of</strong> State Protocol or, in hisabsence, by his / her representative.Page 10 <strong>of</strong> 90


DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONCredentialCerem<strong>on</strong>y1.3.3 As so<strong>on</strong> as possible after arrival <strong>the</strong> Head <strong>of</strong> a <strong>Diplomatic</strong> Missi<strong>on</strong>h<strong>and</strong>s to <strong>the</strong> Chief <strong>of</strong> State Protocol a copy <strong>of</strong> his/her Credentialsc<strong>on</strong>sisting <strong>of</strong> <strong>the</strong> Letter <strong>of</strong> Credence (Ambassadors) or <strong>the</strong> Letter <strong>of</strong>Commissi<strong>on</strong> (High Commissi<strong>on</strong>ers) <strong>and</strong> <strong>the</strong> Letter <strong>of</strong> Recall <strong>of</strong>his/her predecessor. State Protocol <strong>the</strong>reup<strong>on</strong> approaches <strong>the</strong>Presidency to arrange for a cerem<strong>on</strong>y for <strong>the</strong> presentati<strong>on</strong> <strong>of</strong> <strong>the</strong>credentials to <strong>the</strong> President. The designated Head <strong>of</strong> a <strong>Diplomatic</strong>Missi<strong>on</strong> may not undertake <strong>of</strong>ficial duties prior to h<strong>and</strong>ing overhis/her Credentials issued by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> sending State to <strong>the</strong>President.Appointment<strong>of</strong> a Chargéd’Affaires entitre1.3.4 In <strong>the</strong> case <strong>of</strong> a Chargé d’Affaires en titre, he/she requests forappointments to call <strong>on</strong> <strong>the</strong> Deputy Minister <strong>and</strong> <strong>the</strong> Minister <strong>of</strong>Internati<strong>on</strong>al Relati<strong>on</strong>s <strong>and</strong> Cooperati<strong>on</strong>. DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION“<strong>the</strong> head <strong>of</strong> a C<strong>on</strong>sular Post shall not enter up<strong>on</strong> his duties untilhe has received an exequatur”.Exequaturprior to arrival1.3.6 Article 13 <strong>of</strong> <strong>the</strong> C<strong>on</strong>venti<strong>on</strong> stating that provisi<strong>on</strong>al admissi<strong>on</strong> maybe granted pending <strong>the</strong> delivery <strong>of</strong> an exequatur, is not applied by<strong>the</strong> Republic <strong>of</strong> South Africa as a receiving State. Therefore,designated Heads <strong>of</strong> C<strong>on</strong>sular Posts should not proceed to take upduties in <strong>the</strong> Republic <strong>of</strong> South Africa prior to <strong>the</strong> President issuingan exequatur. Accreditati<strong>on</strong> with <strong>the</strong> Department is similarlysubject to an exequatur.Appointment<strong>of</strong> <strong>the</strong> Head <strong>of</strong>an H<strong>on</strong>oraryC<strong>on</strong>sular Post1.3.7 The Branch: State Protocol is processing <strong>the</strong> request for recogniti<strong>on</strong>for <strong>the</strong> President to approve <strong>the</strong> appointment a Head <strong>of</strong> anH<strong>on</strong>orary C<strong>on</strong>sular Post as specified in Secti<strong>on</strong> 84(2)(h) <strong>of</strong> <strong>the</strong>C<strong>on</strong>stituti<strong>on</strong>. The c<strong>and</strong>idate shall be a South African citizen, acitizen <strong>of</strong> <strong>the</strong> sending State or a citizen <strong>of</strong> ano<strong>the</strong>r country withpermanent residence in <strong>the</strong> Republic. Up<strong>on</strong> c<strong>on</strong>firmati<strong>on</strong> <strong>of</strong> <strong>the</strong>appointment (e.g. Commissi<strong>on</strong> <strong>of</strong> Appointment) by <strong>the</strong> sendingState, an exequatur is issued by <strong>the</strong> President.Size <strong>of</strong> <strong>the</strong>missi<strong>on</strong>1.3.8 The size <strong>of</strong> a missi<strong>on</strong> is regulated by Article 11 <strong>of</strong> <strong>the</strong> ViennaC<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>Diplomatic</strong> Relati<strong>on</strong>s, 1961 which provides <strong>the</strong>Page 12 <strong>of</strong> 90


DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONEnlargement<strong>of</strong> staffestablishmentreceiving State with <strong>the</strong> prerogative to determine <strong>the</strong> size <strong>of</strong>diplomatic Missi<strong>on</strong>s in its territory. Diplomats entering <strong>the</strong>Republic without <strong>the</strong> Department having agreed to <strong>the</strong> expansi<strong>on</strong> in<strong>the</strong> size <strong>of</strong> <strong>the</strong> missi<strong>on</strong> beforeh<strong>and</strong> are not accredited. They returnto <strong>the</strong>ir country <strong>of</strong> origin until c<strong>on</strong>sensus is reached <strong>on</strong> <strong>the</strong> size <strong>of</strong><strong>the</strong> missi<strong>on</strong> <strong>and</strong> <strong>the</strong> required posts are created to accommodate <strong>the</strong>additi<strong>on</strong>al members <strong>of</strong> <strong>the</strong> staff <strong>of</strong> <strong>the</strong> missi<strong>on</strong>.<strong>Diplomatic</strong>IdentityDocument1.3.9 Certificates <strong>of</strong> identity are issued by <strong>the</strong> Department to pers<strong>on</strong>srepresenting foreign Governments <strong>and</strong> Internati<strong>on</strong>al Organisati<strong>on</strong>sc<strong>on</strong>ferred with immunity who are <strong>of</strong>ficially recognised by <strong>the</strong>sending State / Internati<strong>on</strong>al Organisati<strong>on</strong> <strong>and</strong> legally accreditedwith <strong>the</strong> Department. The certificate <strong>of</strong> identity is a means <strong>of</strong>identificati<strong>on</strong> to <strong>the</strong> private <strong>and</strong> public sector, including lawenforcement agencies. The certificate <strong>of</strong> identity remains <strong>the</strong>property <strong>of</strong> <strong>the</strong> Department, <strong>and</strong> must be returned to <strong>the</strong> Departmentup<strong>on</strong> request <strong>and</strong>/or departure. The Department will not accredit anincoming representative without <strong>the</strong> return to <strong>the</strong> Department forcancellati<strong>on</strong> <strong>of</strong> all <strong>the</strong> certificates <strong>of</strong> identity <strong>of</strong> <strong>the</strong> predecessor,his/her members <strong>of</strong> <strong>the</strong> diplomatic household <strong>and</strong> diplomaticvehicle number plates.Term <strong>of</strong> duty1.3.10 For wrapping up <strong>of</strong> affairs at <strong>the</strong> end <strong>of</strong> term <strong>of</strong> duty <strong>of</strong> a transferredrepresentative, <strong>the</strong> Department will allow for a period <strong>of</strong> two weeksby having <strong>the</strong> validity <strong>of</strong> <strong>the</strong> Substituti<strong>on</strong> <strong>of</strong> <strong>the</strong> TemporaryPage 13 <strong>of</strong> 90


DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONResidence Permit extended in <strong>the</strong> passport for this period.<strong>Diplomatic</strong>accreditati<strong>on</strong>1.3.11 The following pers<strong>on</strong>s qualify for registrati<strong>on</strong> with <strong>the</strong> Departmentin terms <strong>of</strong> <strong>the</strong> Act:(a) <strong>the</strong> foreign representative;(b) <strong>the</strong> spouse;(c) any dependent child under <strong>the</strong> age <strong>of</strong> 18 years;(d) any o<strong>the</strong>r dependent family member <strong>of</strong>ficially recognised as suchby <strong>the</strong> sending State, Head Office <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s, aspecialised agency or an internati<strong>on</strong>al organisati<strong>on</strong> <strong>and</strong> accepted assuch by <strong>the</strong> Department;(e) <strong>the</strong> life partner <strong>of</strong>ficially recognised as such by <strong>the</strong> sending State,Head <strong>of</strong> Office <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s, a specialised agency or aninternati<strong>on</strong>al organisati<strong>on</strong> <strong>and</strong> accepted as such by <strong>the</strong> Department.Member <strong>of</strong>family1.3.12 Official recogniti<strong>on</strong> means:(a)<strong>the</strong> dependent / life partner is issued with a diplomatic or an<strong>of</strong>ficial/service passport; or in <strong>the</strong> absence <strong>the</strong>re<strong>of</strong>;(b)<strong>the</strong> Department is presented under cover <strong>of</strong> a Note Verbale, with anoriginal letter signed by <strong>the</strong> head in charge <strong>of</strong> pers<strong>on</strong>nel matters at<strong>the</strong> Foreign Ministry or Head Office <strong>of</strong> an Internati<strong>on</strong>alOrganisati<strong>on</strong>, verifying that:Page 14 <strong>of</strong> 90


DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION(i)<strong>the</strong> pers<strong>on</strong> is <strong>of</strong>ficially accepted <strong>and</strong> registered with <strong>the</strong> ForeignMinistry or Head Office <strong>of</strong> an Internati<strong>on</strong>al Organisati<strong>on</strong> as <strong>the</strong>dependent <strong>of</strong> <strong>the</strong> foreign representative for <strong>the</strong> purposes <strong>of</strong> <strong>the</strong> ViennaC<strong>on</strong>venti<strong>on</strong>s <strong>on</strong> <strong>Diplomatic</strong> <strong>and</strong> C<strong>on</strong>sular Relati<strong>on</strong>s <strong>of</strong> 1961 <strong>and</strong> 1963respectively, or a Treaty entered into with <strong>the</strong> South AfricanGovernment <strong>and</strong> citing <strong>the</strong> applicable Article in <strong>the</strong> Treaty regulatingdependents;(ii)<strong>the</strong> dependent child is <strong>of</strong>ficially recognised by <strong>the</strong> Foreign Ministry asa member <strong>of</strong> <strong>the</strong> diplomatic household for <strong>the</strong> durati<strong>on</strong> <strong>of</strong> <strong>the</strong> term <strong>of</strong>duty <strong>of</strong> <strong>the</strong> transferred representative in <strong>the</strong> Republic <strong>of</strong> South Africa;(iii)any o<strong>the</strong>r dependent family member who is financially dependent <strong>on</strong><strong>and</strong> residing full time in <strong>the</strong> Republic <strong>of</strong> South Africa at <strong>the</strong> samepremises <strong>of</strong> <strong>the</strong> foreign representative during <strong>the</strong> latter’s term <strong>of</strong> dutyin <strong>the</strong> Republic.PrivateServants1.3.13 The Department regularises employment <strong>of</strong> foreign private servantsaccording to <strong>the</strong> Vienna C<strong>on</strong>venti<strong>on</strong>s <strong>on</strong> <strong>Diplomatic</strong> <strong>and</strong> C<strong>on</strong>sularRelati<strong>on</strong>s <strong>of</strong> 1961 <strong>and</strong> 1963 respectively, subject to employmentwith <strong>on</strong>e employer; reciprocity c<strong>on</strong>firmati<strong>on</strong> <strong>and</strong> placing <strong>on</strong> recordwith <strong>the</strong> Department two n<strong>on</strong>-transferable repatriati<strong>on</strong> guaranteesPage 15 <strong>of</strong> 90


DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION<strong>of</strong>ficially entered into between <strong>the</strong> representative <strong>and</strong> <strong>the</strong> employer;<strong>and</strong> between <strong>the</strong> representative <strong>and</strong> <strong>the</strong> Department. Therepatriati<strong>on</strong> guarantee provides that <strong>the</strong> private servant shall notchange employers <strong>and</strong> leave <strong>the</strong> RSA up<strong>on</strong> severance <strong>of</strong>employment or <strong>on</strong> completi<strong>on</strong> <strong>of</strong> <strong>the</strong> representative’s term <strong>of</strong> dutyin <strong>the</strong> Republic. The Department <strong>of</strong> Home Affairs is informedaccordingly.1.3.14 Up<strong>on</strong> reciprocity c<strong>on</strong>firmati<strong>on</strong>, <strong>the</strong> number <strong>of</strong> private servantsregulated by <strong>the</strong> Department in terms <strong>of</strong> <strong>the</strong> Vienna C<strong>on</strong>venti<strong>on</strong>s <strong>on</strong><strong>Diplomatic</strong> <strong>and</strong> C<strong>on</strong>sular Relati<strong>on</strong>s <strong>of</strong> 1961 <strong>and</strong> 1963 respectivelyare as follows:(a)(b)(c)(d)Heads <strong>of</strong> diplomatic missi<strong>on</strong>s: two pers<strong>on</strong>s with functi<strong>on</strong>alimmunity;Heads <strong>of</strong> c<strong>on</strong>sular posts: <strong>on</strong>e pers<strong>on</strong> without immunity;Transferred representatives at diplomatic missi<strong>on</strong>s <strong>and</strong> c<strong>on</strong>sularposts: <strong>on</strong>e pers<strong>on</strong> without immunity;Heads <strong>of</strong> Offices <strong>of</strong> Internati<strong>on</strong>al Organisati<strong>on</strong>s c<strong>on</strong>ferred withdiplomatic status specified in <strong>the</strong> Treaty entered into with <strong>the</strong>South African Government: <strong>on</strong>e pers<strong>on</strong> without immunity.Page 16 <strong>of</strong> 90


DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION1.3.15 Private servants shall apply for courtesy visas at South Africanmissi<strong>on</strong>s abroad subject to presenting to <strong>the</strong> missi<strong>on</strong> certifiedcopies <strong>of</strong> <strong>the</strong> two prescribed repatriati<strong>on</strong> guarantees referred toabove.1.4 <strong>Diplomatic</strong> Properties/PremisesC<strong>on</strong>structi<strong>on</strong>;relocati<strong>on</strong>;renovati<strong>on</strong>;replacing;extending;leasing1.4.1 In terms <strong>of</strong> Secti<strong>on</strong> 12 (1) <strong>of</strong> <strong>the</strong> Act, all foreign missi<strong>on</strong>s orc<strong>on</strong>sular posts, <strong>the</strong> United Nati<strong>on</strong>s, its specialised agencies <strong>and</strong>internati<strong>on</strong>al organisati<strong>on</strong>s must submit a written request to <strong>the</strong>Director General <strong>of</strong> Internati<strong>on</strong>al Relati<strong>on</strong>s <strong>and</strong> Cooperati<strong>on</strong> foracquiring, c<strong>on</strong>structing, relocating, renovating, replacing, extendingor leasing immovable property.1.4.2 In terms <strong>of</strong> Secti<strong>on</strong> 12 (4) <strong>of</strong> <strong>the</strong> Act diplomatic missi<strong>on</strong>s must belocated in Pretoria or, during sessi<strong>on</strong>s <strong>of</strong> Parliament, in Cape Town.1.4.3 Despite subsecti<strong>on</strong> 12 (4) <strong>of</strong> <strong>the</strong> Act, <strong>the</strong> Minister <strong>of</strong> Internati<strong>on</strong>alRelati<strong>on</strong>s <strong>and</strong> Cooperati<strong>on</strong> may approve that a secti<strong>on</strong> <strong>of</strong> <strong>the</strong>diplomatic missi<strong>on</strong> be located elsewhere, subject to <strong>the</strong> followingpre-requisites:(a)Only <strong>the</strong> ec<strong>on</strong>omic secti<strong>on</strong> <strong>of</strong> a diplomatic missi<strong>on</strong> headed by acareer diplomat can be located outside <strong>the</strong> capital;Page 17 <strong>of</strong> 90

Fulldiplomatic privileges encompass diplomatic staff <strong>and</strong> career c<strong>on</strong>sular<strong>of</strong>ficers.1.5.2 Transferred <strong>of</strong>ficials accredited with <strong>the</strong> Department <strong>and</strong> c<strong>on</strong>ferredwith functi<strong>on</strong>al immunity except career c<strong>on</strong>sular <strong>of</strong>ficers butincluding c<strong>on</strong>sular employees, may import goods <strong>and</strong> pers<strong>on</strong>aleffects within <strong>the</strong> first six m<strong>on</strong>ths from date <strong>of</strong> arrival, including <strong>the</strong>import or local purchase <strong>of</strong> motor vehicles. Pro-rata customs duty <strong>and</strong>taxes are payable prior to two years’ ownership.1.6.6 Official vehicles bel<strong>on</strong>ging to diplomatic missi<strong>on</strong>s, c<strong>on</strong>sular posts <strong>and</strong>internati<strong>on</strong>al organisati<strong>on</strong>s as well as private vehicles bel<strong>on</strong>ging todiplomatic <strong>and</strong> c<strong>on</strong>sular representatives may be replaced after <strong>the</strong> two yearownership period, or earlier up<strong>on</strong> pro<strong>of</strong> <strong>of</strong> payment <strong>of</strong> pro-rata customs duty<strong>and</strong> taxes as well as de-registrati<strong>on</strong> <strong>of</strong> <strong>the</strong> vehicle to be replaced.1.6.7 Vehicles acquired duty <strong>and</strong> tax-free may be disposed <strong>of</strong> without payment <strong>of</strong>duties <strong>and</strong> taxes before <strong>the</strong> two-year ownership period, <strong>on</strong>ly when sold toano<strong>the</strong>r transferred representative who is entitled to such a privilege.Registrati<strong>on</strong> in <strong>the</strong> name <strong>of</strong> <strong>the</strong> new owner is subject to <strong>the</strong> de-registrati<strong>on</strong><strong>of</strong> <strong>the</strong> vehicle from <strong>the</strong> name <strong>of</strong> <strong>the</strong> previous owner. A copy <strong>of</strong> <strong>the</strong> guide is obtainable from <strong>the</strong> Department ordirectly from SARS.1.8.2 All diplomatic missi<strong>on</strong>s, c<strong>on</strong>sular posts <strong>and</strong> internati<strong>on</strong>alorganisati<strong>on</strong>s may claim a refund <strong>of</strong> VAT <strong>on</strong> tax invoices exceeding<strong>the</strong> amount <strong>of</strong> R200 <strong>on</strong> all <strong>of</strong>ficial purchases <strong>and</strong> services rendered at<strong>of</strong>fices <strong>and</strong> <strong>of</strong>ficial residences.1.8.3 <strong>Diplomatic</strong> <strong>and</strong> c<strong>on</strong>sular representatives may reclaim VAT <strong>on</strong> locallypurchased vehicles subject to prescripts applicable to <strong>the</strong> acquisiti<strong>on</strong>,ownership period <strong>and</strong> disposal <strong>the</strong>re<strong>of</strong>.1.8.4 Transferred <strong>of</strong>ficials c<strong>on</strong>ferred with first entry privileges will beallowed <strong>the</strong> same privileges as diplomatic <strong>and</strong> c<strong>on</strong>sularrepresentatives, within <strong>the</strong> first six m<strong>on</strong>ths <strong>of</strong> arrival <strong>on</strong>ly. The firstentry restricti<strong>on</strong> is prescribed by legislati<strong>on</strong>. DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION1.9 Refunds <strong>of</strong> TV licensesPayment <strong>of</strong> televisi<strong>on</strong> licenses is n<strong>on</strong>-refundable.1.10 Police Protecti<strong>on</strong> <strong>and</strong> Traffic ArrangementsEmergencies1.10.1 The <strong>Diplomatic</strong> Policing Unit <strong>of</strong> <strong>the</strong> South African Police Service(DPU) is tasked to provide protecti<strong>on</strong> to <strong>the</strong> accredited diplomatic<strong>and</strong> internati<strong>on</strong>al communities in <strong>the</strong> Republic. Members <strong>of</strong> <strong>the</strong>secommunities must c<strong>on</strong>tact <strong>the</strong> DPU 24 hour emergency number at<strong>the</strong> C<strong>on</strong>trol Room at 012 400 6590 / 91 in case <strong>of</strong> emergency.1.10.2 In additi<strong>on</strong>, <strong>the</strong> South African Police Service 24 hour nati<strong>on</strong>alemergency line at 10 111 could also be c<strong>on</strong>tacted with a clearinstructi<strong>on</strong> that a member <strong>of</strong> <strong>the</strong> diplomatic community is in anemergency situati<strong>on</strong> where <strong>the</strong> DPU reacti<strong>on</strong> is immediatelyrequired.Officialfuncti<strong>on</strong>s:Requests forsecurityassistance<strong>and</strong> trafficc<strong>on</strong>trol1.10.3 The DPU will provide additi<strong>on</strong>al protecti<strong>on</strong> during <strong>the</strong> hosting <strong>of</strong> all<strong>of</strong>ficial functi<strong>on</strong>s, including <strong>the</strong> celebrati<strong>on</strong> <strong>of</strong> Nati<strong>on</strong>al Days. Thisincludes visible policing <strong>and</strong> patrolling <strong>of</strong> <strong>the</strong> venue <strong>and</strong> immediatesurroundings <strong>and</strong>, where <strong>and</strong> when required, inspecti<strong>on</strong> <strong>of</strong> <strong>the</strong>premises by <strong>the</strong> bomb squad unit. Therefore <strong>the</strong> Department requiresthat <strong>the</strong> accredited diplomatic <strong>and</strong> internati<strong>on</strong>al communities pay alltraffic fines issued by South African law enforcement agencies.C<strong>on</strong>sequently <strong>the</strong> Department will under no circumstancesintervene with law enforcement in this regard.1.12.2 Locally recruited pers<strong>on</strong>nel including chauffeurs <strong>and</strong> drivers <strong>of</strong>diplomatic vehicles do not enjoy immunity from <strong>the</strong> jurisdicti<strong>on</strong> <strong>of</strong><strong>the</strong> South African courts.1.12.3 Members <strong>of</strong> diplomatic missi<strong>on</strong>s, c<strong>on</strong>sular posts <strong>and</strong> internati<strong>on</strong>alorganisati<strong>on</strong> <strong>of</strong>fices are required to keep <strong>the</strong>ir diplomatic identitydocument issued by <strong>the</strong> Department <strong>of</strong> Internati<strong>on</strong>al Relati<strong>on</strong>s <strong>and</strong>Cooperati<strong>on</strong> (formerly <strong>the</strong> Department <strong>of</strong> Foreign Affairs), with<strong>the</strong>m at all times <strong>and</strong> to present it up<strong>on</strong> request to law enforcementagents <strong>and</strong> financial instituti<strong>on</strong>s. The document verifies <strong>the</strong> legalstatus <strong>of</strong> foreign representatives <strong>and</strong> transferred <strong>of</strong>ficials.Road TrafficRegulati<strong>on</strong>s1.12.4 In relati<strong>on</strong> to traffic violati<strong>on</strong>s, <strong>the</strong> Department holds <strong>the</strong> view thatas far as c<strong>on</strong>sular <strong>of</strong>ficers are c<strong>on</strong>cerned, driving a motor vehicleper se does not regularly fall within <strong>the</strong> definiti<strong>on</strong> <strong>of</strong> c<strong>on</strong>sularfuncti<strong>on</strong>s covered by functi<strong>on</strong>al immunity, as defined in Article 43<strong>of</strong> <strong>the</strong> Vienna C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> C<strong>on</strong>sular Relati<strong>on</strong>s, 1963. All pers<strong>on</strong>nel attached to diplomaticmissi<strong>on</strong>s, including those who enjoy diplomatic immunity, are<strong>the</strong>refore expected not to abuse such immunity when driving. TheDepartment views transgressi<strong>on</strong>s <strong>of</strong> <strong>the</strong> South African Road Code<strong>and</strong> Traffic Regulati<strong>on</strong>s in an extremely serious light, especiallywhere alcohol is a c<strong>on</strong>tributing factor.1.12.7 In such cases <strong>the</strong> Department may request <strong>the</strong> withdrawal <strong>of</strong> <strong>the</strong><strong>of</strong>fender even though it may be a first <strong>of</strong>fence, especially wheretransgressi<strong>on</strong>s are associated with reckless driving, violentbehavior, alcohol <strong>and</strong>/or drug abuse <strong>and</strong> where this leads to injuryor death to third parties. In <strong>the</strong> event <strong>of</strong> n<strong>on</strong>-compliance towithdraw an <strong>of</strong>fender within a specified timeframe, <strong>the</strong> Departmentwill no l<strong>on</strong>ger recognize <strong>the</strong> <strong>of</strong>fender as a diplomatic agent <strong>and</strong> deregister<strong>the</strong> pers<strong>on</strong> from <strong>the</strong> Departmental records. The Department may also, where extremely gravetransgressi<strong>on</strong>s have occurred, resort to declare <strong>the</strong> <strong>of</strong>fender pers<strong>on</strong>an<strong>on</strong> grata <strong>and</strong>/or request that <strong>the</strong> <strong>of</strong>fender's immunity be withdrawnto be brought before a court to st<strong>and</strong> trial.1.12.9 Drivers should <strong>the</strong>refore familiarise <strong>the</strong>mselves with <strong>the</strong>stipulati<strong>on</strong>s <strong>of</strong> <strong>the</strong> relevant traffic regulati<strong>on</strong>s before venturing <strong>on</strong>South African roads. A brief synopsis <strong>of</strong> <strong>the</strong> most importantelements <strong>of</strong> <strong>the</strong> regulati<strong>on</strong>s are as follows:(a)Driving under <strong>the</strong> influence <strong>of</strong> drugs or alcohol is c<strong>on</strong>sidered a veryserious <strong>of</strong>fence in South Africa. Missi<strong>on</strong> pers<strong>on</strong>nel should acquaint<strong>the</strong>mselves with <strong>the</strong> legal alcohol limit allowed when driving amotor vehicle.(b)Should Missi<strong>on</strong> pers<strong>on</strong>nel refuse to be subjected to a blood orbreath alcohol test, <strong>the</strong> Department <strong>of</strong> Internati<strong>on</strong>al Relati<strong>on</strong>s <strong>and</strong>Cooperati<strong>on</strong> may view such a refusal as a possible transgressi<strong>on</strong> <strong>of</strong><strong>the</strong> Republic’s drinking <strong>and</strong> driving laws <strong>and</strong> reserves <strong>the</strong> right totake fur<strong>the</strong>r acti<strong>on</strong>.Page 34 <strong>of</strong> 90

Utmost cauti<strong>on</strong> is <strong>the</strong>refore called for by drivers toassist pedestrians to safely use <strong>and</strong> cross roads in <strong>the</strong> urban areas,<strong>the</strong> countryside <strong>and</strong> <strong>on</strong> highways.Seat Belts1.12.16 Seat belts should be worn when <strong>the</strong> vehicle is in moti<strong>on</strong>, includingat <strong>the</strong> rear <strong>of</strong> <strong>the</strong> vehicle where this is provided.Accidents1.12.17 Procedures following an accident involving a vehicle(a)Accidents must first be reported to <strong>the</strong> South African Police Service<strong>and</strong> <strong>the</strong>n to <strong>the</strong> Branch: State Protocol <strong>of</strong> <strong>the</strong> Department.Notificati<strong>on</strong> should be by means <strong>of</strong> a Note Verbale toge<strong>the</strong>r with acopy <strong>of</strong> <strong>the</strong> police report or <strong>the</strong> case number.(b)Where a vehicle is declared a write-<strong>of</strong>f or damaged bey<strong>on</strong>dec<strong>on</strong>omical repair, a detailed report from <strong>the</strong> insurance company inwhich it is clearly stated that <strong>the</strong> vehicle is a write-<strong>of</strong>f or damagedbey<strong>on</strong>d repair must be submitted as well as a copy <strong>of</strong> <strong>the</strong> Bill <strong>of</strong>Entry.(c)Where motor vehicles are involved in accidents <strong>and</strong> to be sold oro<strong>the</strong>rwise disposed <strong>of</strong>, pro-rata import duties <strong>and</strong> value-added taxPage 36 <strong>of</strong> 90

This c<strong>on</strong>stitutes an administrative arrangementwith <strong>the</strong> Department authorising spouses to take up employment.3.1.2 For both States <strong>and</strong> Internati<strong>on</strong>al Organisati<strong>on</strong>s <strong>the</strong> spouse'sdiplomatic identity document is withdrawn, re-issued <strong>and</strong> endorsed toindicate that a spouse who engages in pr<strong>of</strong>essi<strong>on</strong>al services forremunerati<strong>on</strong> outside <strong>the</strong> missi<strong>on</strong> will in terms <strong>of</strong> Article 31.1(c) <strong>of</strong><strong>the</strong> Vienna C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>Diplomatic</strong> Relati<strong>on</strong>s <strong>of</strong> 1961 not enjoyimmunity from <strong>the</strong> civil <strong>and</strong> administrative jurisdicti<strong>on</strong> <strong>of</strong> <strong>the</strong>receiving State.Page 52 <strong>of</strong> 90

DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION(c) Step 3: Serving <strong>of</strong> <strong>the</strong> referral form <strong>on</strong> <strong>the</strong> Missi<strong>on</strong>The Department through its Directorate: <strong>Immunities</strong> <strong>and</strong> <strong>Privileges</strong> willensure that <strong>the</strong> referral form with <strong>the</strong> statement is properly served <strong>on</strong> <strong>the</strong>Missi<strong>on</strong>, subsequent to discussi<strong>on</strong>s with <strong>the</strong> relevant bilateral/multilateralbusiness unit, within a set timeframe to institute proceedings.(d)Step 4: Protocol puts diplomatic pressure <strong>on</strong> <strong>the</strong> Missi<strong>on</strong>Up<strong>on</strong> receipt <strong>of</strong> <strong>the</strong> referral form from <strong>the</strong> CCMA, <strong>the</strong> Director: <strong>Immunities</strong><strong>and</strong> <strong>Privileges</strong> in c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong> relevant bilateral/multilateralcounterpart <strong>of</strong> <strong>the</strong> Department shall call in <strong>the</strong> Deputy Head <strong>of</strong> <strong>the</strong> relevantMissi<strong>on</strong> for c<strong>on</strong>sultati<strong>on</strong>s <strong>and</strong> present a <strong>Diplomatic</strong> Note c<strong>on</strong>taining <strong>the</strong>referral form <strong>and</strong> <strong>the</strong> statement <strong>of</strong> <strong>the</strong> complainant.In <strong>the</strong> <strong>Diplomatic</strong> Note, Protocol shall formally bring <strong>the</strong> dispute to <strong>the</strong>attenti<strong>on</strong> <strong>of</strong> <strong>the</strong> Missi<strong>on</strong> with a request to do everything reas<strong>on</strong>ably possible toresolve <strong>the</strong> dispute in compliance with <strong>the</strong> law, <strong>and</strong> set a timeframe forresolving <strong>the</strong> matter. DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION(e) Step 5: Protocol informs CCMA that <strong>the</strong> referral form had been servedProtocol shall provide <strong>the</strong> CCMA with a written c<strong>on</strong>firmati<strong>on</strong> that <strong>the</strong> referralnote had been properly delivered to <strong>the</strong> Head <strong>of</strong> <strong>the</strong> relevant Missi<strong>on</strong>.(f) Step 6: Advisory Arbitrati<strong>on</strong> AwardAdvisoryArbitrati<strong>on</strong>AwardUp<strong>on</strong> receipt <strong>of</strong> <strong>the</strong> resp<strong>on</strong>se from <strong>the</strong> missi<strong>on</strong>, <strong>the</strong> Department forwards <strong>the</strong>resp<strong>on</strong>se to <strong>the</strong> CCMA who would evaluate statements <strong>of</strong> both parties <strong>and</strong>,should <strong>the</strong> CCMA determine that <strong>the</strong> LRP’s claim has merit, an advisoryarbitrati<strong>on</strong> award will be issued <strong>and</strong> <strong>the</strong> CCMA will approach <strong>the</strong> Departmentto request <strong>the</strong> Missi<strong>on</strong> to take note <strong>of</strong> <strong>the</strong> award or alternatively to attend ac<strong>on</strong>ciliati<strong>on</strong>/arbitrati<strong>on</strong> hearing.5.3 The CCMA resolves <strong>the</strong> dispute by way <strong>of</strong> c<strong>on</strong>ciliati<strong>on</strong> <strong>and</strong>/ or arbitrati<strong>on</strong>CCMAschedules ahearingThe CCMA will schedule <strong>the</strong> dispute for a hearing, as <strong>the</strong> case maybe. DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATIONpursuant to Article 41(1) <strong>of</strong> <strong>the</strong> Vienna C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>Diplomatic</strong> Relati<strong>on</strong>s<strong>of</strong> 1961 <strong>and</strong> Article 55(1) <strong>of</strong> <strong>the</strong> Vienna C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> C<strong>on</strong>sular Relati<strong>on</strong>s <strong>of</strong>1963.5.5 Default arbitrati<strong>on</strong> awardsIn <strong>the</strong> event that <strong>the</strong> CCMA has issued a default award against a Missi<strong>on</strong>where <strong>the</strong> Missi<strong>on</strong> has failed to make an appearance at <strong>the</strong> arbitrati<strong>on</strong> hearing,notwithst<strong>and</strong>ing <strong>the</strong> fact that <strong>the</strong> prescribed procedure, as provided for in this<str<strong>on</strong>g>Policy</str<strong>on</strong>g>, has been complied with, <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> secti<strong>on</strong> 13(5) <strong>of</strong> <strong>the</strong> ForeignStates <strong>Immunities</strong> Act, 1981 (Act No. 87 <strong>of</strong> 1981) shall be applied whichstates:“A copy <strong>of</strong> any default judgment against a foreign state shall betransmitted through <strong>the</strong> Department <strong>of</strong> Foreign Affairs <strong>and</strong>Informati<strong>on</strong> <strong>of</strong> <strong>the</strong> Republic to <strong>the</strong> ministry <strong>of</strong> foreign affairs <strong>of</strong> <strong>the</strong>foreign state, <strong>and</strong> any time prescribed by rules <strong>of</strong> court or o<strong>the</strong>rwisefor applying to have <strong>the</strong> judgment set aside shall begin to run twom<strong>on</strong>ths after <strong>the</strong> date <strong>on</strong> which <strong>the</strong> copy <strong>of</strong> <strong>the</strong> judgment is received atthat ministry.”5.6 Enforcement <strong>of</strong> arbitrati<strong>on</strong> awardsThe procedure c<strong>on</strong>tained in Part 4 (see paragraphs 4.2.3 to 4.2.9) <strong>of</strong> this <str<strong>on</strong>g>Policy</str<strong>on</strong>g>shall be applied to ensure compliance with any arbitrati<strong>on</strong> award issued by <strong>the</strong>CCMA.Page 90 <strong>of</strong> 90
