I- Definition:AEX 2To Anukret o. 209 AK.BK dated 31 December 2007Explana<strong>to</strong>ry otes f<strong>or</strong> the Enf<strong>or</strong>cement ofThe List of <strong>Prohibited</strong> and <strong>Restricted</strong> Goods<strong>Prohibited</strong> and <strong>Restricted</strong> Goods are goods whose imp<strong>or</strong>ts <strong>or</strong> exp<strong>or</strong>ts subject <strong>to</strong>a certain conditions f<strong>or</strong> any of the following purposes:value;- The protection of national security;- The Protection of public <strong>or</strong>der and standards of decency and m<strong>or</strong>ality;- The protection of human, animal <strong>or</strong> plant life <strong>or</strong> health;- The protection of national treasures of artistic, his<strong>to</strong>ric <strong>or</strong> archaeological- The conservation of natural resources;- The compliance with the provisions of any legislation of The Kingdom ofCambodia currently in f<strong>or</strong>ce;- The fulfillment of obligations under the Charter of the United Nations.The list shall be determined by the Royal Government of Cambodia inacc<strong>or</strong>dance with provisions of Article 8 of the Law on Cus<strong>to</strong>ms promulgated by ReachKram No NS/RKM/0707/017 dated 20 July 2007.Imp<strong>or</strong>t <strong>or</strong> exp<strong>or</strong>t of any item in the list is subject <strong>to</strong>:- Absolute prohibition on imp<strong>or</strong>t <strong>or</strong> exp<strong>or</strong>t <strong>or</strong>,- License, permit, <strong>or</strong> certificates as well as other legal documents in similarf<strong>or</strong>m, pri<strong>or</strong> <strong>to</strong> its imp<strong>or</strong>t <strong>or</strong> exp<strong>or</strong>t, <strong>or</strong> under other specific treatment required bycompetent auth<strong>or</strong>ities of the government including relevant technical ministries <strong>or</strong>agencies in acc<strong>or</strong>dance with laws and regulations of the Kingdom of Cambodiacurrently in f<strong>or</strong>ce.II- otes:1- The list shall not be applicable <strong>to</strong> imp<strong>or</strong>t <strong>or</strong> exp<strong>or</strong>t of non-commercialpurposes such as sample, personal effects, stuff of moving accommodation, <strong>or</strong> others insimilar kinds. However, imp<strong>or</strong>t <strong>or</strong> exp<strong>or</strong>t of non-commercial purposes of items subject<strong>to</strong> absolute prohibition on imp<strong>or</strong>t/exp<strong>or</strong>t <strong>or</strong> and items of high-risk of public securityshall not be eligible f<strong>or</strong> the above exemption.
2- Product of animal <strong>or</strong>igin which belongs <strong>to</strong> the CITES’ list but not preciselyspecified in the sub-decree due <strong>to</strong> technical issue shall subject <strong>to</strong> CITES permit on itsimp<strong>or</strong>t/exp<strong>or</strong>t.3- Due <strong>to</strong> technical issue of the cus<strong>to</strong>ms tariff, the list cannot be included thefollowing prohibited and restricted items:- Right-hand drive vehicle;- A number of used commodities such as computers, shoes, bags, battery etc.- Religious books, Politics books, P<strong>or</strong>nography, Advertisement Pictures, andother kinds of printed documents prohibited by law;- Goods of IPR infringement, fake items, and goods of monopoly rightinfringement.4- Imp<strong>or</strong>t of instruments <strong>or</strong> technical equipment f<strong>or</strong> airplane shall havepermission from Civil Aviation Auth<strong>or</strong>ity.5- “All kinds of used equipment of cold” and “brand new equipment of coldconsuming ozone depletion substance” shall have imp<strong>or</strong>t permission from the Ministryof Environment.6- All imp<strong>or</strong>ted goods shall be in compliant with the Industrial Standard ofCambodia and Quality and Safety Standard.7- Seeds of crops and other seeds which are not stated in the list shall besubject <strong>to</strong> the same treatments of those of seeds in the list in acc<strong>or</strong>dance with theexisting regulations relevant <strong>to</strong> agriculture materials.8- F<strong>or</strong> those exp<strong>or</strong>ted goods whose Animal Health Certificate, Phy<strong>to</strong>sanitaryCertificate, Fishery Health Certificate, <strong>or</strong> other certificates are required by exp<strong>or</strong>tingcountry, exp<strong>or</strong>ter shall request those certificate from the Ministry of AgricultureF<strong>or</strong>estry and Fishery <strong>or</strong> from other relevant competent auth<strong>or</strong>ities.9- Exp<strong>or</strong>t of Mines shall have permission from the Ministry of Industry Minesand Energy.10- Imp<strong>or</strong>t permit from the Ministry of Health shall be required f<strong>or</strong> items inchapter 28 and chapter 29 which are used as input materials f<strong>or</strong> medicinal manufacture,and/<strong>or</strong> listed in the list of Narcotics Drugs, Psychotropic <strong>Sub</strong>stance, and Drug Precurs<strong>or</strong>s.Otherwise, the rest of items in the two chapters shall acquire permission fromthe Ministry of Industry Mines and Energy.11- Imp<strong>or</strong>t permit from the Ministry of Agriculture F<strong>or</strong>estry and Fisheryshall be required f<strong>or</strong> animal medicines which are not stated clearly in the list.
12- In case where imp<strong>or</strong>t/exp<strong>or</strong>t permit from the Council of Development f<strong>or</strong>Cambodia (CDC) is available, there shall be no need permit from competent ministries<strong>or</strong> agencies, except that goods are under restriction of transp<strong>or</strong>tation due <strong>to</strong> public safetyand security reasons.13- Considering the needs of management, physical examination,decentralization of auth<strong>or</strong>ity issues, and the capability of electronic linkage ofinf<strong>or</strong>mation among all cus<strong>to</strong>ms offices around the country, goods in the list whichalready acquired permit from competent auth<strong>or</strong>ity <strong>to</strong> imp<strong>or</strong>t/exp<strong>or</strong>t in the f<strong>or</strong>m ofpackage of m<strong>or</strong>e than once through m<strong>or</strong>e than one b<strong>or</strong>der check-points, they shall beplaced under temp<strong>or</strong>arily-specific control from the Cus<strong>to</strong>ms and Excise Departmentand/<strong>or</strong> the Department of Camcontrol.III- Treatment Codes:(1) : <strong>Sub</strong>ject <strong>to</strong> the existing cus<strong>to</strong>ms f<strong>or</strong>mality in-f<strong>or</strong>ce which merely requires<strong>to</strong> lodge the Single Administrative Document (SAD) with supp<strong>or</strong>ting documents such asinvoice, packing list, and bill of transp<strong>or</strong>tation during imp<strong>or</strong>tation/exp<strong>or</strong>tation at theb<strong>or</strong>der check-points. This treatment shall not require any permission pri<strong>or</strong> <strong>to</strong>imp<strong>or</strong>tation/exp<strong>or</strong>tation, except goods are under preferential regime in part <strong>or</strong> as awhole of duty and taxes <strong>or</strong> other kinds of preferences.(2) : License, imp<strong>or</strong>t permission, <strong>or</strong> other legal documents in similar f<strong>or</strong>ms arerequired on imp<strong>or</strong>t from competent ministries <strong>or</strong> agencies.(3) : License, exp<strong>or</strong>t permission, <strong>or</strong> other legal documents in similar f<strong>or</strong>ms arerequired on exp<strong>or</strong>t from competent ministries <strong>or</strong> agencies.(4) : Imp<strong>or</strong>t is absolutely prohibited.(5) : Exp<strong>or</strong>t is absolutely prohibited.(6) : Both imp<strong>or</strong>t and exp<strong>or</strong>t are absolutely prohibited.(7) : Animal Health Certificate shall be required under the request ofimp<strong>or</strong>ting country.(8) : Phy<strong>to</strong>sanitary Certificate shall be required under the request of imp<strong>or</strong>tingcountry.(9): Fishery Certificate from exp<strong>or</strong>ting country shall be required.IV- How <strong>to</strong> Read the List:1- Acronyms:CDC: Council of Development of Cambodia
