Flexible regulation —The process of technological development<br />
of the world telecommunications market, also the convergence of different<br />
technological facilities and informational-telecommunications<br />
service types have required the necessity of similar approaches and<br />
accordingly — the establishment of united regulating legislative base.<br />
Scope of regulation —New regulating directives consider every<br />
field of informational-telecommunications service types, such as service<br />
with electronic communications networks and means, cable<br />
broadcasting, transmission of data (the field does not include the regulation<br />
of the content of this service or media informational products).<br />
Neutral approach of regulation to telecommunications technologies<br />
—The regulation of the telecommunications field shall maximally<br />
be based on the character of service provided to the end user<br />
and not on consideration of the utilized technological facilities.<br />
Harmonization of the regulating processes — Harmonization<br />
after regulation is the key topic in the new package of regulating<br />
directives. The exchange of practice between regulating authorities of<br />
different countries and the establishment of a united consulting system<br />
by the aegis of European <strong>Commission</strong> are the effective ways for<br />
the future increase of harmonization.<br />
System of authorization of activity and liberalization of licensing<br />
process —New package of directives require regulatory authorities<br />
to change the system of licensing and go to that of authorization.<br />
In that case, the undertakings are authorized to provide service using<br />
the telecommunications network and means. Only in case of having<br />
significant market power, limitations and special conditions can be<br />
imposed.<br />
Secondary trade system of frequency scarce resources —The<br />
modern structure of regulating directives encourage the issuance of<br />
decisions on initiatives of establishment of secondary trade system of<br />
frequency spectrum and other scarce resources by member countries.
