Sex Sites on <strong>the</strong> Run, Nearly Nude Photos Hit <strong>the</strong> Web” and “From Their Own OnlineWorld, Pedophiles Extend Their Reach,” respectively. The first article discussedwebsites commonly referred to as “child modeling websites,” where young girls areposed provocatively in <strong>sexual</strong> clothing. According to Mr. Eichenwald’s investigation, <strong>the</strong>owners and operators <strong>of</strong> <strong>the</strong>se websites have deliberately posed <strong>the</strong> girls in clothingbecause <strong>the</strong>y believe that <strong>the</strong> current definition <strong>of</strong> “child pornography” requires <strong>the</strong>genitalia to be somehow visible in order for <strong>the</strong> images to be illegal. The second articlefocused on <strong>the</strong> online forums and chatrooms visited by pedophiles and child predators,where Mr. Eichenwald observed child predators encouraging one ano<strong>the</strong>r andrationalizing <strong>the</strong>ir behavior.Dr. Hernandez’s testimony focused on <strong>the</strong> treatment <strong>of</strong> sex <strong>of</strong>fenders within <strong>the</strong>Bureau <strong>of</strong> Prisons (“BOP”). Dr. Hernandez runs <strong>the</strong> BOP’s only Sex Offender TreatmentProgram. Currently, that treatment program can only house 112 inmates at a time, out <strong>of</strong><strong>the</strong> almost 12,000 federal prisoners now incarcerated for <strong>sexual</strong> crimes. The program iswholly voluntary for <strong>of</strong>fenders. The treatment program lasts 18 months and is conductedin seven phases; <strong>the</strong>se phases include a complete psychiatric evaluation and group andindividual <strong>the</strong>rapy. The final phase includes a polygraph. During <strong>the</strong> polygraph, inmatesare questioned about whe<strong>the</strong>r <strong>the</strong>y have committed contact <strong>of</strong>fenses for which <strong>the</strong>y havenot been arrested or convicted. The information provided during <strong>the</strong> polygraph was <strong>the</strong>basis for a presentation Dr. Hernandez gave in 2000 entitled “Self-Reported ContactedSexual Offenses by Participants in <strong>the</strong> Federal Bureau <strong>of</strong> Prisons’ Sex OffenderTreatment Program: Implications for Internet Sex Offenders.” With regard to <strong>the</strong>inmates he had treated, Dr. Hernandez found that 76 percent <strong>of</strong> <strong>the</strong> inmates convicted oncharges related to <strong>the</strong> possession <strong>of</strong> child pornography or luring a child had alsocommitted <strong>sexual</strong> contact <strong>of</strong>fenses against <strong>children</strong>. Dr. Hernandez believed that thisfinding suggested that <strong>the</strong> majority <strong>of</strong> sex <strong>of</strong>fenders convicted <strong>of</strong> Internet sex crimes had“similar behavioral characteristics as many child molesters.”In her testimony, Dr. Salter confirmed that a “considerable percentage” <strong>of</strong>individuals convicted for child pornography crimes had also committed contact <strong>of</strong>fenses.More disturbingly, in her testimony, Dr. Salter’s suggested that this number may beunderestimated, as one report found that only three percent <strong>of</strong> individuals who havecommitted contact <strong>of</strong>fenses are caught. In addition to finding a link between possessingchild pornography and committing contact <strong>of</strong>fenses, Dr. Salter also testified that shebelieves <strong>the</strong>re is a link between viewing online pornography and committing contact<strong>of</strong>fenses. With regard to reducing <strong>the</strong> number <strong>of</strong> contact <strong>of</strong>fenses against <strong>children</strong>, bothDr. Jenkins and Dr. Salter testified that reducing online child pornography would alsoreduce contact crimes, especially among those <strong>of</strong>fenders who are emboldened to act on<strong>the</strong>ir <strong>sexual</strong> desires or urges by viewing child pornography. According to Dr. Salter,“child pornography increases <strong>the</strong> arousal to kids and is throwing gasoline on <strong>the</strong> fire.”As Dr. Salter acknowledged, while recidivism is common among sex <strong>of</strong>fenders,treatment can be successful in reducing it. One report cited by Dr. Salter found thatrecidivism among sex <strong>of</strong>fenders can be reduced by as much as 40 percent with propertreatment. Dr. Salter and Dr. Hernandez agreed that cognitive behavioral <strong>the</strong>rapy or32
