The <strong>Auction</strong>eers make everyreasonable effort to ensure theaccuracy of advertisements, cataloguedescriptions <strong>and</strong> other publicity, butexcept where specifically instructedso to certify by a Vendor, declare thatall statements, oral or in writing, arethose of opinion only, made withoutresponsibility <strong>and</strong> shall not give riseto any action in law for damages,compensation or rescission of a sale bya Purchaser, against any Vendor, the<strong>Auction</strong>eers or their employees.5. Many lots are of an age or naturethat preclude their being in pristinecondition. Some catalogue descriptionsmay make reference to damage <strong>and</strong>/orrestoration; however, omission of suchreference does not imply a lot is freefrom defects nor does any reference toa particular defect imply the absence ofothers.6. Purchasers should therefore satisfythemselves by physical inspection oflots, before bidding, as to the origin,authenticity, quality, age, weight,size <strong>and</strong> general description – as lotsare sold in their actual state withfaults, imperfections <strong>and</strong> errors ofdescription.7. Electrical/mechanical goods aresold on the strict underst<strong>and</strong>ingthat those items originally intendedto be operated by mains electricityare untested, without warranties orany guarantee as to serviceabilityor working order. These may notcomply with the current StatutoryRequirements <strong>and</strong> as such are offeredfor sale solely for display purposesor historical interest, THESE ARENOT SUITABLE FOR CONNECTIONTO THE MAINS ELECTRICITY SUPPLY.The auctioneers cannot acceptresponsibility for any act by a buyer incontravention of this condition.8. Persons h<strong>and</strong>ling lots do so at theirown risk <strong>and</strong> shall make good all lossor damage howsoever sustained: suchestimate of cost to be assessed by the<strong>Auction</strong>eers whose decisions shall befinal.9. In making a bid, Purchasersacknowledge their attention has beendrawn to the conditions of sale <strong>and</strong> aresatisfied as to the description on theinvitation of bids.10. Lots are sold subject to anyannouncement, declaration, <strong>and</strong>alteration of description or othermatters, made by the <strong>Auction</strong>eers priorto the invitation of bids.11. At the fall of the hammer, the highestbidder, acceptable to the <strong>Auction</strong>eers,shall be the Purchaser <strong>and</strong> the<strong>Auction</strong>eers, whose decision shall beabsolute <strong>and</strong> final, shall settle anydispute. No lots shall be transferred.12. The <strong>Auction</strong>eers may divide, combine,ad to or withdraw lots <strong>and</strong> make anycatalogue alterations without notice or50


General Conditions of Sale(continued)reason; they shall regulate the advanceof bidding, accept or reject any bid (attheir absolute discretion <strong>and</strong> withoutjustification) <strong>and</strong> bid on behalf of theVendor, where there is a reserve priceor at their authorised discretion.13. The Purchaser shall give his full name(<strong>and</strong> permanent place of abode, ifdem<strong>and</strong>ed) <strong>and</strong> upon failure to doso, the <strong>Auction</strong>eers may offer the lotsagain, at their sole discretion.14. As Agents only, the <strong>Auction</strong>eers shallnot be responsible for default on thepart of the Vendors or Purchasers.Any resultant deficiency, togetherwith interest, costs <strong>and</strong> expenses,shall be made good by the defaulter,recoverable as <strong>and</strong> for liquidateddamages. This condition is, however,without prejudice to the right ofthe <strong>Auction</strong>eers, in appropriatecircumstances, to enforce to SaleContract if they see fit.15. The Contract of Sale is made with the<strong>Auction</strong>eers, as Agents for the Vendor<strong>and</strong> payment shall only be made tothem. Notwithst<strong>and</strong>ing the foregoing,the <strong>Auction</strong>eers shall retain a lien onall goods that shall not pass to thePurchaser until full payment has beenreceived.16. At the fall of the hammer, all lotsshall be <strong>and</strong> remain in every respect,at the absolute risk of the Purchaser,including those of fire, burglary, etc.,<strong>and</strong> damage occasioned to lots by theremoval of other goods.17. Prospective purchasers are requestedto Register at the office upon arrival orbefore the commencement of sale.18. Purchasers unknown to the auctioneersmust make prior arrangements to payby cheque. Most major debit cards <strong>and</strong>credit cards are accepted.19. Legal title to the goods purchased shallnot pass to the buyer until paymenthas been received in full.20. Purchasers shall pay for <strong>and</strong> removelots at their own risk <strong>and</strong> expenseimmediately but at the latest within24 hours following the sale; after suchtime they shall be subject to a dailycharge of £1 per lot to cover storage<strong>and</strong> where applicable, interest onoutst<strong>and</strong>ing accounts will be levied at3% above Barclays Bank PLC MinimumLending Rate. Such additional chargesbeing subject to the foregoingconditions regulating payment <strong>and</strong> nolots shall be released to a Purchaseruntil any excess payments have beenpaid. In any event, the <strong>Auction</strong>eersreserve the right to resell uncollectedlots by auction or private treaty oralternatively, warehouse goods at thePurchaser’s expense. In all cases, the<strong>Auction</strong>eers may act without notice <strong>and</strong>any incidental expenses incurred willbecome the liability of the defaulter.21. Notwithst<strong>and</strong>ing any other terms inthese Conditions of Sale, if withinseven days of the Sale, a Purchasergives notice in writing to the<strong>Auction</strong>eers, that in his/her opinion aparticular lot (this shall not apply tobooks or similar printed matter) is adeliberate forgery, returns the lot tothe <strong>Auction</strong>eers in the same conditionas it was at the time of the Sale – <strong>and</strong>by producing evidence, the burdenof proof to be upon the Purchaser– satisfies the <strong>Auction</strong>eers that thelot is a deliberate forgery, then the<strong>Auction</strong>eers are authorised to <strong>and</strong> willrescind the transaction <strong>and</strong> refundthe purchase price received by them.This benefit is not assignable. In thecontext of this guarantee, a ‘deliberateforgery’ means a lot made with anintention to deceive, when consideredin the light of the catalogue entry <strong>and</strong>at the date of the Sale had a valuesubstantially less than it would havehad, had it been in accordance withthe description. However, there will beno right where the description in thecatalogue at the time of the Sale wasin accordance with the then generalopinion. The auctioneers reservethe right in forming their opinion toconsult <strong>and</strong> rely upon any expert orauthority considered by them to bereliable.22. The <strong>Auction</strong>eers are prepared toaccept commission bids on behalf ofintending Purchasers, unable to attendat the time of the Sale, providingrequests are made in writing <strong>and</strong> up tohalf an hour before the commencementof the Sale <strong>and</strong> given the <strong>Auction</strong>eer or<strong>Auction</strong> <strong>Rooms</strong>’ manager. This serviceis undertaken free of charge butwithout responsibility. The <strong>Auction</strong>eerscannot be held responsible for, norare they connected with, commissionbids given to <strong>Auction</strong> Room Porters orany other members of the <strong>Auction</strong>eersstaff.23.
