FREE bottle of wine1. This Promotion is only open to existing JewsonTrade Account and Jewson Trade Cash Card Account(the “Accounts”) holders (the “Participants”). TheAccounts do not include trade accounts or tradecash card accounts of other brands of the Promoteror Saint-Gobain Building Distribution Limited.Participants must be aged 18 or over and cannot beemployees of the Promoter (or any other companywithin the Saint-Gobain group) (an “Employee”), anEmployee’s immediate family, their agents or anyoneelse professionally connected with this Promotion. AnyAccount holders which have their own Jewson accountmanager may not participate within this Promotion andwill not be included within the definition of Participants.If there is any uncertainty as to who may be a Participant,please contact the Jewson Marketing Department on024 7643 8400 whose decision shall be final andbinding.2. The Promoter and its third party supplier (who willbe responsible for delivery of any Awards (as definedbelow)) reserve the right in their sole discretion to askfor evidence to verify the age, identity and/or eligibilityof a Participant at any time, and to use any channelsand methods available to carry out checks of anydetails provided, especially at the point that the Awardis delivered. The Promoter may withhold delivery of theAward until it has received such evidence and failure toprovide such evidence in a timely manner may result inforfeiture of the Award.3. This Promotion will run from when a branchbranded Jewson within the Promoter’s network ofbranches (a “Branch”) opens on 1st December 2012until a Branch closes on 14th December 2012 (the“Closing Date”) (the “Promotion Period”). Please seewww.jewson.co.uk for details of branch opening times.No award will be made for any spend by a Participantafter the Closing Date.4. Subject to clause 17, if a Participant spends atleast one hundred pounds (£100.00) (excluding VAT)in any single transaction through an Account duringthe Promotion Period (a “Transaction”), they willbe awarded one free bottle of wine (the “Bottle/ the“Award”) per one hundred pounds (£100.00) spent. Toqualify for an Award, the Transaction order must becollected from a Branch. Delivered orders and directto site deliveries by the Promoter’s third party supplierare excluded from this Promotion. In any Transaction,a Participant’s spend will be rounded down to thenearest one hundred pounds (£100) and any spendover and above this will not carry over to a followingTransaction. A maximum of twelve (12) Bottles maybe awarded to a Participant (no matter how manyAccounts they have or how many Transactions theymake) during the Promotion Period.5. If a Participant requires a refund on any spend madeduring the Promotion Period that resulted in an Award,the Promoter will deduct the value of the refund fromthe relevant Transaction value which may result inthe Award no longer being made due to subsequentTransaction value falling below the relevant multiple ofone hundred pounds (£100).6. If you are making a purchase through an Accountbut you are not the named Account holder, any Awardmade during the Promotional Period is for the benefitof and will be sent to the address of the Account holder.7. No cash alternative is available.8. The Bottles will be either a Lamblin Sauvignon Vinde Pays du Val de Loire – 2011 (“White”) or LamblinMerlot-Cabernet Vin de Pays d’Oc – 2011 (“Red”) andwill be awarded in the following format:Participant Award- Total Numberof BottlesNumber ofWhite Bottles9. The Bottles will be awarded whilst stocks last. In theevent that stocks of the Bottles run out, the Promotermay make an alternative Award of the same colour ofwine and of a similar value.10. All Bottles awarded to a Participant during thePromotional Period will be delivered together tothe address of the relevant Account holder by thePromotor’s third party supplier following the ClosingDate. The Promoter’s intention is to arrange for theAward to be delivered as soon as is reasonably possiblefollowing the Closing Date but at least prior to 31stJanuary 2013 (no deliveries will be made between 22ndDecember 2012 and 1st January 2013 (inclusive)). ThePromoter and their agents will not be liable where anAward has been lost or stolen following delivery andsuch Award will not be replaced.11. In relation to this Promotion:a. Nothing in these terms and conditions shall excludeor limit the Promoter’s or its third party supplier’sliability for death or personal injury caused by their staffor supplier’s negligence or for fraud.b Subject to 11a, the Promoter does not acceptresponsibility for any fault, malfunction, damage, lossor disappointment suffered by a Participant howsoeverarising from accepting any Award whether due to anyerror, omission or other cause by the Promoter or itsemployees, agents or others.c. Subject to 11a, the Promoter reserves the right toamend any element of this Promotion, or foreclose thisPromotion and cannot be held responsible for failureto deliver for reasons beyond its reasonable control,including but not limited to strike, lock-out, labourdispute, illness, act of God, natural disaster, adverseweather conditions, war, riot, civil commotion, accident,epidemic or pandemic, malicious damage, fire, floodand/or storm, compliance with law or governmentalorder, rule, regulation or direction, breakdown ofplant, machinery or transportation. The Promoter isnot responsible for any loss or damage caused to theParticipant as a result of any of these occurrences.e. The Participant agrees to reimburse the Promoterin respect of any damages or any losses suffered bythe Promoter resulting from any claim made by a thirdparty in each case in respect of any matter arisingfrom the Participant’s participation in the Promotionin breach of these terms and conditions or fromthe Participant’s violation of any applicable law orregulation.f. Subject to 11a, if any details on a Participant’s Accountare incorrect meaning that the Promoter’s third partysupplier is unable to deliver an Award to the Accountholder, the Promoter will use reasonable endeavoursto contact the Participant and redeliver the Award butthe Promoter does not accept responsibility for anyinability to deliver if for whatever reason it is unable tomake contact with the Participant to redeliver.12. In the event of unforeseen circumstances, thePromoter reserves the right to offer an alternativeAward of equal or greater value.13. The Promoter may require any Participant whoreceives an Award to take part in future publicity.14. The Promoter reserves the right to disqualify anyParticipant in the event the Promoter believes that theyhave contravened any of these terms and conditions.15. The Promoter’s decision is final and binding and nocorrespondence will be entered into.16. Accepting an Award may give rise to a tax liabilitywhich will be the Participant’s responsibility.17. If for whatever reason you do not wish to takepart in this Promotion, you may opt out by calling024 7625 2341 or emailing optout@jewsonoffers.co.ukwith your company name, Jewson account numberand post code or by making staff at the Branch awareof these details and the fact that you do not wish to takepart in this Promotion.18.
