Following an accompanied site visit attended by Councillors Jim Roberts, AndrewHershaw, George Mair, Bobby McDill and David Shaw together with Craig Ilesrepresenting the Head of Planning and Economic Development, Amy Townsend andAndrew Mair, the applicant’s representatives, Jim Smith representing the Head ofRoads and Transportation Division, Bill Gilchrist representing Environmental HealthServices, Karl Doroszenko, Development Planning and Regeneration Manageracting as Planning Adviser and Jennifer Morrison, Administrative Officer, held priorto the meeting, Members considered the application for erection of one wind turbineup to a maximum tip height of 61m and ancillary infrastructure for a temporary periodof 25 years at Clonherb Farm, Stewarton.The updated position statement, the Notice of Review submission, therepresentations received in relation to the original planning application, andsuggested planning conditions were all circulated.The Local Review Body considered the Notice of Review submission dated 18December 2012 and other supporting documents as well as the originalrepresentations from interested parties. A supporting statement which wassubmitted as part of the Notice of Review and location plans/photomontages weremade available (a) on the Councillors’ Portal; (b) on the Council website; and (c) atthe Local Review Body meeting.The Local Review Body taking account of the materials produced, agreed that it hadsufficient information before it and that the review application could be determinedwithout further procedure in terms of the Town and Country Planning (Schemes ofDelegation) and Local Review Body Procedure (Scotland) Regulations 2008.The Local Review Body determined in its view the proposed development wasacceptable and as a consequence therefore determined that the application beapproved subject to the suggested planning conditions as detailed in Appendix 3 ofthe position statement and subject also, to the conclusion of a Section 75 Agreement

2for the purpose of (1) ensuring the provision of a Restoration Bond by the Applicantfor all decommissioning and site restoration costs on the expiry of the PermissionPeriod or such other earlier date should the wind turbine be removed prior to theexpiry of the Permission Period; and (2) reviewing the adequacy of the RestorationBond during the duration of the planning permission.The meeting terminated at 1153 hours.
