Following an accompanied site visit attended by Councillors Jim Ro<strong>be</strong>rts, AndrewHershaw, George Mair, Bobby McDill and David Shaw <strong>to</strong>ge<strong>the</strong>r with Craig Ilesrepresenting <strong>the</strong> Head of Planning and Economic Development, Amy Townsend andAndrew Mair, <strong>the</strong> applicant’s representatives, Jim Smith representing <strong>the</strong> Head ofRoads and Transportation Division, Bill Gilchrist representing Environmental HealthServices, Karl Doroszenko, Development Planning and Regeneration Manageracting <strong>as</strong> Planning Adviser and Jennifer Morrison, Administrative Officer, held prior<strong>to</strong> <strong>the</strong> meeting, Mem<strong>be</strong>rs considered <strong>the</strong> application for erection of one wind turbineup <strong>to</strong> a maximum tip height of 61m and ancillary infr<strong>as</strong>tructure for a temporary periodof 25 years at Clonherb Farm, Stewar<strong>to</strong>n.The updated position statement, <strong>the</strong> Notice of Review submission, <strong>the</strong>representations received in relation <strong>to</strong> <strong>the</strong> original planning application, andsuggested planning conditions were all circulated.The Local Review Body considered <strong>the</strong> Notice of Review submission dated 18Decem<strong>be</strong>r 2012 and o<strong>the</strong>r supporting documents <strong>as</strong> well <strong>as</strong> <strong>the</strong> originalrepresentations from interested parties. A supporting statement which w<strong>as</strong>submitted <strong>as</strong> part of <strong>the</strong> Notice of Review and location plans/pho<strong>to</strong>montages weremade available (a) on <strong>the</strong> Councillors’ Portal; (b) on <strong>the</strong> Council website; and (c) at<strong>the</strong> Local Review Body meeting.The Local Review Body taking account of <strong>the</strong> materials produced, agreed <strong>that</strong> it hadsufficient information <strong>be</strong>fore it and <strong>that</strong> <strong>the</strong> review application could <strong>be</strong> determinedwithout fur<strong>the</strong>r procedure in terms of <strong>the</strong> Town and Country Planning (Schemes ofDelegation) and Local Review Body Procedure (Scotland) Regulations 2008.The Local Review Body determined in its view <strong>the</strong> proposed development w<strong>as</strong>acceptable and <strong>as</strong> a consequence <strong>the</strong>refore determined <strong>that</strong> <strong>the</strong> application <strong>be</strong><strong>approved</strong> subject <strong>to</strong> <strong>the</strong> suggested planning conditions <strong>as</strong> detailed in Appendix 3 of<strong>the</strong> position statement and subject also, <strong>to</strong> <strong>the</strong> conclusion of a Section 75 Agreement


2for <strong>the</strong> purpose of (1) ensuring <strong>the</strong> provision of a Res<strong>to</strong>ration Bond by <strong>the</strong> Applicantfor all decommissioning and site res<strong>to</strong>ration costs on <strong>the</strong> expiry of <strong>the</strong> PermissionPeriod or such o<strong>the</strong>r earlier date should <strong>the</strong> wind turbine <strong>be</strong> removed prior <strong>to</strong> <strong>the</strong>expiry of <strong>the</strong> Permission Period; and (2) reviewing <strong>the</strong> adequacy of <strong>the</strong> Res<strong>to</strong>rationBond during <strong>the</strong> duration of <strong>the</strong> planning permission.The meeting terminated at 1153 hours.
