the plan itself, plan administration, and any detenninations made under the plan shall not besubject to grievance or arbitration procedures or to any other provisions <strong>of</strong> this Agreement or tonegotiation by the Union.ARTICLE 12: MEDICAL, DENTAL, <strong>AND</strong> LIFE PLANThe Pmt agrees to contribute the following amounts for each Employee performing work covered bythis Agreement to the Puget Sound Electrical Workers Healthcare Tmst Fund, a jointly ttusteedwelfare tmst created pursuant to Section 3.02(c) <strong>of</strong> the Labor-Management Relations Act <strong>of</strong> 1947(Taft-Hartley).Effective June I, 2012 employer contribution in the amount <strong>of</strong> $7.20 per each hour worked for eachEmployee perfonning work covered by this Agreement.Effective June I, 2013 employer contribution in the amount <strong>of</strong> $7.45 per each hour compensated forthe monthly contribution equaling 155 hours each month for each Employee covered by thisAgreement.Effective June I, 2014, the hourly contribution rate paid by the Pmt per hour compensated for themonthly contribution equaling !55 hours per month shall be maintained in the following way:Any increases to the healthcare hourly contribution base rate <strong>of</strong> $7.45 that is necessary to match thehealth care contribution rate in effect in the Inside Constmction Agreement after June I, 2014 shall beshared 50% by the employee and 50% by the <strong>Port</strong> up to I 0% <strong>of</strong> the Base Rate. One employeecontributions have reached I 0% <strong>of</strong> the Base Rate, future increases shall be split I 0% paid by theemployee and 90% by the Pmt.The employee's share <strong>of</strong> the monthly contribution will be a pre-tax deduction subject to the monthlycontribution amount based on 155 hours.Payment shall be due on the fifteenth <strong>of</strong> the month following the month in which the hours wereworked. Each remittance shall be accompanied by a fonn, which will be made available for thispurpose.The <strong>Port</strong> agrees to be bound by the terms and provisions <strong>of</strong> the Tmst Agreement governing the PugetSound Electrical Workers Healthcare Tmst Fund, effective January I, 1976, and all amendments orrevisions hereafter adopted, and futther agrees to accept as its representatives the current EmployerTmstees and their lawfully appointed successors. Except monthly contributions by the Pmt shall notexceed the negotiated amounts above.The failure <strong>of</strong> the Pott to comply with the applicable provisions <strong>of</strong> the Tmst Agreement governing thePuget Sound Electrical Workers Healthcare Tmst Fund shall also constitute a breach <strong>of</strong> this LaborAgreement.Electricians Collective Bargaining Agreement June 1, 2012- May 31, 2017Page 21 <strong>of</strong>29
