Participation in theEvent constitutes Participant's express consent thereto. In consideration for participation, Participant furtheracknowledges and agrees that America Undiscovered may use Participant's name, portraits, photographs, statementsand any and all other likeness obtained in connection with the Event, in any form, format and media, for any purposein the promotion of America Undiscovered or its assigns and its products and services. America Undiscovered willhave exclusive ownership and right to assign all copyrights and other intellectual property rights associated with allportraits, photographs, all video and audio recordings, and all statements that are transcribed by AmericaUndiscovered, containing the voice, statements and/or likeness of Participant. Participant shall have no claim oraction against America Undiscovered, its agents or representatives in connection with such use.Participant understands and agrees that all representatives of the modeling and talent agencies and other modelingand entertainment professionals attending the Event are attending to look for talent in which they may have aninterest, but that offers of employment are to occur without the involvement of America Undiscovered. In fact, all suchprofessionals have agreed to not make any employment or other offers to participants during the Event. Participantfurther understands that America Undiscovered strongly recommends that no Participant deal directly with anyemployer without utilizing the services of a qualified agent to represent their interests. America Undiscovered does notprovide any advice to participants in regard to matters of employment or the selection of agents to represent them.Participant understands that no providers of transportation, accommodations and other services to, from and duringthe Event are acting as agents of America Undiscovered, and that America Undiscovered shall have no liability orresponsibility for their acts or omissions, including, but not limited to, transportation delays, damage to or loss ofbaggage, conditions of accommodations, and so forth. It is Participant's responsibility to read and abide by all termsgoverning baggage, and to pay the cost of any excess baggage or baggage insurance. It is Participant's soleresponsibility to abide by all rules and regulations governing air and sea travel, customs, and immigration. Participantacknowledges that failure to abide by such regulations may result in a travel provider's refusal of service toParticipant, and further agrees to hold harmless and indemnify America Undiscovered for any such refusal of service.

Participant expressly agrees and represents that Participant is not acting in concert with, in agreement with or inconnection with any member of the outside media. In consideration of the intellectual property rights of AmericaUndiscovered, as well as the privacy of others, America Undiscovered retains the right to confiscate any unauthorizedvideotape or audiotape of any of the events or workshops. Participant agrees that Participant shall not make anyderogatory, disparaging or negative comments or statements about America Undiscovered. In the event Participantviolates this provision and makes such statements, America Undiscovered shall have the right to obtain injunctiverelief prohibiting Participant from making any further such statements.This Agreement shall be construed under the laws of the State of Illinois. Any suit or action brought to enforce any ofthe terms and conditions of this Agreement shall be brought solely in Illinois.Participant acknowledges that there are inherent risks associated with travel and participation in the Event. Therefore,America Undiscovered does not accept responsibility for, and shall not be liable for, any loss, injury or damage toParticipant or Participant's personal belongings. Participant expressly assumes all risks associated with the Event,and any activities undertaken by Participant, including, without limitation, injury or illness and damage to or loss ofpersonal property. Participant expressly waives, releases and shall forever hold harmless America Undiscovered, itslicensees and agents, and their personnel from and against any and all claims, suits, demands, losses, damages, andall other expenses or liabilities attributable to or arising out of the Event. Participant expressly agrees to indemnifyAmerica Undiscovered for any and against all claims, suits, demands, losses, damages, and all other expenses orliabilities attributed to or arising out the Event.In the event that any term or provision of this Agreement is held by a court or tribunal of competent jurisdiction to beunenforceable, then the remaining provisions of this Agreement shall remain in full force and effect.If Participant is a minor or is married, the legal guardian or spouse also agrees to all terms of the foregoing Agreementand Release. If the Spouse of a married Participant is not present to sign this Agreement, then the Participant -spouseagrees to indemnify and hold harmless America Undiscovered for any and all causes of action, which may arise oraccrue to said spouse.Participant understands that if Participant is not in attendance during the final award ceremony and is chosen as asemi-finalist, their spot may be given to another contestant.
