data_THE PARTICIPATION OF THE SC1 IN THE WORK RELATED TO THE TPA WITH THE UNITEDStates was quite active on the design of the new package of Legislative Decrees. In some cases,the Chamber was the main promoting entity of the approved policy-setting body, proposing itspreliminary draft, and in other cases, it contributed with the formulation of opinions, suggestionsand criticisms to the versions presented by other functional bodies.SC1DEFENSE OF COMPETITION CHAMBER Nº 1The Defense ofCompetition Chamber Nº1 is the body that resolves,as second and lastadministrative instance,procedures relatedto the defense of freecompetition, the repressionof unfair competition andthe elimination of nontarifftrade barriers andbureaucratic barriers, aswell as anti-dumping andcountervailing duties.In turn, it resolvesclaims and complaintsfiled against otherCommissions andTribunal Chambers forthe defense of competitionand intellectual property.MAJOR ACHIEVEMENTS'08Only 4 months after the SC1 beganoperating its achievementshave already been shown in themarket as a result of the various pronouncementsissued in each area of itscompetence. Among the most importantachievements is the criteria establishedto determine the amount of penaltiesfor economic agents who incur inunfair competition acts or infringe regulationsthat promote free competition.The purpose of the new criteria isto establish penalties that represent atrue disincentive for committing infringements,as what has occurred in the exofficio proceedings filed by the Overseeingof Unfair Competition Commission(CCD) against Quality Products S.A.In this case, one of the most outstandingof 2008, two penalties amountingto 80 UIT (Tax Assessment Units) wereimposed after the CCD determined thatthe company Quality Products S.A. hadcommitted deceitful advertising whenoffering weight-reducing products withoutfurther technical grounds.A similar precedent was set afterthe proceeding filed by the PeruvianAssociation of Consumers and Users(Aspec) against Panificadora Bimbo delPerú S.A, also due to deceitful advertising,when offering diet products withouta supporting study. In this case,a penalty of 100 UIT (Tax AssessmentUnits) was imposed after the SC1 foundthe complaint to be well-founded as thecompany did not prove the veracity ofan advertisement where it was ensuredthat its “Sliced Bread” product was100% whole-grain bread.As for antidumping and countervailingprocedures, the SC1 definedthe competences of the commissionregarding claims filed for the import ofproducts subject to the assessment ofantidumping rights. The SC1 establishedthat <strong>Indecopi</strong> is not the competentagency to determine the characteristicsof the imported goods, since it is the exclusiveresponsibility of the National TaxAdministration (Sunat).Regarding the elimination of bureaucraticbarriers, the Chamber declared thatthe restriction in business hours of commercialestablishments in the district ofMiraflores was an unreasonable bureaucraticbarrier since it was aimed at delimitingthe development of activities, not onlyin a noise generation area, but in the entiredistrict; in addition to being applicable to

data_LEGISLATIVE DECREE Nº 1033, ENACTED IN THE FRAMEWORK OF THE REFORMS TO ADAPTthe legislation to the FTA, specifies that the Antidumping and Countervailing Duties Commissionis the competent agency for the application of antidumping or countervailing duties and for thepreparation of technical reports that define the need to impose safeguarding measures.CDSCLCSC1CDSCLCCCDCEBCNBSC2CPCCCOANTIDUMPING AND COUNTERVAILINGDUTIES COMMISSIONThe Antidumping andCountervailing DutiesCommission (CDS) isin charge of overseeingcompliance with theregulations that seekto prevent and correctdamage to the marketcaused by the practiceof dumping or subsidiesthrough the impositionof antidumping andcountervailing duties.The CDS also acts as theinvestigative authorityin proceedings derivingfrom the imposition ofsafeguarding measures.Throughout 2008, the CFD hasprovided technical support in thenegotiations that Peru has carriedout with other countries in order to signtrade agreements, including China, theEuropean Union, Canada, Singaporeand the EFTA, among others.The work carried out during the year toprepare a proposal to modify the AntidumpingRegulations stands out, whichwas worked on intensively with othersectors of the government.GOALS'09The processing of cases presented bythe national industry shall be prioritizedso that the investigation proceedingsare completed within the legal timeframe,with the proper quality of the technicaland legal analyses.Greater emphasis will be placed on coordinatingwith customs to improve theeffectiveness of the antidumping andcountervailing measures imposed bythe commission.Finally, the commission will continueproviding technical support in the negotiationsfor the Trade Promotion and FreeTrade Agreements with other countrieson issues regarding trade defense.DEFENSE OF FREECOMPE-TITION COMMISSIONThe CLC is the <strong>Indecopi</strong>body in charge ofoverseeing anticompetitiveconducts inthe market, accordingto what is stipulated inLegislative Decree 1034.In addition, according towhat is foreseen in Law26876, Antimonopolyand Antioligopoly Lawof the Electric Sector, it isin charge of controllingbusiness concentrationoperations in the electricsector.

The Technical Secretariatis authorized to investigate and submitevidence with the purpose of preparingopinions and recommendations so theCLC can issue its final decisions as firstadministrative instance.MAIN ACHIEVEMENTS'08Law on Overseeing of Anti-CompetitiveConductsBetween January and May, the CLCand its Technical Secretariat took partin the preparation of the Bill on Overseeingof Anti-Competitive Conducts,which was approved on June 25th,through Legislative Decree 1034. Thislaw contains a series of improvementsin relation to the previous one andallows for a more predictable and timelydevelopment of procedures.Agreement on concerted action inthe insurance marketThe CLC started an ex officio investigationagainst the Peruvian Association ofInsurance Companies (APESEG), eightinsurance companies and several directorsand managers of the latter for carryingout a collusive practice in referen-ce to establishing minimum premiumsand minimum deductibles in vehicleinsurance policies carried out (Dossier004-2004/CLC).During the investigation, it was verifiedthat, since october 2000, the differentinsurance companies had agreedto raise the average premium at a standardizedhigher amount.Likewise, documents from the GeneralAssembly, Board of Directorsand Vehicles Committee of the APE-SEG were found, in which insurancecompanies stated their concern onthe reduction of their incomes and askedfor the approval of technical, administrativeand financial measures toincrease their profitability.Finally, documents were foundin which the APESEG requested insurancecompanies to inform on theimplementation of a technical memorandum(document to support the estimatedcost of the insurance); and aletter requesting a member companyto inform on the implementation actionsof agreements made.Consequently, through Resolution 009-2008-INDECOPI/CLC of February 25th,2008, the CLC sanctioned the APESEG,the insurance companies and several directorsand managers of the latter for carryingout a concerted action consisting inestablishing minimum premiums and minimumdeductibles of basic and completetype insurance policies for privately-ownedvehicles. Fines imposed totaled 3,396.54Tax Assessment Units (UIT).To December 2008, Resolution 009-2008-INDECOPI/CLC was in the appealstage at the Defense of CompetitionChamber No. 1.GOALS'09For 2009, the CLC and its Technical Secretariatplan to speed up the processingprocedures to finish them in a timely way;as well as to strictly adapt to deadlinescontained in the new Law on Overseeingof Anti-Competitive Conducts. It also expectsto increase its predictability throughthe publication of criteria applicable toprocessing procedures.Finally, the Technical Secretariat is committedto permanently supervise marketperformance with the purpose of identifyingreasonable indications of anti-competitiveconducts and if this were the case, to startthe respective ex officio proceedings.103


data_FOR SIX MONTHS, THE CCD TOOK PART IN DRAWING UP AND REVIEWING LEGISLATIVEDecree No. 1044 (Overseeing of Unfair Competition Act). Improvements introduced by such legislativedecree clearly determined the attributions and competences of the CCD and its TechnicalSecretariat for the benefit of the market.CCD[99%]of dossiers wereprocessed within theOVERSEEING OF UNFAIR COMPETITION COMMISSIONSC1CDSCLCCCDCEBCNBSC2CPCThe purpose of the CCDis to detect and sanctionpractices against businessgood faith that shouldguide competition in asocial market economysuch as ours. Theadvertising activity isincluded in such practices.It is worth pointing outthat with the enforcementof Legislative Decrees1033 and 1044, in July2008, the CCD monitorsthe market through itsTechnical Secretariat withthe purpose of detectingconducts contrary tobusiness good faith and tothe effective advertisinglegislation. Likewise, theTechnical Secretariat ofthe CCD also determinesthe need to start ex officiosanctioning procedures.It was a very significant year for theCCD, as the enforcement of LegislativeDecree 1044 represents a change bothin substantive as well as procedural laws.Among other points, LD 1044 unifies andperfects provisions established in the Repressionof Unfair Competition Act (LawDecree 26122) and Advertising Regulationsfor Consumer Protection (LegislativeDecree 691).For example, in the past, companiesexcused the dissemination of deceitfuladvertisement by requesting <strong>Indecopi</strong>to verify the information they disseminated.The new legal provision emphaticallyestablishes that the company itselfis the one that should validate its information,prior to its dissemination, withtechnical and independent criteria.It is worth pointing out that in 2008cases processed before the Commissionhave remained on an upward trend.Such trend has been constant for thelast eight years.MAIN ACHIEVEMENTS'08Vibro Max Power Case: A weightreducer that does not reduceDuring 2008, the CCD carried out variouscampaigns with the purpose ofmaking the information provided toconsumers through advertising moretransparent. Thus, the Commission, togetherwith the General Directorate ofMedicines, Supplies and Drugs (Digemid),began 25 ex officio procedures ondeceitful advertising of medicines andnatural products.One of the most outstanding proceduresended with a sanction of 80Tax Assessment Units (UIT) againstQuality Products S.A., for disseminatingdeceitful advertising about its product“Vibro Max Power”. The Commissionverified that the abovementionedcompany attributed weight-reducingcharacteristics to its product withoutmajor technical support.It is important to highlight that eventhough there has been a significantchange in its internal structure, theCCD has successfully implementedthe new legislation, generating trust inmarket agents.GOALS'09To process 100% of dossiers within thelegal term.Increase in 10% ex officio cases.CCO


CEB[177 38]proceedings weremore thanin 2007.ELIMINATION OF BUREAUCRATIC BARRIERS COMMISSIONThe Elimination ofBureaucratic BarriersCommission (CEB) is incharge of identifying andeliminating requirementsthat are illegal orlacking reasonabilitythat are imposed by theadministrative entities of thegovernment, particularlythose requirements placedby municipalities on theeconomic agents that want togain access or remain on themarket.Furthermore, it oversees thatthe procedures, requirementsand fees that such entitiesrequire from citizensare legal and reasonable.It also verifies that themunicipalities do not limitthe free movement of people,goods and merchandisewithin the country.MAIN ACHIEVEMENTS'08In 2008, the CEB prepared the Indexof Locally Imposed Bureaucratic Barriersfor 2007, detailing:1. The bureaucratic barriers declaredto be illegal or lacking reasonability inthe district and provincial municipalitiesof the country; 2. The statistics on theparticipation of the Commission duringthat period; and 3. The list of municipalitiesthat complied with approving andpublishing their Unified Texts for AdministrativeProcedures (TUPA).The CEB, in coordination with theEconomic Studies Management of <strong>Indecopi</strong>,participated in the preparationof the Market Access Index (IAM) 2007-2008, in which the information providedby 98 municipalities in the country wasanalyzed and compared in order to determinewhether the licensing of operationprocedures, placement of publicannouncements or authorization for publicworks, as well as whether the TUPAof such municipalities, conformed withthe legal framework in effect. Based onthese results, points were given andmarket agents were informed of whichmunicipalities better facilitate the openingof businesses.GOALS'09The Elimination of Bureaucratic BarriersCommission plans to carry out a highernumber of official investigations verifyingcompliance with the regulations andprinciples of administrative simplification.Furthermore, it seeks to continueoverseeing compliance with the FrameworkLaw for Licenses of Operation.Additionally, the Commission plansto improve the Index of Locally ImposedBureaucratic Barriers and the MarketAccess Index so that they become permanentinstitutionalized tools benefitingthe country.The CEBparticipated in thepreparation of theMarket Access Index(IAM) 2007-2008, inwhich the informationprovided by 98municipalities in thecountry was analyzedand compared.105


data_ON JUNE 25TH, 2008, THE STANDARDIZATION AND NON-TARIFF BARRIERS SURVEILLAN-CE Commission (CNB) was created through the enactment of Legislative Decree No. 1033. TheCNB came to replace the former Technical and Commercial Regulations Commission (CRT). Itspurpose was to strengthen and modernize <strong>Indecopi</strong> and for the country to benefit from marketexpansion through free trade agreements.SC1CDSCLCCCDCEBCNBSC2CPCCCOCNBSTANDARDIZATION AND NON-TARIFFBARRIERS SURVEILLANCE COMMISSIONAmong the main functionsof the Standardizationand Non-tariff BarriersSurveillance Commission(CNB) is the approvalof Peruvian Standards,whose technical supportis essential for increasingcompetitiveness of marketproducts and services. Itspurpose is also to defendfreedom of trade througha subsequent control andelimination of non-tarifftrade barriers. It is alsoin charge of authorizingthe use of ElectronicSignatures to entities thataward digital certification,registration or dataverification and to entitiesthat deliver value addedservices.Through Legislative Decree 1030,the Law of National Standardizationand Accreditation Systemswas approved. It was established thatStandards and conformity assessmentprocedures constitute instruments thathelp promote development of quality inthe industry, protect consumers and improvethe competitiveness of economicagents nationwide and abroad. Withinthis framework, the CNB sends its techniciansto support in international tradingnegotiations on matters related tothe agreement on Technical Obstaclesto Trade, of the World Trade Organization(WTO), and manage the NationalInformation System for Standards andConformity Assessment procedures.The CNB expresses its opinion and/or vote at regional and internationalStandardization forums and preparesthe annual Standardization Plan in coordinationwith the various sectors.MAIN ACHIEVEMENTS'08During 2008, Peruvian TechnicalStandards (PTS) were approved for themain economic activities. Also, activitieswere carried out to help small andmedium-size companies take part in thestandardization process of their goodsand services so these can have accessto global markets.Thus, regarding the Peruvian StandardizationEntity, the CNB approved207 PTS, and established eleven newTechnical Committees (CTN), which totaled101 CTN by the end of 2008.In compliance with internationalcommitments it assumed, the CNB activelyparticipated in the APEC Forumand chaired plenary meetings of theStandardization and Conformity Subcommittee.It also headed and executedthe Project on the VII Standardizationand Conformity Conference held inCusco.During negotiations for the subscriptionof trade promotion agreementswith the EFTA, China and the EuropeanUnion, the CNB assisted the Ministry ofForeign Trade and Tourism (Mincetur) atnegotiation tables on matters in relationto Technical Obstacles to Trade (OTC).In relation to non-tariff measures, inNovember 2008, the CNB dismisseda complaint, which pretended to establisha non-tariff measure requiringthat only used vehicles with a mileageof more than 80,000 kilometers could


[36 2,680]conferences weregiven by CNB officialsnationwide in 2008.Pymesattended.enter the market.In relation to direct support to smalland medium size enterprises (pymes),during 2008, an active awarenesscampaign was carried out through theNorexport Program, which enabled toidentify products and services that neededto be standardized.Technical assistance was also givento 21 Pymes of the Leather-Footwear,Software, Timber and Agri-businesssectors through pilot projects for implementingPeruvian Standards.In relation to e-Signatures, in march2008, the four guidelines for the accreditationof electronic certification entitiesand related entities were approved.These guidelines will establish proceduresto evaluate and acknowledge technicalcompetence of entities that issueelectronic GOALS'09 certificates.Strengthen the development of PeruvianTechnical Standards for the construction,manufacturing and farmingindustrialsectorsContinue assisting Mincetur in free tradeagreement negotiations.Strengthen the quality infrastructurethrough training activities relatedto the importance of the applicationof Standards and their impact in trade.Carry out 18 training courses in 13regions of the country addressedat 540 Pymes representatives thatwork in the agri-business, leatherand footwear, timber, aquiculture,handcraft, textile and garment sectors,among others.Within the international framework,the CNB shall put into effect thecommitments assumed in variousStandardization forums.Likewise, it has been foreseen tomake progress in the constructionof the official infrastructure for theElectronic Signature by implementingtechnical mechanisms to helpsupervise the operation of electroniccertification entities.In compliancewith internationalcommitments itassumed, the CNBactively participatedin the APEC Forumand chaired plenarymeetings of theStandardizationand ConformitySub-committee.It also headedand executed theProject on the VIIStandardizationand ConformityConference held inCusco.107


data_WITH CHANGES IN THE INTERNAL RULES THAT WERE PROMOTED THROUGHOUT 2008, DUEto the imminent entry into force of the FTA with the United States, improvements in the Insolvencyand Consumer Protection rules have been introduced. These rules have strengthened the defenseof the consumer rights and the effectiveness of the insolvency system as protection instrument ofSC2DEFENSE OF COMPETITION CHAMBER Nº 2The Defense ofCompetition ChamberNº 2 (SC2) is <strong>Indecopi</strong>’sfunctional body thatreviews, as second andlast administrativeinstance, processesrelated to the protectionof consumer’s rightsand insolvency matters.The SC2 was formallyset up by PresidencyResolution of <strong>Indecopi</strong>’sBoard of Directors (084-2008/INDECOPI/COD),published on September 21,2008 in El Peruano, officialnewspaper.MAIN ACHIEVEMENTS'08The Chamber issued two precedentsof mandatory observancein insolvency matters in 2008.The first precedent deals with thepayment of insolvent credits that aretopic for a transfer of rights (ResolutionNo. 0018-2008/TDC-INDECOPI,dated January 10, 2008). The secondprecedent, approved by ResolutionNo. 0532-2008/TDC-INDECOPI, datedMarch 12, 2008, defines the participationin the Board of creditorsappearing late in the process.In 2008, the SC2 officials participatedin the reform of the following laws:Consumer Protection Law, General InsolvencySystem Law, Law on Organizationand Functions of <strong>Indecopi</strong>, andLaw on National Standardization andAccreditation Systems. The purposewas to adapt <strong>Indecopi</strong>’s rules and regulationsto the obligations assumed byPeru as a result of the Trade PromotionAgreements signed with other countries,among them the United States.The SC2 - aware that its role in themarket is to make service providers andproduct suppliers conduct activities withinthe law - has punished conducts that in-fringed consumer rights in several sectorsincluding the ones listed below:Transportation:Ground and river transportation companiesthat failed to comply with safety measuresand jeopardized the lives and integrityof its passengers were sanctioned.Air and ground transportation companiesthat lost or misplaced luggage were alsosanctioned and a refund amount in favorof consumers was established.Education:Schools that charged tuition in advanceand fees non-authorized by the Ministry ofEducation - like directing parents to buyschool supplies from a certain supplier, orcharging higher registration fees than thatof the monthly tuition – were sanctioned.Bank:Several practices of the banking sectorcontrary to the Consumer Protection regulationswere sanctioned. One of thesepractices was the unjustified denialfrom a bank to transfer a client’s bankaccounts to an office other than wherethey opened their credit report, but thatbelonged to the same bank entity. TheChamber established as criterion thatwhenever a consumer chooses a bank,he or she does not enter into a contract


the right to credit from creditors. Unlike the previous rules and regulations regarding ConsumerProtection, infringements will be classified as minor, major and very serious, increasing thusthe penalizing capacity of the Chamber, which now can impose penalties of up to 300 UIT (TaxAssessment Units).with a particular office but with the companyas a whole. Precisely, part of theservices offered by a bank – and whichare advertised to capture consumerpreferences – is the possibility to carryout operations from any bank agencythrough its nationwide networks.Travel assistance:The SC2 established that whenever aconsumer enters into a contract with atravel assistance service the traveler assumesthat in the event of an emergencythe company will provide the necessaryassistance. Therefore, it sanctioned atravel assistance company that refusedto cover a client’s medical assistancecosts arguing that this emergency wasrelated to a pre-existing disease.Safety in shopping centersThe Defense of Competition ChamberNo. 2 established that the appropriatemechanisms for surveillance, securityand control of commercial establishmentsand other private entities cannot be usedin such a way that affect the dignity andpeace of their clients. In that regard, theSC2 established that the supplier’s authorityto have safety mechanisms protectingtheir establishments is not under discussion,but it stated that those mechanismscannot create situations that aredetrimental to or affect the consumer’sdignity, for instance, obliging them to removesome of their clothes in order torule out a potential shoplifter.GOALS'09The SC2 objective for 2009 is to improveits internal processes. For that purpose,there will be a change in the dynamicsof its procedures in order to meet in atimely manner the growing demand ofcases as a result of a greater presenceof the institution in provinces and of disseminationcampaigns.The SC2 will continue publishingresolutions in order to inform suppliersand consumers on how to conductthemselves in the market.The SC2 - aware thatits role in the marketis to make serviceproviders and productsuppliers conductactivities within the law -has punished conductsthat infringed consumerrights in several sectors.109


data_THE CPC, TOGETHER WITH THE DEFENSE OF COMPETITION CHAMBER, PREPARED AConsumer Protection Act in 2008 that, among other points, has reinforced the sanctioning power ofthe Commission. It can now impose fines of up to 300 Tax Units (UIT). The Technical Secretary ofthe CPC participated in the debate for the creation of the Law on the Organization and Functions ofthe National Institute for Defense of Competition and Protection of Intellectual Property (<strong>Indecopi</strong>).CPC[92private schools weresanctioned for requiringadvance payment in 2008.CONSUMER PROTECTION COMMISSIONSC1CLC CDSCFD CLCCEB CCDCNB CEBCCD CNBCCO SC2SC2 CPCThe Consumer ProtectionCommission (CPC) isthe area responsible forsafeguarding consumerrights and sanctioningthose who violate them.Thereby, it constitutes theagency of first administrativeinstance to resolve disputesbetween suppliers andconsumers. It can alsodictate corrective measures.One of the fundamentalgoals of the CPC is to helpconsumers make appropriatedecisions. To this end, itmust guarantee access toinformation that is truthful,timely, accessible, and easy tounderstand.The CPC verifies the information receivedby the consumer, and basedon this, it determines which rightsthe consumer may claim upon purchasinga product or hiring a service. It also intervenesin issues related to discriminatoryacts and the use of coercive commercialmethods (such as automatically chargingthe consumer without having his prior andexpress agreement).The CPC is composed of two areas:the Procedural and the Preventive, throughwhich, in addition to attending to claimspresented by consumers, it also carries outpreliminary investigations that could resultin official sanctioning procedures.MAIN ACHIEVEMENTS'08In 2008, official proceedings were begunagainst 108 private schools thatevidenced alleged violations of theConsumer Protection Law and theFamily Economy Protection Law byrequiring advance pension paymentsor ordering the purchase of school supplies.Out of the 109 proceedings, 92were declared founded. It should benoted that cautionary measures wereimmediately ordered for the suspensionof undue charges in order to protectthe heads of household.Additionally, thanks to an agreementsigned with the Congress of the Republic,a Citizens Attention Service was establishedfor Consumer Protection issuesin the Legislative Building. This new officehas been created in addition to the otherfive that <strong>Indecopi</strong> has in different sectors ofLima in order to facilitate citizen services.These offices are located in La Victoria, LosOlivos, San Miguel, Villa El Salvador and atthe <strong>Jorge</strong> Chavez International Airport.As part of the World ConsumerRights Day celebration, <strong>Indecopi</strong> gavean “Award for Excellence in Service” toseveral companies who were selectedthrough surveys given to consumersand after evaluating their business behaviorreflected in a lack of complaints,for example, in their conciliatory attitude,or in their willingness to attend toand solve complaints.In 2008, the CPC also carried outoversight and dissemination campaigns,seeking to achieve transparent price informationin several markets in the capital,as well as truthfulness in the stated weightof products. THE OBJECTIVE OF THE INSOLVENCY PROCEDURES COMMISSION (CCO) is to facilitateand promote negotiations between creditors and debtors respecting private autonomy.Before negotiations, the CCO validates the claims of the creditors and defines who willparticipate in the proceedings. Finally, it defines the legality of the agreements.196,315]the total amount offines, in soles.CCO[13,987]the number of petitionsprocessed by the CCOINSOLVENCY PROCEDURES COMMISSIONre, the institution disclosed a series ofrecommendations that consumersshould take into consideration whenpurchasing a product or service.GOALS'09Implement the Consumer Registryto verify that suppliers thatuse call centers, phone call andcellular text message systemsor mass e-mailing to promoteproducts and services excludethe phone numbers and e-mailaddresses that have been incorporatedinto the Registry.Verify compliance with thenew regulations established inthe reform of the Consumer ProtectionLaw, without prejudice tothe monitoring that the CPC continuouslycarries out in its sphereof competence.The CPC verifies theinformation receivedby the consumer,and based on this, itdetermines which rightsthe consumer may claim.MAIN ACHIEVEMENTS'08The number of petitions processed betweenJanuary and December 2008 hasincreased by 13.40% in comparison tothe previous year.The average time currently registeredby the CCO to issue a pronouncementshows an increase in the speed of theCommission to process petitions initiatinginsolvency procedures. For 2008,this time has decreased by 37.64% withrespect to 2007. The average time forthe establishment of Creditors’ Meetingscalculated from January to December of2008 (169 days), presents a reduction of37.17% in comparison to the previousyear (269 days).The CCO and its Technical Secretaryparticipated in the preparation ofthe project modifying the General Lawof the Insolvency System (LegislativeDecree Nº 1050), which defines conceptsregarding the payment of recognizedcredits and has broadened thefield of action of the Commission onissues related to the supervision of theparties involved in the procedures.GOALS'09It should be mentioned that for 2009,the Insolvency Procedures Commissionhas proposed focusing on the resolutionof the petitions presented withinthe legal timeframe and increasing theinvestigation procedures in order to verifyviolations of the General Law of theInsolvency System.The average timecurrently registeredby the CCO to issue apronouncement showsan increase in the speedof the Commissionto process petitionsinitiating insolvencyprocedures.111
