7Support<strong>in</strong>g Young People <strong>in</strong> theChapter Bail Process7.12 ‘Special’ conditions may also be imposed on bail to ensure that an accused:surrenders him- or herself <strong>in</strong>to custody, does not commit an offence while on bail,does not endanger members of the public and does not <strong>in</strong>terfere with witnesses orotherwise obstruct the course of justice. 19 These conditions might <strong>in</strong>clude where theaccused person must live or restrictions upon where that person may go.7.13 The Bail Amendment Act 2010 (Vic) will commence no later than 1 January2011. 20 The Act repeals and replaces section 5 of the Bail Act 1977 (Vic), 21 whichcurrently governs the imposition of bail conditions. In addition to other changes,the Act alters the order <strong>in</strong> which conditions must be considered. 22 A court mustnow consider the conditions for release of an accused person on bail <strong>in</strong> thefollow<strong>in</strong>g order:• on his or her own undertak<strong>in</strong>g without any other condition• on his or her own undertak<strong>in</strong>g with conditions about conduct• with a surety or deposit, with or without conditions about conduct. 23Presence and role of an <strong>in</strong>dependent person dur<strong>in</strong>g the bail process7.14 In most circumstances, section 10 of the Bail Act 1977 (Vic) empowers a seniormember of the <strong>police</strong> force to grant bail to a person who has been arrestedand charged with a crim<strong>in</strong>al offence. When exercis<strong>in</strong>g that power <strong>in</strong> relation toa <strong>young</strong> person, the senior member of the <strong>police</strong> force must also comply withsection 346(7) and (8) of the CYF Act which provide that:(7) If a member of the <strong>police</strong> force <strong>in</strong>quires <strong>in</strong>to a case under section 10of the Bail Act 1977, a parent or guardian of the child <strong>in</strong> custody or an<strong>in</strong>dependent person must be present.(8) An <strong>in</strong>dependent person present <strong>in</strong> accordance with sub-section (7)may take steps to facilitate the grant<strong>in</strong>g of bail, for example, by arrang<strong>in</strong>gaccommodation. 247.15 Like section 464E of the Crimes Act, 25 the CYF Act does not describe the role ofthe parent, guardian or <strong>in</strong>dependent person <strong>in</strong> the bail hear<strong>in</strong>g. This lack of clarityaffects both the process of grant<strong>in</strong>g bail under section 346(7) and (8) of the CYFAct, 26 and act<strong>in</strong>g as the ‘other person’ <strong>in</strong> sign<strong>in</strong>g bail forms at the <strong>police</strong> stationunder section 346(10) of the CYF Act. 277.16 In an earlier report, 28 the Commission considered the obligations imposed bysection 346(7) of the CYF Act, 29 not<strong>in</strong>g that an <strong>in</strong>dependent person is requiredonly when <strong>police</strong> are mak<strong>in</strong>g the bail decision and not for hear<strong>in</strong>gs before abail justice. 30 In its earlier report, the Commission recommended that section346(7) and (8) of the CYF Act be amended so that the requirements also apply tohear<strong>in</strong>gs before bail justices. 31 A <strong>young</strong> person charged with a crim<strong>in</strong>al offencemust be brought before the Children’s Court, or a bail justice, with<strong>in</strong> 24 hours ofbe<strong>in</strong>g taken <strong>in</strong>to custody if not released with<strong>in</strong> this period unconditionally or by asenior member of the <strong>police</strong> force act<strong>in</strong>g pursuant to section 10 of the Bail Act. 327.17 Section 346(10) of the CYF Act is also relevant. It states:If, <strong>in</strong> the op<strong>in</strong>ion of the Court or bail justice or member of the <strong>police</strong> force, thechild does not have the capacity or understand<strong>in</strong>g to enter <strong>in</strong>to an undertak<strong>in</strong>gwith<strong>in</strong> the mean<strong>in</strong>g of the Bail Act 1977, the child may be released on bailif the child’s parent or some other person enters <strong>in</strong>to an undertak<strong>in</strong>g, <strong>in</strong>any amount which the Court or bail justice or member of the <strong>police</strong> forceth<strong>in</strong>ks fit, to produce the child at the venue of the Court to which thecharge is adjourned or the court to which the child is committed for trial. 33110Victorian Law Reform Commission – Support<strong>in</strong>g Young People <strong>in</strong> Police Interviews: F<strong>in</strong>al Report 21


7.18 Under section 346(10) of the CYF Act, 34 therole of the <strong>young</strong> person’s parent or ‘someother person’ is to act as surety for theaccused <strong>young</strong> person if the Children’s Court,bail justice or <strong>police</strong> officer believes that the<strong>young</strong> person is <strong>in</strong>capable of enter<strong>in</strong>g <strong>in</strong>to anundertak<strong>in</strong>g on their own. This person mustbe able to produce the child to a court on anom<strong>in</strong>ated date. 357.19 Enter<strong>in</strong>g <strong>in</strong>to an undertak<strong>in</strong>g <strong>in</strong> thesecircumstances means provid<strong>in</strong>g a guarantee <strong>in</strong>writ<strong>in</strong>g as a surety that the accused will appearbefore court at the next hear<strong>in</strong>g and agree<strong>in</strong>gto forfeit a sum of money if the accused failsto do so. 367.20 The reference <strong>in</strong> section 346(10) 37 to ‘someother person’ is not def<strong>in</strong>ed <strong>in</strong> the CYF Act andhas created some confusion about whetherthe <strong>in</strong>dependent person who was present forthe <strong>police</strong> <strong>in</strong>terview should act as this ‘otherperson’. While any person may take on thisresponsibility, it is <strong>in</strong>appropriate that the<strong>in</strong>dependent person present dur<strong>in</strong>g a <strong>young</strong>person’s <strong>police</strong> <strong>in</strong>terview should be expected torisk the consequences of act<strong>in</strong>g as surety if the<strong>young</strong> person does not answer bail.Current practice: <strong>in</strong>dependent personsand the bail processFacilitat<strong>in</strong>g the grant<strong>in</strong>g of bailCentral After Hours and Bail Placement Service7.21 DHS operates a scheme for facilitat<strong>in</strong>g thegrant<strong>in</strong>g of bail for <strong>young</strong> <strong>people</strong> under section346(7) and (8) of the CYF Act. 38 With<strong>in</strong> DHS,youth justice units and CAHABPS providesupport for <strong>young</strong> <strong>people</strong> who are subjectto bail processes. 7Support<strong>in</strong>g Young People <strong>in</strong> theChapter Bail Process7.22 CAHABPS is a service that <strong>young</strong> <strong>people</strong> aged between 10 and 18 years mayvoluntarily access when subject to bail processes. 44 The Victoria Police Manualrequires <strong>police</strong> to notify CAHABPS whenever remand of a <strong>young</strong> person is be<strong>in</strong>gconsidered and the <strong>young</strong> person is not legally represented before a bail justice. 45In 2009, CAHABPS responded to 550 callouts—an average of 46 per month. 467.23 The Victoria Police Manual provides that where a CAHABPS representative is to bepresent, that representative must be allowed access to the <strong>young</strong> person prior tothe bail hear<strong>in</strong>g. 47 In metropolitan areas, CAHABPS workers will attend the <strong>police</strong>station <strong>in</strong> person with<strong>in</strong> CAHABPS service times. 48 CAHABPS is available over thephone <strong>in</strong> rural areas. 497.24 CAHABPS representatives conduct an assessment of the <strong>young</strong> person’s suitabilityfor bail placement. 50 If placement is appropriate, the CAHABPS worker willplace the <strong>young</strong> person <strong>in</strong> suitable accommodation. 51 The CAHABPS workerwill <strong>in</strong>form the <strong>young</strong> person about the nature of the proceed<strong>in</strong>gs, their rightsand responsibilities, and what they can expect if placement <strong>in</strong> the community isconsidered suitable. 52 CAHABPS can also refer the <strong>young</strong> person to youth andfamily referral services. 537.25 The service operates not only <strong>in</strong> relation to hear<strong>in</strong>gs before a bail justice, butextends to locat<strong>in</strong>g appropriate accommodation for <strong>young</strong> <strong>people</strong> where <strong>police</strong>are not consider<strong>in</strong>g remand and are prepared to release the <strong>young</strong> person on bail,but the <strong>young</strong> person has no access to suitable accommodation. 547.26 The CYF Act does not stipulate who can be an <strong>in</strong>dependent person for bailpurposes. 55 Both the <strong>in</strong>dependent person present dur<strong>in</strong>g the <strong>young</strong> person’s <strong>police</strong><strong>in</strong>terview and the <strong>in</strong>dependent person present dur<strong>in</strong>g the bail process providesupport <strong>in</strong> the absence of a <strong>young</strong> person’s parent or guardian. However, thetwo roles are quite different, requir<strong>in</strong>g different skills. Despite this, the dist<strong>in</strong>ctionbetween the <strong>in</strong>terview and bail support roles is sometimes blurred <strong>in</strong> practice. 567.27 Views expressed dur<strong>in</strong>g consultations were that the <strong>in</strong>dependent person’s roleunder section 346 of the CYF Act 57 is one for CAHABPS workers, rather than<strong>in</strong>terview support persons, because of the function of f<strong>in</strong>d<strong>in</strong>g appropriateaccommodation for <strong>young</strong> <strong>people</strong>. 58Restrictions on CAHABPS’s service provisionLimitations on operat<strong>in</strong>g hours7.28 CAHABPS provides a service that takes new referrals from 5 pm until 3 am onweekdays and 9.30 am to 3 am on weekends and public holidays. 59 Dur<strong>in</strong>gconsultation, the Commission heard that difficulties sometimes arise <strong>in</strong> the hoursoutside of CAHABPS’s service times. However, CAHABPS notes that there arevery few <strong>young</strong> <strong>people</strong> subject to bail hear<strong>in</strong>gs outside of its service times. 60 TheCommission was told that <strong>in</strong> these circumstances, <strong>police</strong> sometimes hold the <strong>young</strong>person until court opens at 9 am rather than proceed<strong>in</strong>g with a bail justice hear<strong>in</strong>g. 617.29 If a <strong>young</strong> person is arrested outside of CAHABPS’s service times, someone otherthan a CAHABPS worker may be asked to fill this ‘gap’, such as the <strong>in</strong>dependentperson present for <strong>police</strong> question<strong>in</strong>g of a <strong>young</strong> person under section 464E ofthe Crimes Act. 62 A non-CAHABPS <strong>in</strong>dependent person is placed <strong>in</strong> a challeng<strong>in</strong>gposition when required to facilitate bail without the clear guidel<strong>in</strong>es or access tostatutory services that a CAHABPS worker has access to. CAHABPS notes that<strong>in</strong>dependent persons who are present <strong>in</strong> <strong><strong>in</strong>terviews</strong> do not have the necessaryqualifications to facilitate bail or f<strong>in</strong>d bail accommodation. 63 A number of non-CAHABPS <strong>in</strong>dependent persons also expressed concerns about facilitat<strong>in</strong>g bailunder section 346(8) of the CYF Act. 64 Specific concerns are discussed below. 65112Victorian Law Reform Commission – Support<strong>in</strong>g Young People <strong>in</strong> Police Interviews: F<strong>in</strong>al Report 21


7Support<strong>in</strong>g Young People <strong>in</strong> theChapter Bail Process7.34 The YRIPP Independent Person Procedure Manual (YRIPP Manual) provides thatif CAHABPS is <strong>in</strong> attendance, the YRIPP volunteer is not required to stay for thebail hear<strong>in</strong>g and ‘will have fulfilled the [<strong>in</strong>dependent person] role at this time’. 76The manual notes that YRIPP volunteers may stay if they are asked to by the<strong>young</strong> person, but may only do this if the CAHABPS representative agrees. 77 TheCommission heard <strong>in</strong> consultation that sometimes CAHABPS asks the <strong>in</strong>terview<strong>in</strong>dependent person to leave, but that bail justices are sometimes adamant thatthey stay. 787.35 The YRIPP Manual also states that the YRIPP <strong>in</strong>dependent person should ask the<strong>police</strong> if they have contacted CAHABPS when they plan to contact a bail justice andhave the <strong>young</strong> person remanded <strong>in</strong> custody. 79 If <strong>police</strong> do not contact CAHABPS,CAHABPS will accept a referral directly from the YRIPP <strong>in</strong>dependent person. 807.36 The YRIPP Manual also provides that the YRIPP <strong>in</strong>dependent person has a roledur<strong>in</strong>g the bail hear<strong>in</strong>g outside CAHABPS’s operat<strong>in</strong>g hours or where CAHABPScarries out an assessment over the phone <strong>in</strong> rural areas. 81 Where no CAHABPSrepresentative is present, the YRIPP <strong>in</strong>dependent person should expla<strong>in</strong> the bailand remand process to the <strong>young</strong> person. 827.37 The YRIPP Manual provides that the YRIPP <strong>in</strong>dependent person must state thatthey are not there to advocate for the <strong>young</strong> person or provide an op<strong>in</strong>ion onthe grant<strong>in</strong>g of bail, but to assist the <strong>young</strong> person to understand the process. 83Where a CAHABPS representative is absent, the YRIPP Manual states that the<strong>in</strong>dependent person can assist <strong>in</strong> arrang<strong>in</strong>g accommodation by mak<strong>in</strong>g a referralto accommodation services. 84 The Commission understands that this <strong>in</strong>tersectionof the roles of CAHABPS and YRIPP is sometimes highly problematic <strong>in</strong> practice. 85Sign<strong>in</strong>g bail condition forms7.38 When the <strong>police</strong> or a bail justice grant a <strong>young</strong> person bail, a number ofdocuments must be completed, <strong>in</strong>clud<strong>in</strong>g an undertak<strong>in</strong>g to answer bail. 86 If a<strong>police</strong> officer, bail justice or the Children’s Court is not satisfied that the <strong>young</strong>person has sufficient capacity or understand<strong>in</strong>g to enter <strong>in</strong>to an undertak<strong>in</strong>g ontheir own, their parent or ‘some other person’ must sign the bail undertak<strong>in</strong>g. 877.39 The documents that are required, who may sign them and where they areto be signed are matters of considerable confusion, as highlighted <strong>in</strong> theCommission’s earlier report on the review of the Bail Act 1977 (Vic). 88 Police<strong>in</strong>volved <strong>in</strong> consultation for this report expressed different views about whetheran <strong>in</strong>dependent person who was present for the <strong>in</strong>terview could sign bail forms. 897.40 As discussed, be<strong>in</strong>g a surety for bail <strong>in</strong>volves significant responsibilities andobligations. For example, a surety may have to sign an undertak<strong>in</strong>g that theaccused will appear at the next court hear<strong>in</strong>g and not breach the conditions oftheir bail, as well as agree<strong>in</strong>g to forfeit a nom<strong>in</strong>ated amount of money if theaccused person fails to answer bail. 90 While a parent may be will<strong>in</strong>g and able tomake such promises on behalf of a <strong>young</strong> person, an <strong>in</strong>dependent person is illequipped to so. 917.41 YRIPP tra<strong>in</strong>s its volunteers not to sign any bail forms under section 346(10) ofthe CYF Act. 92 The YRIPP manual states that ‘Under no circumstances should aYRIPP Independent Person sign [the] undertak<strong>in</strong>g of bail. This would make youresponsible for ensur<strong>in</strong>g the <strong>young</strong> person’s attendance at court’. 93114Victorian Law Reform Commission – Support<strong>in</strong>g Young People <strong>in</strong> Police Interviews: F<strong>in</strong>al Report 21


7.42 Dur<strong>in</strong>g consultations, there was considerable confusion as to who could sign theform <strong>in</strong> the absence of a parent or guardian. Some YRIPP <strong>in</strong>dependent personswere uncerta<strong>in</strong> about what was required of them <strong>in</strong> these circumstances. 94 Somestated that they had signed bail forms <strong>in</strong> the past when asked to do so and thenarranged for transport for the <strong>young</strong> person to get home. 95 Others felt this wasentirely <strong>in</strong>appropriate, as the YRIPP <strong>in</strong>dependent person would be unable toensure that the <strong>young</strong> person would appear before court when required. 967.43 It is CAHABPS’s policy that their workers do not sign bail forms. 97 CAHABPS notesthat when a <strong>young</strong> person is <strong>in</strong> out-of-home care, it would most likely be theplacement coord<strong>in</strong>ator or someone not affiliated with CAHABPS who signs. 987.44 A number of YRIPP <strong>in</strong>dependent persons stated <strong>in</strong> consultations that theyhad signed bail forms as a witness only, and had clearly noted on the formthat they were sign<strong>in</strong>g only as a witness and not <strong>in</strong> the capacity of the <strong>young</strong>person’s parent. 99 Police confirmed this practice, with participants <strong>in</strong> one <strong>police</strong>consultation stat<strong>in</strong>g that there should be a place on the bail form for the<strong>in</strong>dependent person to sign as a witness and confirm that the <strong>young</strong> personunderstood what was happen<strong>in</strong>g. 100Commission’s views7.45 There is significant uncerta<strong>in</strong>ty surround<strong>in</strong>g the role of an <strong>in</strong>dependent personwho is present when a bail decision is be<strong>in</strong>g made <strong>in</strong> relation to a <strong>young</strong> person<strong>in</strong> custody. This uncerta<strong>in</strong>ty is directly attributable to the lack of clarity <strong>in</strong> therelevant parts of section 346 of the CYF Act. 1017.46 In practice, some <strong>in</strong>dependent persons who attend <strong>police</strong> stations to assist a<strong>young</strong> person <strong>in</strong> custody dur<strong>in</strong>g <strong>police</strong> question<strong>in</strong>g are asked to play the roleof the <strong>in</strong>dependent person dur<strong>in</strong>g the bail process. Some of these <strong>people</strong> havenot been tra<strong>in</strong>ed to assist with the bail process and do not have access to<strong>in</strong>formation about emergency accommodation facilities that may be an importantconsideration when bail decisions are made. In addition, some <strong>people</strong> are unfairlyasked to act as a surety for a <strong>young</strong> person or give an undertak<strong>in</strong>g on their behalf.7.47 It is apparent that while the hours of the CAHABPS’s service are restricted, gapswill cont<strong>in</strong>ue to exist when no appropriate person is available to facilitate bail for<strong>young</strong> <strong>people</strong>. 7Support<strong>in</strong>g Young People <strong>in</strong> theChapter Bail Process7.49 The <strong>in</strong>dependent person’s role under section346(7) and (8) of the CYF Act 107 requiresfurther consideration. The requirement<strong>in</strong> section 346(10) 108 that ‘some otherperson’ give an undertak<strong>in</strong>g that a <strong>young</strong>person will answer bail when the <strong>young</strong>person does not have the capacity to givethe undertak<strong>in</strong>g, and there is no parent orguardian available to do so, also needs to beclarified.
