Section 1.1 Incorporation<strong>WESTON</strong> <strong>TOWN</strong> <strong>CHARTER</strong>ARTICLE 1INCORPORATION AND GENERAL POWERSAll the inhabitants dwelling within the territorial limits <strong>of</strong> the <strong>Town</strong> <strong>of</strong><strong>Weston</strong>, as presently constituted, shall continue to be a body politic andcorporate under the name <strong>of</strong> the "<strong>Town</strong> <strong>of</strong> <strong>Weston</strong>", in this Charter called"The <strong>Town</strong>". As such, it shall have perpetual succession and may hold andexercise all powers and privileges heret<strong>of</strong>ore exercised by the <strong>Town</strong> and notinconsistent with the provisions <strong>of</strong> this Charter. It shall also have theadditional powers and privileges herein conferred, and all powers andprivileges conferred upon towns under the general law <strong>of</strong> the State <strong>of</strong>Connecticut.Section 1.2 Rights and ObligationsAll rights in and to property, both real and personal, all rights <strong>of</strong>action, and rights <strong>of</strong> every description, and all securities and liens, vested inthe <strong>Town</strong> as <strong>of</strong> the date this Charter shall take effect, are continued. The<strong>Town</strong> shall continue to be liable for its debts and obligations. Nothing hereinshall be construed to affect the right <strong>of</strong> the <strong>Town</strong> to collect any assessment,charge, debt or lien.If, prior to the effective date <strong>of</strong> this Charter, any contract has beenentered into by the <strong>Town</strong>, or any bond or undertaking has been given by or infavor <strong>of</strong> the <strong>Town</strong> which contains provisions that the same may be enforcedby any <strong>of</strong>fice or agency therein named which is hereby abolished, suchcontracts, bonds or undertakings shall continue in full force and effect. Thepowers conferred and the duties imposed with reference to the same uponany such <strong>of</strong>fice or agency shall, except as otherwise provided in this Charter,thereafter be exercised and discharged by the Board <strong>of</strong> Selectmen <strong>of</strong> the<strong>Town</strong>.Section 1.3 General Grant <strong>of</strong> PowersIn addition to all powers granted to towns under the Constitution andgeneral law <strong>of</strong> the State <strong>of</strong> Connecticut, the <strong>Town</strong> shall have all powersspecifically granted by this Charter and all powers fairly implied in or incidentto the powers expressly granted, and all other powers incident to themanagement <strong>of</strong> the property, government and affairs <strong>of</strong> the <strong>Town</strong>, includingthe power to enter into contracts with the United States or any federalagency, the State <strong>of</strong> Connecticut or any political subdivision there<strong>of</strong> forservices and the use <strong>of</strong> facilities, the exercise <strong>of</strong> which is not expresslyforbidden by the Constitution and the general laws <strong>of</strong> the State <strong>of</strong>Connecticut.The enumeration <strong>of</strong> particular powers in this and any other article <strong>of</strong>this Charter shall not be construed as limiting this general grant <strong>of</strong> power, butshall be considered as an addition thereto.Section 1.4 DefinitionsAs used in this Charter:(a) "Agency" means any elective or appointive board, commission,<strong>of</strong>ficer or committee <strong>of</strong> the <strong>Town</strong>.(b) "Qualified voters" means persons who are eligible to vote at<strong>Town</strong> Meetings as defined in the General Statutes <strong>of</strong> theState <strong>of</strong> Connecticut.*(c) "Resident Electors" means persons eligible to vote in the national,state and town elections under the Constitution <strong>of</strong> the UnitedStates and the State <strong>of</strong> Connecticut and under the generallaw <strong>of</strong> the State <strong>of</strong> Connecticut.(d) "Voting List" means the Registrars <strong>of</strong> Voters' latest <strong>of</strong>ficial list.(e) The "General Statutes" means the General Statutes <strong>of</strong>Connecticut, revision <strong>of</strong> 1958 and any amendments thereto.(f) "General Law" means all applicable laws including (withoutlimitation) the Constitutions <strong>of</strong> the United States and <strong>of</strong> theState <strong>of</strong> Connecticut, General Statutes, Special Acts, thisCharter, ordinances and regulations, and interpretations <strong>of</strong>the foregoing by courts <strong>of</strong> competent jurisdiction.* At present the General Statutes (Sec. 7-6) provide in pertinent part asfollows: "…any person who is an elector <strong>of</strong> such town may vote and anycitizen <strong>of</strong> the age <strong>of</strong> eighteen years or more who, jointly or severally, is liableto the town, …for taxes assessed against him on an assessment <strong>of</strong> not lessthan one thousand dollars on the last-completed grand list <strong>of</strong> such town, …orwho would be so liable if not entitled to an exemption…may vote…".-2-
