D R A F T<str<strong>on</strong>g>C<strong>on</strong>cept</str<strong>on</strong>g> <str<strong>on</strong>g>Paper</str<strong>on</strong>g>2 nd <str<strong>on</strong>g>ARF</str<strong>on</strong>g> <str<strong>on</strong>g>Seminar</str<strong>on</strong>g> <strong>on</strong> <strong>UNCLOS</strong>To be held 2013 – 2014This paper outlines a proposal by Australia and the Philippines <str<strong>on</strong>g>for</str<strong>on</strong>g> the 2 nd <str<strong>on</strong>g>ARF</str<strong>on</strong>g> <str<strong>on</strong>g>Seminar</str<strong>on</strong>g> <strong>on</strong>the UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Law of the Sea (<strong>UNCLOS</strong>). The 1 st <str<strong>on</strong>g>ARF</str<strong>on</strong>g> seminar <strong>on</strong> <strong>UNCLOS</strong> washeld <strong>on</strong> 8 – 9 March 2011, in Manila.The 2 nd <str<strong>on</strong>g>ARF</str<strong>on</strong>g> seminar aims to c<strong>on</strong>tinue building <str<strong>on</strong>g>ARF</str<strong>on</strong>g> Members’ understanding of keyprovisi<strong>on</strong>s of <strong>UNCLOS</strong> and its <strong>on</strong>going benefits <str<strong>on</strong>g>for</str<strong>on</strong>g> regi<strong>on</strong>al maritime security. <str<strong>on</strong>g>ARF</str<strong>on</strong>g>participants will have the opportunity to study with and learn from expert speakers, andexchange views <strong>on</strong> how <strong>UNCLOS</strong> can help promote regi<strong>on</strong>al maritime security ef<str<strong>on</strong>g>for</str<strong>on</strong>g>ts.The general objective of the 2 nd <str<strong>on</strong>g>ARF</str<strong>on</strong>g> seminar will be c<strong>on</strong>sistent with the <str<strong>on</strong>g>ARF</str<strong>on</strong>g> Hanoi Plan ofActi<strong>on</strong>, which states that “the <str<strong>on</strong>g>ARF</str<strong>on</strong>g> should serve as a regi<strong>on</strong>al <str<strong>on</strong>g>for</str<strong>on</strong>g>um <str<strong>on</strong>g>for</str<strong>on</strong>g> maritime securityissues that promotes and enhances maritime domain awareness, and develop c<strong>on</strong>crete andeffective regi<strong>on</strong>al resp<strong>on</strong>ses to maritime security challenges”. The 2 nd <str<strong>on</strong>g>ARF</str<strong>on</strong>g> seminar will alsoc<strong>on</strong>tribute to the ef<str<strong>on</strong>g>for</str<strong>on</strong>g>ts and measures of the <str<strong>on</strong>g>ARF</str<strong>on</strong>g> Work Plan <strong>on</strong> Maritime Security.<str<strong>on</strong>g>Seminar</str<strong>on</strong>g> FormatThe seminar will be divided into five main sessi<strong>on</strong>s, where expert speakers and participantswill focus <strong>on</strong> the following issues:1. <strong>UNCLOS</strong> - basic c<strong>on</strong>ceptsMaritime z<strong>on</strong>es Rights and resp<strong>on</strong>sibilities in the exclusive ec<strong>on</strong>omic z<strong>on</strong>e Rights and resp<strong>on</strong>sibilities <strong>on</strong> the high seasMaritime boundary delimitati<strong>on</strong><strong>UNCLOS</strong> Instituti<strong>on</strong>s: the Commissi<strong>on</strong> <strong>on</strong> the Limits of the C<strong>on</strong>tinental Shelf2. <strong>UNCLOS</strong> - Implementati<strong>on</strong> and PracticeFreedom of navigati<strong>on</strong>Naval perspectivesRecent ICJ jurisprudence: Nicaragua v Colombia3. Current issues <str<strong>on</strong>g>for</str<strong>on</strong>g> <strong>UNCLOS</strong>Biodiversity Bey<strong>on</strong>d Nati<strong>on</strong>al Jurisdicti<strong>on</strong> (BBNJ)Speakers in these subjects will (a) cite and explain the relevant provisi<strong>on</strong>s of the C<strong>on</strong>venti<strong>on</strong>,(b) identify possible opportunities and challenges, (c) discuss examples of initiatives in theseareas. Delegati<strong>on</strong>s may be identified as key discussants in each area.Participati<strong>on</strong>All <str<strong>on</strong>g>ARF</str<strong>on</strong>g> members will be invited to nominate participants to attend the seminar. Participantsfrom <str<strong>on</strong>g>ARF</str<strong>on</strong>g> member countries could include officials and specialists from agencies that dealwith internati<strong>on</strong>al maritime issues, including, but not limited to, <str<strong>on</strong>g>for</str<strong>on</strong>g>eign affairs, trade,resources, envir<strong>on</strong>ment, fisheries and defence.Representatives of internati<strong>on</strong>al organisati<strong>on</strong>s, universities and think-tanks may be invited togive presentati<strong>on</strong>s to the seminar.OutcomeThe outcome and recommendati<strong>on</strong>s of the seminar will be reported to the 2014 <str<strong>on</strong>g>ARF</str<strong>on</strong>g>ministerial meeting.Administrative arrangementsThe seminar will be two days in durati<strong>on</strong> and held sometime in the sec<strong>on</strong>d half of 2013 orthe first quarter of 2014. The meeting will be held in English.The Philippines will host the meeting and the Philippines and Australia will co-chair themeeting.
