PURPOSE OF THIS ADVERT1.1 <strong>Housing</strong> <strong>Authority</strong> wishes to announce the sale of 115 apartments, 8 maisonettes and 98garages in the localities of Buġibba, Kirkop, Mellieħa, Mġarr, Mrieħel, Mtarfa, Naxxar, Paola,Pembroke, Qawra, Qrendi, San Ġwann, Tarxien, Zejtun and Zurrieq. Prices are subsidised upto 25%.2. DEFINITION OF TERMSThroughout this advert:-2.1. unless otherwise stated, the masculine shall imply the feminine and the feminine shall imply themasculine and the singular shall imply the plural and the plural shall imply the singular;2.2. the word ‘applicant’ shall imply those who apply under this Advert and in the case of marriedcouples who are not separated or divorced and engaged couples, means the married couples insolidum and the engaged couples in solidum;2.3. the words “capital assets: include:(a)Banks Accounts, fixed deposits and funds:Applicants must sign a form giving their consent to the banks to forward thisinformation to the <strong>Authority</strong>;(b)Businesses and Profits:


These will be verified through the VAT Department and the Trading LicenceDepartment;(c)Shares:These will be verified through <strong>Malta</strong> Financial Services <strong>Authority</strong>.(d)Land and property:These will be verified by the <strong>Authority</strong> through the Public Registry and the InlandRevenue. In the case of property being used for the business from which the applicantearns his main income, the first thirty five thousand Euro (€35,000) of such propertywill not be included to the value of the assets.2.4. unless otherwise stated, the word ‘advert’ means ‘Advert Number 76 – <strong>Darek</strong> Facli’ whichappears in the Government Gazette of the 8 th May 2012;2.5. unless otherwise stated, the word ‘<strong>Authority</strong>’ means the ‘<strong>Housing</strong> <strong>Authority</strong>’;2.6. the words ‘bank and financial institution’ have the same definition given to it in the Act ofCommercial Banking (Act No XV of 1994);2.7. the word ‘beneficiary’ means every person who benefits under this Advert;2.8. the terms ‘aggregate annual gross income’ include:-(a)the gross income from any occupation, pay and/or salary, overtime, pension and/or othersocial benefits (excluding children’s allowance) earned by the applicants during thebasic preceding calendar year. When the application is made by two applicants, thegross income of both applicants is taken into consideration. But, in case when one of thejoint applicants has worked during part of the said basis year only and is gainfullyemployed on the date of application, a projected income for that particular year shall beworked out in each case;(b)the applicant’s income during the basic calendar year from capital assets such as; bankdeposits, stocks, shares, rents, investments in commercial enterprises, other investmentsin property, including capital gains;(c)for the purpose of this advert, the aggregate annual income of the applicants shall be theincome of the applicant/s determined in accordance to sub-clauses (a) and (b) of Clause


2.8. Yet the <strong>Authority</strong> shall not be bound to accept any declaration, documents orinformation given to it by the applicants or beneficiaries under this Advert, should itreasonably consider such declaration, documents or information incorrect or untrue;From the gross annual income of a separated/divorced person any amount paid to theother part as alimony will be deducted. This amount will be deducted after a documentis provided, signed by the lawyer of the party paying the alimony showing the amountdue, with a declaration that the official amount as declared in the Deed of Separation isin fact being paid.The Chairman of the <strong>Authority</strong> may refuse to accept any declaration of income of theapplicants if, in the <strong>Authority</strong>’s absolute discretion decides that this is incorrect oruntrue.(d)In this case the <strong>Authority</strong> is to refer the matter to the Independent Revisory Board of the<strong>Housing</strong> <strong>Authority</strong> appointed by the <strong>Housing</strong> <strong>Authority</strong> Board, in order to establish theincome of the applicants/beneficiaries. The decision of the Independent Revisory Boardwill be final and shall bind both the <strong>Authority</strong> and the applicants/beneficiaries. Theapplicants/ beneficiaries affected by this provision have the right to make writtenobjections to the Independent Revisory Board.2.9. the word ‘disability’ means a physical and/or intellectual disability as well as, mental and/orphysical chronic illnesses as certified by the National Commission for Persons with Disability;2.10. the word ‘disabled’ means a persons with a disability as defined in this Advert and who is inpossession of a Special Identification Card issued by the National Commission for Persons withDisability;2.11. the word ‘family’ includes wife or husband of applicant who are not separated/divorced and theoffspring of the applicant under twenty four (24) years of age (any age in case of disability),and/or fostered children by applicant, under twenty four (24) years of age (any age in case ofdisability) who are not married and live with them;2.12. the word ‘finished’ means the property will be completed except for the bathroom;2.13. the word ‘financial institutions’ has the same definition as defined in Clause 2.6;2.14. the term ‘preliminary agreement’ means an agreement entered into between the <strong>Housing</strong><strong>Authority</strong> as the vendor and the beneficiaries/applicants as the purchasers regarding theeventual sale/purchase of property. On the preliminary agreement, 10% deposit on account ofthe price is paid to the <strong>Housing</strong> <strong>Authority</strong> whereas the remaining 90% of the purchase price is tobe paid to the <strong>Housing</strong> <strong>Authority</strong> on the final deed of sale, which deed is to be signed within


(six) 6 months from date of preliminary agreement. Stamp duty and all expenses related toand ancillary to the deed are to be paid by the purchasers on the final deed of sale.2.15. the term ‘registered preliminary agreement’ means an agreement entered into between the<strong>Housing</strong> <strong>Authority</strong> as the vendor and the beneficiaries/applicants as the purchasers regardingthe eventual sale/purchase of property. On the registered preliminary agreement, 15% depositon account of the price is paid to the <strong>Housing</strong> <strong>Authority</strong> whereas the remaining 85% of thepurchase price is to be paid to the <strong>Housing</strong> <strong>Authority</strong>, without interests, by means of monthlypayments within a 20 year period. After payment of the total price, the parties obligethemselves to appear for the final deed of sale. Stamp duty at the rate of 1% is payable by thepurchasers on date of the registered preliminary agreement. The remaining balance of stampduty due and all expenses related to and ancillary to the deed are to be paid by the purchasers onthe final deed of sale;2.16. the term ‘final deed’ means the notarial deed by which the <strong>Housing</strong> <strong>Authority</strong> transfers to thebeneficiaries/applicants the ownership of the immovable property allocated to them by virtue ofthis Advert, or in the case of immovable property in respect of which the <strong>Housing</strong> <strong>Authority</strong> hasnot yet attained legal title, the notarial deed by which the <strong>Housing</strong> <strong>Authority</strong> promises totransfer the ownership of the immovable property allocated to them by virtue of this Advert,once it acquires the legal title thereof;2.17. the term ‘semi-finished’ means the property will be built in shell form whilst the façade, theroof, the external apertures, the rain water system and the drainage system together with thecommon parts wil be finished or installed.2.18. the terms ‘basic year’ means the year 2011;2.19. the word ‘shell form’ depicts the condition of the property immediately after completion of theconstruction activity but before the installation of building services, flooring, plastering, fixturesand any other addition to the property normally referred to as finishing;3. VIEWING OF PROPERTY, PLANS AND APPLICATION FORMS3.1. The property listed in Schedule B shall be open for viewing to the public on Saturday 12 th Mayand Sunday 20 th May between 9:00am and 6:00pm.3.2. The offices of the <strong>Housing</strong> <strong>Authority</strong> will also be open during the dates and hours mentionedabove, from where the sale of the applications for these premises will take place. A CD withthe plans of the property will be distributed together with the application forms and otherconditions. <strong>Housing</strong> <strong>Authority</strong> representatives will assist applicants in their application.


(c)have never benefited from a premises issued for sale by this <strong>Authority</strong> by means of aLegal Notice or any assistance under what used to be known as the "Home OwnershipScheme", from a repair scheme or interest subsidy scheme, “Right to Buy” or a Schemewhich encourages tenants to become owner occupiers by the Department of Social<strong>Housing</strong>, Lands Department or other parastatal bodies and local Authorities for theencouragement of home ownership. However in those cases where, in the absolutediscretion of the <strong>Authority</strong>, the applicant has not in fact benefitted or such subsidyenjoyed was fully refunded, the <strong>Authority</strong> will have the right to accept and process theapplication;(d)have an aggregate annual gross income not exceeding the sum of:Category A: €40,000;Category B: €40,000;Category C: €25,000.An income which exceeds these limits would automatically disqualify an applicant andwould affect one’s eligibility to qualify for the purchase of a premises under this advert.The income will be calculated as per Clause 2.8;(e)from a period of one (1) year prior the date of the first publication of this Advert up tillthe date of the Preliminary Agreement, applicants do not have in their possession capitalassets exceeding:Category A: €40,000;Category B: €40,000;Category C: €25,000;Any overriding of the above amounts in capital assets, would automatically affect one’seligibility to qualify for the purchase of a premises under this advert. Assets will becalculated and indicated in Clause 2.3;(f)from a period of one (1) year prior the date of the first publication of this Advert in theGovernment Gazette up till the date of the preliminary agreement under this Advert, theapplicant:


(i) did not have immovable unbuilt property either in whole or in part ownership, eitheron their own or in partnership, on absolute ownership or on perpetual emphyteusisand on which a building permit for habitation purposes has been issued or can beissued by the <strong>Malta</strong> Environment and Planning <strong>Authority</strong>;(ii) did not have in full ownership or in part ownership, either alone or together withothers, premises suitable for habitation purposes or on perpetual emphyteusis or ontemporary emphyteusis of more than forty (40) years duration from date of originalconstitution of the emphyteutical grant of the said temporary emphyteusis;(iii)did not possess holdings or shares in any commercial body which after the date ofthe first publication of this Advert in the Government Gazette has immovableproperty or as mentioned in sub-paragraphs 4.3 (f) (i) & (ii);(iv) Are not parties in a preliminary agreement, which is still valid, to purchase and sellan immovable property.4.4. The <strong>Housing</strong> <strong>Authority</strong> shall have the right to conduct the necessary verifications regarding theapplicants covering the last three years prior date of this advert, and it also reserves the right inat its absolute discretion to disqualify applicants if is results that during the period mentionedherein, these applicants have sold their property and consequently they have acquired capitalwhich would have otherwise disqualified them and this notwithstanding the fact that said capitalis not yet evident from the verifications conducted.5. VALIDITY OF THE APPLICATION5.1. To be valid the application must satisfy the following requirements:(a)the application must be made on the prescribed form and must be duly and completelyfilled;(b)the application must be signed by all applicants;(c)the application must be personally presented by the applicant, together with allnecessary documents (this is not applicable in case of disabled applicants);(d)the application submitted by a married but separated/divorced person or by a personwhose civil status has been changed after the marriage must be accompanied by anauthenticated deed of separation or by a Final Decree of the Competent Court.


5.2. After the closing date of the applications no other documents and/or additional informationwhich was not included with the documentation and/or information submitted with theapplication form will be accepted.5.3 Applications containing false or incorrect information may be disqualified at the sole and finaldiscretion of the <strong>Authority</strong> and this at any time even after the premises has been allocated underthis advert. The <strong>Authority</strong> shall have the right to request a rescission and a refund of any subsidyand/or grant if at any time it results that the beneficiary qualifies for any assistance due toinformation which results to be false and/or incorrect. This shall come into affect after the<strong>Housing</strong> <strong>Authority</strong> shall have verified the veracity of the case. And this without prejudice to anyaction for damages and/or action of a criminal nature which may be taken by the <strong>Authority</strong>.5.4 The applicants shall be required to give their consent to the <strong>Authority</strong> so that the latter can obtainany necessary information from third parties regarding any assets appertaining to the applicantand all this at the sole expense of the same applicant.6. ALLOCATION OF UNITS6.1. The premises issued under this advert will be allocated as follows:Category A 46%Category B 46%Category C 8%6.2. Under each category, the <strong>Authority</strong> first allocates up to 10% of the units which are reserved toapplicants who either themselves or any member of their family (who resides with them) has aphysical or intellectual disability as well as persons who are suffering or suffered from chronicmental illness and who are in possession of a special I.D. Card issued by the NationalCommission for Persons with a Disability. If there are more applicants exceeding the amountreserved for disabled persons, those disabled persons who have not been allocated a unit willcompete with the other applicants according to the number of points attained by them.6.3. The units will be allocated according to the category and under the points system as detailed inSchedule C.7. LISTS7.1. A list of all applications received shall be exhibited on the Notice Board of the <strong>Housing</strong><strong>Authority</strong> at 22, Pietro Floriani Street, Floriana, and on the Notice Board of the <strong>Housing</strong><strong>Authority</strong> at 25, Enrico Mizzi Street, Victoria Gozo, in case of any applicants from Gozo.


7.2. Applicants whose names do not appear on the said lists should write, on the prescribed form, tothe Chairman of the <strong>Housing</strong> <strong>Authority</strong> Board. Any representation in this respect is to be madein writing, addressed to the Chairman and delivered by hand at the <strong>Housing</strong> <strong>Authority</strong> up toseven (7) working days from the publication of the said lists.7.3. As soon as the necessary processing work has been completed a list of all valid and invalidapplications will be exhibited on the Notice Boards of the <strong>Housing</strong> <strong>Authority</strong>.7.4. Interested persons will be entitled to object in writing on a prescribed form which may beobtained from the <strong>Housing</strong> <strong>Authority</strong> regarding the points given to them and any other decisiontaken by the <strong>Authority</strong>. Any objection should be addressed to the Chairman and delivered byhand at the <strong>Housing</strong> <strong>Authority</strong> up to five (5) working days from the publication of the said lists.7.5. Objection forms can be obtained from the <strong>Authority</strong>. These will be accepted during theindicated period and no other objection will be accepted after the indicated period.7.6. The amount of twenty five Euro (€25) should be attached to this objection, as administrationcharge. No objection will be considered without this payment. This amount will be refundedonly and when the <strong>Housing</strong> <strong>Authority</strong> Independent Revisory Board studies and accepts theobjection made by the applicants.7.7. The <strong>Housing</strong> <strong>Authority</strong> shall draw up lists of names of applicants (Reserve Lists) for these samepremises and garages so that those premises and garages which are either refused by applicantswho are chosen first will be offered to applicants in reserve. Reserve Lists will be compiled onthe order of merit according to the points awarded to the applicants as indicated in Schedule Cand shall remain valid for a period of six (6) months from the date of their publication.However this period can be changed according to the discretion of the <strong>Housing</strong> <strong>Authority</strong>.7.8. Those persons whose names appear on these Reserve Lists shall be entitled to apply for anyadvert issued by the <strong>Housing</strong> <strong>Authority</strong>, however, in the event of their benefiting from otherapplications, their names shall be automatically deleted from these Reserve Lists.7.9. However the <strong>Authority</strong> shall reserve the right that immovable property, which has not beentaken up by qualifying original applicants, is retained by the <strong>Authority</strong> so as to dispose of theseas the <strong>Authority</strong> deems to be necessary.7.10 In those cases where applicants under the same category obtain the same amount of points, the<strong>Authority</strong> reserves the right to hold a ballot in public in order to establish the order of meritamongst those applicants who obtained the same amount of points.


(iii)The beneficiary purchasing the immovable property shall be obliged to:(1) within two (2) years from the date when he is given possession of the immovableproperty which is in shell form/semi-finished; or(2) within six (6) months from the date when he is given possession of theimmovable property which is in a finished state, and in case of engaged coupleswithin two (2) years;commences to reside in the immovable property as his ordinary residence andcontinues to do so for at least five (5) years from when the beneficiary startedresiding in the immovable property. It is being established that the beneficiary isconsidered to have started living in the premises from the date that his name appearsin the Electoral Register. He also binds himself, that in the same period stated above,gives vacant possession of the premises he used to live in to the <strong>Housing</strong> <strong>Authority</strong>if the property is burdened by a Requisition Order, if the property is either theproperty of the Government, the <strong>Housing</strong> <strong>Authority</strong>, the Joint Office or the propertyof any other parastatal entity so that this property will be used according to thepolicy of the <strong>Housing</strong> <strong>Authority</strong>. He also binds himself not to apply for the issue ofDecontrol Certificate on the premises occupied by him in date of application. Incase that the beneficiary fails to observe these obligations, the deed will be rescindedipso jure and the beneficiary will not have any right for the compensation for theimprovements which he carries out in the premises and has to refund the <strong>Housing</strong><strong>Authority</strong> all subsidies enjoyed under this Advert or under any title in connectionwith the premises in question.(iv) During the said period of five (5) years, the beneficiary cannot dispose of thisimmovable property by title inter vivos, by real title as well as by personal title. Thebeneficiary shall also oblige himself and/or his successor in title (unless he does nottransfer the immovable property by real title) not to lease the immovable property orallow third parties to occupy the immovable property under any title even if bygratuities or by mere tolerance.However, in case of immovable property in shell form or semi-finished thebeneficiary shall oblige himself to carry out the necessary works, so as to avoid anydamages that could result to the overlying and/or underlying and/or adjacentproperty within three (3) months from the date of possession of property. Thebeneficiary who has been granted possession of the immovable property shall beresponsible for the payment of any damages caused to third parties and this notwithstanding that the deed of transfer has not as yet been published.In the eventuality that the beneficiary fails to move into and/or to continue residingin the immovable property sold to him, or in the eventuality that the immovableproperty is no longer utilized by the beneficiary for his residential purpose, thebeneficiary has to pay back the entire subsidy enjoyed. And all this withoutprejudice to any action which may be taken by the <strong>Authority</strong> – including therescission of the deed.


(b)Price of Property(i) The fair market price of the property is that indicated in column G of Schedule B,whilst the subsidised price with which the immovable property is being sold andwhich has to be paid by the beneficiary is indicated in column H of the sameSchedule B. In these cases the <strong>Housing</strong> <strong>Authority</strong> shall retain in its favour a firsthypothec, a general hypothec and a special hypothec and all this up to the value ofsubsidy enjoyed by the beneficiary.(ii) The garages shall be sold at the prices indicated in column L of the same ScheduleB.(iii)The price of all the common parts excluding the roof which is not being included inthe sale (in the case of apartments) is being included in the fair market price asspecified in Schedule B. The roof and common areas, in the case of apartments, willremain the sole property of the <strong>Housing</strong> <strong>Authority</strong>, which reserves the right to buildhigher levels and to give the right of use of the roof and common areas to thirdparties. The beneficiary cannot in any way object to this development.(c)Method of PaymentThe beneficiaries will be given two options of method of payment for the purchase of aproperty under this advert as detailed below:(i) Option One(1) The price shall be paid as follows::Ten percent (10%) of the subsidised price shall be paid on the preliminaryagreement as deposit on account of the price. This amount shall not be refundedin the eventuality that the beneficiary does not appear on the deed of sale withouta valid reason.The balance on the said price shall be paid on deed of sale. In the case theimmovable property in question has not as yet been transferred to the <strong>Housing</strong><strong>Authority</strong>, the preliminary agreement is first signed and then following thisinstead of the final deed, a ‘deed konvenju’ is signed in these cases whichindicates tha the full amount due has been paid.


finishing; the beneficiary will be liable for settlement of such amounts withoutany right for refund. The beneficiary obliges himself also not to cause anydamages to the property or its improvements. In case any damages are caused tothe property, the beneficiary will be responsible to shoulder the necessaryexpense for the finishing and/or damages.(3) The Registered Preliminary Agreement will be valid for not more than twenty(20) years and the beneficiary will not be allowed to carry out alterations or buildextensions to the property before the full balance is paid to the <strong>Authority</strong> or priorhe obtains permission from the <strong>Authority</strong>.(4) Any risks in connection with the property will become the responsibility of thebeneficiary upon signing of the Registered Preliminary Agreement.(5) A registration Tax of 1% is to be paid by the beneficiary on the RegisteredPreliminary Agreement which will be valid for twenty (20) years.(d)Preliminary AgreementThe Preliminary Agreement shall be signed within three (3) months from when thebeneficiary is informed that he has been allocated a property. In the eventuality wherethe applicant does not appear on the preliminary agreement on the date indicated by the<strong>Housing</strong> <strong>Authority</strong>, he shall ipso jure forfeit any right which he may have had on theproperty and the <strong>Authority</strong> has the right to allocate the same property to third parties.(e)Transfer of Property and Rescission(i) In the eventuality that the beneficiary wants to sell their property purchased underthis advert to third parties, that is after the lapse of five (5) years from the date whenthey had occupied the immovable property, they shall inform the <strong>Authority</strong> prior thesigning of the preliminary agreement and shall, refund to the <strong>Authority</strong> the subsidyenjoyed up till the deed of transfer of the property to third parties as shown in thetable below:Period of Years After Occupancy Percentage of Subsidy RefundableUp to 5 years 100%Between 5 & 6 years 80%Between 6 & 7 years 70%Between 7 & 8 years 50%Between 8 & 9 years 30%


laudemium in terms of law on each future transfer of the property; this condition shallremain applicable even after the redemption of ground rent;(b)the beneficiary shall bind himself to finish the property which has been allocated to himin a way that he is able to start residing in it in terms of Clause 9.3(a) of this Advert;(c)the property shall be transferred to the beneficiary tale quale and in a state as shown inColumn I Schedule B and together with rights and pertinences which include, wherethere is no roof, those of keeping a water tank and installing a TV aerial on the overlyingroof. Guarantee for latent defects is to be excluded, the property will be sold with thecommon parts as described and subject to usual servitudes;(d)The beneficiary shall bind himself not to keep any dangerous substances and/orexplosives in the property or in the common parts;(e)The beneficiary must, at his own expense, and prior the signing of he PreliminaryAgreement insure the property against all risks with an insurance company acceptable tothe <strong>Authority</strong> and shall also continue paying the premium of the said insurance. Thebeneficiaries must also send a copy of the receipt of premium paid every year.10.6 In the case of apartments under this Advert:(a)these are subject to an annual perpetual ground rent of sixty euro (€60) that has to beredeemed within ten (10) years from the date of acquisition and payment of alaudemium in terms of law on each future transfer of the property; this condition shallremain applicable even after the redemption of ground rent;(b)the beneficiary shall bind himself to finish the property which has been allocated to himin a way that he is able to start residing in it in terms of Clause 9.3(a) of this Advert;(c)the property shall be transferred to the beneficiary tale quale and in a state as shown inColumn I Schedule B and together with rights and pertinences which include, wherethere is no roof, those of keeping a water tank, install a TV aerial and a solar waterheater on the roof of the block where is obliged to as shown in Schedule B. Guaranteefor latent defects is to be excluded, the property sold with the common parts asdescribed and subject to servitudes;(d)the beneficiary who is allocated an apartment under this Advert shall have the obligationto become a member of the Residents’ Association and where this does not exist, to


form together with the other buyers of the same block of apartments such Association interms of the law on Condominiums (Act 29 of 1997).This Association has to be established once the majority of the apartments are sold andsuch Association has to be registered within one month from when it is appointed by theRegistrar of Land in terms of Cap 398 of the Laws of <strong>Malta</strong>. Under no circumstances the<strong>Housing</strong> <strong>Authority</strong> shall be expected to perform such any obligation which is theresponsibility of the Association according to Law;(e)the beneficiary binds himself not to keep any animal/s of whatever kind in any part ofthe building block, including the roof, common parts of the block, not even in theproperty itself which is being sold to him by the <strong>Authority</strong> under this Advert. If thisobligation is breached;(f)the beneficiaries should be aware that if they want to install a lift in a block ofapartments where there is no indication in Column O Schedule B that it would beinstalled by the <strong>Authority</strong>, the cost of installation shall be borne by them and it shall betheir sole responsibility and not that of the <strong>Authority</strong>. The same applies to any otherexpenses in connection to such lift;(g)the beneficiaries of the apartments shall have the right to use the common parts and theroof of the block where applicable. In the case of a common roof, they can use it onlyfor clothes hanging, and parties and barbecues are not permitted. In the case ofpenthouses, access to the overlying roof is limited to the installation and maintenance ofthe water tanks, TV aerials and solar water heaters;(h)the roof and the common parts remain the absolute property of the <strong>Authority</strong> whichreserves the right to build other levels and give the right of use of the roof and commonparts to third parties. In such a case the <strong>Authority</strong> shall provide access for theinstallation of a water tank, TV aerial and solar water heater on the new development.The beneficiary may in no way object to such development;(i)No beneficiary shall have the right to do any structural alterations to the façade or in theproperty or build an extension without the written approval of the <strong>Authority</strong>;(j)No construction, including the construction of washrooms, is permitted in the commonroof of blocks or terraces;(k)The beneficiary shall bind himself not to keep any dangerous substances and/orexplosives in the property or in the common parts;


(l)The beneficiary must, at his own expense, and prior the signing of he PreliminaryAgreement insure the property against all risks with an insurance company acceptable tothe <strong>Authority</strong> and shall also continue paying the premium of the said insurance. Thebeneficiaries must also send a copy of the receipt of premium paid every year.10.7 In the case of a garage sold under this Advert:(a)(b)(c)(d)where the access for the garage is from a common entrance, the sale shall include theundivided share of the common parts/drive-way;within one month from possession of their garage , the buyers of the garages shall havethe obligation to form or become members of the garage Owners’ Association whichwould be responsible for all expenses and the maintenance of the common parts of thegarages;no parking is allowed or any other hindrance is allowed in the common parts of thegarages. In the eventuality, it shall be up to the Association to proceed civilly orcriminally against the person causing the hindrance;The buyer shall bind himself not to keep any dangerous substances and/or explosives inthe garage or in the common parts.10.8 Where there are wells built under the housing blocks issued in this Advert, the undivided shareof such wells shall be sold to the beneficiaries of the apartments in the following two caseswhen:(a)(b)the water being collected in the well is to be used as second class water;the water being collected in the well is to be used for irrigation of the landscaped areasin common parts as indicated in Schedule B.In these two cases the Residents’ Association will be responsible for the maintenance of thewell, pumps, and rain water pipes, and shall have the exclusive right of the water collected forthe purposes explained above.In all other cases the sale of the undivided share of the well shall be in favour of the garagebuyers. The use, control and maintenance of the said well, pumps and rain water pipes shall beregulated by the garage Owners’ Association.11 ADDITIONAL CONDITIONS11.1Solar Water Heaters(a)The beneficiaries of the apartments under this Advert shall have the obligation to installa solar water heater as indicated above.


(b)The beneficiaries are responsible to repair and make good for whatever damage is madeto the roof during the installation, maintenance or repair of the solar water heatingsystems.(c)The beneficiaries will be given a plan that shows the positioning on the roof of suchsolar water heaters systems and shall be obliged to install them as indicated in the planprovided by the <strong>Authority</strong>.11.2Apartments in Blocks A5 – A11, Triq Pietro Darmenia, Pembroke(a)Upon the acquisition of the apartment the beneficiaries of these apartments shall havethe obligation to pay the fee of six hundred and fifty Euros (€650) to the <strong>Authority</strong> tomake good for the cost of maintenance to the façade of the said block after the seventh(7 th ) year following purchase.(b)After the seventh (7th) year from purchase and every seven years thereafter, thebeneficiaries shall have the obligation to pay to the <strong>Authority</strong> an amount of money forthe maintenance of the said façade.(c)The <strong>Authority</strong> shall bind itself to do the required maintenance on the façade of the blockevery seven (7) years and such obligation would only be in effect where each and everyoccupier of the units in the block has contributed his share as indicated above.12 ADDITIONAL INFORMATION12.1 The <strong>Housing</strong> <strong>Authority</strong> wishes to notify that these conditions are at the absolute discretion ofthe <strong>Authority</strong> and apply for this Advert only.12.2 The <strong>Authority</strong> is not bound to retain similar conditions for future issues for sale of immovableproperty.12.3 The <strong>Authority</strong> shall reserve the right to make any necessary amendments to this scheme bypublishing said amendments in the Government Gazette.12.4 The <strong>Housing</strong> <strong>Authority</strong> shall have the right to give retroactive effects to any such amendments.Similarly any person who may have qualified under this scheme prior to any such amendment


can be rendered ineligible (disqualified) by virtue of such amendment and all this without anyother obligations by the <strong>Authority</strong>.12.5 The <strong>Housing</strong> <strong>Authority</strong> notifies any other conditions, which it deems necessary, may beincluded in the final deed.
