Code § 1021.94a(b)(1)(i), (c).For the reasons more fully explained in the accompanying supporting brief, there is nodispute as to any material fact, and PennFuture is entitled to judgment as a matter of law thatthe Pennsylvania Department of Environmental Protection’s issuance of General PermitNumber WMGR128 violated 25 Pa. Code § 287.623 governing public notice of an applicationfor a residual waste general permit and public participation in the review of the application.This issue is raised in Objection 1 of PennFuture’s October 1, 2012 Notice of Appeal.PennFuture requests that the Environmental Hearing Board grant this Motion, sustainPennFuture’s appeal, and invalidate General Permit Number WMGR128.As required by 25 Pa. Code § 1021.94a(b)(1)(ii)-(v), this Motion is accompanied by theevidentiary materials relied upon by Appellant (three affidavits, with attachments), a“Statement of Undisputed Material Facts,” a “Brief in Support of Appellant’s Motion forSummary Judgment,” and the proposed order attached to this Motion.
