Target islocated both in a census tract which is “overconcentrated” and in a “highcrime” Police Beat as defined by ABC.PCN LETTER JUSTIFICATION:As part <strong>of</strong> the request for a PCN Letter, an applicant must explain how thealcohol license will serve the public’s convenience and necessity. In response,the applicant notes that alcoholic beverage products would provide acomplete range <strong>of</strong> products in the store. The applicant also notes that the sale<strong>of</strong> alcoholic beverages would meet customer demand and would allowshoppers to buy a range <strong>of</strong> products at one location rather than having totravel, park, and pay at different stores (Attachment 2).ANALYSIS:Chapter 4.54 <strong>of</strong> the <strong>Elk</strong> <strong>Grove</strong> Municipal Code establishes a protocol for theissuance and review <strong>of</strong> Letters <strong>of</strong> Public Convenience and Necessity. Avariety <strong>of</strong> <strong>City</strong> departments and other agencies (including the <strong>Elk</strong> <strong>Grove</strong> PoliceDepartment and the <strong>Elk</strong> <strong>Grove</strong> Code Enforcement division) are required toreview PCN Letter applications in order to determine current and pastproblems at the Applicant’s proposed store location. Issues examined bythese departments and agencies include:• Criminal activity,• Building code violations, and• Complaints to the <strong>City</strong> and/or ABC.None <strong>of</strong> the reporting agencies noted any issues with the Target location.The store site is zoned Shopping Center (SC). This zoning district allowsalcohol sales as a permitted-by-right use. Further, the applicant indicates thatalcohol sales, including beer, wine, and liquor, will constitute less than 1% <strong>of</strong>the floor area <strong>of</strong> the store. The area dedicated to alcohol sales is less than the<strong>City</strong> standard that would trigger a conditional use permit. This means that the<strong>City</strong> Council cannot impose conditions on the sale <strong>of</strong> alcohol other than thebasic requirements <strong>of</strong> State law (which would be enforced by the State <strong>of</strong>California) and <strong>of</strong> the <strong>Elk</strong> <strong>Grove</strong> Zoning Code (sign area, lighting, and otherstandards common to all retail stores).3


<strong>Elk</strong> <strong>Grove</strong> <strong>City</strong> CouncilAugust 24, 2011Page 4 <strong>of</strong> 5The project is located in census tract 96.13, which ABC considers to have“high crime” and to be “overconcentrated.” ABC makes the “overconcentrated”determination when the number <strong>of</strong> liquor licenses issued exceeds the number<strong>of</strong> licenses which should be permitted in a census tract per ABC’s standards.There is one license allowed in this census tract, and eight licenses exist.ABC determines an area to be “high crime” when the number <strong>of</strong> crimescommitted in a census tract exceeds 120% <strong>of</strong> the average number <strong>of</strong> crimescommitted citywide. The <strong>City</strong> <strong>of</strong> <strong>Elk</strong> <strong>Grove</strong> Police Department, has reviewedthe project, and noted that the project is in Beat 2. Total crimes in Beat 2 were1,416 in 2010, while 120% <strong>of</strong> the average number <strong>of</strong> crimes in the <strong>City</strong> is 987.Therefore, Beat 2 exceeded the 120% <strong>of</strong> average by 429 crimes in 2010. Thecrime statistics for Beat 2 are provided in Attachment 3.The Department <strong>of</strong> Alcoholic Beverage Control notes that there are noviolations <strong>of</strong> ABC rules under Target’s existing type 20 license (Off Sale Beerand Wine).ENVIRONMENTAL ANALYSIS:The California Environmental Quality Act (Section 21000, et seq., <strong>of</strong> theCalifornia Public Resources Code - hereafter CEQA) requires analysis <strong>of</strong>agency approvals <strong>of</strong> discretionary “projects.” A “project,” under CEQA, isdefined as “the whole <strong>of</strong> an action, which has a potential for resulting in eithera direct physical change in the environment, or a reasonably foreseeableindirect physical change in the environment.” The proposed project is a projectunder CEQA.Staff has reviewed the project to determine the required level <strong>of</strong> review underCEQA. The proposed project is exempt from CEQA under State CEQAGuidelines Section 15061(b)(3) (Review for Exemption) <strong>of</strong> Division 6 <strong>of</strong>Chapter 3, Title 14 <strong>of</strong> the California Code <strong>of</strong> Regulations. Section 15061(b)(3)<strong>of</strong> the CEQA Guidelines states that an activity is covered by the general rulethat CEQA only applies to projects, which have the potential for causing asignificant effect on the environment. Where it can be seen with certainty thatthere is no possibility that the activity in question may have a significant effecton the environment, the activity is not subject to CEQA review. Granting thisLetter <strong>of</strong> Public Convenience and Necessity will not bring about any physicalchange to the environment and will not have any potential for causing asignificant effect on the environment.4
