Case 3:07-cv-01436-RNC Document 51-2 Filed 02/01/2008 Page 30 <strong>of</strong> 32provides that the Suffolk County Sheriff's Department agrees <strong>to</strong>:provide the basic needs <strong>for</strong> all ICE detainees, including housing,subsistence, on-premises medical services, and other service, such asinterpretive services;provide escort/transportation services;ensure compliance with ICE's detention procedures and may adopt, adap<strong>to</strong>r establish alternative procedures, provided they meet or exceed thestandard;request approval <strong>for</strong> <strong>of</strong>f-site, non-emergent medical treatment;provide 24 hour emergency medical care;allow <strong>for</strong> periodic inspections;indemnify the federal government <strong>for</strong> all liability claims arising out <strong>of</strong> the"occupancy, use, service, operation or per<strong>for</strong>mance <strong>of</strong> work ..., resultingfrom the negligent acts or omissions <strong>of</strong> the Service Provider, or anyemployee, or agent <strong>of</strong> the Service Provider;" andand retains the Provider's right <strong>to</strong> refuse <strong>to</strong> accept or request removal <strong>of</strong>any detainee exhibiting violent or disruptive behavior or who has amedical condition beyond the prison's ability <strong>to</strong> treat.See Declaration <strong>of</strong> Susan D. Erickson and Suffolk County Sheriff's Department, attached there<strong>to</strong>as Exhibit B. Similar <strong>to</strong> the Plymouth contract, Suffolk County had no obligation <strong>to</strong> in<strong>for</strong>m ICE<strong>of</strong> the day-<strong>to</strong>-day operations <strong>of</strong> the facility, and ICE had no control over these day-<strong>to</strong>-dayoperations. Suffolk County was only obliged <strong>to</strong> seek approval <strong>to</strong> incur outside medical expenses<strong>for</strong> non-emergent care. Additionally, the Suffolk County contract specifically provided <strong>for</strong>indemnification <strong>for</strong> all liability arising from the negligent acts or omissions <strong>of</strong> the ServiceProvider, or any employee, or agent <strong>of</strong> the Service Provider.
