376D, 377 or 509 of <strong>the</strong> Indian Penal Code is alleged <strong>to</strong> have been committed orattempted, <strong>the</strong> statement shall be recorded by a female police officer <strong>and</strong> in case afemale police officer is not available, by a female government servant available in <strong>the</strong>vicinity <strong>and</strong> in case a female government servant is also not available, by a femaleauthorised by an organisati<strong>on</strong> interested in <strong>the</strong> welfare of women or children.(4) Where in any case n<strong>on</strong>e of <strong>the</strong> alternatives menti<strong>on</strong>ed in sub-secti<strong>on</strong> (3) can befollowed for <strong>the</strong> reas<strong>on</strong> that no female police officer or female government servant ora female authorised by an organisati<strong>on</strong> interested in <strong>the</strong> welfare of women <strong>and</strong>children is available, <strong>the</strong> officer in charge of <strong>the</strong> police stati<strong>on</strong> shall, after recording<strong>the</strong> reas<strong>on</strong>s in writing, proceed with <strong>the</strong> recording of <strong>the</strong> statement of such femalevictim in <strong>the</strong> presence of a relative of <strong>the</strong> victim.”III 2III 3Modificati<strong>on</strong> of <strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160. – The age menti<strong>on</strong>ed in<strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160 should be raised from fifteen years <strong>to</strong>sixteen years.Substituti<strong>on</strong> of <strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160. – In additi<strong>on</strong> <strong>to</strong> <strong>the</strong>above modificati<strong>on</strong>, <strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160 be substituted <strong>to</strong>read as follows:III 4“Provided that no male pers<strong>on</strong> under <strong>the</strong> age of 16 years or woman shall be required <strong>to</strong>attend at any place o<strong>the</strong>r than <strong>the</strong> place in which such male pers<strong>on</strong> or woman resides.While recording <strong>the</strong> statement, a relative or a friend or a social worker of <strong>the</strong> choice of<strong>the</strong> pers<strong>on</strong> whose statement is being recorded shall be allowed <strong>to</strong> remain present.Inserti<strong>on</strong> of a new secti<strong>on</strong>, namely, secti<strong>on</strong> 164A in <strong>the</strong> code of Criminal Procedure,1973. – The following secti<strong>on</strong> 164A be inserted in <strong>the</strong> code of Criminal Procedure:“164A.(1) Where, during <strong>the</strong> stage when any offence under secti<strong>on</strong> 376, Secti<strong>on</strong> 376A,secti<strong>on</strong> 376B, secti<strong>on</strong> 376D, is under investigati<strong>on</strong> <strong>and</strong> it is proposed <strong>to</strong> get <strong>the</strong>victim examined by a medical expert, such examinati<strong>on</strong> shall be c<strong>on</strong>ducted by aregistered medical practiti<strong>on</strong>er, with <strong>the</strong> c<strong>on</strong>sent of <strong>the</strong> complainant or of somepers<strong>on</strong> competent <strong>to</strong> give such c<strong>on</strong>sent <strong>on</strong> his/her behalf. In all cases, <strong>the</strong>complainant should be sent for such examinati<strong>on</strong> without any delay.Provided that if <strong>the</strong> complainant happens <strong>to</strong> be a female, <strong>the</strong> medical examinati<strong>on</strong>shall be c<strong>on</strong>ducted by a female medical officer, as far as possible.(2) The registered medical practiti<strong>on</strong>er <strong>to</strong> whom <strong>the</strong> complainant is forwarded shallwithout delay examine <strong>the</strong> pers<strong>on</strong> <strong>and</strong> prepare a report specifically recording<strong>the</strong> result of his/her examinati<strong>on</strong> <strong>and</strong> giving <strong>the</strong> following details:(i)(ii)(iii)(iv)(v)The name <strong>and</strong> address of <strong>the</strong> complainant <strong>and</strong> <strong>the</strong> pers<strong>on</strong> by whom he/she wasbrought,<strong>the</strong> age of <strong>the</strong> complainant,marks of injuries, if any, <strong>on</strong> <strong>the</strong> pers<strong>on</strong> of <strong>the</strong> complainant,general mental c<strong>on</strong>diti<strong>on</strong> of <strong>the</strong> complainant <strong>and</strong>O<strong>the</strong>r material particulars, in reas<strong>on</strong>able detail.
