(b)(c)(d)(e)(f)(g)(h)(i)(j)(k)Being a public servant, takes advantage of his official positi<strong>on</strong> <strong>and</strong> commitssexual assault <strong>on</strong> a woman or minor in his cus<strong>to</strong>dy as such public servant or in<strong>the</strong> cus<strong>to</strong>dy of a public servant subordinate <strong>to</strong> him; orbeing <strong>on</strong> <strong>the</strong> management or <strong>on</strong> <strong>the</strong> staff of a jail, rem<strong>and</strong> home or o<strong>the</strong>r placeof cus<strong>to</strong>dy established by or under any law for <strong>the</strong> time being in force or of awomen’s or children’s instituti<strong>on</strong> takes advantage of his official positi<strong>on</strong> <strong>and</strong>commits sexual assault <strong>on</strong> any woman or minor inmate of such jail, rem<strong>and</strong>home, place or instituti<strong>on</strong>; orBeing <strong>on</strong> <strong>the</strong> management or <strong>the</strong> staff of a hospital, takes advantage of hisofficial positi<strong>on</strong> <strong>and</strong> commits sexual assault <strong>on</strong> a woman or minor in thathospital; orcommits sexual assault <strong>on</strong> a pregnant woman, orcommits sexual assault <strong>on</strong> a pers<strong>on</strong> when such pers<strong>on</strong> is under sixteen yearsof age; orcommits gang sexual assault, orbeing in a positi<strong>on</strong> of ec<strong>on</strong>omic or social or political dominance commitssexual assault <strong>on</strong> a woman or minor under such dominance, orcommits sexual assault <strong>on</strong> a pers<strong>on</strong> suffering from mental <strong>and</strong> physicaldisability, orwhile committing sexual assault causes grievous bodily harm, maimsdisfigures or endangers <strong>the</strong> life of a woman or minorcommits persistent sexual assaultShall be punished with impris<strong>on</strong>ment of ei<strong>the</strong>r descripti<strong>on</strong> for a term which shall not be lessthan ten years but which may be for life <strong>and</strong> shall also be liable <strong>to</strong> fine.Explanati<strong>on</strong> 1. – “Minor ” in this sub-secti<strong>on</strong>, Secti<strong>on</strong> 376 C, <strong>and</strong> 376 D (2), (3) means apers<strong>on</strong> below <strong>the</strong> age of sixteen years.”Explanati<strong>on</strong> 2 -Where a pers<strong>on</strong> is subjected <strong>to</strong> sexual assault by <strong>on</strong>e or more in a group ofpers<strong>on</strong>s acting in fur<strong>the</strong>rance of <strong>the</strong>ir comm<strong>on</strong> intenti<strong>on</strong>, each of <strong>the</strong> pers<strong>on</strong>s shall bedeemed <strong>to</strong> have committed gang sexual assault within <strong>the</strong> meaning of this sub-secti<strong>on</strong>.Explanati<strong>on</strong> 3. – “Women’s or children’s instituti<strong>on</strong>” means an instituti<strong>on</strong>, whe<strong>the</strong>r called anorphanage or a home for neglected women or children or a widows’ home or an instituti<strong>on</strong>called by any o<strong>the</strong>r name, which is established <strong>and</strong> maintained for <strong>the</strong> recepti<strong>on</strong> <strong>and</strong> care ofwomen or children.Explanati<strong>on</strong> 4. – “Hospital” means <strong>the</strong> precincts of <strong>the</strong> hospital <strong>and</strong> includes <strong>the</strong> precinctsof any instituti<strong>on</strong> for <strong>the</strong> recepti<strong>on</strong> <strong>and</strong> treatment of pers<strong>on</strong>s during c<strong>on</strong>valescence or ofpers<strong>on</strong>s requiring medical attenti<strong>on</strong> or rehabilitati<strong>on</strong>.”


Modificati<strong>on</strong> in secti<strong>on</strong> 376A of <strong>the</strong> IPC recommended :- Secti<strong>on</strong> 376A shall read as follows :II 3II 4Deleti<strong>on</strong> of Secti<strong>on</strong> 376 A - The existing Secti<strong>on</strong> 376 A is hereby deleted.The existing Secti<strong>on</strong>s 376 B, C & D will become Secti<strong>on</strong> 376 A, Secti<strong>on</strong> 376 B <strong>and</strong>Secti<strong>on</strong> 376 C. new provisi<strong>on</strong> in sec 376E“376A. Sexual intercourse by public servant with a woman in his cus<strong>to</strong>dy. Whoever, beinga public servant, takes advantage of his official positi<strong>on</strong> <strong>and</strong> induces or seduces awoman, who is in his cus<strong>to</strong>dy as such public servant or in <strong>the</strong> cus<strong>to</strong>dy of a publicservant subordinate <strong>to</strong> him, <strong>to</strong> have sexual intercourse with him, such sexualintercourse not amounting <strong>to</strong> <strong>the</strong> offence of sexual assault, shall be punished withimpris<strong>on</strong>ment of ei<strong>the</strong>r descripti<strong>on</strong> for a term which shall not be less than five years<strong>and</strong> which may extend <strong>to</strong> ten years <strong>and</strong> shall also be liable <strong>to</strong> fine.Explanati<strong>on</strong>: “Sexual intercourse” in this secti<strong>on</strong> <strong>and</strong> secti<strong>on</strong>s 376B <strong>and</strong> 376C shall meanany of <strong>the</strong> acts menti<strong>on</strong>ed in clauses (a) <strong>to</strong> (e) of secti<strong>on</strong> 375. Explanati<strong>on</strong> <strong>to</strong> secti<strong>on</strong> 375shall also be applicable.”“376B.Sexual intercourse by superintendent of jail, rem<strong>and</strong> home, etc. Whoever, being <strong>the</strong>superintendent or manager of a jail, rem<strong>and</strong> home or o<strong>the</strong>r place of cus<strong>to</strong>dyestablished by or under any law for <strong>the</strong> time being in force or of a women’s orchildren's instituti<strong>on</strong> takes advantage of his her official positi<strong>on</strong> <strong>and</strong> induces orseduces any inmate of such jail, rem<strong>and</strong> home, place or instituti<strong>on</strong> <strong>to</strong> have sexualintercourse with him/her, such sexual intercourse not amounting <strong>to</strong> <strong>the</strong> offence ofsexual assault, shall be punished with impris<strong>on</strong>ment of ei<strong>the</strong>r descripti<strong>on</strong> for a termwhich shall not be less than five years <strong>and</strong> which may extend <strong>to</strong> ten years shall alsobe liable <strong>to</strong> fine.Explanati<strong>on</strong> 1. – “Superintendent” in relati<strong>on</strong> <strong>to</strong> a jail, rem<strong>and</strong> home or o<strong>the</strong>r place ofcus<strong>to</strong>dy or a women’s or children’s instituti<strong>on</strong> includes a pers<strong>on</strong> holding any o<strong>the</strong>r office insuch jail, rem<strong>and</strong> home, place or instituti<strong>on</strong> by virtue of which he/she can exercise anyauthority or c<strong>on</strong>trol over its inmates.Explanati<strong>on</strong> 2. – The expressi<strong>on</strong> “Women’s or children’s instituti<strong>on</strong>” shall have <strong>the</strong> samemeaning as in Explanati<strong>on</strong> 2 <strong>to</strong> sub-secti<strong>on</strong> (2) of secti<strong>on</strong> 376.376C.Sexual intercourse by any member of <strong>the</strong> management or staff of a hospital with anywoman or minor in that hospital. – Whoever, being <strong>on</strong> <strong>the</strong> management of a hospitalor being <strong>on</strong> <strong>the</strong> staff of a hospital takes advantage of his\her positi<strong>on</strong> <strong>and</strong> has sexualintercourse with a woman or minor in that hospital, such sexual intercourse notamounting <strong>to</strong> <strong>the</strong> offence of sexual assault, shall be punished with impris<strong>on</strong>ment ofei<strong>the</strong>r descripti<strong>on</strong> for a term which shall not be less than five years <strong>and</strong> which mayextend <strong>to</strong> ten years <strong>and</strong> shall also be liable <strong>to</strong> fine.Explanati<strong>on</strong>: - The expressi<strong>on</strong> “hospital” shall have <strong>the</strong> same meaning as in Explanati<strong>on</strong> 3<strong>to</strong> sub-secti<strong>on</strong> (2) of secti<strong>on</strong> 376.”


Explanati<strong>on</strong> 2: Penetrati<strong>on</strong> of <strong>the</strong> anus or mouth by <strong>the</strong> penis or penetrati<strong>on</strong> by anobject or part of <strong>the</strong> body in<strong>to</strong> <strong>the</strong> anus or vagina is necessary <strong>to</strong> c<strong>on</strong>stitute <strong>the</strong>sexual intercourse necessary for <strong>the</strong> offence described in this secti<strong>on</strong>.Explanati<strong>on</strong> 3: No c<strong>on</strong>sent is obtained for <strong>the</strong> purpose of <strong>the</strong> above secti<strong>on</strong> if it hasbeen obtained by coerci<strong>on</strong> or under undue influence or if <strong>the</strong> pers<strong>on</strong> giving <strong>the</strong>c<strong>on</strong>sent suffers from in<strong>to</strong>xicati<strong>on</strong> or unsoundness of mind or mistake as <strong>to</strong> <strong>the</strong>identity of <strong>the</strong> offender.II 8 Amendment of secti<strong>on</strong> 509, IPC.- The existing secti<strong>on</strong> 509 be amended as follows :“509.Word, gesture or act with a sexual purpose or with <strong>the</strong> intenti<strong>on</strong> <strong>to</strong> insult a woman -Whoever, with a sexual purpose or with <strong>the</strong> intenti<strong>on</strong> <strong>to</strong> insult any woman, utters any word,makes any sound or gesture, or exhibits any object or a part of <strong>the</strong> body intending thatsuch word or sound shall be heard, or that such gesture or object shall be seen, by suchwoman, or intrudes up<strong>on</strong> <strong>the</strong> privacy of such woman, shall be punished with impris<strong>on</strong>men<strong>to</strong>f ei<strong>the</strong>r descripti<strong>on</strong> for a term which may extend <strong>to</strong> three years <strong>and</strong> shall also be liable <strong>to</strong>fine.”II 9New secti<strong>on</strong>s 509A <strong>and</strong> 509 B, IPC. - New secti<strong>on</strong>s 509 A <strong>and</strong> 509 B & 509C <strong>to</strong> beadded in <strong>the</strong> IPC in <strong>the</strong> following terms.509A (i) Whoever, with a sexual purpose utters any word, makes any sound or gesture orexhibits any object or a part of <strong>the</strong> body intending that such word or sound shallbe heard or that such gesture or object shall be seen by a minor, or(ii) Whoever makes a minor witness any sexual activity,Shall be punished with an impris<strong>on</strong>ment of ei<strong>the</strong>r descripti<strong>on</strong> for a term which may extend<strong>to</strong> 5years but shall not be less than 3 years.Explanati<strong>on</strong>1." Minor " for <strong>the</strong> purpose of this secti<strong>on</strong> will be any pers<strong>on</strong> under <strong>the</strong> age ofsixteen years.509B. “Any pers<strong>on</strong> who stalks a woman with <strong>the</strong> intenti<strong>on</strong> <strong>to</strong> cause,(a) serious harm orinjury <strong>to</strong> that woman or a third pers<strong>on</strong> or (b) apprehensi<strong>on</strong> or fear of serious harm orinjury <strong>to</strong> that woman or <strong>to</strong> a third pers<strong>on</strong> shall be punished with impris<strong>on</strong>ment ofei<strong>the</strong>r descripti<strong>on</strong> which may extend <strong>to</strong> 7 years or with fine or with both."Explanati<strong>on</strong> 1: For <strong>the</strong> purpose of this secti<strong>on</strong> a pers<strong>on</strong> shall be taken <strong>to</strong> stalk a woman if,<strong>on</strong> at least 3 occasi<strong>on</strong>s, that pers<strong>on</strong>(a) follows or approaches <strong>the</strong> woman or


(b) loiters near, watches, approaches or enters a place where <strong>the</strong> woman resides ,works or,visits or(c) keeps <strong>the</strong> woman under surveillance or(d) interferes with <strong>the</strong> property in possessi<strong>on</strong> of <strong>the</strong> woman or(e) gives or sends offensive material <strong>to</strong> <strong>the</strong> woman or leaves offensive material where it islikely <strong>to</strong> be found by, given <strong>to</strong> or brought <strong>to</strong> <strong>the</strong> attenti<strong>on</strong> of, <strong>the</strong> woman or(f) Acts covertly in a manner that could reas<strong>on</strong>ably be expected <strong>to</strong> arouse apprehensi<strong>on</strong> orfear in <strong>the</strong> woman or(g) Engages in c<strong>on</strong>duct amounting <strong>to</strong> intimidati<strong>on</strong>, or an offence under Secti<strong>on</strong> 509Explanati<strong>on</strong> 2. 'harm' means physical harm as well as mental harm.Secti<strong>on</strong> 509C - O<strong>the</strong>r forms of Sexual Harassment" Whoever by means of atelecommunicati<strong>on</strong> Device or by any o<strong>the</strong>r electr<strong>on</strong>ic form including <strong>the</strong> Internet knowinglymakes, creates, or solicits, or initiates <strong>the</strong> transmissi<strong>on</strong> of, any comment, request,suggesti<strong>on</strong>, proposal, image, or o<strong>the</strong>r communicati<strong>on</strong> which is obscene, lewd, lascivious,filthy, or indecent, with intent <strong>to</strong> annoy, abuse, threaten, or harass or stalk ano<strong>the</strong>rpers<strong>on</strong>/pers<strong>on</strong>s shall be punished with impris<strong>on</strong>ment of ei<strong>the</strong>r descripti<strong>on</strong> which mayextend <strong>to</strong> 7 years or with fine or with both."II 10 New secti<strong>on</strong> 166A, IPC.- A new secti<strong>on</strong> 166A be introduced in <strong>the</strong> IPC in <strong>the</strong> followingterms :“166A.Whoever, being a public servant –(a)(b)Knowingly disobeys any directi<strong>on</strong> of <strong>the</strong> law prohibiting him from requiring<strong>the</strong> attendance at any place of any pers<strong>on</strong> for <strong>the</strong> purpose of investigati<strong>on</strong> in<strong>to</strong>an offence or o<strong>the</strong>r matter, orKnowingly disobeys any o<strong>the</strong>r directi<strong>on</strong> of <strong>the</strong> law regulating <strong>the</strong> manner inwhich he shall c<strong>on</strong>duct such investigati<strong>on</strong>, <strong>to</strong> <strong>the</strong> prejudice of any pers<strong>on</strong>,shall be punished with impris<strong>on</strong>ment for a term which may extend <strong>to</strong> <strong>on</strong>e yearor with fine or with both.”III Changes recommended in <strong>the</strong> Code of Criminal Procedure, 1973.III 1 Inserti<strong>on</strong> of sub-secti<strong>on</strong>s (3) <strong>and</strong> (4) in secti<strong>on</strong> 160 of <strong>the</strong> code of Criminal Procedure,1973. – The following two sub-secti<strong>on</strong>s be inserted in secti<strong>on</strong> 160 of <strong>the</strong> code ofCriminal Procedure:“(3) Where under this chapter, <strong>the</strong> statement of a female is <strong>to</strong> be recorded ei<strong>the</strong>r as firstinformati<strong>on</strong> of an offence or in <strong>the</strong> course of an investigati<strong>on</strong> in<strong>to</strong> an offence <strong>and</strong> sheis a pers<strong>on</strong> against whom an offence under secti<strong>on</strong>s, 375, 376, 376A, 376B, 376C,


376D, 377 or 509 of <strong>the</strong> Indian Penal Code is alleged <strong>to</strong> have been committed orattempted, <strong>the</strong> statement shall be recorded by a female police officer <strong>and</strong> in case afemale police officer is not available, by a female government servant available in <strong>the</strong>vicinity <strong>and</strong> in case a female government servant is also not available, by a femaleauthorised by an organisati<strong>on</strong> interested in <strong>the</strong> welfare of women or children.(4) Where in any case n<strong>on</strong>e of <strong>the</strong> alternatives menti<strong>on</strong>ed in sub-secti<strong>on</strong> (3) can befollowed for <strong>the</strong> reas<strong>on</strong> that no female police officer or female government servant ora female authorised by an organisati<strong>on</strong> interested in <strong>the</strong> welfare of women <strong>and</strong>children is available, <strong>the</strong> officer in charge of <strong>the</strong> police stati<strong>on</strong> shall, after recording<strong>the</strong> reas<strong>on</strong>s in writing, proceed with <strong>the</strong> recording of <strong>the</strong> statement of such femalevictim in <strong>the</strong> presence of a relative of <strong>the</strong> victim.”III 2III 3Modificati<strong>on</strong> of <strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160. – The age menti<strong>on</strong>ed in<strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160 should be raised from fifteen years <strong>to</strong>sixteen years.Substituti<strong>on</strong> of <strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160. – In additi<strong>on</strong> <strong>to</strong> <strong>the</strong>above modificati<strong>on</strong>, <strong>the</strong> proviso <strong>to</strong> sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 160 be substituted <strong>to</strong>read as follows:III 4“Provided that no male pers<strong>on</strong> under <strong>the</strong> age of 16 years or woman shall be required <strong>to</strong>attend at any place o<strong>the</strong>r than <strong>the</strong> place in which such male pers<strong>on</strong> or woman resides.While recording <strong>the</strong> statement, a relative or a friend or a social worker of <strong>the</strong> choice of<strong>the</strong> pers<strong>on</strong> whose statement is being recorded shall be allowed <strong>to</strong> remain present.Inserti<strong>on</strong> of a new secti<strong>on</strong>, namely, secti<strong>on</strong> 164A in <strong>the</strong> code of Criminal Procedure,1973. – The following secti<strong>on</strong> 164A be inserted in <strong>the</strong> code of Criminal Procedure:“164A.(1) Where, during <strong>the</strong> stage when any offence under secti<strong>on</strong> 376, Secti<strong>on</strong> 376A,secti<strong>on</strong> 376B, secti<strong>on</strong> 376D, is under investigati<strong>on</strong> <strong>and</strong> it is proposed <strong>to</strong> get <strong>the</strong>victim examined by a medical expert, such examinati<strong>on</strong> shall be c<strong>on</strong>ducted by aregistered medical practiti<strong>on</strong>er, with <strong>the</strong> c<strong>on</strong>sent of <strong>the</strong> complainant or of somepers<strong>on</strong> competent <strong>to</strong> give such c<strong>on</strong>sent <strong>on</strong> his/her behalf. In all cases, <strong>the</strong>complainant should be sent for such examinati<strong>on</strong> without any delay.Provided that if <strong>the</strong> complainant happens <strong>to</strong> be a female, <strong>the</strong> medical examinati<strong>on</strong>shall be c<strong>on</strong>ducted by a female medical officer, as far as possible.(2) The registered medical practiti<strong>on</strong>er <strong>to</strong> whom <strong>the</strong> complainant is forwarded shallwithout delay examine <strong>the</strong> pers<strong>on</strong> <strong>and</strong> prepare a report specifically recording<strong>the</strong> result of his/her examinati<strong>on</strong> <strong>and</strong> giving <strong>the</strong> following details:(i)(ii)(iii)(iv)(v)The name <strong>and</strong> address of <strong>the</strong> complainant <strong>and</strong> <strong>the</strong> pers<strong>on</strong> by whom he/she wasbrought,<strong>the</strong> age of <strong>the</strong> complainant,marks of injuries, if any, <strong>on</strong> <strong>the</strong> pers<strong>on</strong> of <strong>the</strong> complainant,general mental c<strong>on</strong>diti<strong>on</strong> of <strong>the</strong> complainant <strong>and</strong>O<strong>the</strong>r material particulars, in reas<strong>on</strong>able detail.


III 6C<strong>on</strong>sequential <strong>amendments</strong> in <strong>the</strong> First Schedule <strong>to</strong> <strong>the</strong> Code of Criminal Procedure,1973 recommended. – C<strong>on</strong>sequent up<strong>on</strong> <strong>the</strong> proposed <strong>amendments</strong> in <strong>the</strong> IPC, <strong>the</strong>existing entries in respect of secti<strong>on</strong>s 376C <strong>to</strong> 376D, 377 <strong>and</strong> 509 will have <strong>to</strong> besubstitutedIII 7 Amendment of sub-secti<strong>on</strong> (6) of secti<strong>on</strong> 198 of <strong>the</strong> code of Criminal Procedure, 1973.– C<strong>on</strong>sequent up<strong>on</strong> proposed amendment of secti<strong>on</strong> 376 of IPC, sub-secti<strong>on</strong> (6) ofsecti<strong>on</strong> 198 Cr.PC shall be amended in <strong>the</strong> following manner: -The words “sexual intercourse” shall be substituted by <strong>the</strong> words “sexual assault” <strong>and</strong> <strong>the</strong>word “fifteen” shall be substituted by <strong>the</strong> word “sixteen”.III 8 Secti<strong>on</strong> 164 of <strong>the</strong> Cr.P.C. shall be amended as follows:The present sub secti<strong>on</strong> 1 will be read as 1 (a) <strong>and</strong> a new sub secti<strong>on</strong> 1 (b) will be added <strong>to</strong><strong>the</strong> following effect: -(b)III 9Any statement made under sub secti<strong>on</strong> (a) by a young pers<strong>on</strong> under <strong>the</strong> age ofeighteen years who is a victim of sexual assault under Secti<strong>on</strong> 375, 376 or Secti<strong>on</strong>509 shall, except in excepti<strong>on</strong>al circumstances be video taped.Amendment of secti<strong>on</strong> 273, Code of Criminal Procedure, 1973. – A proviso <strong>to</strong> <strong>the</strong>following effect be added under secti<strong>on</strong> 273 above <strong>the</strong> Explanati<strong>on</strong> clause <strong>the</strong>rein:Provided that where <strong>the</strong> evidence of a pers<strong>on</strong> below eighteen years who is alleged <strong>to</strong> havebeen subjected <strong>to</strong> sexual assault or any o<strong>the</strong>r sexual offence, is <strong>to</strong> be recorded, <strong>the</strong> courtshall, take appropriate measures <strong>to</strong> ensure that such pers<strong>on</strong> is not c<strong>on</strong>fr<strong>on</strong>ted by <strong>the</strong>accused. These measures may include video taping <strong>the</strong> evidence of <strong>the</strong> complainant in aplace <strong>to</strong> be decided by <strong>the</strong> Court, or placing a screen between <strong>the</strong> complainant <strong>and</strong> <strong>the</strong>accused <strong>and</strong> o<strong>the</strong>rs. Provided fur<strong>the</strong>r that <strong>the</strong> cross examinati<strong>on</strong> of a young pers<strong>on</strong> beloweighteen years shall be carried out by <strong>the</strong> court <strong>on</strong> questi<strong>on</strong>s put <strong>to</strong> it by <strong>the</strong> accused or hiscounsel.IV Changes recommended in <strong>the</strong> Indian Evidence Act, 1872IV 1Amendment of Secti<strong>on</strong> 45 of <strong>the</strong> Evidence Act, -- Secti<strong>on</strong> 45 of <strong>the</strong> Indian EvidenceAct will be amended <strong>to</strong> add a clause (d) under Illustrati<strong>on</strong>s as under:" Where <strong>the</strong> questi<strong>on</strong> is whe<strong>the</strong>r a child who is unable <strong>to</strong> talk of sexual abuse has beensubjected <strong>to</strong> sexual abuse as defined in S.375 IPC or S. 376 IPC or elsewhere <strong>the</strong> opini<strong>on</strong> ofan expert that <strong>the</strong> symp<strong>to</strong>ms <strong>and</strong> behaviour of <strong>the</strong> child are such that <strong>the</strong>y show that <strong>the</strong>child has suffered from such abuse are relevant."IV 2 Modificati<strong>on</strong> of Secti<strong>on</strong> 114A of <strong>the</strong> Evidence Act. Secti<strong>on</strong> 114A be modified <strong>to</strong> read asfollows:“114A. Presumpti<strong>on</strong> as <strong>to</strong> absence of c<strong>on</strong>sent in certain prosecuti<strong>on</strong>s for sexual assault. – In aprosecuti<strong>on</strong> for sexual assault under (a) or clause (b) or clause(c) or clause (d) or clause (e)or clause (g) or clause (h) (i) or (j) of sub-secti<strong>on</strong> (2) of secti<strong>on</strong> 376 of <strong>the</strong> Indian Penal Code


(45 of 1860) where sexual intercourse by <strong>the</strong> accused is proved <strong>and</strong> <strong>the</strong> questi<strong>on</strong> is whe<strong>the</strong>rit was without <strong>the</strong> c<strong>on</strong>sent of <strong>the</strong> o<strong>the</strong>r pers<strong>on</strong> alleged <strong>to</strong> have been sexually assaulted <strong>and</strong>such o<strong>the</strong>r pers<strong>on</strong> states in his/her evidence before <strong>the</strong> court that he/she did not c<strong>on</strong>sent,<strong>the</strong> court shall presume that he/she did not c<strong>on</strong>sent.Explanati<strong>on</strong>: “Sexual intercourse” in this secti<strong>on</strong> <strong>and</strong> secti<strong>on</strong>s 376A <strong>to</strong> 376C shallmean any of <strong>the</strong> acts menti<strong>on</strong>ed in clause (a) <strong>to</strong> (e) of secti<strong>on</strong> 375. Explanati<strong>on</strong> <strong>to</strong> secti<strong>on</strong>375 shall also be applicable.”IV 3Deleti<strong>on</strong> of clause (4) of secti<strong>on</strong> 155 of <strong>the</strong> Evidence Act.- Clause (4) of secti<strong>on</strong>155 of <strong>the</strong> Evidence Act is hereby deleted.IV 4Amendments in proposed secti<strong>on</strong> 53A, Evidence Act.- After secti<strong>on</strong> 53, <strong>the</strong>following secti<strong>on</strong> be inserted:“53A. In a prosecuti<strong>on</strong> for an offence under secti<strong>on</strong> 376, 376A, 376B, 376C, 376D orfor attempt <strong>to</strong> commit any such offence, where <strong>the</strong> questi<strong>on</strong> of c<strong>on</strong>sent is inissue, evidence of <strong>the</strong> character of <strong>the</strong> victim or of his/her previous sexualexperience with any pers<strong>on</strong> shall not be relevant <strong>on</strong> <strong>the</strong> issue of such c<strong>on</strong>sen<strong>to</strong>r <strong>the</strong> quality of c<strong>on</strong>sent.”IV 5Inserti<strong>on</strong> of clause (4) in secti<strong>on</strong> 146 of <strong>the</strong> Evidence Act– In secti<strong>on</strong> 146 of <strong>the</strong>Evidence Act, <strong>the</strong> following clause shall be added after clause (3):“(4) In a prosecuti<strong>on</strong> for an offence under secti<strong>on</strong> 376, 376A, 376B, 376C or 376D orfor attempt <strong>to</strong> commit any such offence, where <strong>the</strong> questi<strong>on</strong> of c<strong>on</strong>sent is inissue, it shall not be permissible <strong>to</strong> adduce evidence or <strong>to</strong> put questi<strong>on</strong>s in <strong>the</strong>cross-examinati<strong>on</strong> of <strong>the</strong> victim as <strong>to</strong> his/her general immoral character, or as<strong>to</strong> his/her previous sexual experience with any pers<strong>on</strong> for proving suchc<strong>on</strong>sent or <strong>the</strong> quality of c<strong>on</strong>sent.”IV 6A new secti<strong>on</strong> will be inserted in <strong>the</strong> Indian Evidence Act <strong>to</strong> make <strong>the</strong> videotaped or o<strong>the</strong>r statement of <strong>the</strong> minor complainant of sexual assault admissiblein evidence as follows:“In any trial or inquiry related <strong>to</strong> <strong>the</strong> sexual assault of a minor under Secti<strong>on</strong> 375, 376 <strong>and</strong> 509of <strong>the</strong> Indian Penal Code, <strong>the</strong> video taped statement of <strong>the</strong> minor made <strong>to</strong> a Magistrate isadmissible in evidence if <strong>the</strong> complainant while testifying adopts <strong>the</strong> c<strong>on</strong>tents of <strong>the</strong> videotaping.”Amendment in secti<strong>on</strong> 309 CRPC -Secti<strong>on</strong> 309 Crpc – sub-secti<strong>on</strong> (1) of secti<strong>on</strong> 309 a proviso <strong>to</strong> be added that “provided that where<strong>the</strong> inquiry or <strong>the</strong> trial relates <strong>to</strong> an offence under secti<strong>on</strong> 376 <strong>to</strong> 376 E (both inclusive) of <strong>the</strong> IPC<strong>the</strong> judgment shall, as far as possible be delivered within a period of 6 m<strong>on</strong>ths from <strong>the</strong> date ofcommencement of <strong>the</strong> trial.*****
