What a great job!Carol Sanders, our HeadquartersCoordinator wasavailable to all of us over theentire weekend. Many of usspeak with you by phone, but how nice toknow what your smiling face looks like!Thank you Carol <strong>for</strong> all you do to help ourmembers!We offered a tour of San Quentin on the firstday of our Annual Meeting. Forty attendeesfound the tour interesting, intense and itreally opened our eyes to the realities ofbeing in prison.My theme <strong>for</strong> this year is Knowledge isPower, Unity is Strength — COME HOMEto CMAA. You will be seeing a lot of birdsand birdhouses connected with this theme.I know you recognize some of those wordsas they are the words in our motto. I believethese words to be so true. My goal <strong>for</strong> thisyear will be to invite medical assistants allover <strong>Cali<strong>for</strong>nia</strong> to “COME HOME to CMAA”.Knowledge is so important in our professionand CMAA is a great resource <strong>for</strong> continuingeducation. COME HOME <strong>for</strong> knowledgewith the educational opportunities we offer.COME HOME and gather with others tonetwork and share experiences <strong>for</strong> Unity isStrength. The more of us who flock together,the stronger we can become.Think of the birds that fly together in a V<strong>for</strong>mation. Why do they do this? First, anS <strong>for</strong>mation is too hard. All thebirds except the first, flyin the upwash from the birdahead. The upwash assistseach bird in supportingits own weight in flight maintainingheight indefinitely.The birds flying at thetips and at the front are rotatedto spread flight fatigueequally among the flockmembers. The <strong>for</strong>mationalso makes communication easier and allowsthe birds to see each other.Christian Morganstern said that “Home isnot where you live, but where they understandyou.” I want CMAA to be the home <strong>for</strong>all medical assistants in <strong>Cali<strong>for</strong>nia</strong>.In Girl Scouts, I learned a campfire song thatyou may also remember. “Make newfriends, but keep the old...one is silver andthe other gold.” Our “golden” friends arethe roots of the tree that secures our CMAAbirdhouse. We have them to thank <strong>for</strong> somuch of what makes this organization great.If you are a “silver” friend and new to medicalassisting or this organization, we inviteyou to come and make CMAA your home.You will not find a better place to networkand grow in your career. If you have been amember in the past and have not been activelately, please consider “flying” home toCMAA. We need your valuable experience.I am asking every member to take part inpromoting CMAA. One way I am planningto do this is to participate in a national eventscheduled <strong>for</strong> October 22nd. It is called“Make a Difference Day.” I will be asking youas an individual or as a Region, to help inyour community. PRESIDENT-ELECT’S <strong>MESSAGE</strong>Food <strong>for</strong> ThoughtI found this on the Internet and it caused me to stop and think. How do I look at patients? Do I see them as patientswho are in need? Do I treat them different because they have no money, the way they look, dress, or smell? Or do Ilook close enough to see a spouse, and grandparent, someone who needs love?This is how the story and poem goes;When an old gentleman died in the geriatric ward of a nursing home in Grass Valley, CA it was believed that he hadnothing left of any value. Later, when the nurses were going through his meager possessions, they found this poem.Crabby Old Man…What do you see nurses? …… What do you see?What are you thinking? ….. When you’re looking at me?A crabby old man …... not very wise,Uncertain of habit …... with faraway eyes?Who dribbles his food…..? And makes no replyWhen you say in a loud voice….. ‘I do wish you’d try!’Who seems not to notice…..? The things that you do.And <strong>for</strong>ever is losing….. A sock or shoe?Who, resisting or not….. Lets you do as will.With bathing or feeding… The long day to fill?Is that what you’re thinking?….. Is that what you see?Then open your eyes, nurse…..you’re not looking at me.I’ll tell you who I am….. As I sit here so still,As I do at your bidding,….. As I eat at your will.I’m a small child of ten….. With a father and mother,Brothers and sisters….. Who love one another.A young boy of sixteen….. With wings on his feet.Dreaming that soon now…. a lover he’ll meet.A groom soon at twenty….. My heart gives a leap.Remembering, the vows….. That I promised to keep.At Twenty-Five, now….. Where I once had a heart.But inside this old carcass….. A young guy still dwells,And now and again….. My battered heart swells.I remember the joys….. I remember the pain.And I’m loving and living….. Life over again.I think of the years, all too few….. Gone too fast.And accept the stark fact….. That nothing can last.So open your eyes, people….. Open and see.Not a crabby old man….. Look closer….. See ME!!The quality and content of this poem so touched one nurse that she took a copy to Missouri andposted it on the Internet. Since then this old man’s sole bequest to posterity has appeared in theChristmas edition of the News Magazine, the St. Louis Association <strong>for</strong> the Mental Health, and it ismaking its way through the internet. A slide presentation has also been made based on his simple,but eloquent, poem.So when you next meet an older person whom you might have once brushed aside, remember thispoem and see the young soul within. CONTINUING EDUCATIONOSHA: “Our Workers’ Safety Net”OSHA—The ActThe Occupational Safety and Health Actwas set up as Federal law in 1970 to“assure as far as possible, to every workingman and woman in the nation, safeand healthful working conditions, and topreserve our human resources.” <strong>Cali<strong>for</strong>nia</strong>is one of the states which also havea state-specific program. Cal/OSHA isapproved by Federal OSHA, is monitoredby and receives part of its fundingfrom that Federal agency.Federal OSHA vs. Cal/OSHAThere are a few major differencesbetween Federal and Cal/OSHA.Cal/OSHA requires a Written Illness andInjury Prevention Program whereas theFederal OSHA does not. Federal OSHAdefines “catastrophe” as one or moreworker deaths, or three or more workerhospitalizations compared to Cal/OSHAwhich defines “catastrophe” as one ormore worker deaths, or one or moreworker hospitalizations. Cal/OSHA doesnot cover Federal Employees but, ofcourse, Federal OSHA does. It also doesnot cover offshore maritime workers ordomestic service people in privatehouseholds.Cal/OSHA OverviewCal/OSHA has developed standards(regulations) that require:A. All <strong>Cali<strong>for</strong>nia</strong> employers to establish,implement, and maintain a WrittenInjury and Illness Prevention (IIP) program.B. Employers with 10 or more workersmust have an Emergency Action planwith emergency escape proceduresand escape route assignments.C. Employers will ensure the availabilityof medical personnel <strong>for</strong> advice andconsultation on matters of industrialhealth or injury.D. Employers, with one or moreemployees who have occupationalexposure to human blood or otherpotentially infectious materials (OPIM),must have an effective written ExposureControl plan which should preventor minimize the employees’occupational exposure to blood andOPIM. There is necessary employeetraining with specific methods of complianceand record keeping to beaccomplished. Cal/OSHA alsorequires more post-exposure testingand follow-up than other states.E. The employer will provide andmaintain, whenever necessary,Personal Protective Equipment (PPE).The employer must also assess theworkplace to determine if hazardsare present or could be presentwhich make the use of PPEnecessary.F. 1. Workers have the right to knowabout the hazardous chemicalsthat they may be exposed to inthe workplace; employers musthave an effective program toin<strong>for</strong>m employees about such hazards.2. Hazardous substances must beidentified and inventoried. Theyshould be labeled and MaterialSafety Data Sheets must beobtained and setup <strong>for</strong> each substance.Reporting and Record KeepingAll employers except those with 10 orfewer employees the preceeding year,and business establishments in certainindustry classifications which are partiallyexempt.A. Reporting--The death or in-patienthospitalization of any employee froma work-related incident must beverbally reported within 8 hours ofthe incident.B. Recording—The in<strong>for</strong>mation is to beentered on the OSHA Log 300 relatingto the illness or injury. Theemployer is expected to know whichinjuries and illnesses are recordable.C. All work-related needlestick injuriesand cuts from objects which are contaminatedwith another person’sblood or other potentially infectiousmaterial must be entered on the logas an injury. The employee’sname should not be entered—Enter the words “privacy case.”InspectionsCal/OSHA does all types of inspectionsincluding physician’s clinics and offices.Some of the most common violationsare:A. Bloodborne pathogen risks andexposuresB. Portable Fire Extinguishers, i.e., notsafe or up to dateC. Electrical Equipment, i.e., machines,plugs, worn wiringD. Aisles and walkways clutteredE. Compressed gas and air cylindersThe Cal/OSHA en<strong>for</strong>cement unit hasjurisdiction over every place of employmentwhere it is necessary to en<strong>for</strong>ceand administer all of the standards andregulations. They conduct inspectionsof <strong>Cali<strong>for</strong>nia</strong> workplaces in response toindustrial accidents, a complaint aboutan occupational safety or health hazardor as part of an inspection programchecking on industries which have ahigh rate of occupational hazards, fatalities,injuries or illnesses.Citations/In<strong>for</strong>mal Conferences/AppealsCitations are issued to in<strong>for</strong>m theemployer and employees of the regulations/standardsthat are alleged to have12 CALIFORNIA MEDICAL ASSISTANT — MAY/JUNE 2011

The employer willreceive citations and the proposed penaltiesby certified mail; a copy of each citationmust be posted at or near the placethe violation occurred <strong>for</strong> three days oruntil the violation is abated.A. Employers can agree to the citationand penalty notification; correct thecondition by the date set and pay apenalty if one is proposed.B. Employers who disagree with thecitation or penalty, have 15 workingdays from the date the citation wasreceived to contest in writing—thecitation, the proposed penalty or theabatement date.C. An in<strong>for</strong>mal conference may berequested with the OSHA areadirector to discuss any issues relatedto the issues.D. Discounts may be levied on the finesdepending on the gravity of the violation,the size of the company, goodfaith and good history of the company.What’s Happening in <strong>Cali<strong>for</strong>nia</strong>!<strong>Cali<strong>for</strong>nia</strong> is the first in the nation toapprove safety standards <strong>for</strong> ATD’s(Aerosol Transmissible Diseases) in healthcarerelated workplaces and workplaceshandling animals potentially infected withAIDS’. These standards became effectiveAugust 5, 2009. These were developed<strong>for</strong> worker safety due to the advent ofSARS, H1N1 (Swine Flu), West Nile Virusand Tuberculosis. ATD’s are diseases(pathogens) which are spread by bodyfluid droplets or airborne exposure.A. The first ATD citations were issued ina meningitis exposure case whichtook place on December 3, 2009.These citations were issued to AltaBates Summit <strong>Medical</strong> Center, theOakland Police and Fire Departments.The handling of a patient with bacterialmeningitis sent an Alta Batesemployee and an Oakland police officerin intensive care. There was alsopossible meningitis exposure to ambulancedrivers employed by American<strong>Medical</strong> Response.B. The hospital was cited <strong>for</strong> not reportingthe original meningitis case to thelocal health authorities in a timelymanner and failure to conduct anexposure analysis of employeesexposed to the disease <strong>for</strong> a weekafter the exposure. The hospital wasalso cited <strong>for</strong> not implementing anATD program, not providing postexposurein<strong>for</strong>mation to employees,not properly fit-testing employees <strong>for</strong>respirators and not providing medicaltreatment <strong>for</strong> the exposed employee.Proposed penalties were $101,485.C. Oakland Police Department was cited<strong>for</strong> failing to develop and implementan ATD program, not notifying theFire Department and AmericanResponse of the officer’s exposure,not obtaining a medical evaluation ofthe exposed employee, failing toreport the hospitalization toCal/OSHA and not notifying the officerof his exposure to meningitis. Proposedpenalties were $31,520.D.
