3. Definitions and interpretation[Varied by PR994478, PR997772, PR503684]Registered and Licensed Clubs Award 20103.1 In this award, unless the contrary intention applies:Act means the Fair Work Act 2009 (Cth)[Definition of agreement-based transitional instrument inserted by PR994478 from 01Jan10]agreement-based transitional instrument has the meaning in the Fair Work(Transitional Provisions and Consequential Amendments) Act 2009 (Cth)assistant secretary/manager, assistant general manager, assistant chief executiveofficer, assistant secretary or assistant manager means an employee who isappointed by the club’s Board of Directors or Committee of Management to assistand in the absence of the Secretary/Manager, General Manager, Chief ExecutiveOfficer, Secretary or Manager, to undertake duties the major and substantial part ofwhich is responsibility for the duties of the employees as definedaward-based transitional instrument has the meaning in the Fair Work(Transitional Provisions and Consequential Amendments) Act 2009 (Cth)club means any club which is registered and licensed under the provisions ofrelevant State or Commonwealth Statutes (Liquor and/or Gaming Acts, Associations’Incorporation Acts or Corporations Acts) and which is established and operates on anot-for-profit basis for the benefit of members and the communityclub manager means a person appointed as such who is responsible for the directionand overall operation of a registered and licensed club, subject to the strategicdirection determined by its Board of Directors or Committee of Management. Registered and Licensed Clubs Award 2010maintenance and horticultural employee means an employee engaged in aclassification referred to in clause C.9 of Schedule C—Classification DefinitionsNES means the National Employment Standards as contained in sections 59 to 131of the Fair Work Act 2009 (Cth)[Definition of on-hire inserted by PR994478 from 01Jan10]on-hire means the on-hire of an employee by their employer to a client, where suchemployee works under the general guidance and instruction of the client or arepresentative of the clientpublic holiday means a day identified as a public holiday in the NESrostered day off means any continuous 24 hour period between the completion ofthe last ordinary shift and the commencement of the next ordinary shift on which anemployee is rostered for dutyshiftworker means a seven day shiftworker who is regularly rostered to work onSundays and public holidays, and includes a club managerspread of hours means the period of time elapsing from the time an employeecommences duty to the time the employee ceases duty within any period of 24 hoursstandard rate means the minimum wage for the Level 4 classification (Cook(tradesperson) grade 3) in clause 17.2. The standard weekly rate means theminimum weekly wage for that classification. The standard hourly rate means theminimum hourly wage for that classification.[Definition of transitional minimum wage instrument inserted by PR994478 from 01Jan10]transitional minimum wage instrument has the meaning in the Fair Work(Transitional Provisions and Consequential Amendments) Act 2009 (Cth)3.2 Where this award refers to a condition of employment provided for in the NES, theNES definition applies.4. Coverage[Varied by PR994478]4.1 This award covers employers of employees engaged in the performance of all or anywork in or in connection with or for clubs registered or recognised under State,Territory or Commonwealth legislation and their employees in the classificationswithin Schedule C—Classification Definitions, to the exclusion of any other modernaward.4.2 To avoid doubt, this award covers the work of bar attendants or stewards employedin a club situated on a football ground, cricket ground or sports ground and personsengaged as greenkeepers, ground attendants, gardeners, propagators, lawn mowerand motor roller drivers and general labourers in the construction and maintenance ofbowling greens and golf courses, but does not cover:(a)(b)persons employed by a student union of a university;employees of municipal, shire or county councils;MA000058 5
