Context (or background)1.1 Wait<strong>in</strong>g restrictions have <strong>be</strong>en <strong>in</strong>troduced <strong>in</strong> <strong>the</strong> area around <strong>the</strong> University <strong>of</strong> Warwick aspart <strong>of</strong> a Section 106 agreement relat<strong>in</strong>g <strong>to</strong> its development. The wait<strong>in</strong>g restrictions wereorig<strong>in</strong>ally <strong>in</strong>troduced as an experimental traffic regulation order, which was varied <strong>in</strong> May2011 <strong>to</strong> <strong>in</strong>clude properties 4 <strong>to</strong> 74 (evens) <strong>Charter</strong> <strong>Avenue</strong>. A petition with 13 signatureshas <strong>be</strong>en received request<strong>in</strong>g that properties 76 <strong>to</strong> 86 (evens) are also <strong>in</strong>cluded.2. Options considered and recommended proposal2.1 In March 2011 <strong>the</strong> review <strong>of</strong> <strong>the</strong> effectiveness <strong>of</strong> <strong>the</strong> University <strong>of</strong> Warwick residentspark<strong>in</strong>g scheme was completed and <strong>the</strong> Cab<strong>in</strong>et Mem<strong>be</strong>r (City Services) approved <strong>the</strong><strong>in</strong>stallation <strong>of</strong> some areas <strong>of</strong> residents' park<strong>in</strong>g, which <strong>in</strong>cluded part <strong>of</strong> <strong>Charter</strong> <strong>Avenue</strong>, <strong>the</strong>section <strong>in</strong> front <strong>of</strong> properties 4 -74 (even num<strong>be</strong>rs) (<strong>be</strong>tween Fletchampstead Highway andSir Henry Parkes Road).2.2 This part <strong>of</strong> <strong>Charter</strong> <strong>Avenue</strong> is with<strong>in</strong> <strong>the</strong> UW residents park<strong>in</strong>g zone. The restriction is'Monday <strong>to</strong> Friday, 8:00am <strong>to</strong> 6:00pm UW permit holders only, or limited wait<strong>in</strong>g 1 hour, noreturn with<strong>in</strong> 2 hours'. Outside <strong>of</strong> <strong>the</strong>se times any vehicle can park <strong>in</strong> <strong>the</strong> road <strong>for</strong> anunlimited time period.2.3 Residents <strong>of</strong> 76 <strong>to</strong> 86 (evens) <strong>Charter</strong> <strong>Avenue</strong> are not <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> residents park<strong>in</strong>gscheme. In this section <strong>of</strong> <strong>Charter</strong> <strong>Avenue</strong> <strong>the</strong>re is no wait<strong>in</strong>g at any time restrictions(double yellow l<strong>in</strong>es) so residents are unable <strong>to</strong> park on <strong>the</strong> road directly outside <strong>the</strong>irhouses. Fur<strong>the</strong>rmore, <strong>the</strong>re is a pedestrian cross<strong>in</strong>g with associated zig-zags.2.4 Fur<strong>the</strong>rmore, residents <strong>of</strong> <strong>the</strong>se properties are unable <strong>to</strong> park on Moat House Lane <strong>for</strong>longer than 1 hour as it is part <strong>of</strong> <strong>the</strong> UW residents park<strong>in</strong>g zone. Their only o<strong>the</strong>r option <strong>to</strong>park on <strong>Charter</strong> <strong>Avenue</strong> <strong>be</strong>yond its junction with Moat House Lane.2.5 The options <strong>to</strong> <strong>be</strong> considered are:(i)(ii)give residents <strong>of</strong> 76 <strong>to</strong> 86 (evens) <strong>Charter</strong> <strong>Avenue</strong> eligibility <strong>to</strong> permits <strong>for</strong> <strong>the</strong> UWresidents park<strong>in</strong>g zone; ordo noth<strong>in</strong>g.2.6 It is recommended that a variation <strong>to</strong> <strong>the</strong> University <strong>of</strong> Warwick Residents Park<strong>in</strong>g Schemetraffic regulation order <strong>be</strong> advertised <strong>to</strong> give residents <strong>of</strong> 76 <strong>to</strong> 86 (evens) <strong>Charter</strong> <strong>Avenue</strong>eligibility <strong>to</strong> permits <strong>for</strong> <strong>the</strong> UW residents park<strong>in</strong>g zone.3. Results <strong>of</strong> consultation undertaken3.1 No consultation has <strong>be</strong>en undertaken <strong>to</strong> date.4. Timetable <strong>for</strong> implement<strong>in</strong>g this decision4.1 The proposed variation <strong>to</strong> <strong>the</strong> traffic regulation order will <strong>be</strong> advertised with<strong>in</strong> <strong>the</strong> next threemonths. The timetable <strong>for</strong> implement<strong>in</strong>g <strong>the</strong> decision will depend on whe<strong>the</strong>r or not <strong>the</strong>reare any objections <strong>to</strong> <strong>the</strong> proposal.3


5. Comments from Direc<strong>to</strong>r <strong>of</strong> F<strong>in</strong>ance and Legal Services5.1 F<strong>in</strong>ancial implicationsThe funds used <strong>to</strong> implement <strong>the</strong> wait<strong>in</strong>g restrictions are from an external source, <strong>the</strong>serelate <strong>to</strong> <strong>the</strong> Section 106 agreement <strong>in</strong> regard <strong>to</strong> <strong>the</strong> development <strong>of</strong> <strong>the</strong> University <strong>of</strong>Warwick. Approximately £41700 rema<strong>in</strong>s <strong>for</strong> <strong>the</strong> on-go<strong>in</strong>g moni<strong>to</strong>r<strong>in</strong>g and ma<strong>in</strong>tenance <strong>of</strong><strong>the</strong> scheme plus <strong>in</strong>troduction <strong>of</strong> any changes.The costs associated with this proposal are limited <strong>to</strong> a contribution <strong>to</strong>wards <strong>the</strong> costs <strong>of</strong>advertis<strong>in</strong>g this and o<strong>the</strong>r wait<strong>in</strong>g restriction changes across <strong>the</strong> city, plus those associatedwith process<strong>in</strong>g and issu<strong>in</strong>g <strong>the</strong> permits. No additional signs or road mark<strong>in</strong>gs are required.It is estimated that <strong>the</strong> costs will not exceed £500.5.2 Legal implications.The Council varies or revokes wait<strong>in</strong>g restrictions by mak<strong>in</strong>g a Traffic Regulation Order.This <strong>in</strong>volves a statu<strong>to</strong>ry consultation and notice/objection process.When consider<strong>in</strong>g whe<strong>the</strong>r it would <strong>be</strong> expedient <strong>to</strong> make a traffic order <strong>the</strong> Council isunder a duty <strong>to</strong> have regard <strong>to</strong> and balance various potentially conflict<strong>in</strong>g fac<strong>to</strong>rs, <strong>for</strong>example <strong>the</strong> convenient/safe movement <strong>of</strong> traffic, adequate park<strong>in</strong>g, improv<strong>in</strong>g orpreserv<strong>in</strong>g local amenity, air quality, public transport provision.6. O<strong>the</strong>r implications6.1 How will this contribute <strong>to</strong> achievement <strong>of</strong> <strong>the</strong> Council's key objectives / corporatepriorities (corporate plan/scorecard) / organisational bluepr<strong>in</strong>t / Local AreaAgreement (or Coventry Susta<strong>in</strong>able Community Strategy)?This will contribute <strong>to</strong> <strong>the</strong> City Council’s objective <strong>of</strong> mak<strong>in</strong>g Coventry an attractive andenjoyable place <strong>to</strong> <strong>be</strong> <strong>for</strong> <strong>the</strong>se residents, as <strong>the</strong> <strong>in</strong>troduction <strong>of</strong> <strong>the</strong> residents park<strong>in</strong>gscheme is impact<strong>in</strong>g on <strong>the</strong>ir daily lives.
