FOREWORDWhen the European C<strong>on</strong>sortium <str<strong>on</strong>g>of</str<strong>on</strong>g> Foundati<strong>on</strong>s <strong>on</strong> Human Rights <strong>and</strong> Disabilitywas launched in 2009, no <strong>on</strong>e doubted the immense challenge that lay ahead<str<strong>on</strong>g>of</str<strong>on</strong>g> this group as it sought to c<strong>on</strong>vince European governments <strong>and</strong> other relevantstakeholders to commit to the ratificati<strong>on</strong> <strong>and</strong> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the UN C<strong>on</strong>venti<strong>on</strong><strong>on</strong> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> People with Disabilities - the first legally-binding treaty recognisingthe <strong>human</strong> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> people with disabilities.INTRODUCTIONThe C<strong>on</strong>sortium provided <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g> already active in the field <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>disability</strong> or <strong>human</strong><strong>rights</strong> with a unique opportunity to influence the shape <strong>and</strong> speed <str<strong>on</strong>g>of</str<strong>on</strong>g> a l<strong>on</strong>goverdue reform process <strong>on</strong> <strong>disability</strong>. It was also a chance for <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g> workingwith a variety <str<strong>on</strong>g>of</str<strong>on</strong>g> populati<strong>on</strong> groups, from the elderly to women <strong>and</strong> migrants toapply their expertise in this emerging field <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>disability</strong>.Three years since its launch, I am greatly pleased to see the c<strong>on</strong>siderable strides<strong>and</strong> achievements made by the C<strong>on</strong>sortium, which clearly shows how <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g> can add significant value <strong>and</strong>fill the gaps left by governments, NGOs <strong>and</strong> other actors in implementing the C<strong>on</strong>venti<strong>on</strong>. This report charts thiswork <strong>and</strong> highlights the key priorities set <strong>and</strong> milest<strong>on</strong>es met by the C<strong>on</strong>sortium – Let me menti<strong>on</strong> just a few <str<strong>on</strong>g>of</str<strong>on</strong>g>these. One is the launch <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>sortium’s first operati<strong>on</strong>al project - the ‘League <str<strong>on</strong>g>of</str<strong>on</strong>g> Historical Accessible Cities’ - t<str<strong>on</strong>g>of</str<strong>on</strong>g>ind innovative soluti<strong>on</strong>s to improving the accessibility <str<strong>on</strong>g>of</str<strong>on</strong>g> historical towns by working in partnership with variousEuropean <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g> <strong>and</strong> local authorities. By focusing equally <strong>on</strong> improving accessibility while at the same timepreserving historical heritage, the collaborati<strong>on</strong> has been an undoubted success.Another important piece <str<strong>on</strong>g>of</str<strong>on</strong>g> work was the publicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the “Study <strong>on</strong> the challenges <strong>and</strong> good practices in the implementati<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> the UN C<strong>on</strong>venti<strong>on</strong>”. I am pleased to see that our analyses <strong>and</strong> recommendati<strong>on</strong>s have c<strong>on</strong>tributedto shaping the European debate about the strategic directi<strong>on</strong> <strong>and</strong> dynamics <str<strong>on</strong>g>of</str<strong>on</strong>g> European <strong>disability</strong> law reform, <strong>and</strong>more c<strong>on</strong>cretely the new European Disability Strategy 2010-2020. The C<strong>on</strong>sortium thus far has been a productivepartnership, which serves as an example <str<strong>on</strong>g>of</str<strong>on</strong>g> how to develop a more strategic engagement between EU instituti<strong>on</strong>s<strong>and</strong> <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g>.I am fully c<strong>on</strong>vinced that given the current ec<strong>on</strong>omic crisis we must double our efforts to improve our efficiency<strong>and</strong> efficacy <strong>and</strong> working together will be more necessary than ever. With the C<strong>on</strong>sortium, we have dem<strong>on</strong>stratedthat setting up partnerships am<strong>on</strong>g <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g> <strong>and</strong> other organisati<strong>on</strong>s can create leverage, making moreefficient use <str<strong>on</strong>g>of</str<strong>on</strong>g> our finances, expertise <strong>and</strong> time. Why the C<strong>on</strong>venti<strong>on</strong> matters?The UN C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Pers<strong>on</strong>s with Disabilities is the first <strong>human</strong> <strong>rights</strong> treaty<str<strong>on</strong>g>of</str<strong>on</strong>g> the 21st century which cleverly combines civil <strong>and</strong> political <strong>rights</strong>, as well as ec<strong>on</strong>omic,social <strong>and</strong> cultural <strong>rights</strong> with the overarching theory <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-discriminati<strong>on</strong>. Up untilthe C<strong>on</strong>venti<strong>on</strong>, <strong>human</strong> <strong>rights</strong> had not been a framework in which to c<strong>on</strong>sider <strong>disability</strong>.Instead, a mixture <str<strong>on</strong>g>of</str<strong>on</strong>g> social policies, charity <strong>and</strong> paternalism was adopted, which maintainedthe status quo rather than providing equal <strong>rights</strong> to people with disabilities. That allchanged with C<strong>on</strong>venti<strong>on</strong>, which clearly moved the questi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>disability</strong> to the core <str<strong>on</strong>g>of</str<strong>on</strong>g> theUN <strong>human</strong> <strong>rights</strong> agenda.The C<strong>on</strong>venti<strong>on</strong> refers to the “universality, indivisibility, interdependence <strong>and</strong> interrelatedness<str<strong>on</strong>g>of</str<strong>on</strong>g> all <strong>human</strong> <strong>rights</strong> <strong>and</strong> fundamental freedoms”, a paradigm first affirmed by the 1993Vienna World C<strong>on</strong>ference <strong>on</strong> Human Rights. The inclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this wording signals a “coming<str<strong>on</strong>g>of</str<strong>on</strong>g> age” in <strong>human</strong> <strong>rights</strong> st<strong>and</strong>ard-setting, not just within the area <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>disability</strong> <strong>rights</strong>, but more generally in the development<str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al st<strong>and</strong>ards in equality <strong>and</strong> <strong>human</strong> <strong>rights</strong> law.A number <str<strong>on</strong>g>of</str<strong>on</strong>g> elements in the C<strong>on</strong>venti<strong>on</strong> are worth highlighting. One is the explicit reference to equality, which goesmuch further than equality before the law, equal treatment <strong>and</strong> equal opportunity, <strong>and</strong> corresp<strong>on</strong>ds with best modernpractices such as those developed in the EU <strong>on</strong> equal participati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> people with disabilities. This is a remarkable breakthroughc<strong>on</strong>sidering that no previous UN C<strong>on</strong>venti<strong>on</strong>s menti<strong>on</strong> equality, opting instead for n<strong>on</strong>-discriminati<strong>on</strong> wording.The C<strong>on</strong>venti<strong>on</strong> also emphasises the importance <str<strong>on</strong>g>of</str<strong>on</strong>g> mainstreaming <strong>disability</strong> issues within relevant strategies for sustainabledevelopment that seek to cover the <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> other vulnerable groups. While this may sound familiar to a policyexpert in the field, this principle has not been explicit in <strong>human</strong> <strong>rights</strong> law. It suggests a modern underst<strong>and</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> “<strong>human</strong>agency” <strong>and</strong> the related issue <str<strong>on</strong>g>of</str<strong>on</strong>g> legal capacity while at the same time stressing individual aut<strong>on</strong>omy <strong>and</strong> independence.This is a welcome departure from the traditi<strong>on</strong>al image <str<strong>on</strong>g>of</str<strong>on</strong>g> the “victim” denoted in earlier <strong>human</strong> <strong>rights</strong> law.Recognising the complex, multi-layered nature <str<strong>on</strong>g>of</str<strong>on</strong>g> discriminati<strong>on</strong> is another significant element <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>venti<strong>on</strong>, whichreflects current efforts by anti-discriminati<strong>on</strong> lawyers, particularly in the EU, to codify prohibiti<strong>on</strong>s against multiple instances<str<strong>on</strong>g>of</str<strong>on</strong>g> discriminati<strong>on</strong>. The C<strong>on</strong>venti<strong>on</strong> makes a helpful link between the enjoyment <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>human</strong> <strong>rights</strong> <strong>and</strong> the eradicati<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> poverty, <strong>and</strong> in this regard recognises the critical need to address the negative impact <str<strong>on</strong>g>of</str<strong>on</strong>g> poverty <strong>on</strong> pers<strong>on</strong>s withdisabilities <strong>and</strong> other vulnerable groups.New ground is also broken in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> who is legally bound by the C<strong>on</strong>venti<strong>on</strong>. While EC law <strong>on</strong> discriminati<strong>on</strong> has alwayscovered private parties (as it derives from employment law), the questi<strong>on</strong> is not as straightforward in <strong>human</strong> <strong>rights</strong> law.The C<strong>on</strong>venti<strong>on</strong> makes explicit that the State is obliged ”to take all appropriate measures to eliminate discriminati<strong>on</strong> <strong>on</strong>the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>disability</strong> by any pers<strong>on</strong>, organisati<strong>on</strong> or private enterprise.”While progressive <strong>and</strong> significant, n<strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> the abovementi<strong>on</strong>ed can be in any way meaningful without <strong>on</strong>e last, vital element<str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>venti<strong>on</strong>, namely that EU <strong>and</strong> public authorities ”closely c<strong>on</strong>sult with <strong>and</strong> actively involve pers<strong>on</strong>s withdisabilities”. INTRODUCTIONWHO WE AREThe EFC European C<strong>on</strong>sortium <str<strong>on</strong>g>of</str<strong>on</strong>g> Foundati<strong>on</strong>s <strong>on</strong> Human Rights <strong>and</strong> Disability (Hereafter referred to as the “C<strong>on</strong>sortium”)brings together funders <strong>and</strong> other stakeholders committed to promoting the implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the UN C<strong>on</strong>venti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>the Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> People with Disabilities (Hereafter referred to as the “C<strong>on</strong>venti<strong>on</strong>”). After the C<strong>on</strong>venti<strong>on</strong>’s entry into force in2008, a group <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g> led by Fundación ONCE resp<strong>on</strong>ded by forming a C<strong>on</strong>sortium which was launched during anevent held at the European Parliament in April 2009.OUR GOALTo breathe life <strong>and</strong> vigour into the applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the UN C<strong>on</strong>venti<strong>on</strong> in Europe; <strong>and</strong> to mobilise the foundati<strong>on</strong> sector toplay a catalytic role in ensuring that European governments <strong>and</strong> other relevant stakeholders commit to <strong>and</strong> support boththe ratificati<strong>on</strong> <strong>and</strong> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>venti<strong>on</strong>.OUR OBJECTIVESThe C<strong>on</strong>sortium’s activities are divided into four areas:1. Zero Project C<strong>on</strong>ferencein Vienna (Austria) inJanuary 2012ZERO PROJECTACHIEVEMENTSThe C<strong>on</strong>sortium collaborated with the EsslFoundati<strong>on</strong> in the “2012 Zero Project Report”<strong>and</strong> its predecessor the “2010 Social Index PilotStudy”. This annual study aims to give a picture<str<strong>on</strong>g>of</str<strong>on</strong>g> the implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>venti<strong>on</strong>in Europe. The methodology is based <strong>on</strong> socialindicators assessed (using a survey) by a network<str<strong>on</strong>g>of</str<strong>on</strong>g> experts from nati<strong>on</strong>al NGOs, <str<strong>on</strong>g>foundati<strong>on</strong>s</str<strong>on</strong>g>,universities, am<strong>on</strong>g others. The result is a completeoverview <str<strong>on</strong>g>of</str<strong>on</strong>g> the legal situati<strong>on</strong> <strong>and</strong> living c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g>people with disabilities in 36 countries. Examples <str<strong>on</strong>g>of</str<strong>on</strong>g> goodpractices <strong>and</strong> policies have been included in the latest editi<strong>on</strong>.The full 2012 report <strong>and</strong> an <strong>on</strong>going compilati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> good practices <strong>and</strong>good policies are available from www.zeroproject.org.The C<strong>on</strong>sortium also participated in the “Internati<strong>on</strong>al C<strong>on</strong>ference <strong>on</strong> Good Policies for Disabled People”, held in Vienna <strong>on</strong>January 2012 <strong>and</strong> organised by the Essl Foundati<strong>on</strong>, the World Future Council <strong>and</strong> Bank Austria within the framework <str<strong>on</strong>g>of</str<strong>on</strong>g>the Zero Project. This high-level event gathered over 240 internati<strong>on</strong>al decisi<strong>on</strong>-makers <strong>and</strong> experts <strong>on</strong> accessibility, NGO<strong>and</strong> foundati<strong>on</strong> representatives, academics <strong>and</strong> <strong>disability</strong> <strong>rights</strong> activists to discuss the internati<strong>on</strong>ally exemplary aspects<str<strong>on</strong>g>of</str<strong>on</strong>g> eight previously selected “Good Policies”. These policies focused <strong>on</strong> accessibility, inclusive educati<strong>on</strong>, supported decisi<strong>on</strong>-making<strong>and</strong> access to justice <strong>and</strong> were selected by a scientific advisory board in a carefully designed research <strong>and</strong>evaluati<strong>on</strong> process.Impact: Identificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> good practices <strong>and</strong> c<strong>on</strong>necting implementati<strong>on</strong> efforts at nati<strong>on</strong>al <strong>and</strong> local levels.MAINSTREAMING DISABILITY IN ADVOCACY WORKThe C<strong>on</strong>sortium focused <strong>on</strong> bringing a <strong>disability</strong> perspective to broader EU advocacy framework, within the EFC, namely it:• C<strong>on</strong>tributed to work within the framework <str<strong>on</strong>g>of</str<strong>on</strong>g> 2012 European Year <str<strong>on</strong>g>of</str<strong>on</strong>g> Active Ageing <strong>and</strong> Solidarity between Generati<strong>on</strong>s.The League <str<strong>on</strong>g>of</str<strong>on</strong>g> Historical <strong>and</strong> Accessible Cities project was included in a Roadmap drafted by a coaliti<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> stakeholders, including the EFC, whose aim is to work together to bring about an age-friendly European Uni<strong>on</strong>by 2020• C<strong>on</strong>tributed to EC public c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong> the future EU “Accessibility Act” (February 2012)• Chaired a panel discussi<strong>on</strong> at a forum <strong>on</strong> the implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>venti<strong>on</strong> organised by the European Commissi<strong>on</strong>(October 2011)9

Established in 2010, the League is thefirst operati<strong>on</strong>al project <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>sortium <strong>and</strong> in line with its commitment <strong>and</strong> willingness to provide a c<strong>on</strong>crete c<strong>on</strong>tributi<strong>on</strong>to the implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the European Disability Strategy.
