II. <strong>What</strong> Does <strong>DRM</strong> Look Like?ing television content, combined with some use ofencryption. Under the “hybrid” version of thescheme, the first step is, as with the broadcast-flagscheme generally, to insert the “broadcast flag”into the digital-television signal. If that signal is notitself encrypted, there are no technical barriers toremoval of this flag.For this reason, the <strong>DRM</strong> Hybrid version of thebroadcast-flag scheme would require a legal orregulatory mandate that receivers check for thebroadcast flag, and apply an approved <strong>DRM</strong>method (such as encryption or “tethering” thereceived content to a particular home entertainmentsystem or user) to the content if it is markedwith the flag.The <strong>DRM</strong> Hybrid version of the broadcast flagapproach illustrates a problem with marking systemsgenerally — whether one is using a “pure” markingscheme or a <strong>DRM</strong> hybrid version of the scheme,there is a general requirement that the scheme bebuttressed by government regulation of some sort.This brings us to our next policy question.18
