III. <strong>Should</strong> <strong>DRM</strong> Be ImposedBy the Government?No treatment of the copy-protectionmandateissue (which hereafter we’llrefer to as “technology mandates” orsimply “mandates”) can proceed withoutrecognizing that a confluence of severalfactors has brought copyright issues tothe center of the public-policy arena.Although not quite commanding thesame attention as, say, counterterrorismmeasures or foreign-policy concerns,copyright issues have risen to the top ofthe discussion of broadband-Internetpolicy and digital-television policy inaddition to commanding attention ontheir own.The reason for this increasingly evidentintersection of copyright policyand technology policy lies in the fundamentalnature of the personal computeritself. Computers are designed to copyand manipulate data with ease and withaccuracy, (e.g., from hard disk to RAM,or from your e-mail program to afriend’s). This copying is part of theessential functionality of computers. Forthis reason, the increasing ubiquity ofpowerful but inexpensive general-purposecomputers poses a particular challengefor copyright holders whoseinterests lie in digital works.A Brief History ofSoftware Copy ProtectionFor some copyright holders, this challengehas long been apparent. Softwaremakers in the 1970s and 1980s werefully aware that computers could beused to make unlicensed copies of theirproducts. Many and perhaps most softwaremakers attempted to use various“copy protection” technologies to preventusers from making copies of commercialsoftware; these efforts were lessthan completely successful in large partbecause general-purpose computerscould be programmed to edit or alterthe very copy-protection measure thatwas designed to prevent copying.
