Box 202, 3970 AE Driebergen, <strong>The</strong> Ne<strong>the</strong>rlandsSUMMARYS<strong>in</strong>ce 1992 over a third <strong>of</strong> all police-<strong>of</strong>ficers, i.e. basis-police<strong>of</strong>ficers, specialists andmanagers, have followed one <strong>of</strong> <strong>the</strong> specially designed environmental courses. An <strong>in</strong>formationmodule on environmental police-<strong>in</strong>formation was designed, to make communication possibleon <strong>in</strong>terregional and national level. <strong>The</strong> module is based on a handbook on <strong>the</strong> environmentaltask. All <strong>the</strong> necessary arrangements and studies have been carried out to establish anenvironmental <strong>in</strong>formation and expertise centre for <strong>the</strong> police.<strong>The</strong> number <strong>of</strong> <strong>of</strong>ficial reports and facts found on environmental matters have <strong>in</strong>creaseddrastically over <strong>the</strong> last years. <strong>The</strong> police have <strong>in</strong> 1994 reported 8924 facts and <strong>in</strong> 1995 11385.<strong>The</strong> year <strong>1996</strong> seems to show a stabilisation. On serious environmental crime 56 cases werestarted 1995. Over 30 <strong>of</strong> those are still <strong>in</strong> process. <strong>The</strong> CITES-project (Convention on IllegalTrade <strong>in</strong> Endangered Species) has directly contributed to <strong>the</strong> start <strong>of</strong> 7 specific <strong>in</strong>vestigations.Much effort has also been put <strong>in</strong>to design<strong>in</strong>g-tra<strong>in</strong><strong>in</strong>g modules, provid<strong>in</strong>g <strong>in</strong>formation and educationon CITES and operat<strong>in</strong>g a help desk.1 ORGANIZATION, AUTHORITY AND MANAGEMENT<strong>The</strong> police force <strong>of</strong> <strong>the</strong> Ne<strong>the</strong>rlands is comprised <strong>of</strong> 25 <strong>in</strong>dependent regional policeforces, which vary <strong>in</strong> size from 400 to 5000 <strong>of</strong>ficers, and a National <strong>Police</strong> Force <strong>of</strong> about 3000<strong>of</strong>ficers. <strong>The</strong> regional forces are subdivided <strong>in</strong>to districts and operat<strong>in</strong>g units. <strong>The</strong> total policeforce numbers about 40,000 <strong>of</strong>ficers on a population <strong>of</strong> 15 million.<strong>The</strong> authority and management <strong>of</strong> <strong>the</strong> police are organized on a regional basis: thisrests with <strong>the</strong> Chief Public Prosecutor, and <strong>the</strong> regional head <strong>of</strong> <strong>the</strong> police force who is <strong>the</strong> mayor<strong>of</strong> <strong>the</strong> largest city <strong>in</strong> <strong>the</strong> region. A board <strong>of</strong> all mayors <strong>in</strong> <strong>the</strong> region has an important voice <strong>in</strong>management questions. <strong>The</strong> local authority on matters <strong>of</strong> public order is <strong>the</strong> mayor <strong>of</strong> <strong>the</strong>municipality concerned. Crim<strong>in</strong>al enforcement is conducted under <strong>the</strong> authority <strong>of</strong> <strong>the</strong> PublicProsecutor.<strong>The</strong> enforcement <strong>of</strong> environmental legislation is based on <strong>the</strong> regions as def<strong>in</strong>ed <strong>in</strong>connection with <strong>the</strong> ‘Jo<strong>in</strong>t Regulations Act’. This is a level <strong>of</strong> collaboration <strong>in</strong> which a number <strong>of</strong>(mostly smaller) municipalities synchronize <strong>the</strong>ir efforts. On occasion <strong>the</strong>y also make agreementswith o<strong>the</strong>r enforcement authorities active <strong>in</strong> this area. <strong>The</strong> synchronization activities concern <strong>the</strong>sett<strong>in</strong>g <strong>of</strong> priorities, and <strong>the</strong> approach to <strong>the</strong> enforcement <strong>of</strong> <strong>the</strong> environmental legislation.<strong>The</strong> police play a part <strong>in</strong> this consultation and synchronization process. An environmentalcoord<strong>in</strong>ator (a staff <strong>of</strong>ficer or an <strong>of</strong>ficer <strong>in</strong>volved with policy-mak<strong>in</strong>g) <strong>of</strong>ten participates <strong>in</strong> <strong>the</strong>seconsultations. <strong>The</strong> l<strong>in</strong>e management is also becom<strong>in</strong>g <strong>in</strong>volved to an <strong>in</strong>creas<strong>in</strong>g extent. Localconsultations are also <strong>of</strong>ten held with<strong>in</strong> each municipality, <strong>in</strong> which <strong>the</strong> police also participate.Enforcement activities are also synchronized <strong>in</strong> prov<strong>in</strong>cial environmental consultations.<strong>The</strong> police have also been entrusted with <strong>the</strong> enforcement <strong>of</strong> environmental legislationby <strong>the</strong> M<strong>in</strong>ister <strong>of</strong> Hous<strong>in</strong>g, Spatial Plann<strong>in</strong>g and <strong>the</strong> Environment. In <strong>the</strong> first <strong>in</strong>stance <strong>the</strong> attention<strong>of</strong> <strong>the</strong> police was focused on participation <strong>in</strong> <strong>the</strong> above-mentioned enforcement organization.This participation has now been realized throughout <strong>the</strong> Ne<strong>the</strong>rlands.

4FOURTH INTERNATIONAL CONFERENCE ON ENVIRONMENTAL COMPLIANCE AND ENFORCEMENT3 OPERATIONAL DUTIES: THE NUMBER OF OFFICIAL REPORTS, SERIOUSENVIRONMENTAL CRIME, WASTE STREAMS, #CITES3.1 Number <strong>of</strong> <strong>of</strong>ficial reports<strong>The</strong> police are mak<strong>in</strong>g <strong>in</strong>creas<strong>in</strong>g efforts <strong>in</strong> <strong>the</strong> area <strong>of</strong> <strong>the</strong> enforcement <strong>of</strong> environmentallegislation. <strong>The</strong>se efforts cannot be measured solely by <strong>the</strong> number <strong>of</strong> <strong>of</strong>ficial reports that havebeen made, although this does give a good <strong>in</strong>dication. <strong>The</strong>re has been a clear <strong>in</strong>crease <strong>in</strong> <strong>the</strong>number <strong>of</strong> <strong>of</strong>ficial reports from 1994 onwards. It can also be seen that <strong>the</strong>re is a reasonablerange <strong>in</strong> <strong>the</strong> k<strong>in</strong>ds <strong>of</strong> <strong>of</strong>ficial reports made.Summary <strong>of</strong> <strong>the</strong> <strong>of</strong>ficial reports made by <strong>the</strong> police <strong>in</strong> 1994 and 1995:- 1994 - 8.924 facts- 1995 - 11.385 facts<strong>The</strong> Dutch national police corps is not <strong>in</strong>cluded <strong>in</strong> <strong>the</strong>se figures. <strong>The</strong> figures <strong>of</strong> <strong>the</strong> firsthalf <strong>of</strong> <strong>1996</strong> show a stabilisation <strong>of</strong> <strong>the</strong> number <strong>of</strong> <strong>of</strong>ficial reports. <strong>The</strong> exact number is close to<strong>the</strong> number <strong>of</strong> <strong>the</strong> first half <strong>of</strong> 1995. <strong>The</strong> figures shown give no <strong>in</strong>formation about <strong>the</strong> character/size <strong>of</strong> <strong>the</strong> reports made or <strong>the</strong> type <strong>of</strong> facts <strong>in</strong>volved. This <strong>in</strong>formation was not yet available forme.3.2 (Serious) environmental crimeDeal<strong>in</strong>g with serious environmental crime is a matter which is receiv<strong>in</strong>g <strong>in</strong>creas<strong>in</strong>gattention from many authorities, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> regional police forces. Problems are <strong>of</strong>tenencountered with <strong>the</strong> manpower available, and <strong>the</strong> knowledge which is required. <strong>The</strong>se are two<strong>of</strong> <strong>the</strong> reasons for <strong>the</strong> formation <strong>of</strong> <strong>the</strong> ‘core’ environmental team. <strong>The</strong> team formed to <strong>in</strong>vestigate<strong>the</strong> notorious TCR/TCA case <strong>in</strong> <strong>the</strong> Ne<strong>the</strong>rlands was not disbanded, but rema<strong>in</strong>ed <strong>in</strong> existence<strong>in</strong> order to help <strong>the</strong> regional forces build up <strong>the</strong> knowledge <strong>the</strong>y need. <strong>The</strong> TCR case yielded anamount <strong>of</strong> <strong>in</strong>formation which would have been sufficient to start seven cases immediately.<strong>The</strong> acquisition <strong>of</strong> <strong>the</strong> required knowledge and <strong>the</strong> necessary manpower with<strong>in</strong> <strong>the</strong>regional forces is now <strong>in</strong> progress. <strong>The</strong> forces are gradually develop<strong>in</strong>g <strong>the</strong>ir potential to be ableto deal with <strong>in</strong>creas<strong>in</strong>gly larger cases. As such cases <strong>of</strong>ten need more resources than can besupplied by one police force, agreements are <strong>of</strong>ten used to enable a number <strong>of</strong> regions tocollaborate on <strong>the</strong> case. Information from <strong>the</strong> Crim<strong>in</strong>al Information Department <strong>of</strong> <strong>the</strong> National<strong>Police</strong> Force <strong>in</strong>dicates that <strong>the</strong> police dealt with <strong>the</strong> follow<strong>in</strong>g numbers <strong>of</strong> cases <strong>in</strong> 1994. <strong>The</strong>number <strong>of</strong> cases started <strong>in</strong> 1995 is 56. Over 30 cases are still <strong>in</strong> process. <strong>The</strong>re have also beenabout 10 pre-<strong>in</strong>vestigations that were closed as such; <strong>the</strong> <strong>in</strong>foramtion was not enough to start acase.If <strong>the</strong> share <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigative authorities and <strong>the</strong> total <strong>of</strong> <strong>the</strong> environmental casesunder <strong>the</strong> Economic Offences Act are exam<strong>in</strong>ed <strong>the</strong>n it can be seen that <strong>the</strong> share <strong>of</strong> <strong>the</strong> regionalpolice forces is by far <strong>the</strong> largest. <strong>The</strong> share <strong>of</strong> <strong>the</strong> regional police forces <strong>in</strong>creased from 56% <strong>in</strong>1992 to 62% <strong>in</strong> 1994.<strong>The</strong> share <strong>of</strong> <strong>of</strong>ficial reports from <strong>the</strong> General Inspectorate decreased dur<strong>in</strong>g this sameperiod from 23% (1725 reports) <strong>in</strong> 1992, to 16% (1456 reports) <strong>in</strong> 1994. <strong>The</strong> reason for thisdecrease was <strong>the</strong> improved compliance with <strong>the</strong> Determ<strong>in</strong>ation <strong>of</strong> Year-End Form Regulations.

6FOURTH INTERNATIONAL CONFERENCE ON ENVIRONMENTAL COMPLIANCE AND ENFORCEMENT<strong>The</strong> figures also reflect a decrease <strong>in</strong> <strong>the</strong> number <strong>of</strong> <strong>of</strong>ficial reports made by <strong>the</strong> portauthorities, <strong>in</strong> particular <strong>the</strong> Municipal Port Management <strong>of</strong> Rotterdam, on <strong>the</strong> grounds <strong>of</strong> <strong>the</strong>Pollution <strong>of</strong> Surface Waters Act. In 1992 387 <strong>of</strong>ficial reports were made, which fell to 210 reports<strong>in</strong> 1994.Ano<strong>the</strong>r strik<strong>in</strong>g development is <strong>the</strong> <strong>in</strong>crease <strong>in</strong> <strong>the</strong> share <strong>of</strong> ‘o<strong>the</strong>rs’ <strong>in</strong> <strong>the</strong> number <strong>of</strong><strong>of</strong>ficial reports. This is caused by <strong>the</strong> <strong>in</strong>creased enforcement <strong>of</strong> <strong>the</strong> Endangered Exotic Animaland Plant Species Act and <strong>the</strong> Import and Export (Endangered Exotic Animal and Plant Species)Decree by Customs.3.3 Waste streamsDur<strong>in</strong>g 1992 it became clear that extra efforts were needed to obta<strong>in</strong> an <strong>in</strong>sight <strong>in</strong>towaste, <strong>in</strong> particular waste streams, both with<strong>in</strong> <strong>the</strong> country and transfrontier. This was <strong>the</strong> duty <strong>of</strong><strong>the</strong> National <strong>Police</strong> Force, which is entrusted with <strong>the</strong> supervision <strong>of</strong> <strong>the</strong> through roads andwaterways, <strong>the</strong> regional police forces, <strong>the</strong> National Transport Inspectorate, Customs, and <strong>the</strong>Inspectorate for <strong>the</strong> Environment. A jo<strong>in</strong>t project was <strong>in</strong>itiated to tra<strong>in</strong> a large number <strong>of</strong> <strong>of</strong>ficersfor <strong>the</strong> enforcement <strong>of</strong> <strong>the</strong> European Regulation on <strong>the</strong> supervision and control <strong>of</strong> shipments <strong>of</strong>waste.<strong>The</strong> above-named authorities collaborated <strong>in</strong> several major waste <strong>in</strong>spections (<strong>the</strong> video<strong>in</strong> <strong>the</strong> exhibition shows an example). <strong>The</strong> police are also conduct<strong>in</strong>g an <strong>in</strong>creas<strong>in</strong>g number <strong>of</strong><strong>in</strong>dependent smaller-scale <strong>in</strong>spections. <strong>The</strong> National <strong>Police</strong> Force is us<strong>in</strong>g <strong>in</strong>spection forms <strong>in</strong>order to obta<strong>in</strong> an <strong>in</strong>dication <strong>of</strong> <strong>the</strong> movement <strong>of</strong> waste streams over <strong>the</strong> larger transportationroutes. A comprehensive national project under <strong>the</strong> direction <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Hous<strong>in</strong>g, SpatialPlann<strong>in</strong>g and <strong>the</strong> Environment toge<strong>the</strong>r with <strong>in</strong>itiatives by <strong>the</strong> National <strong>Police</strong> Force have <strong>the</strong> aim<strong>of</strong> giv<strong>in</strong>g a new impulse to <strong>the</strong> enforcement <strong>of</strong> <strong>the</strong> legislation on <strong>the</strong> transport <strong>of</strong> waste substances.3.4 CITESA national agreement has been signed between <strong>the</strong> police forces <strong>of</strong> Rotterdam/Rijnmond, <strong>the</strong> National <strong>Police</strong> Force/Crim<strong>in</strong>al Information Department and <strong>the</strong> GeneralInspectorate <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Agriculture, Nature Management and Fisheries. This purpose <strong>of</strong>this agreement is to stimulate <strong>the</strong> enforcement <strong>of</strong> <strong>the</strong> Endangered Exotic Animal Species Actand <strong>the</strong> CITES Decree. At <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> <strong>1996</strong> <strong>the</strong> agreement was prolonged for a fur<strong>the</strong>r twoyears. A lot <strong>of</strong> patience is needed to get a clear picture <strong>of</strong> this area, and ensure that specificenforcement activities are taken.<strong>The</strong> project has contributed towards <strong>the</strong> current situation <strong>in</strong> which 7 specific <strong>in</strong>vestigationsare <strong>in</strong> progress. One case is already brought to court.Apart form hav<strong>in</strong>g contributed to judicial cases, <strong>the</strong> project has implemented a helpdeskon <strong>the</strong> CITES-subject. Ano<strong>the</strong>r major activity has been <strong>the</strong> design<strong>in</strong>g <strong>of</strong> education and tra<strong>in</strong><strong>in</strong>gprogrammes,especially for police-<strong>of</strong>ficers work<strong>in</strong>g <strong>in</strong> <strong>the</strong> general task as well as for those work<strong>in</strong>g<strong>in</strong> <strong>the</strong> crim<strong>in</strong>al departments. Last but not least provid<strong>in</strong>g <strong>in</strong>formation and education on CITEShas taken a lot <strong>of</strong> time and energy.
