Cobb County Business License Division 4New Alcoholic Beverage Establishment ApplicationRevised 3/1021. Zoning – Page 16, Question 37 of the alcoholic beverage application must be completed and oneplat signed by a member of the Zoning Division indicating the zoning designation of the proposedlocation must be provided.22. Each application for a location which has not previously been occupied for other than residentialpurposes or on which there is or is to be new construction shall also include a copy of a site planapproved by all the departments in the site plan review process. This plan can be obtainedthrough the Site Plan Review Section of the Development & Inspections Division. If a SitePlan is unavailable, a current Certificate of Occupancy is acceptable upon approval of theBusiness License Division Manager.23. Provide blueprints (approved by Zoning Division & Development Inspections Division) ofthe proposed building if it is a new location.24. NOTICE - Any and all false information provided to the Business License Division verballyor written will subject the person that provides this false information to prosecution to the fullextent of the law and will subject the application to denial or revocation.25. LIQUOR PACKAGE ONLY- Submit drawings or snapshots of the location of theexisting building to show compliance with Section 6-129 of the Cobb County Code of Ordinances.A five percent (5%) tax on liquor package sales must be collected on annual gross sales of liquorbetween $100,000 and $178,000. This tax will not exceed $3,900.00 annually and is in addition tothe annual license fee. This tax must be submitted on the appropriate tax form to the Cobb CountyBusiness License Division at P.O. BOX 649, Marietta, Georgia, 30061-0649. Taxes must besubmitted by the twentieth (20 th ) of each month following the month that the tax was collected. Itis the responsibility of the license holder to obtain the appropriate tax forms from the BusinessLicense Office and submit them to the Business License Office in a timely manner.26. LIQUOR POURING ONLY- A three percent (3%) tax on the price of all drinks containingspirituous liquor, sold by the drink, must be collected by the liquor pouring license holder. This taxmust be submitted on the appropriate tax form to the Cobb County Business License Division at P.O.BOX 649, Marietta, Georgia, 30061-0649., utilizing the appropriate tax form. These taxes mustbe submitted by the twentieth (20 th ) of each month following the month the tax was collected.It is the responsibility of the license holder to obtain the appropriate tax forms from the BusinessLicense Office.27. SUBSTITUTE LICENSEE- An application, personal statement, consent form, on the substitutelicensee and his/her spouse and the same documentation required for a licensee may also beprovided for a substitute licensee as provided in Section 6-92(f) of the Cobb County Code ofOrdinances and may be submitted in addition to the licensee and approved as a substitute licenseeto avoid the disruption of alcoholic beverage sales. The substitute licensee may serve as thelicensee in the event the licensee leaves the business or is no longer qualified to be the licensee.The substitute licensee must meet all of the qualifications of the licensee and have managementcapacity, as defined in Section 6-1 of the Cobb County Code of Ordinances. For pool tables utilized in the establishment, a separate business license application is required inaddition to the alcoholic beverage application and approval is required for pool tables utilized in theestablishment.29. Once the license is approved, all fees must be paid within fourteen (14) days or thelicense will be void. All alcoholic beverage license fees must be paid with a certifiedcheck.30. For your information - Employees must apply for a permit to serve/sell alcoholic beverages in CobbCounty. See attached Cobb County Alcohol Work Permit affidavit pages (33-35.) To obtain a CobbCounty Alcohol Server’s Permit, go to the Cobb County Police Permits Unit located at 154 NorthMarietta Parkway, Marietta, Georgia 30060. (Phone: 770-499-3943). The work permit is valid at onlyone location. If your employee is selling alcohol at more than one location for more than onecompany, more than one alcohol permit is required. Employees who possess an alcohol work permit ata different location do not have a valid alcohol work permit until they change the establishment andthe establishment address with the Cobb County Police Department’s Regulatory Services and PermitsUnit and are issued a new permit with the new establishment address. It is the responsibility of thelicensee that employees obtain alcohol server’s permits. Failure of employees to comply will result inprosecution and possible suspension or revocation of business owner’s alcoholic beverage license. 31. All Licensees must complete the Status affidavit on page 39. 32. All Convenience Stores and Liquor Package Stores must complete the Camera affidavit on page 40.33. All alcoholic beverage establishments must apply for and receive a State Alcoholic Beverage Licenseprior to stocking and selling alcoholic beverages. State applications can be obtained by contactingthe Georgia Department of Revenue Alcohol Division. (Phone: 404-417-4490)34. Alcoholic beverage establishments must also pay a Federal Special Tax to the Bureau of Alcohol,Tobacco and Firearms (see attached information)35. Area alcoholic beverage wholesalers may provide alcoholic beverage training seminars. If interestedin this service, please contact your wholesaler to see if this service is available.36.
