NOTICE OF HEARING ON MOTIONS<br />
HEARING ORDER EH-1-<strong>2000</strong><br />
Sumas Energy 2, Inc.<br />
Application to Construct an International Power Line<br />
The National Energy Board (the Board) has received from Sumas Energy 2, Inc. (SE2) an application<br />
dated 7 July 1999, as amended 23 October <strong>2000</strong>, pursuant to Part III, section 58.23 <strong>of</strong> the National<br />
Energy Board Act (the Act) requesting a Certificate <strong>of</strong> Public Convenience and Necessity to construct an<br />
international power line (IPL).<br />
By a letter dated 21 December <strong>2000</strong>, SE2 made a motion for an order that the Board convene a hearing in<br />
early January 2001 to consider whether it would be appropriate for Intervenors to address issues relating<br />
to the environmental effects in Canada <strong>of</strong> SE2's proposed power plant to be located in Sumas,<br />
Washington (the Environmental Effects Motion). SE2 submitted that the issues should not be included.<br />
As well the Board received motions from James Degen dated 20 January 2001 and Randy White dated 26<br />
June 2002 in regard to other matters.<br />
The Board had scheduled oral argument on the Environmental Effects Motion to be heard on 19 February<br />
2001. However, at the request <strong>of</strong> SE2, the Board, on 19 February 2001 adjourned the public hearing. By<br />
letter dated 4 June 2002, SE2 requested that the Board reconvene the hearing. By letter dated 19 June<br />
2002, SE2 stated that the design, engineering and routing <strong>of</strong> the IPL have not changed since the<br />
amendments to the Application were filed on 23 October <strong>2000</strong>.<br />
The Board has decided to hold an oral public hearing to consider the following motions (Motions<br />
Hearing):<br />
1. Degen Motion<br />
a) the Board review the I.P.L. application Sumas E 2 for potential prejudice, at this<br />
time <strong>of</strong> proceeding, arising from the absence <strong>of</strong> full detail <strong>of</strong> an alleged verbal<br />
agreement between Sumas 2 & Canadian Pacific Railway for use <strong>of</strong> C.P.R. right <strong>of</strong><br />
way in Canada<br />
b) the Board review the IPL application Sumas E 2 for any fundamental deficiency<br />
in the application arising from absence <strong>of</strong> full detail <strong>of</strong> an alleged verbal agreement<br />
between Sumas & Canadian Pacific Railway.
2. White Motion<br />
Whereas it is the unanimous opinion <strong>of</strong> all Canadians so involved in the process that<br />
the SE2 application to proceed within the jurisdiction <strong>of</strong> Canada not be approved;<br />
that the NEB discontinue its hearings regarding an application to construct and<br />
operate an international power line - Hearing Order EH-1-<strong>2000</strong><br />
3. Environmental Effects Motion<br />
Should the Board hear evidence concerning the environmental effects in Canada <strong>of</strong><br />
Sumas’ proposed power plant to be located in Sumas, Washington?<br />
The Board will hear oral argument on these motions beginning at 6:00 p.m. on Friday,<br />
18 October 2002, at Garden Park Tower, 101-2825 Clearbrook Road, Abbotsford, British Columbia.<br />
This hearing will be concerned only with the above-noted motions.<br />
The hearing on the motions will proceed in the following order:<br />
• the Degen motion (1 above)<br />
• the White motion (2 above)<br />
• the Environmental Effects Motion (3 above)<br />
The hearing on SE2’s application for a Certificate to construct an international power line (IPL<br />
Hearing) will not proceed until the Board has ruled on all <strong>of</strong> the above motions. A revised schedule<br />
will be released at that time.<br />
The following procedures apply to the Motions Hearing:<br />
1. SERVICE TO PARTIES<br />
1.1 Intervenors are reminded that any correspondence must be served on both the Board and SE2.<br />
2. INTERVENORS<br />
2.1 The intervenor status <strong>of</strong> those receiving this Notice <strong>of</strong> Hearing remains unchanged. The Board<br />
requests that any changes to contact information be communicated to Mona Butler, Regulatory<br />
Officer, in writing at the address under paragraph 6.3.<br />
2.2 An Option 1 intervenor may participate at the Motions Hearing, but will not be subject to any<br />
ongoing distribution <strong>of</strong> documents leading up to the hearing. If an Option 1 intervenor requires<br />
any documents for the purpose <strong>of</strong> this Motions Hearing the documents can be viewed at the<br />
locations referred to in paragraph 6.1 or 6.3, or make a request to the Board with an explanation<br />
<strong>of</strong> the need.<br />

3.3 Generally, the Board will hear Option 2 intervenors prior to hearing Option 1 intervenors. Due to<br />
the number <strong>of</strong> intervenors and in order to accommodate the public, the Board is prepared to hold<br />
evening sessions to hear some intervenors. The Board may revisit this matter during the Motions<br />
Hearing.<br />
4. INTENTION TO PARTICIPATE<br />
4.1 Upon receipt <strong>of</strong> this notice, each intervenor who proposes to participate in the Motions Hearing<br />
is requested to serve a notice <strong>of</strong> intention to participate on SE2 and on the Secretary <strong>of</strong> the Board<br />
in writing by Thursday 12 September 2002 by close <strong>of</strong> business Mountain Time. For your<br />
convenience an Intention to Participate Form is provided as Appendix 3. As soon as practicable,<br />
the Board will publish a <strong>list</strong> <strong>of</strong> all <strong>parties</strong> who intend to participate in the argument and shall<br />
circulate a copy to all <strong>parties</strong> on the Interim List <strong>of</strong> Parties.<br />
5. AFFIDAVITS, LIST OF AUTHORITIES AND CASEBOOKS APPLICABLE TO THE<br />
ENVIRONMENTAL EFFECTS MOTION<br />
5.1 DEFINITIONS<br />
Affidavit- A voluntary declaration <strong>of</strong> facts, written down and sworn to by the person declaring<br />
those facts before a Commissioner for Oaths or a Notary Public.<br />
Casebook - A compilation <strong>of</strong> Affidavits, legislation and legal cases on which a party intends to<br />
rely in legal argument either in favour <strong>of</strong> or against that motion.<br />
List <strong>of</strong> Authorities - List placed at the front <strong>of</strong> the Casebook citing the Affidavits, legislation<br />
and cases found in the Casebook.<br />
5.2 On 19 January 2001 the Board decided that it will hear evidence in affidavit form on the<br />
Environmental Effects Motion. That evidence must be directly relevant to, and must be confined<br />
strictly to, the question <strong>of</strong> law that must be decided, which is, “does the Board have the<br />
jurisdiction to consider the environmental effects in Canada <strong>of</strong> the plant in Washington state?”.<br />
In the Board’s view, it would be inappropriate and unnecessary to hear all <strong>of</strong> the evidence <strong>of</strong><br />
possible environmental effects in Canada <strong>of</strong> the plant in Washington before deciding the<br />
question <strong>of</strong> law raised by the Environmental Effects Motion.<br />
5.3 Parties shall serve any new or additional copies <strong>of</strong> any Affidavits, their proposed List <strong>of</strong><br />
Authorities and Casebook on the Board and on all Option 2 intervenors and place copies in the<br />
public libraries noted under section 6 by Thursday 26 September 2002 by close <strong>of</strong> business<br />
Mountain Time. The Board anticipates that these would primarily relate to the Environmental<br />
Effects Motion as opposed to the Degen and the White Motions.<br />
5.4 SE2's Reply Evidence on the Environmental Effects Motion shall be served on the Board and<br />
Option 2 intervenors and placed in libraries by Thursday 10 October 2002 by close <strong>of</strong> business<br />
Mountain Time.<br />

6. PUBLIC VIEWING<br />
6.1. All <strong>parties</strong> are reminded that SE2 shall deposit and keep on file, for public inspection during<br />
normal business hours, a copy <strong>of</strong> its application at its <strong>of</strong>fices <strong>list</strong>ed below and at all Public<br />
Libraries in Abbotsford, Chilliwack, Agassiz, Hope and Aldergrove. This direction was set out<br />
in the Directions on Procedure <strong>of</strong> 9 November <strong>2000</strong> and in a letter from the Board dated 15<br />
February 2001.<br />

7.1 Where a party is required by these Directions on Procedure to file or serve documents on other<br />

Parties are reminded that, pursuant to paragraph 9(8) <strong>of</strong> the National Energy Board Rules <strong>of</strong><br />
Practice and Procedure, 1995, a facsimile filing must be followed by the filing <strong>of</strong> original hard<br />
copies <strong>of</strong> the document.<br />
7.2 Parties filing or serving documents at the Motions Hearing shall file five copies with the Hearing<br />
Officer and five copies with Board Counsel and shall leave a sufficient number <strong>of</strong> copies for<br />
<strong>parties</strong> at a designated location in the hearing room.<br />
8. SIMULTANEOUS INTERPRETATION<br />
8.1 Parties shall indicate the <strong>of</strong>ficial language they in which they wish to be heard at the hearing. If<br />
it appears that both <strong>of</strong>ficial languages will be used at the hearing, simultaneous interpretation<br />
will be provided.<br />
9. GENERAL<br />
9.1 Parties shall quote Hearing Order EH-1-<strong>2000</strong> and File 2200-S040-1 when corresponding with<br />
the Board in respect <strong>of</strong> this proceeding.<br />
9.2 The Motions Hearing will be recorded and transcribed daily. Transcripts will be available on the<br />
Board’s website (www.neb-one.gc.ca). Transcripts can also be ordered directly from<br />
International Reporting Inc. during the hearing, by calling (613) 748-6043 ext. 26, or by<br />
emailing: bprouse@irri.net. Upon request, one hard copy <strong>of</strong> the daily transcript will be provided<br />

subsequent copies, including delivery, are the responsibility <strong>of</strong> the requesting party. SE2 will<br />
